Re: Item 5a of San Rafael City Council Meeting – July 18, 2022 Dear Mayor Hello Mayor Colin and Councilmembers Ketrz, Bushey, Hill, and Gulati, Senate Bill No. 9 (SB9) does not require the City allow up to four houses on a single family parcel but it does specify no more than two houses on parcels within a single-family residential zone:
“A proposed housing development containing no more than two residential units within a single-family residential zone shall be considered ministerially,” Thus, it is unnecessary to approve the draft ordinance since it goes beyond the mandate of SB9.
I am writing to request that you consider not approving the ordinance to implement SB9 at the July 18th meeting and instead direct staff to develop guidelines that can be approved and followed on an interim basis for the implementation of SB9. An interim period of two or three years would seem a reasonable time to consider.
The City is not required to adopt an ordinance. SB9 states that you may adopt an ordinance but it is not required.
The implications San Rafael neighborhoods of SB9 are so substantial that easing into it, while still complying with it, may allow you to get better information after there is an opportunity to experience how it effects San Rafael.
I hope you will consider this approach. Thank you.
Sincerely,
Gregory Andrew
