RESOLUTION 2023-###
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO (1)
APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A
COOPERATIVE AGREEMENT BETWEEN CALTRANS AND THE CITY OF SAN PABLO IN THE AMOUNT OF $562,500 FOR THE FULL TRASH CAPTURE DEVICE AT CHURCH LANE AND WILLOW AVENUE PROJECT; AND (2) ACCEPTING AND APPROPRIATING THE FUNDS TO THE PROJECT BUDGET ( 320-0304-43604-ALT- 224)
WHEREAS, the design and installation of a Full Trash Capture (FTC) Device at Church and Willow Project (No. 0304) (Project) is a major City coordination project with the California Department of Transportation (Caltrans) that proposes to preserve natural waterways and minimize pollution, and comply with trash reduction requirements outlined in National Pollution Discharge Elimination System (NPDES) permits issued by the State Water Resources Control Board (SWRCB) to Caltrans;
WHEREAS, the Project scope involves installing a SWRCB approved FTC device that is connected to the City’s storm drain system and will remove debris from the stormwater run-off;
WHEREAS, one of the strategies in the Caltrans Trash Control Implementation Work Plan is to maximize the efficiency of available State resources by partnering with local municipalities (i.e. cities, counties) to construct permanent FTC devices to meet the milestones in the cease and desist order by the SWRCB;
WHEREAS, the Project also includes infrastructure that will requir e routine maintenance to remove trash and debris from the device;
WHEREAS, the area of drainage contributing to the capture device is 5.625 acres and Caltrans is proposing to fund construction costs up to $100,000 per acre for a total of $562,500; and
WHEREAS, City staff and Caltrans developed a cooperative agreement (Cooperative Agreement) to provide $562,500 in funding for the Project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Pablo hereby approves and authorizes the City Manager to execute the Cooperative Agreement between Caltrans and the City of San Pablo for the Full Trash Capture Device at Church Lane and Willow Avenue Project (No. 0304) in the amount of $562,500;
BE IT FURTHER RESOLVED that the City Council of the City of San Pablo accepts and appropriates those funds to the Project budget (320-0304-43604-ALT-224); and

BE IT FURTHER RESOLVED that the foregoing recitations are true and correct and are included herein by reference as findings.
