FINANCE COMMITTEE STAFF REPORT
DATE: March 7, 2022
TO: Finance Committee/City Manager
FROM: Debbie Chamberlain, Community Development Director By: Lauren Barr, Division Manager
SUBJECT: Proposed Appropriation of $126,642 from Fund 201, Planning Cost Recovery Fees, to Fund CIP 969003 for Amendment #1 to the Mintier Harnish Consultant Contract for Additional Environmental Review, Additional Traffic Analysis, and Climate Action Plan Data Collection and Analysis Related to the Housing Element, General Plan Updates, and Related Actions, for a Total Amount Not to Exceed $1,226,321.
RECOMMENDED ACTION
That the Finance Committee recommend City Council approval of an appropriation of $126,642 from Fund 201, Planning Cost Recovery Fees, to fund CIP 969003 for an amendment to the Mintier Harnish consultant contract for additional Environmental Review, additional traffic analysis, and Climate Action Plan data collection and analysis related to the Housing Element, General Plan Updates, and related actions, for a Total Amount Not to Exceed $1,226,321.
BACKGROUND/ANALYSIS
The City is in process of the General Plan Update to address required changes to the Housing Element to address the Regional Housing Needs Allocation (RHNA). In addition to the Housing Element revisions, the Update will amend the other elements of the General Plan for consistency between General Plan elements and to address updates based on State law requirements. The project scope will also include an Environmental Impact Report, updates to the Climate Action Plan and Zoning Ordinance to maintain consistency between documents.
On May 11, 2021, the City Council approved a consultant contract with Mintier Harnish for the General Plan Update scope of work in the amount of $1,099,697 funded by CIP 969003 for General Plan updates and modifications. The approved contract funding was:
Proposed General Plan Update Funding
Funding Source Amount
Existing CIP Balance $530,000
LEAP Grant $300,000
5.1 Packet Pg. 6
REAP Grant $0 (has not been awarded yet)
201 Recovery Fee Request $140,000
General Fund $129,679
Approved Contract Cost $1,099,679
Since contract adoption, the General Fund fees, previously appropriated, have been returned to the General Fund from the 201 Planning Recovery fee fund.
Proposed Contract Amendment
As the staff and consultant team have progressed with the data collection and analysis, coupled with implications of AB 215 that compressed the Housing Element review time, it has become necessary to modify the CEQA review process and supplement the CAP data needs and analysis.
Additional CEQA Review
The State adopted a new State law (AB 215) that went into effect January 1, 2022, related to draft Housing Element publication requirements. To meet the statutory deadline to adopt the Housing Element by January 2023, San Ramon’s preparation of the Housing Element component of the General Plan Update must move at a quicker pace than originally scheduled to allow more time for public review and review by the State Department of Housing and Community Development (HCD).
While AB 215 did not change the January 2023 due date to the State, more agency and public review time of the Housing Element is required:
Public review of first draft – minimum of 30 days
Incorporation of public comments – minimum of 10 business days. Incorporation of public comments must be done before submitting to HCD
Subsequent drafts must be posted for the public for at least seven days before submitting revised public review draft to HCD
HCD has 90 days to review first draft; 60 days to review subsequent drafts Under the new State statute, San Ramon will need to release the first public review draft in Spring 2022 to allow adequate time for submittal to HCD in Summer 2022 for the review of the first and subsequent drafts of the Housing Element. As such, the accelerated review timeline for the Housing Element no longer aligns with the proposed EIR that was intended to cover the entire update. In response, Staff and the Consultant are proposing to prepare a Mitigated/Negative Declaration for the Housing Element that can be processed with the accelerated timeline to ensure that there are no late modification to the Housing element as a result of CEQA review that might create problems with HCD review timelines. The Consultant has prepared a scope of work for the additional environmental review in the amount of $45,057 which can be funded from Fund 201, Planning Cost Recovery Fees which are intended to support such planning efforts.
