A U.S. Army Corps of Engineers determination identifies wetlands and waters of the United States on the parcel.

None of this was assembled by an outside critic. It is the City's own consultants, its own environmental documents, and its own signed agreement.

I respectfully request that the Council remove Item 2.j from the Consent Calendar and decline to authorize ground-disturbing work until a biological survey appropriate to these documented conditions is completed.

This comment is submitted for the purpose of, among other things, satisfying the requirements of Public Resources Code section 21177.

Respectfully submitted,
Mark Allen

4. The proposed action, together with Item 2.i, reflects an ongoing commitment to a course of action before environmental review is complete.

Item 2.i establishes a Council subcommittee for the permanent affordable housing development at the same parcel, while Item 2.j authorizes construction contracting and approves plans and specifications for the interim shelter phase. Approving construction funding and specifications, and simultaneously advancing the permanent phase, commits the City to a definite course of action with respect to the property as a whole. Reviewing the interim and permanent phases separately, while treating the interim phase as exempt, does not reflect the whole of the action.

5. Waiver of competitive bidding.

I further note, without waiving any of the foregoing, that the proposed waiver of competitive bidding under San Rafael Municipal Code section 11.50.090(B) rests in part on schedule urgency arising from the same emergency determinations that are presently under judicial review.

For these reasons, I respectfully request that the City Council decline to adopt the proposed resolution, or in the alternative continue Item 2.j pending resolution of the pending proceedings and completion of appropriate environmental review.

This comment is submitted for the purpose of, among other things, satisfying the requirements of Public Resources Code section 21177.

Respectfully submitted,
Mark Allen
