SAN PABLO CITY COUNCIL
APRIL 2022
ARPA FUNDING $10 MILLION USE RULE
On January 6, 2022, the U.S. Treasury Department (Treasury) released the Final Rule for the State and Local Coronavirus Fiscal Recovery Fund (Recovery Fund), which was authorized under the American Rescue Plan Act (ARPA). The Final Rule will go into effect on April 1, 2022. • The final rule presented a significantly simpler option by permitting local governments to choose a “standard allowance” for lost revenue of $10 million for government services without needing to use the Treasury revenue loss formula. • Revenue loss is more flexible and may be used for a broad range of government services, programs and projects outside of typical eligible uses of recovery funds under the interim rule.
• The City intends to choose the entire ARPA allocation of $7.4 million for lost revenue to simplify and streamline reporting requirements.
• The funding allocations for priorities and recommendations being proposed are government services, programs and projects allowed in the use of “revenue loss.”
ARPA Funding Allocation Priorities
ARPA Funding has strict guidelines on eligible expenses under US Treasury guidelines. Highlight Indicates City Priority Funding Categories.
1. Support Public Health Response: Fund COVID-19 mitigation efforts, medical expenses, behavioral healthcare, and certain public health and safety staff
2. Replace Public Sector Revenue Loss: Use funds to provide government services to the extent of the reduction in revenue experienced due to the pandemic
3. Water and Sewer Infrastructure: Make necessary investments to improve access to clean drinking water and invest in wastewater and stormwater infrastructure
4. Address Negative Economic Impacts: Respond to economic harms to workers, families, small businesses, impacted industries, and the public sector
5. Premium Pay for Essential Workers: Offer additional support to those who have and will bear the greatest health risks due to service in critical infrastructure sectors
6. Broadband Infrastructure: Make necessary investments to provide unserved or underserved locations with new or expanded broadband access

Critical Infrastructure: Water & Sewage
• The following are Priorities under the FY 2021-2023 City Council Priority Workplan ✓ # 203. Assess Environmental Impacts Over the Long-Term to Assist Resiliency Planning ✓ # 505. Keep San Pablo Clean Litter and Illegal Dumping Initiative • Per the Municipal Regional Permit, the City is required to reduce 100% of the trash entering the stormwater by 2022, however, the Regional Water Board is expected to extend this compliance deadline to June 30, 2025. ✓ 67.9% of the storm drain inlets have individual trash capture devices or other equivalent measures. ✓ Remaining infrastructure is more difficult.
• Caltrans received a Cease and Desist Order to stop litter from their roadways from entering the Bay Area stormwater system ✓ 16.5 acres of I-80 drainage can be treated in San Pablo. ✓ Caltrans will have a “financial contribution only” of $1.65M to go toward construction. All other costs (remaining balance of permitting, design, construction, operations and maintenance) becoming the responsibility of the City. ✓ City contribution estimated to be $1M.
✓ $350,000 will fund permitting and through 65% design. ❖ Recommendation: Leverage City ARPA Funds with Caltrans’s mandated contribution to install underground trash capture device near the intersection of Church and Willow.