5.1 Packet Pg. 7
Additional Traffic Analysis
The current General Plan has a Level of Service (LOS) standard associated with intersections within the City. This LOS is used to measure impact associated with future development and for the development of the City’s Capital Improvement Program (CIP). Current regional planning and environmental review documents have been transitioning to a Vehicle Miles Traveled (VMT) model that looks less at individual roadway segments and focuses on overall community and regional traffic patterns. The LOS analysis on major arterials is still important for consistency with Local Action Plans until such time as they formally transition to VMT. The current scope of work for the General Plan Update and Housing Element includes a VMT and road assessment, but does not include intersection specific analysis. After discussion, the consultant team has proposed a contact modification for the additional intersection traffic counts. The additional analysis will obtain 2-hour AM and 2-hour PM peak period counts of vehicles, bicycles and pedestrians at 16 primary intersections within the City. The cost associated with the additional work is $64,000, which can be funded through the Fund 201, Planning Cost Recovery Fee.
Climate Action Plan Inventory Updates
As part of the General Plan, Housing Element, and Climate Action Plan (CAP) Update, the scope of work includes conducting a current (2019) CAP Greenhouse Gas (GHG) inventory for the City. Cities can track progress on GHG reduction efforts and show alignment with State GHG reduction goals through regular updates to GHG emissions inventories. In order to provide an adequate comparison of changes in GHG emissions over time, it is essential that GHG inventories and subsequent updates have consistent reporting of GHG emission sources, use consistent data sources, and use consistent calculation methodologies. As part of the process of updating the CAP and GHG emissions inventory for the year 2019, the consultant team looked at prior community GHG emissions for 2008, 2010, and 2014. Since adoption of those inventories, there have been changes in reporting requirements, improvements in data reporting and new best practices that have resulted in potential inconsistencies between the current 2019 and prior GHG inventories. As such, Staff is recommending that the City update the 2008, 2010, and 2014 community GHG emissions inventories to improve transparency of calculations and emissions factors being used and to confirm changes in activity data/emissions between inventory years.
This additional analysis would allow for better understanding of the effectiveness of existing GHG emissions reduction policies and programs, provide more defensible GHG emissions reduction targets based on the first CAP iteration, and result in more accurate tracking of GHG emissions reductions over time.
The majority of the proposed updates to the prior inventories relate to following areas:
Update previous inventories to account for electricity and natural gas transmission and distribution losses.
Update previous inventories to use IPCC Fourth Assessment Report global warming potentials (GWPs) to maintain consistency with the State’s GHG emissions accounting. Update previous inventories to include fugitive emissions and process GHG emissions associated with wastewater treatment.
5.1 Packet Pg. 8
Update previous inventories to use recent PG&E activity data distributed across included sectors and consistency with methane (CH4) and nitrous oxide (N2O) emission factors. Update previous inventories to use most recent vehicle miles traveled (VMT) data, and emission data for both On/Off road emissions.
Update previous inventories to use GHG emissions factors from EMFAC2021 model. Update Water/Wastewater Conveyance, Treatment, and Distribution analysis. Update previous inventories to include process and out-of-boundary transport emissions associated with solid waste generation to get a more complete picture of emissions associated with waste generation in San Ramon.
Updates to the 2008, 2010, and 2014 GHG inventories, modeling and corresponding documentation are proposed to be provided as a technical appendix to the 2019 CAP. The Consultant has prepared a scope of work for the additional CAP Inventory Consistency Analysis in the amount of $17,585, which can be funded from Fund 201, Planning Cost Recovery Fees which are intended to support such planning efforts.
FISCAL IMPLICATIONS
The primary contract continues to be funded by the existing CIP 969003, consisting of existing State grants and Planning Cost Recovery fees. Staff is requesting $126,642 in funding from the Planning Cost Recovery Fund to cover the proposed contract amendments. The current uncommitted balance of Planning Cost Recovery fees is approximately $130,000, which is intended to cover General Plan and long-range planning efforts. In addition, the City will be receiving SB 2 grant reimbursement in the amount of $234,000 associated with the CCSP update that will be returned to the Planning Cost Recovery Fund balance.
STEPS FOLLOWING APPROVAL
Staff to proceed to the City Council for appropriation of Fund 201 Planning Cost Recovery Fees and authorization of the Amendment to the consultant’s contract scope of work.

