TOPIC: PICKLEWEED PARK ENHANCEMENT PROJECT NOTICE OF COMPLETION SUBJECT: ACCEPT COMPLETION OF THE PICKLEWEED PARK ENHANCEMENT PROJECT, CITY PROJECT NO. C661137610, AND AUTHORIZE THE CITY CLERK TO FILE THE
NOTICE OF COMPLETION
RECOMMENDATION:
Staff recommends that the City Council accept the completion of the Pickleweed Park Enhancement Project and authorize the City Clerk to file the Notice of Completion.
BACKGROUND:
The Pickleweed Park, located in the southeast part of the City of San Rafael, is one of the most used parks and community centers in San Rafael. While Pickleweed Park is closer in size to a city-wide park, it is used predominantly by the surrounding neighborhood and serves those within walking distance. The Canal neighborhood, which surrounds the park, gathers there for its social, educational, spiritual, and recreational needs.
The Pickleweed Park Enhancement Project (Project) has been a community priority for more than a decade, and the City has been developing funding strategies for this project since 2010. Throughout that time, the City has conducted numerous rounds of community outreach, helping planners refine the proposed enhancements based on community needs and interests. The Project adds several park amenities, including an all-weather turf field, basketball/sport court, playground structure for children under five, fitness equipment for adults, shaded seating, and a gazebo.
On February 22, 2022, the City Council approved the application to the Land and Water Conservation Fund (LWCF) for the Pickleweed Park Enhancement Project, which detailed a total funding request of $4,240,000 from LWCF, with a required City match of $4,240,000. In July 2022, California State Parks recommended the Pickleweed Park Enhancement Project to the National Park Service for the LWCF grant. On March 27, 2024, the City and State of California signed an agreement approving the City’s use of $4,240,000 in LWCF grant funds for this project.
On July 15, 2024, the City Council awarded the construction contract to Bauman Landscape and Construction, Inc., in the amount of $6,031,641.50, and approved a construction contingency of SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2
$1,088,358.50, for a total of $7,120,000. Construction began on September 9, 2024, and the anticipated completion of outstanding items is by February 2026.
ANALYSIS:
Pursuant to Civil Code Section 8182, the City is required to record a Notice of Completion upon its acceptance of the improvements. This acceptance initiates a period during which project subcontractors may file Stop Notices seeking payment from the City of the funds owed to the Contractor for the project work.
Undisputed retention for items of work completed to date will be released pursuant to General Conditions Article 8.5 of the Contract. Outstanding items of work, including remaining punch list items and corrective concrete flatwork surrounding the toddler playground improvement, were completed in February 2026.
All outstanding work will be completed and accepted by the City before final payment, and the remaining undisputed retention will be released in accordance with the Contract.
FISCAL IMPACT:
The Pickleweed Park Enhancement Project was funded through appropriations within the Capital Improvement Fund (410) for the Pickleweed Park Enhancement Project. The total cost to complete this project is approximately $7,432,761, including project construction, design, environmental compliance, and construction management.
The remaining funds of $1,861,580 consist of unused construction contingency and remaining project budget, $1,317,496 of which are dedicated LWCF Grant funds and required City match, which shall be utilized exclusively for the Pickleweed Park Enhancement Restroom Project, City Project No.
C44F26P004 and an additional grant for acceptable park improvements. Of the remaining project funds, $544,084 shall be returned to the Capital Improvement Fund (410) balance.
In accordance with Project specifications, the City retained five percent of the full amount due on each progress payment to Bauman Landscape and Construction, Inc., resulting in a total construction retention of $294,481.78. The final payment and release of the undisputed retention will be made 35 days after the recordation of the Notice of Completion.
RECOMMENDED ACTION:
Staff recommends that the City Council accept the completion of the Pickleweed Park Enhancement Project and authorize the City Clerk to file the Notice of Completion.
