RESOLUTION 2023-###
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO , CONTRA COSTA COUNTY, CALIFORNIA (1) CONFIRMING THE DIAGRAM AND
ASSESSMENTS WITHIN SAN PABLO STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT NO. 1982 -1 FOR FISCAL YEAR 2023/24; (2) DIRECTING
THE CITY CLERK TO FILE DIAGRAM AND ASSESSMENTS WITH THE COUNTY AUDITOR NO LATER THAN AUGUST 10, 2023; AND (3) LEVYING ASSESSMENTS
WHEREAS, in August 1982, the City Council of the City of San Pablo ordered the formation of and levied the first assessment within San Pablo Street Lighting and Landscape District No. 1982-1; and
WHEREAS, Assessment District No. 1982-1 received approval from approximately two-thirds of the voters voting in the General Election held on November 5, 1996, and is exempt from the procedures and approval process set forth in Section 4 of Article XIII D of the California Constitution; and
WHEREAS, Resolution No. 2023-037, directing the Assessment District Engineer to prepare and file a report for the levy of annual assessments within San Pablo Street Lighting and Landscape Ass essment District No. 1982- 1 for Fiscal Year 2023/24 was adopted March 20, 2023; and
WHEREAS, the Assessment District Engineer did file a report with the City Clerk; and
WHEREAS, on May 15, 2023, the City Council Adopted Resolution 2023- 069, which preliminarily approved the Engineer’s Report, declared the intention to levy and collect assessments for Fiscal Year 2023-24, set a Public Hearing for June 20, 2023, and directed the City Clerk to public a notice of the Public Hearing pursuant to Streets and Highways Code Section 22626(a) and Government Code Section 6061, which notice has been published; and
WHERAS, on June 20, 2023, the City Council held a Public Hearing to consider levying proposed assessments for San Pablo Street Lighting and Landscape Assessment District No. 1982-1 for Fiscal Year 2023/24, afforded all interested persons an opportunity to hear and be heard, and considered all oral statements and written communications made or filed by interested parties.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Pablo hereby confirms the diagram and assessment as set for th within the Engineer’s Report.

BE IT FURTHER RESOLVED that assessments are not proposed to increase from Fiscal Year 2023/24 assessments.
BE IT FURTHER RESOLVED that this Resolution shall constitute the levy of an assessment for Fiscal Year 2023/24 within San Pablo Street Lighting and Landscape Assessment District No. 1982-1, as referred to in the Engineer’s Report.
BE IT FURTHER RESOLVED that this Council directs the City Clerk to file the diagram and assessment, or a certified copy of it, with the County Auditor no later than August 10, 2023.
BE IT FURTHER RESOLVED that the City Council of the City of San Pablo hereby finds that the foregoing recitations are true and correct and are included herein by reference as findings.