FINANCE COMMITTEE STAFF REPORT
DATE: March 7, 2022
TO: Finance Committee/City Manager
FROM: Christina Franco, City Clerk
By: Christina Franco, City Clerk
SUBJECT: Fee Schedule Proposed Changes FY 2022/2023
RECOMMENDED ACTION
Staff recommends that the Finance Committee review the changes to the FY 2022/2023 Fee Schedule Proposal and recommend that it be forwarded to the City Council to schedule a public hearing.
BACKGROUND/DISCUSSION
City staff annually reviews the Schedule of Fees and Charges as part of the overall budget process and then makes recommendations related to the fees and charges to the City Council.
Staff has completed the annual review of the City’s Fee Resolution and submitted proposed changes and additions. A copy of the proposed Fee Resolution is attached for your review. The proposed changes and additions are noted in a separate column for easy identification. The column is labeled “Proposed Fee” and is in blue text. All other fees and charges are to remain in effect and unchanged as indicated.
Before the City can levy a new fee or service charge, or approve an increase in an existing fee or service charge, a local agency must hold at least one public hearing, at which oral or written presentation can be made, as part of a regularly scheduled meeting. (Government Code §66016).
FISCAL ANALYSIS
GENERAL GOVERNMENT
Subordination Fee
$250 processing fee + $440 Deposit + Time & Materials
This fee has been adjusted to reflect the staff time required to process a subordination agreement
5.2 Packet Pg. 10
which is not included in the current $250 processing fee. A city planner and city attorney is required to communicate with the subordinating party and its representatives, review legal documents and obtain city signatures and a notary in a short timeframe. A $440 Deposit is required to ensure partial payment of staff time as the City historically has not been paid the Subordination Fee upon request and completion of the transaction. The deposit amount will cover the minimum amount of staff time to complete the transaction and anything beyond the deposit amount will be charged as Time and Materials.
FISCAL IMPLICATIONS - GENERAL GOVERNMENT
No significant fiscal impact is expected for the changes in these fees.
ADMINISTRATIVE SERVICES
Business Licenses and Business License Renewals
The User Fee Study for Planning Services Division, February 2020 establishes a maximum $202 fully burdened rate for Business Licenses and Business License Renewals. As a result of staff time required to process these applications, the various applicable fees have been increased by $25 each, up to a maximum $200, below the $202 fully burdened rate. With the proposed fee increases, processing for smaller businesses continues to be subsidized, based on the fully burdened rate. There is no difference in processing time between a smaller sized business and a larger sized business.

Building and Safety Services is proposing to increase the hourly rate and related flat fees that will offset increased cost of providing services.
Building and Safety Services - Hourly Rate
The following fees have been revised to increase the existing Building and Safety Services hourly rate of $160.00 to $200.00:
Hourly fee charged for plan changes and additional plan review; Used to determine Re-Inspection Fees that are assessed when a schedule inspection is not ready;
Used to determine minimum inspection fees;
Used to determine Flat Fees;
The revised Building and Safety Services Hourly Rate is based on an estimated hourly rate for services established in prior fee determinations. Fee increases align with administration and inspection time required to complete each task. The Hourly Rate has not increased in three years for the Division.
5.2 Packet Pg. 14
Building and Safety Services - Fee Changes
As a result of the Hourly Rate changes and a determination of actual time to complete tasks, the following fees are revised to reflect the cost associated with providing the services:
Re-Inspection Fee - assessed when the work for a scheduled inspection is not ready to be inspected.
o Increased from $40.00 to $100.00
Building and Safety Services - Flat Fees
Fees for Solar Heating and Cooling and Photovoltaic installations are flat fees set by California Assembly Bill 1414 and documented in the fee schedule to reflect the fees and calculation method.
Additional flat fees are created for Solar Energy Storage (Battery), Bathroom Remodel and Repair, Kitchen Remodel or Repair, Re-roof, Window/Door Permit and Residential Furnace/Air Conditioning replacement. The flat fees are determined by estimated time for each inspection type, the minimal number of inspections for each project type and the revised hourly rate. The construction cost of these types of projects often vary, but usually have the same number of inspections and take a similar amount of time to complete inspections. Proposed fees reflect consolidated building plan check, mechanical plan check, electrical plan check, building permit, energy inspection, mechanical permit, and electrical permit. High construction valuations also caused some permits to be significantly higher while plan check effort and inspection are the same.
