RESOLUTION 2024-###
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO (1)
ACCEPTING AN EASEMENT FROM CHATTLETON PLACE PARTNERS, LLC FOR ACCESS TO AND MAINTENANCE OF THE CITY’S IRRIGATION DRAIN LINE AT CHATTLETON LANE TOWNHOMES LOCATED AT 2812 CHATTLETON LANE, AND (2) AUTHORIZING THE CITY MANAGER TO EXECUTE THE EASEMENT AND TAKE
SUCH OTHER ACTIONS NECESSARY FINALIZE THE EASEMENT
WHEREAS, this action is not set forth in the FY 2023-25 City Council Priority Workplan, but is necessary and desirable as part of the City’s ongoing operations;
WHERAS, this proposed action does not constitute a “project”, and is otherwise exempt from environmental review, pursuant to the California Environmental Quality Act (CEQA);
WHEREAS, Chattleton Place Partners, LLC (“Chattleton Place”) owns the property located at 2812 Chattleton Lane, San Pablo, CA, which is the site for Chattleton Lane Townhomes;
WHEREAS, the townhome construction project (“Project”) includes the construction of a pocket park, where the City needs access to the irrigation drain line that crosses over the private property;
WHEREAS, upon completion of the Project, the City will need an easement (“Easement”) to enter onto the private site to access, maintain , and make any future necessary repairs to the irrigation drain line; and
WHEREAS, the Easement provides the City with the right to work, from time to time, to maintain and repair its irrigation drain line within the easement area, as well as rights of ingress and egress over and across the property to perform said functions.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Pablo accepts the aforementioned E asement from Chattleton Place Partners, LLC, for access to and maintenance of the C ity’s irrigation drain line at Chattleton Lane Townhomes located at 2812 Chattleton Lane;
BE IT FURTHER RESOLVED that the City Manager is authorized to execute such other documents and take such other actions as are necessary to carry out and implement the City’s acceptance of the Easement; and
BE IT FURTHER RESOLVED that the foregoing recitations are true and correct and are included herein by reference as findings.
