RESOLUTION 2023-###
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO AUTHORIZING
THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH
HINDERLITER DE LLAMA S & ASSOCIATES FOR RENTAL REGISTRY PROGRAM IMPLEMENTATION AND ADMINISTRATION SERVICES FOR A FIVE -YEAR (5)
PERIOD, WITH ALL COSTS OF SERVICES TO BE PAID FROM REVENUES GENERATED BY THE PROGRAM.
WHEREAS, Dedicate resources to create a new rental registry (w/ fees to offset City costs) for available San Pablo housing opportunities is an adopted City Council Priority contained in the adopted Fiscal Year 2023- 2025 City Council Priority Workplan, effective May 1, 2023;
WHEREAS, this agreement is not a project as defined by CEQA;
WHEREAS, the San Pablo City Council expressed creating a rental registry and it was added as a priority in the FY 2023-2025 City Council Priority Workplan;
WHEREAS, a rental registry program will help the City collect data regarding rent and other relevant information about rental units and help inform the City Council about housing stock, trends, and rental market in San Pablo;
WHEREAS, Hinderliter de Llamas & Associates (“HdL”) is a company that was established to maximize local government revenues by providing a variety of financial and compliance audits, analytical services, and software solutions. HdL has worked with many cities to provide rent registry administration;
WHEREAS, HdL would be contracted for a five- year (5) period to provide Rental Registry Program implementation and administration services to the City;
WHEREAS, HdL’s scope of services include:
• Rental property registration database management
• Renewal/update processing
• New account processing
• Payment posting/processing
• Rental support center
• On-line filing & payment processing
WHEREAS, although the City’s Purchasing Guidelines indicate that three written quotes or an RFP process is appropriate for engaging professional services, competitive bidding requirements may be dispensed if the public interest is better served by doing so, as where competitive bidding would not produce an advantage (Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631; L os Angeles Dredging Co. v. Long Beach (1930) 210 Cal.348; Municipal Code sec. 3.16.110); Resolution 2023-### Page 2
WHEREAS, the exception may be invoked where the product or service contracted for is of unique value and may not be obtained elsewhere. (Hodgeman v. City of San Diego (1942) 53 Cal.App.2d 610,618). HdL has knowledge of the City and understands the City’s objective;
WHEREAS, there is no fiscal impact to the City as the rental registry program will be self-sustaining. HdL would take its administration fees out of the revenues generated by collecting the established rental unit fee;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Pablo authorizes the City Manager to dispense with competitive bidding/proposal requirements and to execute a consulting services agreement with Hinderliter de Llamas & Associates, in a form to be approved by the City Attorney that does not substantially alter the rights and responsibilities from what is set forth in the attached draft agreement, to provide rental registry program implementation and administration services, with all costs of services to be paid from revenue generated the program;
BE IT FURTHER RESOLVED that the foregoing recitations are true and correct, and are included herein by reference as findings;