Solar Heating and Cooling System
O New Fee Residential $450 (10 kWth or less) $15 (per add’l kWth) Commercial $1000 (30 kWth or less) $7 (per add’l kWth
between 31 and 260 kWth $5 (per additional kWth above 260 kWth)
Photovoltaic (PV) Installation
O New Fee Residential $450 (15kW or less) $15 (per add’l kW) Commercial $1000 (30 kWth or less) $7 (per add’l kWth between 31 and 260 Wth $5 (per additional kWth above 260 kWth)
Solar Energy Storage (Battery)
O New Fee Residential $200 min. (First Battery) $15(per additional Battery) Bathroom Remodel or Repair

Residential Furnace/Air Conditioning
O New Fee $200* flat fee, * Additional Plan review fees will be charged hourly, if replacement for equipment not replace in-kind.
FISCAL IMPLICATION - COMMUNITY DEVELOPMENT
Planning Services Division
As in past years, the increase in local development impact fees and Planning Services fees are the result of cost increases reflected in the local Construction Cost Index, Consumer Price Index, and the established nexus fee studies. The increase in fees will slightly increase the cost of development, which is paid by the developer and reflects the increased cost of service associated with the fees. The increase in fees will not result in any negative impacts to City finances.
Building & Safety Services Division
Based upon the existing staffing level and respective salaries, benefits, and specific expenditures related to plan reviews and inspections, costs are not being fully recovered to provide this service. Presently, the hourly billing rate of $160/hour does not recover staff salaries and benefits. A new rate of $200/hour is consistent with the general billing rate for Building and Safety Services staff who review and inspect construction projects.
The flat fees proposed do not increase permit fees for these types of permits. The construction cost of these types of projects often vary, but usually have the same number of inspections and take a similar amount of time to complete inspections. Proposed fees reflect consolidated building plan check, mechanical plan check, electrical plan check, building permit, energy inspection, mechanical permit, and electrical permit and are based on time to perform these plan check and inspection services and not the cost of constructing these improvements.
PUBLIC WORKS
Engineering Services Division
Subdivision/Preliminary Development Review Fee
Based upon the existing staffing level and respective salaries, benefits, and specific expenditures related to engineering plan review, costs are not being fully recovered to provide this service.
Presently, the hourly billing rate of $150/hour does not recover staff salaries and benefits. A new rate of $200/hour is consistent with the general billing rate for engineering staff who review
5.2 Packet Pg. 16
these projects. In surveying other cities, the hourly rate ranges from $151/hour to $303/hour, and the average being $221/hour. This change will result in an increase in cost to the applicant, but will significantly improve cost recovery and this increase proposed rate falls within the range of what other surrounding cities charge. The existing review rate has been utilized since 2013.

Citywide Traffic Impact Mitigation Fees
The increase is derived from the December 2021 Engineering News Record (ENR) for the San Francisco Bay Area. The Construction Cost Index (CCI) increase is 8.0%.
San Ramon Transit Center Bike Locker Rental Program Fees Bike Lockers were removed and replaced with E-lockers. The new E-lockers use Clipper Card and the fee is Pay as You Go.
Subdivision/Preliminary Development Review Fee
Based upon the existing staffing level and respective salaries, benefits, and specific expenditures related to transportation plan review, costs are not being fully recovered to provide this service.
Presently, the hourly billing rate of $150/hour does not recover staff salaries and benefits. A new rate of $200/hour is consistent with the general billing rate for transportation staff who review these projects.
Public Services Division
Staffing Rates
The proposed Administration, Field-Regular, Field - Overtime, and Field - Call-Out/Emergency Stand-By staffing rates are being increased to reflect actual staffing costs. The Administration staffing rate is being increased from $136.00 to $139.00. The Field - Regular staffing rate is being increased from $115.00 to $119.00. The Field - Overtime and Field - Call-Out/Emergency Stand-By staffing rates are being increased from $140.00 to $144.00.
Additional Fees & Charges
The proposed Extra Garbage Tags & Yard Trimmings Bags (July 1, 2022 through December 31, 2022 fee is being increased from $10.31 to $10.62. The proposed Extra Garbage Tags & Yard Trimmings Bags (January 1, 2023 through June 30, 2023) fee is being increased from $10.62 to $10.94. This fee reflects the actual contractor cost based on an estimated 3% CPI.

