RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO (1)
APPROVING THE PLANS AND SPECIFICATION FOR THE BUSH AVENUE POCKET PARK PROJECT (0502) (PROJECT), (2) AWARDING MICHAEL PAUL COMPANY INC. A CONSTRUCTION CONTRACT FOR THE PROJECT, (3) AUTHORIZING THE
CITY MANAGER TO EXECUTE AN AGREEMENT WITH MICHAEL PAUL COMPANY INC. IN AN AMOUNT OF $571,887.66 WITH 15% CONTINGENCY FOR A TOTAL AUTHORIZATION NOT TO EXCEED $657,671 AND (4) REAPPROPRIATING FUND 120 FUNDS IN THE AMOUNT OF $247,002 FROM THE FULL TRASH CAPTURE DEVICE PROJECT (0304) TO THE BUSH AVENUE POCKET PARK PROJECT (0502)
WHEREAS, the Bush Avenue Pocket Park project (0502) (Project) is a major City Project that proposes to enhance and beautify the immediate neighborhood underserved by parks and recreation activities;
WHEREAS, the Project includes amenities such as exercise equipment, shade structure, swings, and landscaping to a blighted lot;
WHEREAS, the Project was determined to be categorically exempt under the California Environmental Quality Act (CEQA) Section 15303(d) and (e) and Section 15304(b) and (f), and the CEQA Notice of Exemption was filed at the Contra Costa County Clerk’s office on December 18, 2021;
WHEREAS, the Project has been allocated the following funds:

WHEREAS, the remainder of funding is available in Fund 120;
WHEREAS, the City advertised for bids on December 20, 2023 in conformance with Section 3.16.070 of the Municipal Code;
WHEREAS, six (6) bids were received and publicly opened on January 22, 2024 as follows:

WHEREAS, Michael Paul Company Inc ., of Petaluma California, submitted the apparent lowest responsive and responsible bid of $571,887.66; and
WHEREAS a total project authorization in the amount of $657,671 , including a 15% contingency, is requested to complete project construction.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Pablo hereby approves the Plans and Specification for the Bush Avenue Pocket Park Project (0502);
BE IT FURTHER RESOLVED that the City Council hereby awards the bid for the Bush Avenue Pocket Park Project (0502) to the lowest responsive and responsible bidder, Michael Paul Company, Inc., of Petaluma, California;
BE IT FURTHER RESOLVED that the City Council authorizes the City Manager to execute a contract in the amount $571, 887.66 with a 15% contingency for a total contract authorization not to exceed $657,671;
BE IT FURTHER RESOLVED, that Fund 120 funds be re-appropriated as follows:
