RESOLUTION 2023-###

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO (1) WAIVING

COMPETITIVE BIDDING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE CONSTRUCTION SERVICES CONTRACT FOR THE FY 22-23

CONTINGENCY FUNDS, FOR A NEW TOTAL AUTHORIZATION UNDER THE CONTRACT AS AMENDED NOT TO EXCEED $1,151,328.16; AND (2) APPROPRIATING SB1 RMRA FUNDS IN THE AMOUNT OF $298,326.16 TO THE CITYWIDE SLURRY SEAL PROJECT (0602) FOR THE ADDITIONAL WORK.

WHEREAS, the FY22-23 Citywide Slurry Seal Project is an intermediate sized City project that proposes to restore pavement wearing surface to nearly 80 City Streets, while maintaining a high Pavement Condition Index; and

WHEREAS, Crack Sealing is an essential preliminary task to perform Slurry Seal Pavement repair to ensure longevity of the slurry seal work , thereby lowering long term costs to the City; and

WHEREAS, the project was intended to have Crack Seal work perfo rmed by City Staff prior to notice of proceed to the contractor; and

WHEREAS, said Crack Seal work was unperformed due to excessive winter rain and low temperatures, and lack of available staff when temperatures became conducive to perform work; and

WHEREAS, Slurry Seal pavement repairs are fundamental to a maintain high Pavement Condition Index to qualify for Metropolitan Transportation Commission funding; and

WHEREAS, the FY22 -23 Citywide Slurry Seal Project was approved through Resolution 2023-044 and adopted on April 3 , 2023, the City Council of City authorized the City Manager to enter into an agreement with Doolittle Construction in an amount not to exceed $853,002, including $111,261.50 in contingency funds; and

WHEREAS, in July 2023, the City received a quote for the additional work; and

Resolution 2023-### Page 2

WHEREAS, the quoted work was within the average cost of crack sealing of the previously discarded bids which included crack sealing as a bid alternatives, and with the additional scope added to the Doolittle agreement, the total project cost is $300,000 less than the lowest previously discarded bid that included crack sealing, thus the quoted work is competitive with previous bids in cost; and

WHEREAS, given the reasonableness of the price provided by Doolittle for the crack sealing work, the importance to the Cit y of improving and maintaining the City’s existing PCI and the longevity of the slurry seal project , the need to complete the slurry seal in neighborhoods around schools prior to the August 15 th start date of the upcoming
