The subject property is a 12 000 square foot parcel with an existing 3 000 square foot market with a small parking lot The existing market has been in operation there since approximately 1980
STAFF COMMENTS
The applicant Don Kaplan constructed the existing market in 1980 to provide a much needed service to the community At the time the neighborhood expressedtheir interest in having a corner grocery store and this Bon Fare market was the second of its kind to open in the City of San Pablo the first being near Richmond High School on 23rdSt The applicant has maintained a beer and wine license Type 20 at this location for many years and is only now requesting an upgrade to a Type 21 which would allow distilled spirits hard liquor to be sold for off site consumption
The PC Planned Community zoning district requires a use permit for all new uses and all changesto existing uses and the current request to upgrade a liquor license is determined to be such a changein use The Department of Alcoholic Beverage Sales ABC must also approve this application
The recommendation for denial is made in light of the required finding for a use permit which states
that the establishment maintenance or operation of the use of the building applied for will not under the circumstances of the particular case be detrimental to the health safety peace morals comfort and general welfare of persons residing or working in the neighborhood of such proposed use or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the city Given the proximity to other liquor stores the number of liquor establishments already in the City of San Pablo the site location and the various sources of opposition to the use staff cannot make the above finding Notwithstanding the social problems associated with alcohol in the analysis below the basis on which to deny the proposedapplication for a use permit is explained in more detail
ANALYSIS
The location of the proposed use is at a major gateway into the City of San Pablo residents and visitors alike arriving into the city from the north will pass this location The neighborhood is undergoing change and a new park is planned to be constructed only one block away to serve the families and youth of San Pablo The City of San Pablo s department of recreation and public works have both submitted letters see attached opposing the project based on its proximity to the new park and due to the potential for undesirable alcohol related activity near the park To summarize the letters it is stated that the visibility of public drunkenness is not a desirable element near a new park that is used by families and their children In addition the surrounding area is already adequately served with liquor establishments 2 e e
Within a 500 foot distance there are three other liquor establishments in operation and there is no community benefit from adding an additional liquor outlet The Planning Department has also received letters see attached from various business owners in the area many of whom also sell alcohol to deny the request of the applicant based on over saturation of establishments selling alcohol The letters in opposition state that previous problems with drug dealing loitering and petty theft are only now beginning to disappear and that approving this permit will only exacerbate the current condition
The issue of over saturation has also been confirmed by staffwith the Department of Alcohol Beverage Control ABC In the City of San Pablo the ABC has authorized a total of 21 off sale liquor licenses According to their most recent records the city has in operation 38 actual licenses nearly double the authorized amount This is possible because many of the city s liquor establishments are non conforming but they are legal and no action has been initiated to bring them into conformance In essence the City of San Pablo is over saturated with places for our residents to purchase alcohol according to the ABC

We have had a type 20 license Beer Wine at this location for 21 years and have never had an ABC violation
I have been doing business in the City of San Pablo for 33 years 1 have received an award from San Pablo for my Community Contribution as well as serving on San Pablo s Redevelopment Business Task Force for three years
San Pablo asked me in 1980 to build this store as the neighborhood needed a real grocery store In fact the City demolished a building at their cost to help project ABC tells me that they do not consider this change of type of license to be a new license and therefore the rule concerning a concentration of licenses does not apply Problems that may exist in the City or neighborhood are not caused by our store and so we should not be punished
We need this license to be competitive as all other stores sell all alcoholic beverages Please favorably consider our application for a Conditional Use Permit as an award to a long standing good member of the business community

The area we intend to develop as Wanlass Park is with mile of Bon Fare Market Wanlass Park will serve Census Tract 3660 01 which constitutes the Bayview Area in the City of San Pablo This tract has a total population of 4 632 covering 1 6 miles with 1 312 housing units 32 are under the age of 18 or 1481 youth are in that tract The population per square mile in 724 which is defined as a densely populated area
According to The West Contra Costa Unified School District 8448 of the students at Bayview Elementary School located in the 3660 01 tract are enrolled in the federal free lunch program
This area is a low to poverty level neighborhood with 11 or 371 residents unemployed out of 3497 residents age 16 to 64 in the 3660 Census tract according to the 1990 Census 12 of married households are below the poverty level 25 of the households are on public assistance
Approximately 866 children ages 5 16 years reside in the 3660 01 Census tract If you total the amount the children in the after school recreation program only 5 of the youth are being served in that area with any kind of drop in supervised after school or summer recreational program that is free of charge The neighborhood does not need another liquor store selling hard liquor to these residents Public drunkenness has been a continual problem at Brookside Park due to the amount of liquor stores in the immediate vicinity of the park The statistics in that neighborhood match those of tract 3660 01 The city is intending to build a youth activity center in Wanlass Park The youth who go to the park would probably get a snack at Bon F are Market It would be unfortunate if they were exposed to public drunkenness on their way in to buy food

