PUBLIC HEARING ON THE ANNUAL ASSESSMENT FOR THE CITY COUNCIL MEETING OF JUNE 15, 2026
RECOMMENDATION:

Staff recommends that the City Council approve the following items:

1. Adopt a resolution directing the filing of the Engineer’s FY 2026-27 Annual Report.

2. Adopt a resolution approving the Engineer’s FY 2026-27 Annual Report.

3. Adopt a resolution of intention to order improvements and setting a public hearing on the annual assessment for the City Council meeting of June 15, 2026.

BACKGROUND:

To comply with provisions of the Landscaping and Lighting Act of 1972, which governs this type of assessment district, the City of San Rafael (“City”) City Council must approve an Engineer’s report annually. Assessments to be collected by the assessment district must be allocated and levied annually after a noticed public hearing, to be held this year on June 15, 2026.

In 1990, the Baypoint Lagoons Landscaping and Lighting Assessment District (“Assessment District”) was formed to protect and enhance wildlife habitat and water quality in Baypoint Lagoons, the adjacent ponds, and the diked salt marsh. There are four total ponds/lagoons located within the Assessment District. Maintenance provided by this Assessment District has historically included mowing around the lagoon, replanting areas with native vegetation, and eradicating invasive plants such as cattails.

SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2
Since the mid-2000’s, the Baypoint Lagoons Homeowners Association (HOA) has taken a more active role in the landscaping of the lagoon areas. The HOA has funded landscaping and biannual mowing of the grass around the lagoon.

In 2015, the landscaping and eradication of non-native species moved to a manageable maintenance level. The HOA approached the City with two major concerns: 1) the odor nuisance seasonally emitted from the lagoons; and 2) the need for improvements to the nearby Cayes Stormwater Pump Station. The homeowners agreed that Assessment District funds could be used for these priorities.

The Assessment District was originally structured with three dedicated funds, each serving a specific purpose in support of the environmental health and infrastructure needs of the lagoon and surrounding areas: 1) Eradication of Exotic Plants (EEP) Fund, 2) Environmental Monitoring (EM) Fund, and 3) Cayes Stormwater Pump Station Improvements (CSPSI) Fund. To better reflect the Assessment District’s longterm environmental goals, the EEP and EM funds were merged into a Habitat Protection Fund. The Habitat Protection Fund supports a broad range of environmental stewardship activities, including:
• Ongoing removal and control of invasive, non-native plant species that threaten the biodiversity of the lagoon and surrounding marsh habitat;
• Continued monitoring of lagoon health, including water quality, vegetation growth, and wildlife habitat, to inform adaptive management practices; and,
• Manual and/or automated management of lagoon water levels to mitigate odors, support native species, and maintain the ecological balance of the water body.

The consolidated fund allows the City and the community to respond more nimbly to emerging needs, fund multi-purpose projects, and advance shared goals related to conservation, aesthetics, and odor mitigation.

ANALYSIS:

To align with and support the goals of homeowners and the Assessment District, the City has made concerted efforts over the past handful of years on a couple of key issues. The first combined effort was for the engineering and reconstruction of the Cayes Pump Station. In 2021, a design contract was awarded to Cammisa + Wipf, but the estimated cost exceeded the funds available in the CSPSI Fund.

Therefore, City staff has now pivoted to incorporate the evaluation of the Cayes Pump Station in the City’s Capital Improvement Programs. Furthermore, City staff is now working on a Storm Drain Master Plan that will evaluate the entire storm drain system, including pump stations such as Cayes Pump Station, to determine where the City’s limited stormwater funds will be allocated. The larger pump station project will have to wait until this process is complete to determine its ranking citywide. City staff anticipates the Storm Drain Master Plan to go to Council for consideration in fiscal year 2027. City staff will continue to monitor the progress of the Storm Drain Master Plan in relation to the Cayes Pump Station.

Another ongoing effort for the Assessment District centers around vegetation and invasive species. Some homeowners in the Assessment District approached City staff regarding vegetation and invasive species.

The City proceeded to secure a contract with WRA for landscape design and held meetings with some homeowners and the consultant to discuss the work. The design work was completed in 2025. The design work includes the introduction of native and ecologically appropriate vegetation to enhance habitat value and improve visual aesthetics, irrigation system updates, and water management improvements. City staff expects to continue to work with the homeowners and the consultants on design implementation.

SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 3
Additional ongoing efforts for the Assessment Districts are the lagoons. City staff receives many requests to recharge the lagoon for odor control and removal of water before large storms hit, instead of just allowing the lagoons to rise and fall with the tides. City staff regularly monitors and maintains the outfall, the pump station, and vegetation to ensure the lagoons remain intact.

