Re: Update to Park Impact Fee Programs and Nexus Study
Dear Mayor Kate and Council Members:

We are writing in protest of the Update to the Park Impact Fee that is on the City Council's Agenda for the May 18, 2026 Meeting, which is tonight.

We attended the Finance Subcommittee Meeting on April 14th, 2026, and shared our thoughts with the Subcommittee about this proposed Ordinance. We strongly opposed this fee as a Developer in the City of San Rafael. We see that our comments have been completely disregarded.

Looking specifically at Development Impact Fee for Multi-Family Housing that is proposed, The City is proposing an $18.50 fee per square foot (SF) for all new Multi-Family Housing projects.

Taking a hypothetical project that proposes 100 units that average 850 SF, that equates to a $15,725 per UNIT fee. Over the hypothetical 100 units of the project, this equates to a fee of $1,572,500 for Parks alone. This is on top of all the other impact fees that the City levies on projects.

If this Development impact fee is adopted for new housing in the City, it will make future projects financially infeasible and thus deter future development of the City of San Rafael.

We find it difficult to conceptualize that the City requires over $100,000,000 of new park facilities as illustrated in the Nexus Study. We believe there to be significant legal issues with the Néxus Study as outlined in the Letter presented by the Call Marin Home group dated May 15, 2026.

On behalf of the Monahan Pacific Corporation, we request this action be continued for further study.

Regards,
Steve Monahan
