Subject: RE: documents for Monday's meeting
Hello Ms. Fischer,
Listed below are responses to your inquiry:
1) Ordinance 2043 approves an amendment to the City of San Rafael zoning map to rezone the Northgate property from General Commercial to the Northgate Town Square Planned Development District and approve the Northgate Town Square PD Plan. Pursuant to the Government Code, ordinances require two readings before they can become effective. Therefore, the Item on tonight’s agenda is the second reading and adoption of that ordinance. The other two items which were on the December 2 agenda – (1) adoption of a resolution certifying the EIR, and (2) adoption of a resolution approving the Vesting Tentative Subdivision Map, Master Use Permit, Env. And Design Review Permit, and Master sign program – do not require two readings. Those resolutions were adopted on December 2 and are final. Therefore, they do not appear on tonight’s City Council agenda. 2) The modifications to resolution (2) described above which were read into the record on December 2, will be incorporated into the final resolutions signed by the City Clerk. Once signed by the City Clerk, the resolutions will be posted on the City’s website. Staff anticipates having that complete by the end of the week or early next week. Additionally, the minutes from the December 2 meeting reflect the modifications read into the record on December 2.

Thank you,
Micah

Subject: documents for Monday's meeting
Dear Lindsay,
I just reviewed the agenda for Monday's City Council meeting and have some questions on the consent item for Northgate Mall.
1) I was surprised in reading the 121 pages of Ordinance 2043, that I could not find the Master Use Permit conditions and the Environmental Design and Review Permit conditions, including those that the City Council clarified in the December 2nd meeting nor the additional conditions that were added in the staff report for that meeting.

For example, where do these appear?
a) [from staff report] The Revised Sign Program • Replace the proposed pylon sign at the northern project entrance on Northgate Drive toa a monument sign. • Replace the proposed pylon sign at the main entrance on Las Gallinas at Del Presidio to a monument sign. • Remove existing Northgate Sign on Las Gallinas. • Remove the proposed pylon sign at the norther entrance on Las Gallinas. • Remove the existing Northgate Sign at the northern entrance on Las Gallinas. • Remove the proposed pylon sign at the Merrydale entrance. • Replace the proposed pylon sign at the intersection of Loas Ranchitos and Northgate Drive with a monument sign. • Add a freestanding five-foot-tall tenant identification sign on Las Gallinas frontage for Pad 2 and Pad 4.

b) [from staff report] New Conditions: Condition #129 has been modified to specify that while new or redeveloped commercial kitchens are not required to be all electric, they shall be built to be electric ready to facilitate conversion in the future. • New condition #125 was added in response to Planning Commissioner concern that design details such as colors and materials be closely considered for consistency with materials presented (including renderings) as part of the entitlement process. Condition #125 requires that the applicant present detailed mock-up of colors and materials with each building permit to allow staff to verify consistency with approved plans and renderings. Mayor Colin also requested that these color and materials samples be made available for public inspection. c) [from staff report] a new condition of approval has been added (COA #91) requiring that the Town Square include: 1. playground amenities specific to toddler-aged children; 2. a drinking fountain; and 3. a shade structure to be incorporated into the playground area d) [from the Council Meeting] Mayor Colin requested (and the applicant agreed to) a condition for the applicant to pay for a City traffic study, based on on-the-ground traffic counts, after the completion (buildout) of Phase One 2025. Where does this appear? e) [from the Council Meeting] Mayor Colin also requested that a condition clarifying that electrical conduit would be installed in restaurants so that they will be electric ready in the future.
2) Where do the entitlements of the Master Use Permit and the Environmental Design and Review Permit appear? Aren't these entitlements specific documents that need to be approved by the City Council? How will their approval be recognized in the future if they are not clearly spelled out and formally approved? Will these be included as separate ordinances or as part of Ordinance 2043 (as was done with Ordinance 12332 for the Loch Lomond Project)?
Thank you for your help in clearing up this confusion on the entitlement approval process.

Best regards,
Shirley