The activities for the Assessment District Fund during FY 2025-26 were as follows:

July 1, 2025, Fund Balance $238,736
Revenues
Assessments $25,368
Interest $8,991
Total Revenues $34,359
Assessment District Expenditures through March 31, 2026:

Staff Time $2,000
Contractual Services - WRA Landscape Design $5,000
Total Expenditures (proj.) $20,313
Projected June 30, 2026, Fund Balance $252,782
The table above represents the total estimated assessment district expenditures for FY 2025-26.

For FY 2026-27, the district expenditures are estimated at $36,218 and are summarized in the table below.

Estimated Assessment District Operations Expenditures FY 2026-27 Unallocated Assessments (2025-2026) $1,268
County Administrative Fees $450
Staff Time $8,000
Cattails Removal and Landscaping Maintenance $15,000
Outfall Drainage Inspection & Maintenance $5,000
- (Contingency) Outfall Digout Work $5,000

This table and others are in the attached Engineer’s report. All Assessment District fees collected are legally restricted for use on Baypoint Lagoons and cannot be used for any other purpose.

SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 4
The attached resolutions provide for filing and approval of the Engineer’s 2026-27 Annual Report for the District and setting the public hearing on the assessments.

FISCAL IMPACT:

All revenues and expenses are generated by the Assessment District and are contained within the Assessment District Fund (Fund No. 235). The proposed FY 2026-27 assessment is $131.44 per parcel, which has remained unchanged since 1996. The City incurs indirect General Fund costs for staff time spent managing the Assessment District, monitoring and adjusting the lagoon water level, and managing the capital improvements at the Cayes Stormwater Pump Station. The Assessment District pays for all direct contracted costs.

For FY 2026-27, the City has estimated revenues of $34,628. Of those revenues, $25,368 are proceeds from the proposed assessment for FY 2026-27. For FY 2026-27, the City has estimated expenditures of $36,218. Of those expenditures, $28,218 are direct expense items that exclude costs for staff’s time.

Funding from the Assessment District’s proceeds in support of the identified work plan will be appropriated with the City’s FY 2026-27 budget, pending adoption.

ENVIRONMENTAL ANALYSIS:

Landscaping and lighting district assessments are exempt from the California Environmental Quality Act (CEQA) under Guidelines Section 15378 (b) (4), because government fiscal activities, which do not involve any commitment to any specific project, which may result in a potentially significant physical impact on the environment, are not considered a project.

OPTIONS:

The City Council has the following options to consider relating to this item:

1. Adopt the three resolutions as presented.

2. Provide direction to staff to modify any or all of the resolutions and return to the City Council with additional information.

3. Do not adopt the resolutions. If the Council does not adopt the resolutions, the public hearing will not take place, and the City will be unable to levy the annual assessment against property owners within the Assessment District.

RECOMMENDED ACTION:

Staff recommends that the City Council approve the following items:

1. Adopt a resolution directing the filing of the Engineer’s FY 2026-27 Annual Report.

2. Adopt a resolution approving the Engineer’s FY 2026-27 Annual Report.

Background:

Plans for the maintenance and improvement of the lagoon are the monitoring portions of the report prepared by Western Ecological Services Company, Inc., dated May 31, 1996 and titled Revised Proposal For 1998 And 1999 Budget For Spinnaker Lagoon Management, the Letter Report prepared November 28, 1999 by Wetlands Research Associates, Inc., the Letter Proposal prepared by Pacific OpenSpace dated August 9, 1999, and subsequent documents and contracts between Pacific OpenSpace and the City of San Rafael. These documents have been filed previously with the clerk of the legislative body and are incorporated in this Report by reference.

The actual eradication of the cattails had been handled directly through a City contract. Years ago, the City obtained a number of preliminary proposals to completely eliminate the cattails from the entire lagoon. At the time, the estimated cost to do this work was $90,000. Since the Assessment District was not able to fund the amount from a single annual assessment, the City developed a program to complete a portion of the eradication each year on an ongoing basis, thereby arresting future expansion of the cattail area and slowly reclaiming the lagoon from the emerging cattail areas.

The fund to eradicate exotic plants has remained constant with no additional allocation.

The Homeowner’s Association has continued to take an active role in managing and directing the District. Representatives from the Homeowners Association met on numerous occasions with the District Engineer, the City’s engineering staff, and the City’s maintenance staff regarding the management and operations of the lagoon and surrounding open area. These meetings started a number of years ago and have continued, allowing the homeowners to gain expertise and insight into the original intentions of the District and develop ideas and plans to make the best use of the District funds.

In past years, additional weed abatement was performed by Pacific OpenSpace, Inc. under the direction of the City. The Pacific OpenSpace maintenance crew performed weed control in the form of mowing at Baypoint Lagoon. The major focus of their work was the eradication of broadleaf perennials, such as bristly ox-tongue (Picris echioides) and fennel (Foeniculum vulgare), as well as perennial weeds such as Harding grass (Phalaris aquatica). Based on the active role that the homeowners have taken, much of the annual landscape control maintenance work that had previously been completed by the District is being paid for directly by the Homeowners Association.

