SAN RAFAEL CITY COUNCIL AGENDA REPORT
Department: Public Works
Prepared by: Mariana Sanchez, Junior Engineer City Manager Approval: _________ TOPIC: LINCOLN AVENUE CORRIDOR SAFETY IMPROVEMENTS AT WILSON COURT
AND BROOKDALE AVENUE PROJECT
SUBJECT: RESOLUTION AUTHORIZING AN AMENDMENT TO THE CONTRACT WITH ALTOR CONSTRUCTION LLC (“ALTOR”) TO INCREASE THE NOT-TO-EXCEED CONTRACT AMOUNT BY $790, FOR A TOTAL NOT-TO-EXCEED CONTRACT AMOUNT OF $327,990; AND ACCEPTING COMPLETION OF THE LINCOLN AVE CORRIDOR
SAFETY IMPROVEMENTS AT WILSON CT AND BROOKDALE AVE PROJECT, CITY PROJECT NO. C441145310, AND AUTHORIZE THE CITY CLERK TO FILE THE
NOTICE OF COMPLETION
RECOMMENDATION:
Staff recommends that the City Council adopt the resolution authorizing an increase to the Altor Construction LLC (“Altor”) not-to-exceed contract amount by $790, increasing the total not-to-exceed contract amount from $327,200 to $327,990 to cover the additional time and materials required to complete the Lincoln Ave Corridor Safety Improvements at Wilson Court and Brookdale Avenue Project ("Project"); accept completion of the Project; and authorize the City Clerk to file the Notice of Completion.
BACKGROUND:
The two intersections at Lincoln Avenue/Wilson Court and Lincoln Avenue/Brookdale Avenue were identified as safety priorities in Marin County’s 2018 Systemic Safety Analysis Report (SSAR). The Project improvements included installing rectangular rapid flashing beacons (RRFBs) and corner curb extensions (bulb-outs), upgrading curb ramps, resurfacing the roadway, and enhancing roadway striping and pavement markings to improve pedestrian safety.
On December 15, 2025, the City Council awarded the construction contract to Altor for $284,480 and approved a construction contingency of $42,720, for a total appropriation of $327,200. Construction began on April 6, 2026, and was completed on August 11, 2026.
ANALYSIS:
Pursuant to Civil Code Section 8182, the City is required to record a Notice of Completion upon its acceptance of the improvements. This acceptance initiates a period during which project subcontractors SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2
may file Stop Notices seeking payment from the City for the funds owed to the Contractor for the project work.
The total appropriations for the contract with Altor were $327,200 for construction costs. The final project construction cost totaled $327,990, resulting in a $790 overrun. The additional costs were for temporary traffic and pedestrian control at the intersection of Lincoln Avenue and Wilson Court near the existing Marin Transit bus stop to allow continued access during construction. The additional costs will be paid through the increased not-to-exceed contract amount. The proposed contract amendment incorporates the change order utilizing the authorized project contingency, plus the overrun of $790.
FISCAL IMPACT:
The City Council approved appropriations of $310,000 in the Fiscal Year (FY) 2024-25 Budget and $175,000 in the FY 2025-26 Budget, bringing the total Project budget to $485,000.
The Project was funded through State funds from the Local Highway Safety Improvement Program (HSIP) and City Gas Tax Fund (206).
No additional project appropriation is required, as sufficient funding is available within the existing project budget to supplement the increase to Altor’s not-to-exceed amount by $790, increasing the total not-toexceed contract amount from $327,200 to $327,990.
The total cost to complete this project is approximately $477,500, including project design, construction, construction cost overrun, and construction inspection. The remaining project budget of $7,500 will be returned to the Gas Tax Fund (206) balance.
In accordance with Project specifications, the City retained five percent of the full amount due on each progress payment to Altor, resulting in a total construction retention of $16,400. The City will make the final payment and release the undisputed retention 35 days after the recordation of the Notice of Completion.
OPTIONS:
The City Council has the following options to consider relating to this item:
1. Adopt the resolution as proposed by staff.
2. Do not adopt the resolution and direct staff to return with more information.
