City Manager Approval: __________
TOPIC: PEACOCK GAP PARK PLAYGROUND IMPROVEMENT PROJECT COMPLETION SUBJECT: ACCEPT COMPLETION OF THE PEACOCK GAP PARK PLAYGROUND IMPROVEMENT PROJECT, CITY PROJECT NO. 11436, AND AUTHORIZE THE CITY
CLERK TO FILE THE NOTICE OF COMPLETION
RECOMMENDATION:
Staff recommends that the City Council accept the completion of the Peacock Gap Park Playground Improvement Project No. 11436 and authorize the City Clerk to file the Notice of Completion.
BACKGROUND:
Peacock Gap Park is a neighborhood park on 4.1 acres in the San Pedro Peninsula of San Rafael. Park amenities include a playground, restroom, tennis courts, picnic tables, and a parcourse. Peacock Gap is one of the City’s most frequently visited parks and was proposed as one of the near-term priority park projects in the 2023 Citywide Parks and Recreation Master Plan (CPRMP).
While the CPRMP identifies several improvements for Peacock Gap Park, this Peacock Gap Park Playground Improvement Project (“Project”, Project No. 11436) focused on the play areas. This included redesigning the existing play area to replace the playground structures, installing engineered wood surfacing and landscaping, upgrading nearby benches and picnic tables, and addressing the Americans with Disabilities Act (ADA) accessibility requirements.
On December 18, 2023, the City Council authorized the City Manager to enter into a $130,000 Professional Services Agreement with Royston, Hanamoto, Alley & Abey (RHAA) for landscape architectural and engineering design services, including construction administration support for the Project.
On December 16, 2024, the City Council awarded the construction contract to Rapid Grading Services in the amount of $804,950 and approved a construction contingency of $120,050, for a total not to exceed $925,000. Construction began on March 28, 2025, and was completed on September 9, 2025.
ANALYSIS:
Pursuant to Civil Code Section 8182, the City is required to record a Notice of Completion upon City acceptance of the improvements. This acceptance initiates a period during which project subcontractors SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2
may file Stop Notices seeking payment from the City of the funds owed to the Contractor for the project work.
FISCAL IMPACT:
The Peacock Gap Park Playground Improvement Project was funded through Measure A appropriations totaling $1,069,000. The total cost to complete this project is approximately $930,000, including survey, design, and construction. The remaining funds of $139,000, consisting of unused project funds, shall be returned to the Measure A Fund balance for future programming.
In accordance with the project specifications, the City retained 5% of the full amount due on each progress payment to Rapid Grading Services, resulting in a total construction retention of $40,395.90.
The final payment and release of retention will be made 35 days after the recordation of the Notice of Completion.
RECOMMENDED ACTION:
Staff recommends that the City Council accept the completion of the Peacock Gap Park Playground Improvement Project (Project No. 11436) and authorize the City Clerk to file the Notice of Completion.