This includes the annual or bi-annual mowing around the lagoon.

In 2015, the homeowners approached Nader Mansourian, then Director of Public Works, with two concerns relative to the District. The first concern was the seemingly hopeless task of obtaining adequate funds to replace and upgrade the City of San Rafael’s Cayes Storm Water Pump Station, and the second, the more immediate need, was to address the odor nuisance from the Lagoon.

First Concern:

Since 2006, the District has set aside money every year to fund improvements to the Cayes Storm Water Pump Station. The amount of set aside started small, $5,000.00, and has increased to approximately $10,000.00 annually. The amount set aside is designated to fund the control improvements to the pump station to bring the control system up to date and allow a more automated control of the water level to reduce the potential for hot weather odors and algae growth.

The cost of the control system has increased steadily over the years, and there has never been a formal assessment of the specific control system improvements needed to automate the system.

PART A

Page 5 ends

The Homeowners Association continues to work with the City to use District funds to undertake a formal study to determine the feasibility, cost, and potential benefit of enhancing the control systems at the Cayes Storm Water Pump Station, with specific emphasis on alleviating the unpleasant odors which emanate from the lagoon.

Second Concern:

In 2014, the odor complaints continued to get worse, and the funding for the improvements to the Cayes Storm Water Pump Station continued to be short of what was needed to fund the pump station improvements. Members of the District approached the City and requested that funds from the District be allocated to further study options to control the odor. In January 2015, the City Council, acting on the request from the members of the District, authorized the Public Works Director to engage Siegel Environmental to study the problem and suggest solutions to the odor problems that might be accomplished without changing the controls at the pump station. The cost of the study was $35,485.00, and the members of the District agreed to fund this out of the set-aside funds available in the District. The study was completed in February, 2016, and the District paid the appropriate invoices. The result of this work reduced the overall funds available.

Previous Year’s Activities
Consult the previous year’s Engineer Reports for activity details. 2025-2026 Activities
City staff have continued to regulate the water levels in the lagoon, which has minimized the odor complaints in the area and facilitated the recharge of the lagoon levels. City staff receives requests to recharge the lagoon instead of just allowing the lagoon to rise and fall with the tides for odor control and removal of water before large storms hit. City staff regularly monitors and maintains the outfall, the pump station, and vegetation to ensure the lagoons remain intact and don’t become a nuisance.

Over the past year, City staff has continued to clean out both the pipe that discharges into the lagoon and the pipe that connects the salt marsh to the lagoon. City staff time amounted to $8,000 in these efforts through the end of March and will be approximately $10,000 by June 30, 2026.

City staff have also continued to monitor the floating islands, conducting weekly inspections during the summer and unscheduled maintenance throughout the year. Floating islands offer a sustainable and effective solution for improving water quality and enhancing aquatic habitats. These engineered floating wetlands mimic natural processes by providing a buoyant platform supporting plant growth and fostering microbial activity. The plant roots extend into the water column, creating a large surface area that facilitates the removal of pollutants through sedimentation and microbial uptake.

This design effectively captures nutrients like nitrogen and phosphorus, which are common contributors to water pollution and algal blooms. Research has demonstrated the efficacy of floating treatment wetlands in a variety of settings. Additionally, these systems provide valuable habitat for wildlife, support biodiversity, and aid in restoring aquatic ecosystems. The Habitat Protection Fund balance is expected to have a balance of $110,839 this June 30, 2026.

For the Cayes Storm Water Pump Station (“Cayes Pump Station”), City staff inspect the pump station regularly to prevent algae growth and do unscheduled maintenance throughout the year. As a long-term solution, City staff have included the Cayes Pump Station in the City’s Capital Improvement Programs for a more holistic approach to funding and prioritization. Additionally, PART A

Page 6 ends

City staff is also now working on a Storm Drain Master Plan that will evaluate the entire storm drain system, including the Cayes Pump Station, to determine where the City’s limited stormwater funds will be allocated and what the needs of each station’s functionality are and will be. The Cayes Pump Station's next steps will wait until the Storm Drain Master Plan is complete to see where it ranks citywide. City staff anticipate the Storm Drain Master Plan to go to Council for consideration in fiscal year 2027. City staff will continue to monitor the progress of the Storm Drain Master Plan in relation to the Cayes Pump Station. The Pump Station Control Fund is expected to have a balance of $110,470.00 on June 30, 2026.

Another ongoing effort for the District centers around vegetation and invasive species.

Homeowners of the District approached City staff about vegetation and invasive species, and the City proceeded to secure a contract with WRA for landscape design work. The design work was completed in 2025. The design work included the introduction of native and ecologically appropriate vegetation to enhance habitat value and improve visual aesthetics, irrigation system updates, and water management improvements. City staff expects to continue to work with the homeowners and the consultants on design implementation. The future determinations on funding availability for any implementation of work is ongoing.