PARKS & COMMUNITY SERVICES
1. Advertising Fees for Performing Arts Brochure
Fiscal impact: No anticipated impact on revenue.
(1) Propose a new fee for advertisements in the Presenting Series Performing Arts Brochure. One-half (1/2) page ad - $220.00
Full page ad - $440.00
Staff recommends a new fee instead of using existing advertising fees affiliated with the recreation guide or general department marketing fees. The proposed fee is more in line with the cost of marketing in the Presenting Series Brochure based on size and distribution and is midrange compared to advertising fees charged in other East Bay Area performing arts brochures.
2. All Inclusive Special Event Fee for Combined Building and Park Use Fiscal impact: No anticipated impact on revenue.
(1) Establish an All Inclusive Special Event fee for combined building and park use to include a refundable damage deposit for distinct periods of time. Refundable Damage Deposit: $1,500.00
All Inclusive Special Events up to 6 Hours: $3,300.00/ Day All Inclusive Special Events up to 10 Hours: $5,500.00/ Day All Inclusive Special Events for a Full Day (10+ Hours): $7,000.00/ Day Staff recommends establishing an All Inclusive Special Event fee for combined building and park use for Non-Profit and Private Organization events that take place on city property. The allinclusive fee includes the immediate outdoor area at the San Ramon Community Center (Amphitheater, Terrace Patio, Rose Garden, Meadow) along with the interior Fountain Room, Kitchen and Terrace Room. Rooms 101 and 102 can be rented as add-ons.
5.2 Packet Pg. 18
Staff has seen an increase in Special Event requests by local non-profits and private organizations to celebrate cultural events or to host fundraising events. Often these special events necessitate collaboration with city staff to ensure policies and regulations are followed, and typically require several full-time staff hours. Staffing assistance includes permit review, event logistics, and sharing approval conditions. Along with staffing, these All Inclusive Special Events occur in parks that offer indoor and outdoor space, thus taking the community centers offline for other rentals due to their size and scope.
Based on inquiries for these type of events, staff recommends All Inclusive Special Event fees for up to 6 hours, up to 10 hours, or a Full Day event for over 10 hours. This would cover usage of indoor community center rooms, fields, picnic areas, and common areas within the given park.
These fees do not include the already established Special Event Application Fee of $600.00.
Items including staff overtime, garbage service, janitorial or other necessary fees would continue to be charged in addition to the All Inclusive Special Event Fee.
At this time, this sole fee is intended for Non-Profit groups and was created based on past event fees utilized for Non-Profit groups. The recommended fee is based on the currently established hourly costs of room rentals as well as additional required staff to assist with the event planning.
The All Inclusive Special Event fee would benefit the City of San Ramon and renters because itemized fees would be immediately available at the point of inquiry. Renters will be able to determine the cost of a 6 hour versus 10 hours versus a full day event when completing the Special Event Application and understand which facilities are included in the cost. The fee would also serve as a baseline for all special event inquiries, keeping All Inclusive Special Event fees consistent across organizations.
3. Outdoor Fitness Permit Fee Increase
Fiscal impact: Estimated revenue increase of $250
(1) Propose increasing Outdoor Fitness Permit Fees for residents from $17.00/hr to $18.00/hr and non-residents from $31.00/hr to $32.00/hr.
The proposed increase will help keep pace with required maintenance costs associated with the facilities.
4. Hourly Rate Adjustment for Additional Staff Special Event Support Fiscal impact: No anticipated impact on revenue.
Part-Time Staff
(1) Propose to increase the special event fees requiring a Building Attendant II from $19.00 per hour to $22.00 per hour. These fees are applied to special events in which part-time staff support the event.
This proposed increase is necessary to offset the increased hourly staff rates due to an increase in the minimum wage. The hourly staff fees were last increased in
5.2 Packet Pg. 19
2021 due to an increase in the minimum wage. The $22.00 fee is in line with the hourly staff fees for aquatic events.
Full-Time Staff
(2) Propose to increase the special event fees requiring a Recreation Technician from $60.00 per hour to $85.00 per hour.
(3) Propose to increase the special event fees requiring a Recreation Coordinator from $72.00 per hour to $104.00 per hour.
