AMENDMENT NO. 1
to the Engineer’s Report for
CITY OF SAN PABLO STREET LIGHTING AND
LANDSCAPE ASSESSMENT DISTRICT NO. 1982-1, 2024-25 Fiscal Year (Pursuant to the Landscaping and Lighting Act of 1972)
A number of applications for major residential, mixed use and commercial/industrial projects have been approved by the City in recent years and are in various stages of development. The City has also approved applications for smaller projects including parcel maps, lot line adjustments and Accessory Dwelling Units.
Whenever development occurs, or whenever public property previously not assessed is acquired by private parties, it is necessary to adjust the assessment for the affected property to conform to the approved assessment methodology included in the Engineer’s Report. Government Code Section 53750(h)(3) provides that assessments are not deemed to be “increased” when the increase results from a change in the density, intensity, or nature of the use of land.
Assessments for Assessment District No. 1982-1 are collected on the County Tax Roll with property taxes.
Adjustments to assessments are required when the County Assessor assigns a new Assessor’s Parcel Number (APN) to the newly configured or utilized parcels. Once the new APN has been assigned it is possible to calculate and adjust the assessment for the developing parcels. The Assessor has retired and added new APNs reflecting the referenced changes to property within the District.
This Amendment No. 1 includes the following:
1. Revised Estimate of Cost. Pages B-1 through B-4, attached have been revised to reflect the increase in revenue that results from the revisions to several assessments. This increase has been added to the estimated year-end balance.
2. Update to the Method of Assessment. The attached revised pages C-3 and C-7 remove an exception 10 for a formerly vacant parcel that has been developed. An exception for “Supportive Housing (mini housing) Units” has been added.
3. List of Revisions to Assessments. The attached list revises the assessments for several parcels in the District based upon recent changes to parcel configuration or use. The list provides the assessment for the 2024-25 year and an estimate of the assessment upon project completion. The latter is for information only and subject to change based upon the final construction details.
4. List of Development Projects. A list of recent projects within the City has been included and linked to the List of Revisions with a reference number.
This Amendment including attachments will be placed on file with the City Clerk for consideration by the City Council at the annual public hearing. Upon approval of this Amendment, as submitted or as modified by the Council, the attached changes to Parts B, C and corresponding changes to Part D, the Assessment Roll and the Property Owner List will be incorporated, and the Amended Report placed on file for the 2024- 25 fiscal year.
Respectfully Submitted,
LCC Engineering & Surveying, Inc.

PART B – ESTIMATE OF COST
Summary Cost Estimate
The revenue and expenditures for the District are accounted for in fund 237, department 3610 of the City Budget.
Section 22569 of the Act provides that the estimate of the costs of the improvements for the fiscal year contain estimates for all of the following:
(a) The total costs for improvements to be made that year, being the total costs of constructing or installing all proposed improvements and of maintaining and servicing all existing and proposed improvements, including all incidental expenses.
(b) The amount of any surplus or deficit in the improvement fund to be carried over to the next fiscal year.
(c) The amount of any contributions to be made from sources other than assessments levied pursuant to this part.
(d) The amount, if any, of the annual installment for the fiscal year where the legislative body has ordered an assessment for the estimated cost of any improvements to be levied and collected in annual installments.
(e) The amount of the anticipated balance forward from the previous year.
(f) The net amount to be assessed upon assessable lands within the assessment district, being the total improvement costs, as referred to in subdivision (a), increased or decreased, as the case may be, by any of the amounts referred to in subdivision (b), (c), or (d).
A summary of the estimated District costs and net amount to be assessed for the 2024-25 FY is indicated on Table 1. The costs have been divided into the two (2) basic areas of service: 1) Street Lighting and 2) Landscaping. The total cost has been reduced by a contribution that will be made by the City. This contribution is intended to exceed and offset any benefit not linked to special property benefit. Table 1 lists these amounts for each category of service and maintenance.

Table 1
Summary Cost Estimate and Net Amount to be Assessed
FY 2024-25 expenses are estimated to be $1,853,326. A negative balance of approximately $33,315 is anticipated to be carried forward from the 2023-24 FY and a balance of approximately $9,068 is estimated at the end of FY 2024-25. A contribution of approximately $1.031 million dollars is required to fully fund the FY 2024-25 program. No investment payments have been authorized or scheduled by the Council.

Detailed Cost Estimate
The cost to maintain current street lighting, landscaping, park and recreation facilities described in Part A is shown on Table 2. The table lists:
a statement of the expense by budget category for FY2023-24 as indicated in the City’s Annual Comprehensive Financial Report (ACFR) 2022-23
a projection of expenditures for FY 2023-24 using the previous year’s budget estimate and expenditures to date, and
an estimate of the District costs for the 2024-25 FY based upon the budget for fund 237, department 3610.
This cost estimate shows the Beginning Balance, Revenues, Expense and Estimated balance at the end of the next fiscal year. The expense amounts are listed by category and expense code.
The balance at the end of each year, if any, is carried forward to be used as a credit against future assessments. The Section 22569(a) of the Act provides that the balance in the fund should not exceed the estimated cost of maintenance and servicing improvements between July 1st and the time that the City expects to receive the first installment of the annual tax revenue from the County Auditor. Assuming that revenues are received on January 1st, this amounts to approximately 50% of the annual budget.
