RESOLUTION 2025-###
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN PABLO (1) ACCEPTING WORK PERFORMED BY UNITED STORM WATER, INC. FOR THE CITYWIDE TRASH CAPTURE DEVICE INSTALLATION PROJECT (0305) AS COMPLETE, (2) DIRECTING CITY ENGINEER TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER, AND (3) RE -ALLOCATING PREVIOUSLY APPROPRIATED FUNDS IN THE AMOUNT OF $ 33,300 FROM THE CITYWIDE TRASH CAPTURE DEVICE INSTALLATION PROJECT (0305) TO THE LEROY HEIGHTS STORM DRAIN PROJECT (0306 ) AND THE MCNEIL PARK PROJECT (0501)
WHEREAS, the Citywide Trash Capture Device Installation Project (0305) (Project) aims to meet the City’s compliance requirements for provision C.10 of the National Pollutant Discharge Elimination System permit and fulf ill the expectations outlined in the City’s Long Term Trash Management Plan;
WHEREAS, the project was determined to be Categorically Exempt from environmental review pursuant to Section 15301 of the CEQA Guidelines and a Notice of Exemption was filed with the County following award;
WHEREAS, pursuant to Resolution 2024- 093 adopted on July 1, 2024, City Council awarded the construction contract to United Storm Water, Inc. in the amount of $145,558 with a 10% contingency for a total authorization of $160,114;
WHEREAS, construction work began on September 23, 2024, and was substantially completed by October 14, 2024, in accordance with the Plans and Specifications;
WHEREAS, the final construction contract has been determined to be $124,882;
WHEREAS, the City is holding a 5% retention on this project;
WHEREAS, after the prescribed period of recordation of the Notice of Completion, the City will release the final retention payment;
WHEREAS, the overall project budget was $180,114 and the final project expenditures are estimated to be $146,814, leaving estimated unused funds in the amount of $33,300; and
WHEREAS, unused project funds in the amount of $33,300 will be re-allocated from the Citywide Trash Capture Device Installation Project (0305) to the Leroy Heights Storm Drain Project (0306) in the amount of $13,300 and the McNeil Park Project (0501) in the amount of $20,000.

NOW, THEREFORE, BE IT RESOLVED t hat the City Council of the City of San Pablo hereby:
(1) Accepts the work performed by United Storm Water, Inc. for the Citywide Trash Capture Device Installation Project (0305) as complete;
(2) Directs that a Notice of Completion to be prepared and fil ed with the County Recorder’s Office for the Citywide Trash Capture Device Installation Project (0305); and
(3) Re-allocates unused project funds from the Citywide Trash Capture Device Installation Project (0305) to the Leroy Heights Storm Drain Project (0306) and the McNeil Park Project (0501) in the amount of $33,300.
BE IT FURTHER RESOLVED that the foregoing recitations are true and correct and are included herein by reference as findings.