(4) Propose to remove the hourly fees for Recreation Supervisor and Managers/ Director These fees are applied to special events in which full-time staff provide support.
The current rates for full-time staff have not been increased for several years and the proposed increase would be in line with the current billing rates of pay for full-time Recreation Coordinators and Recreation Technicians. Typically, Supervisors and Managers do not work rental events so the fees for these positions are not needed.
5. Increase Fees for Banner Permit Application
Fiscal impact: No anticipated impact on revenue.
(1) Propose increasing Installation/Removal fee for the Street Banner Program.
Due to the negotiated contract with Sierra Installation, Inc., the City’s street banner installation company, staff recommends increasing the current rates for banner installation from $80.00/per banner to $85.00/per banner and from $15.00/pole to $16.00/pole to cover contract costs.
6. Add Fee for Renting the Walnut Barn Picnic Rentals
Fiscal impact: Estimated revenue increase of $240
(1) Propose a new hourly $70/ per hour fee for renting the Walnut Barn Picnic Rental area
Staff recommends a new hourly fee to rent the Walnut Barn Picnic Rental area by the hour.
Renters look for different opportunities in renting the space and are not always interested in a four-hour block. This would give renters the opportunity to rent per hour. Staff believes this will help attract groups interested in renting the space for meetings and increase overall usage of the Walnut Barn as a location for meetings.
7. Removal of Room Classification Sizes
Fiscal impact: No anticipated impact on revenue.
Staff recommends removal of the Small Room, Medium Room, Large Room, and Grand Room
5.2 Packet Pg. 20
classifications; instead, listing the rooms individually by name.
The current fee resolution for indoor rental fees are listed per room classification. Staff recommends removing all room size classifications and assigning exclusive hourly rental fees per room, as each are unique in size and capacity. This modification will allow staff to evaluate rates by room usage and make future recommended fee adjustments for specific rooms instead of room classifications.
Room rental deposits will remain in effect as listed per the room size classifications (e.g. Small, Medium, Large, Grand).
8. Increase Fees for Indoor Facility Rentals
Fiscal impact: Estimated revenue increase of $25,000.00 San Ramon Community Center
(1) Propose increasing rental rate by $10.00 per hour for the Fountain Room at the San Ramon Community Center.
For Non-Profit Groups, weekday fees would increase from $65.00/Hr.to $75.00/Hr.
For Non-Profit Groups, weekend fees would increase from $145.00/Hr. to $155.00/Hr.
For Residents, weekday fees would increase from $120.00/Hr. to $130.00/Hr. For Residents, weekend fees would increase from $270.00/Hr. to $280.00/Hr. For Non-Residents, weekday fees would increase from $150.00/Hr.to $160.00/Hr. For Non-Residents, weekend fees would increase from $335.00/Hr.to $345.00/Hr.
Amador Rancho Community Center
(2) Propose increasing rental rate by $5.00 per hour for the Russell Room at the Rancho San Ramon Community Center.
For Non-Profit Groups, weekday fees would increase from $35.00/Hr. to $40.00/Hr.
For Non-Profit Groups, weekend fees would increase from $70.00/Hr. to $75.00/Hr.
For Residents, weekday fees would increase from $65.00/Hr. to $70.00/Hr. For Residents, weekend fees would increase from $95.00/Hr. to $100.00/Hr. For Non-Residents, weekday fees would increase from $80.00/Hr. to $85.00/Hr.
5.2 Packet Pg. 21
For Non-Residents, weekend fees would increase from $115.00/Hr. to $120.00/Hr.
(3) Propose increasing rental rate by $10.00 per hour for the Bella Vista Room at the Rancho San Ramon Community Center.
For Non-Profit Groups, weekday fees would increase from $50.00/Hr. to $60.00/Hr.
For Non-Profit Groups, weekend fees would increase from $95.00/Hr. to $105.00/Hr.
For Residents, weekday fees would increase from $85.00/Hr.to $95.00/Hr. For Residents, weekend fees would increase from $145.00/Hr. to $155.00/Hr. For Non-Residents, weekday fees would increase from $105.00/Hr. to $115.00/Hr.
For Non-Residents, weekend fees would increase from $180.00/Hr. to $190.00/Hr.
