RESOLUTON 2023-###
CONSIDER ADOPTING RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A JOINT USE AGREEMENT BETWEEN THE CITY OF SAN PABLO AND THE WEST CONTRA COSTA UNIFIED SCHOOL DISTRICT FOR CITY’S USE OF
DISTRICT RECREATIONAL FACILITIES AND THE WEST CONTRA COSTA UNIFIED SCHOOL DISTRICT’S USE OF CITY FACILITIES.
WHEREAS, t he City has been using West Contra Costa Unified School District (WCCUSD) facilities at no charge since 2009;
WHEREAS, in 2016, the City entered into a formal Joint Use Agreement (JUA) with the WCCUSD for the use of its facilities which was in effect through December 2022 and has since been working with the WCCUSD to create an updated agreement that includes the WCCUSD’s use of City’s facilities;
WHEREAS, as part of this new Joint Use Agreement, the City will have the ability to use Helms , Bayview, Dover, Downer, Lake, Montalvi n, Riverside, and Tara Hills schools to conduct general recreation and sports programs to benefit WCCUSD students, City residents and others in the broader community;
WHEREAS, as part of this JUA, the WCCUSD will have the ability to use the San Pablo Community Center rooms, Maple Hall , and the Wildcat Creek Community Room for general youth and or adult enrichment programs that benefit City residents, WCCUSD students and others in the broader community;
WHEREAS, in recognition of the benefit both agencies receive, both agencies will have use of each other’s premises for no charge except in the event either agency’s use of the other’s premises requires staff to either open or lock facilities, or requires cleaning and/or repair of facilities above and beyond the normal level s of maintenance , both agencies will be required to pay the other agency for the direct cost of those services;
WHEREAS, on November 1, 2022, this item was taken before the Community Services Standing Committee (Cruz/Pineda) for its review and the Committee unanimously recommended moving forward to City Council for formal review at a later date;
WHEREAS, this is not a project as defined by CEQA.
NOW, THEREFORE, BE IT RESOLVED that the foregoing recitations are true and correct, and are included herein by reference as findings;

BE IT FURTHER RESOLVED that the City Council of the City of San Pablo authorizes the City Manager to execute a Joint Use Agreement between the City of San Pablo and the West Contra Cost a Unified School District for City’s use of District recreational facilities and the West Contra Cost a Unified School District’s use of City facilities, in a form to be approved by the City Attorney that is does not substantially alter the City rights or responsibilities from what is set forth in the draft agreement attached hereto.
