1000 Gateway Avenue ● San Pablo, CA 94806 Main: 510-215-3030 ● Fax: 510-215-3014 www.SanPabloCA.gov 2 NOTICE OF INTENDED ZONING ADMINISTRATOR APPROVAL Date: May 3, 2021 To: Derek Turner, Site Acquisition and Zoning Specialist, J5 Infrastructure Partners (Sent via email: [email protected]) Neighboring Property Owners San Pablo City Council From: Elizabeth H. Tyler, Ph.D., FAICP, Planning Manager RE: PLAN2102-0006, 2525 San Pablo Dam Road, San Pablo, CA, APN 417-080-015, Request for an Administrative Use Permit and Sign Permit to remove the sign face of an existing freeway-oriented hotel sign and replace it with a new cabinet to house relocated equipment and replaced ATT antennas from the sign poles to the interior of the sign and to install a new ground-level equipment area with concrete slab and wall at the base of the sign in the SP2- Regional Commercial, Air Quality Health Risk Overlay District. This notice is to inform the applicant and other interested parties that the Planning Division intends to approve an Administrative Use Permit to remove and replace an existing sign face to house telecommunications antennas to be relocated from alongside the existing sign poles to the interior of the sign and to install a new equipment area at the base of the sign to be located to the north of the Holiday Inn Express & Suites at 2525 San Pablo Dam Road, San Pablo, CA, APN 417-080-015. The existing sign received a height and area variance on July 22, 2000 (Variance #1265). The proposal would not change the sign height or sign face area; therefore, no amendments to the previously granted variance are necessary. On behalf of the City of San Pablo, the application has been reviewed by Telecom Law Firm PC, for compliance with the telecommunications provisions of the San Pablo Zoning Ordinance. Telecom Law determined that the proposal is subject to Section 17.62.300 of the San Pablo Zoning Code (Wireless Facilities – new and substantially changed facilities) and that an Administrative Use Permit (AUP) would be necessary for the proposed changes.
Municipal Code Section 17.18.080 authorizes the Zoning Administrator to issue an Administrative Use Permit providing that all of the appropriate finding are met. The following findings were made to approve this Administrative Use Permit: 1. The proposed use is allowed within the applicable zoning district and complies with all other applicable provisions of this zoning ordinance, municipal code, general plan, and any applicable specific plans or city regulations/standards. As noted above, the use would be compliant with a previously approved sign variance. The applicant has submitted all of the technical requirements of Section 17.62.300 of the Zoning Ordinance, including project plans, title report and owner’s authorization, site photos, photo simulations, Radio Frequency (RF) Compliance demonstration, acoustic analysis, and project purpose statement. 2. The site is physically suited for the type, density, and intensity of the proposed use, including access, utilities, and the absence of physical constraints, and can be conditioned to meet all related performance criteria and development standards. The site has been used as a freeway-oriented sign since 2000. It has contained telecommunications facilities since at least 2002. The proposal would help to improve the look of the wireless facilities by containing them within the sign-face structure and removing them from the sign legs. 3. Granting the permit would not be detrimental to the public interest, health, safety, convenience, or welfare, or materially injurious to persons, property, or improvements in the vicinity in which the project is located. The site is in a commercial area alongside Interstate 80, with the rear of residential properties along Vale Road located to the west of the site. There is vegetative screening between the sign and these properties. The proposed changes would not be detrimental to properties in the vicinity and would result in an improved and less cluttered appearance for the sign. The following additional findings are made pursuant to Section 17.62.300.E.: 4. The proposed wireless facility complies with all the criteria for a conditional use permit or administrative use permit in accordance with Section 17.18.080(D) or 17.20.040(B), as applicable; 5. The proposed wireless facility complies with all applicable development standards described in subsection H of this section; 6. The applicant has demonstrated that its proposed facility will be in compliance with all applicable FCC rules and regulations for human exposure to RF emissions; 7. The applicant has demonstrated a good-faith effort to identify and evaluate more preferred locations, collocations and potentially less intrusive designs; 8. The applicant has provided the approving authority with a meaningful comparative analysis that shows all less intrusive or more preferred alternative
locations and designs identified in the administrative record are either technically infeasible or not potentially available. The following conditions of approval are assigned to this project from the Planning Division: 1. The approval is based upon the plans that were submitted to the City of San Pablo on April 5, 2021. The plans show removal and replacement of the existing hotel sign face with Radio Frequency-friendly sign face structure and façade; relocation of existing telecommunications equipment from the legs of the sign structure to within the sign face structure; installation of new antennas and other telecommunications equipment within the sign structure; installation of new utility equipment at ground level on a concrete slab with concrete masonry wall enclosure; and other associated activity. 2. The project is subject to final field inspection from the Planning Division. 3. At such time as the use ceases to operate for more than 6 months, this Administrative Use Permit shall become null and void. 4. Violations of any of these conditions may result in the revocation of the Administrative Use Permit. Additional conditions from the Public Works Department and Building Division will be forthcoming during the Plan Review process. Indemnification: Pursuant to Government Code Section 66474.9, the applicant (including any agent thereof) shall defend, indemnify, and hold harmless the City of San Pablo and its agents, officers, or employees from any claim to attack, set aside, void or annul, the City’s approval concerning this planning application, which action is brought within the time period provided for in Section 66499.37. The City will promptly notify the applicant of any such claim, action, or proceeding and cooperate fully in the defense. Section 17.16.060 requires that members of the City Council and interested parties be notified of Zoning Administrator decisions. In accordance with Section 17.62.300.F., due to expedited federal time frames for approval applicable to small wireless facilities, a decision by the zoning administrator regarding an application for a small wireless facility shall be final and not subject to any appeal. If there are any questions about the request or this decision, please feel free to contact the San Pablo Planning Division at [email protected] or (510) 215-3036.