In addition, a portion of our rental facilities have been remodeled, including the installation of state of the art A/V equipment. Staff recommends that the remodeled rooms are priced higher based on their desirability for rental. The proposed increase will also keep pace with maintenance associated with the renovated facilities, continued increases in utilities, and the increased staff rates due to increased minimum wage.
9. Establish Fees for Use of City Hall Rotunda (pg. 42) Fiscal impact: Estimated revenue increase of $10,500.00 (1) Establish a facility deposit and rental fee for the City Hall Rotunda. Refundable Damage Deposit: $2,500.00
City Hall Rotunda Resident Rental fee for up to 10 hours: $3,500.00 City Hall Rotunda Resident Non-Profit rental fee for up to 10 hours: $2,500.00 Per the City Council Policy Committee, fees for the City Hall Rotunda have been included in the proposed fee resolution; however, no rentals will be allowed until the City Council Policy Committee has reviewed and approved the rental rules/policies for the rotunda. Rental of the City Hall Rotunda would require a refundable facility rental deposit in the amount of $2,500 and all contracted hours (10) shall be charged at the rate of $350/per hour for a total of $3,500 per resident event and $250 an hour for a total of $2,500 per non-profit resident events. Rates were established based on the City of San Francisco and the City of San Jose, both who offer private rental opportunities in 10-hour reservations in their City Hall Rotundas. The City of San Ramon fee proposal also considered guest occupancy limits and utilized the Fountain Room at the San Ramon Community Center (the City’s largest rental facility as a comparison) to propose refundable deposit and hourly rates for the City of San Ramon. Rentals would only be allowed

10. Increase Fees for Group Picnic and Aquatic Picnic Rentals Fiscal impact: Estimated revenue increase of $3,500.00
(1) Recommend to increase all Group Picnic Rental fees by 3.8% and round to the next whole dollar.
For Non-Profit, groups of 1-50, rates would increase from $58.00 to $60.00 For Non-Profit, groups of 51-149, rates would increase from $142.00 to $147.00 For Non-Profit, groups of 150-200, rates would increase from $163.00 to $169.00 For Residents, groups of 1-50, rates would increase from $111.00 to $115.00 For Residents, groups of 51-149, rates would increase from $215.00 to $223.00 For Residents, groups of 150-200, rates would increase from $320.00 to $332.00 For Commercial Residents, groups of 1-50, rates would increase from $156.00 to $162.00

For Non-Residents, groups of 150-200, rates would increase from $528.00 to $548.00
5.2 Packet Pg. 23
(2) Recommend to increase Aquatic Picnic Rental fees by 3.8% and round to the next whole dollar.
For Residents, groups of up to 26, rates would increase from $157.00 to $163.00 For Residents, groups of 26-50, rates would increase from $313.00 to $325.00 For Non-Residents, groups of up to 26, rates would increase from $228.00 to $237.00
For Non-Residents, groups of 26-50, rates would increase from $390.00 to $405.00
Staff recommends a 3.8% (CPI) increase for Group Picnic and Aquatic Picnic reservations. The increase is to keep pace with required maintenance costs associated with the facilities.
Staff also recommends the addition of a Group Picnic area at Monarch Park to be included in the rental program. The picnic area near the play structure at Monarch Park was highly requested over the past several months.
11. Central Park Amphitheater Fee Adjustments
Fiscal impact: Estimated revenue increase of $1,500.00
(1) Staff recommends eliminating the $1,500 fee ($150.00/per hour) for a 10-hour rental and listing any rental over 6 hours as $125.00/per hour Due to a recent use review of the Amphitheater located at the San Ramon Community Center, staff determined renters often choose this outdoor space for over 6 hours. Staff recommends eliminating the current fee structure of $1,500 per 10 hours ($150.00/per hour) and extending the discounted rate of $125.00/per hour to any Central Park Amphitheater rental over 6 hours.
12. Addition of Rancho San Ramon Park Amphitheater Fees Fiscal impact: Estimated revenue increase of $1,000.00
(1) Staff recommends adding a fee of $100.00/per hour (for a 2-hour minimum plus the cost of the field rental) to rent the outdoor Amphitheater space at Rancho San Ramon Park.
