SAN RAFAEL CITY COUNCIL AGENDA REPORT
Department: Public Works
Prepared by: Grey Melgard, Senior Engineer
April Miller,
Director of Public Works
City Manager Approval: __________
TOPIC: COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF SAN RAFAEL AND
THE COUNTY OF MARIN FOR THE POINT SAN PEDRO SLURRY SEAL PROJECT SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AND EXECUTE A COOPERATIVE
AGREEMENT BY AND BETWEEN THE CITY OF SAN RAFAEL AND THE COUNTY
OF MARIN, AND APPROVING THE PLANS AND SPECIFICATIONS FOR THE POINT
SAN PEDRO ROAD SLURRY SEAL PROJECT
RECOMMENDATION:
Staff recommends that the City Council adopt the attached Resolution, authorizing the City Manager to negotiate and execute a cooperative agreement by and between the City of San Rafael and the County of Marin for the Point San Pedro Slurry Seal Project (“Project”) and approving the plans and specifications for the Project.
BACKGROUND:
The City of San Rafael and the County of Marin have been working together to coordinate pavement preservation treatments of streets that are divided between the City’s and the County’s jurisdictions. Most recently, the City and the County have been working together on the County’s Point San Pedro Slurry Seal Project (“Slurry Seal Project”) to expand the limits of proposed improvements to in-between the western edge of the San Rafael High School parking lot on 3rd Street and the eastern City limit of Point San Pedro Road approximately 600 feet northeast of Biscayne Drive (“Project Limits”).
The scope of the Slurry Seal Project includes:
1. Complete a preventative maintenance slurry seal application along the Project Limits on Point San Pedro Road.
2. Incorporate readily implementable safety enhancements, bicycle improvements, and other measures.
3. Complete the Slurry Seal Project in coordination with the City of San Rafael to minimize impacts to residents and provide a uniform corridor.
Additionally, the City will incorporate additional pedestrian safety improvements at key City-maintained intersections along the Project Limits. These improvements are part of the Point San Pedro Pedestrian Quick Build Enhancement Project (“Quick Build Project”), which has received Transportation Development Act Article 3 (“TDA 3”) grant funds in the amount of $88,300 from the Transportation Authority of Marin (TAM). The City Council adopted a resolution authorizing the City Manager to execute SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2
a funding agreement with the Metropolitan Transportation Commission (MTC) for the TDA 3 grant during the January 20, 2026, regular meeting.
ANALYSIS:
Adopting the Resolution would allow the City of San Rafael and the County of Marin to advance the final design and construction of both the Slurry Seal Project and the Quick Build Project cooperatively, limiting additional impacts to residents, avoiding additional costs to both agencies, and streamlining the construction process under a single contract.
Under the cooperative agreement, the City of San Rafael is responsible for completing the design plans for its portion of Point San Pedro Road, including the Quick Build Project. The County will incorporate these design plans into a single construction bid set. The County will administer the bid set and award the construction contract of the Slurry Seal Project to a single contractor. Additionally, the City will reimburse the County for direct project costs associated with the construction phase of the City-owned streets incorporated into the Slurry Seal Project.
The County will complete its own design plans for its portion of Point San Pedro Road. Additionally, the County will serve as the lead agency for the determination and management of the California Environmental Quality Act (CEQA) for the entire Slurry Seal Project scope.
The Quick Build Project will be administered, designed, and implemented as part of the larger Point San Pedro Slurry Seal Project. The Quick Build Project includes pedestrian safety improvements at key Citymaintained intersections along the Point San Pedro Road corridor, including the installation of rectangular rapid flashing beacons (RRFBs), flashing advanced warning signs, minor traffic striping, and rubber curbs to create refuge islands and curb bulb-outs. A pedestrian refuge island is a median with a refuge area intended to help protect pedestrians who are crossing a multilane road, in this case, Point San Pedro Road. This project would promote pedestrian commute options for students who travel to Glenwood Elementary School within the neighborhood.
Adopting the Resolution would allow the construction of both projects, which directly support the City Council’s Three-Year Strategic Plan under Priority Area B: Mobility and Infrastructure.
COMMUNITY OUTREACH:
In September 2025, the Quick Build Project was presented to TAM’s Bicycle and Pedestrian Advisory Committee (BPAC) for discussion and approval of the TDA 3 grant application request. The Slurry Seal Project was presented to the Point San Pedro Coalition in November 2025 to gather public feedback. In April 2026, both projects were presented to the City of San Rafael’s BPAC, and a separate open house for the community was held on April 17 with County and City staff in attendance. Prior to construction, additional mailer notices will be sent out to residents directly impacted by construction activities along the corridor.
FISCAL IMPACT:
If the City Council adopts the Resolution, the City will agree to reimburse the County for direct project costs associated with the construction phase of the City-owned streets incorporated into the Slurry Seal Project. The final cost will be based on actual installed and constructed quantities and the lowest responsible bid received by the County.
While the exact cost of the Slurry Seal Project is not yet available, the Slurry Seal Project will utilize the City’s Annual Pavement Management Program funding to cover all associated costs. The adopted Fiscal Year 2025-2026 Budget, approved by City Council on June 2, 2025, included $3 million in funding to SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 3
support the Annual Pavement Management Program. Staff anticipates that the total project cost incurred by the City will be approximately $1.1 million for construction, design, and construction management.
Point San Pedro Pedestrian Quick Build Enhancement Project The total anticipated cost for the Quick Build Project is $182,000. It is anticipated that appropriations of the TDA 3 funds for the Quick Build Project will be included in the FY 2026-27 Budget as part of the Capital Improvement Program budget under the Annual Pavement Management Program. Additional funds for the construction of the Quick Build Project will be appropriated as part of the Annual Pavement Management Program for the Project, subject to City Council approval of the FY 2026-27 Budget.
ENVIRONMENTAL DETERMINATION:
The County of Marin submitted a Notice of Exemption for the Slurry Seal Project on March 4, 2026, under Categorical Exemption Section 15301: Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety). The approved Notice of Exemption is included as Attachment 2 to this staff report for reference. Staff reviewed the Quick Build Enhancement Project and determined that it also qualifies for a categorical exemption under Section 15301 of the California Environmental Quality Act (CEQA).
OPTIONS:
The City Council has the following options to consider relating to this item:
1. Adopt the resolution as presented.
2. Do not adopt the resolution and provide further direction to staff. This option would significantly delay the Project and result in additional cost and staff time for the City.
RECOMMENDED ACTION:
Staff recommends that the City Council adopt the attached Resolution, authorizing the City Manager to negotiate and execute a cooperative agreement by and between the City of San Rafael and the County of Marin for the Point San Pedro Slurry Seal Project (“Project”) and approving the plans and specifications for the Project.
