CITY COUNCIL STAFF REPORT
DATE: January 18, 2022
TO: City Council/City Manager
FROM: Christina Franco, City Clerk
By: Christina Franco, City Clerk
SUBJECT: MINUTE ORDER NO. 2022-001 - Authorizing the Continued Use of Teleconferencing for the Meetings of All City Legislative Bodies for the Next 30 Days, Pursuant to the Provisions of AB 361 and as Adopted by Minute Order No. 2021-005

RECOMMENDED ACTION
Staff recommends approving this Minute Order to continue the use of teleconferencing for the meetings of all city legislative bodies (as defined by the Brown Act) pursuant to Assembly Bill (AB) 361 effective immediately.

BACKGROUND/DISCUSSION
Beginning in March of 2020, the Governor issued a series of Executive Orders relaxing certain provisions of the Brown Act in response to the COVD-19 pandemic. In short, those orders allowed local governments to conduct their meetings remotely, so long as members of the public still had the ability to view, listen and comment on items on the agenda. The most recent of these Orders expired on September 30, 2021. On September 15, 2021, the Governor signed into law AB 361, an urgency measure, effective immediately. AB 361 builds upon Executive Order ("EO") N-29-20, issued by the Governor on March 17, 2020, which relaxed the teleconferencing requirements of the Brown Act to facilitate virtual meetings during the COVID-19 declared emergency. The order specifies that for any meetings held to determine if remote meetings are justified beyond September 30, local legislative bodies must follow the statutory requirements established by AB 361.

On October 4, 2021 at the City Council special meeting the Council adopted Resolution No. 2021-114 approving the continued use of teleconferencing for the meetings of all City legislative bodies pursuant to the provisions of AB 361. Additionally, at the special meeting the Council made a separate motion to place a minute order on each Council agenda to reconsider the factors, and the motion was approved 4-0-1-0.

AB 361 contains several requirements in order to continue the use of remote meetings. These include:
 There must be a state of emergency declared under the California Emergency Services

Act. This effectively means the Governor must have declared the emergency.  During that state of emergency, either state or local officials have imposed or recommended measures to promote social distancing, or that meeting in person would present an imminent risk to the health or safety of attendees.  In order to continue to utilize remote meetings, the Council must reconsider the factors above every 30 days and adopt the following findings by majority vote:
 The legislative body has reconsidered the circumstances of the state of emergency.  Any of the following circumstances exist:
o The state of emergency continues to directly impact the ability of the members to meet safely in person.
o State or local officials continue to impose or recommend measures to promote social distancing.

The City is in currently in compliance with AB 361 requirements for conducting public meetings with our current implemented teleconference procedures. By approving this Minute Order, the Council adopts the above required findings to allow continued virtual meetings for all of the City’s legislative bodies and committees for the next 30 days. A similar Minute Order will be brought before the Council at every regular meeting as long as the current state of emergency exists.

The state of emergency proclaimed by the Governor on March 4, 2020, related to the COVID-19 pandemic has not been rescinded and remains in effect. Both state and local health officials continue to recommend social distancing and masking to help stop the spread of the virus.

The Minute Order applies to all of the City’s legislative bodies, as defined by the Brown Act, and will remain in effect for the next 30 days.

FISCAL ANALYSIS
None.

STEPS FOLLOWING APPROVAL
If approved, all subsequent Minute Orders will be presented by title only on the council agenda and referenced to this Minute Order No. 2021-005.