Dear Planning Commission
My name is Sang Nam own Western Liquors in San Pablo I have owned this store for 15 years Today this is a nice quiet neighborhood at one time it was not Some years ago we had a lot of problems with panhandlers loiterers drug dealers and other petty criminals These problems were largely due to the situation caused by the Bev Lar Apartments However it still took more than just closing down these apartments to correct the situation
The police department worked long and hard to convmce the former tenants that it was in their best mterest to find another place to hang out As a store owner and member of the community I did all that was asked of me such as checking more I D s and refusing to sell alcoholic beverages to the list of people the police had identified as problems Although my business suffered Jt worked out because the other liquor stores in the neighborhood followed suit If we had had to split the ple any more we would have found Jt even more difficult to make it through
Now that the hard work is done and we are able to enjoy the fruits of our laboL let s not help to create a similar situation through carelessness and complacency If there had been more liquor stores then don t think we would have had enough business to be able to refuse service to the people on the pollct departments list or tighten up on D s and still stay in business I would there fore put forth this thought fwe allow this application for a use permit to go forward will we not create a situation the community will regret at a later date when there will be to many liquor stores to police As I am sure you are aware there are already an adequate number of stores in thlS neighborhood to accommodate the public convemence for the purchase of llquor Western Liquors Handy Liquors J M Liquors and the International Market Place are with in a few hundred feet of Bon Fare Market I can not think of one good reason for the Planning Commission to approve this use permit t will not be of any signiflcant benefit to the city or its citizens It can only create problems today or down the road

Bonfare Market Inc has applied for a type 21 general sales upgrade for their store located at 14701 San Pablo Ave San Pablo California In additional to the off sale of beer wine this license would allow for the off sale of harder alcoho lic beverages The 14700 block of San Pablo Ave has a high volume of police contacts from 01101 01 through 12 30 01 there have been 19 calls for police services which include but are not limited to drug arrests robberies assaults disturbances property crimes and wanted persons arrests In 1999 gang members shot three people approximately 30 yards from this business and most recently a San Pablo Police Officer was involved in an extremely violent gun battle approximately one block from Bonfare Because of the criminal element that frequents this area the public telephone located on the store s property is shut oft by the provider from 7 00pm to 7 00am throughout the week In addition to receiving a request for denial from the City of San Pablo s Planning Staff I have received letters of protest from local residents businesses and police officers alike As a whole these letters indicated that the upgrade would not benefit the community and would only result in an over saturation The officers were alarmed that the selling of hard liquor would only exacerbate their efforts to effectively police this area In fact it was recently reported that clandestine drug activity was observed on the property of Bonfare which culminated in an arrest Officers have reported to me that employees of this store do nothing to discourage illegal activity ie the business refused repeated requests to install brighter lights for the purposes of thwarting criminal activity employees fail to report criminal activity and the business ignores the garbage that routinely collects on and about their property
14701 San Pablo Ave is located in Census Tract 3660 which currently allows for six off sale general licenses Although there are only four active licenses within this tract the city as a whole is highly over saturated i e 21 licenses are authorized but 38 are in use

J M Liquors which has a general off sale license is located directly across the street from Bonfare J M Liquors has a history of police contacts resulting in numerous conditions being levied on that business JR s Bar is located across the street from Bonfare and also has a history of criminal conduct resulting in a high volume of calls for service Although Western Liquors has minimal calls for service it is located one city block south ofBonfare
There is a Housing Urban Development HUD park located approximately 100 yards from Bonfare The park is rarely utilized by the local children because of adults drinking and congregating in and about the park In the near future the city will be breaking ground on the development ofa new Wanlass park oriented towards youths The park s location will be one city block north of Bonfare The obvious concern is that with the approval of an additional general off sale license to the area the park will attract the wrong element
The city and its community will not benefit from this upgrade Furthermore it would be in the best interest of the city to consider rezoning the effected area I recommend an objection to Bonfare Markets Inc application for an upgraded license to general off sale

