RESOLUTION 2024-###
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO AUTHORIZING
THE CITY MANAGER TO EXECUTE A FOURTH AMENDMENT TO AN EXISTING AGREEMENT WITH INTERWEST CONSULTING GROUP , INC. FOR ON -CALL BUILDING INSPECTION SERVICES TO ADD $ 50,000, FOR A TOTAL CONTRACT AMOUNT NOT TO EXCEED $230,000
WHEREAS, “Improve Public Safety” is an adopted policy item under the FY 2023-25 Council Priority Work plan, effective May 1, 2023, and providing adequate inspection services is key to ensuring the safety of San Pablo’s building stock;
WHEREAS, this action is not a project as defined by the California Environmental Quality Act (CEQA) guidelines, Section 15378(b)(4) of which states that a “project” does not include the creation of government funding mechanisms or other governmental fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment;
WHEREAS, on September 1, 2023, the Community Development Department’s incumbent Building Inspector resigned and the City has not yet been able to fill the position;
WHEREAS, o n September 27, 2023, the City entered into an agreement with Interwest Consulting Group, Inc. for the provision of On- Call Building Inspection Services in an amount not to exceed $50,000, to cover the City’s building inspection needs while the Building Inspector position was vacant;
WHEREAS, on February 20, 2024, the City entered into a First Amendment to the agreement with Interwest Consulting Group, Inc, augme nting compensation by $8 0,000, for a total contract amount not-to-exceed $130,000, for the provision of continued Building Inspection services eight hours per day, four days per week, and extending the contract term through June 30, 2025;
WHEREAS, on March 1, 2024, the City executed a S econd Amendment to the agreement, adding a more comprehensive fee schedule to allow more flexibility in staffing assignments;
WHEREAS, the City Council approved a reclassified position of Senior Building Inspector on March 4, 2024 via Resolution 2024- 033, and following a delay due to a temporary position hiring freeze, hiring for this position resumed;
WHEREAS, on July 1, 2024 , as the Sr. Building Inspector position was still vacant , the City executed a Third A mendment to the agreement adding $50,000 in compensation for a total contract not-to-exceed amount of $180,000, with the $50,000 being a reallocation from the Community Development salary account (212- 1755-41000) to the Community Development professional services account (212- 1755-43600), resulting in no budget increase;

WHEREAS, in order to provide continued Building Inspection services until the Sr. Building Inspector position is filled, a Fourth Amendment to the agreement with Interwest Consulting Group is needed to add $50,000 in compensation, for a total contract amount not to exceed $230,000, to be funded by reallocation of Community Development Department funds from a separate on- call consultant within t he Community Development Department Professional Services account (212-1755-43600); and
WHEREAS, since this is a reallocation of existing budgeted funds, no new funding is necessary.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Pablo hereby authorizes the City Manager to execute a Fourth A mendment to an existing agreement with Interwest Consulting Group, Inc. for On-Call Building Inspection Services to add $50,000 in compensation, for a total contract amount not to exceed $230,000; and
BE IT FURTHER RESOLVED that the foregoing recitations are true and correct, and are included herein by reference as findings.
