CITY COUNCIL STAFF REPORT
DATE: February 17, 2022
TO: City Council/City Manager
FROM: Martin Lysons, City Attorney
By: Martin Lysons, City Attorney
SUBJECT: Public Hearing No. 3: The 2021-2022 Redistricting Process

RECOMMENDED ACTION
Staff recommends the City Council receive the staff report, take public testimony, review the draft maps, and provide staff and the City’s demographer with direction regarding proposed edits to the draft maps or the creation of additional drafts of the revised district boundary map.

BACKGROUND/DISCUSSION
Following receipt of updated population data from the 2020 Census, cities in California with electoral districts are required to update (“redistrict”) their district boundaries. This process occurs every 10 years, and for the City of San Ramon, it must be completed by April 17, 2022.

Procedural Requirements for Redistricting: Overview
State law establishes procedural requirements for redistricting. After San Ramon created electoral districts in 2019, the Governor signed into law the Fair and Inclusive Redistricting for Municipalities and Political Subdivisions (“FAIR MAPS”) Act (the “Act”), amending the procedures and redistricting criteria that the City had previously followed. As the City of San Ramon is a Charter City, the council may adopt by ordinance procedures that differ somewhat from those set forth in the Act; however, because the City’s discretion to establish alternate procedures is limited under the Act, the Council elected not to pursue such an ordinance.

The procedural steps required under the Act include a series of public hearings with substantial public input, community outreach to encourage participation, and a specific place on the City’s webpage for posting of redistricting information.

State law also provides cities the option of forming a redistricting commission to assist with the process; however, the Council elected to take the lead on the redistricting process at its meeting on May 11, 2021. Staff and the City’s consultants will facilitate public outreach and the required public hearings. The decision on the final map will be made by the City Council, with public input provided directly to the Council instead of to a separate redistricting commission. This is

2.1 Packet Pg. 3
consistent with the way the City initially established the electoral district boundaries in 2019.

Procedural Requirements for Redistricting: Public Participation

PUBLIC HEARINGS
Before adopting a final map of district boundaries, the City must hold at least four hearings for the public to provide input about the composition of Council districts. These hearing requirements include the following:
 At least one hearing before any maps are drawn.
 At least two hearings after maps are drawn.
 At least one hearing or workshop to be held on a Saturday, Sunday, or after 6 p.m. on a weekday.

Tonight’s hearing is the third of the four required hearings. The City’s independent demographer (Michael Wagaman) led the first meeting on November 9, 2021 and second meeting on January 25, 2022, explaining the required steps for redistricting under State law. The City Council also received comments from residents and interested community groups during the hearings and gave the demographer some general criteria for the draft maps. The City has also done considerable outreach since the initial meeting, including a website with an interactive mapping tool so that members of the public can draw and submit their own boundary maps. To date, only one map has been submitted by the general public and is included in Attachment A.

The remainder of the required meetings will take place on the following dates:

Tuesday, March 22 (final selection and Council adoption of the Resolution).

The City Council is the final decision-making body on adopting district boundaries. Under State Law, adoption of the resolution adopting the new district boundaries must occur no later than April 17, 2022.

COMMUNITY OUTREACH
In compliance with the Act, the City has taken steps to encourage residents, including those in underrepresented and non-English speaking communities, to participate in the redistricting public review process. Specifically, the City has published the date, time, and location of this public hearing in accordance with the act, and will do so for any future public hearing or workshop at least five days before the hearing. In addition, the City must, upon request made at least 72 hours before the meeting, conduct the public hearings with live translation in a requested “Applicable Language.” (“Applicable Language” means any language that is spoken by a group of City residents with limited English proficiency that constitute 3% or more of the City’s population, as determined by the Secretary of State.)
Finally, the City continues to make a good faith effort to do the following:

2.1 Packet Pg. 4
 Provide information to media organizations that offer City news coverage, including those serving language-minority communities.
 Provide information through local community groups and organizations (including those active in language-minority communities, those based on good government, civil rights, or civic engagement, and those requesting to be notified about City redistricting).

CITY WEBSITE REQUIREMENTS
The City is required to establish and maintain a page on its website dedicated to redistricting that includes:

1. A general explanation of the redistricting process;

2. Procedures for how a member of the public can participate;

3. A calendar of all public hearings;

4. The notice and agendas for those hearings;

5. Recordings or written summaries of the hearings; and

6. All draft and final maps.

The general description of redistricting and procedures on how to participate must be in English and any Applicable Language. This information is to be maintained for at least ten years after the redistricting process is completed.

Requirements for Redistricting: Drawing Boundaries
Updated since San Ramon first adopted district boundaries, the substantive requirements for drawing district boundaries are set forth in California Elections Code § 21621, and are summarized as follows:
 Substantially equal population of residents in each district, based on census data.  Compliance with the United States and California Constitutions, and with the Federal Voting Rights Act. These laws require that districts have substantially equal populations, are not drawn using race as a predominant consideration, and do not discriminate against any racial or language minority, including by diluting the voting power of any of those groups.
 Once those standards are met, the boundaries must be drawn using the following criteria, as set forth in the following order of priority:

1. To the extent practicable, council districts shall be geographically contiguous.

Areas that meet only at the points of adjoining corners, or areas that are separated by water and not connected by a bridge, tunnel, or regular ferry service, are not counted as contiguous.

2. To the extent practicable, the geographic integrity of any local neighborhood or local community of interest shall be respected in a manner that minimizes its division. A “community of interest” is a population that shares common social or economic interests that should be included within a single district for purposes of its effective and fair representation. Communities of interest do not include

2.1 Packet Pg. 5
relationships with political parties, incumbents, or political candidates.

3. Council district boundaries should be easily identifiable and understandable by residents. To the extent practicable, council districts shall be bounded by natural and artificial barriers, by streets, or by the boundaries of the city.

4. To the extent practicable, and where it does not conflict with the preceding criteria in this subdivision, council districts must be drawn to encourage geographical compactness in a manner that nearby areas of population are not bypassed in favor of more distant populations.

Baseline maps illustrating criteria used to determine district boundaries can be found on the city’s website, www.sanramon.ca.gov/redistrict_2022. Additionally, the census has changed the boundaries of the census blocks within the City. As district boundaries follow census blocks, some change to the map will be necessary.

FISCAL ANALYSIS
For the 2021-2022 redistricting process, total costs to the General Fund are estimated to be $100,000, broken down as follows:

Special legal counsel: $50,000
Demographer: $35,000
Public outreach: $15,000
The above estimates are conservative, and actual costs may be lower. Costs will, however, increase if the City Council decides to hold more than the required four hearing, or if public outreach turns out to be greater than expected.