Please find attached a copy of the letter of protest sent to the Dept of Alcoholic Beverage Control in regard to the application for an off sale general liquor license for Bon Fare Market on San Pablo Ave
As a business owner and member of the community I encourage the Mayor and City Council to join me in protesting the issuance of this proposed liquor license It is my firm belief that this license will only benefit the licensee at the expense of the surrounding businesses and residents I remind you of the problems we used to have in this neighborhood in years past with street alcoholics drug dealers and other petite criminals and I can only imagine that these problems will return if we allow more liquor licenses in this immediate neighborhood

The area we intend to develop as Wanlass Park is with mile of Bon Fare Market Wanlass Park will serve Census Tract 3660 01 which constitutes the Bayview Area in the City of San Pablo This tract has a total population of 4 632 covering 1 6 miles with 1 312 housing units 32 are under the age of 18 or 1481 youth are in that tract The population per square mile in 724 which is defined as a densely populated area
According to The West Contra Costa Unified School District 8448 of the students at Bayview Elementary School located in the 3660 01 tract are enrolled in the federal free lunch program
This area is a low to poverty level neighborhood with 11 or 371 residents unemployed out of 3497 residents age 16 to 64 in the 3660 Census tract according to the 1990 Census 12 of married households are below the poverty level 25 of the households are on public assistance
Approximately 866 children ages 5 16 years reside in the 3660 01 Census tract If you total the amount the children in the after school recreation program only 5 of the youth are being served in that area with any kind of drop in supervised after school or summer recreational program that is free of charge The neighborhood does not need another liquor store selling hard liquor to these residents Public drunkenness has been a continual problem at Brookside Park due to the amount of liquor stores in the immediate vicinity of the park The statistics in that neighborhood match those of tract 3660 01 The city is intending to build a youth activity center in Wanlass Park The youth who go to the park would probably get a snack at Bon Fare Market It would be unfortunate if they were exposed to public drunkenness on their way in to buy food

Please consider carefully the application before you regarding the off sale liquor license for Bon Fare Market on San Pablo Ave Search back in your memories to the late 1980 s and early 1990 s when we had all the street crime and public drunkenness related to the Bev Lar Apartments Remember how frightening it was to drive through this part of San Pablo Ave Now think about all the hard work that was in involved in getting this situation cleaned up Why would we want to return to the bad old days
It is my opinion that any additional liquor license in this area would be detrimental to this neighborhood and the city s image An additional liquor store would only create an over
consentration and create a situation for problems to develope How long ago was it that Sgt Fossie tried to implement an old law regarding habitual drunkards Can we remember why

My name is SangNam I own Western Liquors in San Pablo I have owned this store for 15 years Today this is a nice quiet neighborhood at one time it was not Some years ago we had a lot of problems with panhandlers loiterers drug dealers and other petty criminals These problems were largely due to the situation caused by the Bev Lar Apartments However it still took more than just closing down these apartments to correct the situation
The police department worked long and hard to convince the former tenants that it was in their best interest to find another place to hang out As a store owner and member of the community I did all that was asked of me such as checking more I D s and refusing to sell alcoholic beveragesto the list of people the police had identified as problems Although my business suffered it worked out because the other liquor stores in the neighborhood followed suit If we had had to split the pie any more we would have found it even more difficult to make it through
Now that the hard work is done and we are able to enjoy the fruits of our labor let s not help to create a similar situation through carelessness and complacency If there had been more liquor stores then I don t think we would have had enough business to be able to refuse service to the people on the police departmentslist or tighten up on IDs and still stay in business I would there fore put forth this thought If we allow this application for a use permit to go forward will we not create a situation the community will regret at a later date when there will be to many liquor stores to police As I am sure you are aware there are already an adequatenumber of stores in this neighborhood to accommodate the public convenience for the purchaseof liquor Western Liquors Handy Liquors J M Liquors and the International Market Place are with in a few hundred feet of Bon Fare Market I can not think of one good reason for the Planning Commission to approve this use permit It will not be of any significant benefit to the city or its citizens It can only create problems today or down the road