(2) Staff recommends adding a discounted rate of $84.00/per hour for rentals that are over 6 hours.
The current fee resolution does not offer the Amphitheater located at the Rancho San Ramon
5.2 Packet Pg. 24
Park for rental opportunities. Staff reviewed requests and found the community is seeking this space to rent for outdoor events and awards ceremonies. Recommended fees were determined by a fee comparison survey and the recommended fees for the Central Park Amphitheater.
13. Field Rental Grass Field Hourly Fee Increase
Fiscal impact: Estimated revenue increase of $25,000
(1) Following the fee methodology approved by the Parks & Community Services Commission associated with the FY2021/22 Fee Resolution recommendations, staff proposes to increase turf field rental rates by $1.00.
For Youth Co-Sponsored Groups and SRVUSD, fees would increase from $10.00 to $11.00/Hr.
For Adult Co-Sponsored Groups and Residents, fees would increase from $17.00 to $18.00/Hr.
For Non-Residents, fees would increase from $31.00 to $32.00/Hr.
This recommendation reflects the previously approved eight-year plan to increase hourly field rental fees. The planned method of increasing hourly field rental fees has positively affected user groups and the City. User groups are able to plan and budget as necessary and the City sees a steady and predictable increase in yearly revenue to offset maintenance costs.
The eight-year plan was established during the FY 2018/19 budget process through staff survey of 44 agencies to collect data comparing current hourly rates, rental classifications, and cost recovery expectations. Seventeen agencies responded with survey data, which revealed City of San Ramon’s hourly rate for field rentals was significantly lower than the average.
Based on the information collected, staff recommended establishing a yearly increase plan for hourly field rates.

14. Outdoor Rental Hourly Fee Increase (Synthetic Fields, Field Lights, Sand Volleyball Courts, Storage, Batting Cages
5.2 Packet Pg. 25
Fiscal impact: Estimated revenue increase of $10,000
(1) Propose increasing fees for Synthetic Fields, Light at Sports Fields, Sand Volleyball Courts, Monthly Storage Units, and Batting Cages, by 3.8% (CPI) and rounding up to the nearest whole dollar.
The proposed increase will help keep pace with required maintenance costs associated with the facilities. The increase in costs are being included in the rental fees for Synthetic Fields, Lights at Sports Fields, Sand Volleyball Courts, Monthly Storage Units, and Batting Cages.
15. Field and Gymnasium Scoreboard Fees for Private Rentals Fiscal impact: Estimated revenue Increase of $2,000
(1) Propose establishing monthly and daily rental rates for the use of field and gym scoreboards for Private Rentals.
Monthly Rental Fee: $400.00
Daily Rental Fee: $100.00
Staff recommends reinstatement of the 2016 daily scoreboard fee and the addition of a monthly fee for private rentals on athletic fields and community gymnasiums where scoreboards are present. This will help cover costs for maintenance and replacement parts. There has been an increase in the use of private field and gymnasium rentals for both practices and games. Staff has received inquiries for the use of scoreboards; however, there are no current fees for scoreboards on fields or gyms. Scoreboards are currently installed at both Iron Horse and Pine Valley gymnasiums as well as Central Park Diamonds 1-4 and the Rancho San Ramon Baseball Field.
16. Dougherty Station Community Center Front Row Theater Rental Fee Increase Fiscal impact: No anticipated impact on revenue.
(1) Propose increasing the hourly rates for Technical and House Staff for theater rentals by $2.00 per hour from $33.00 per hour to $35.00 per hour.
Due to the negotiated contract with Venuetech, the City’s theater management company, staff recommends increasing the current rates for Theater Staff by $2.00/hour to cover contract costs associated with increases in the minimum wage and to stay in line with current hourly rates for Theater Staff in the Bay Area.
17. Dougherty Valley Performing Arts Center Theater Rental Fee Increases Fiscal impact: No anticipated impact on revenue.
(1) Propose increasing the hourly rates for the Technical and House Staff for theater rentals by $2.00 per hour from $33.00 per hour to $35.00 per hour. (2) Propose increasing the hourly rates for the Production Manager II Staff for theater rentals
5.2 Packet Pg. 26
by $2.00 per hour from $41.00 per hour to $43.00 per hour.
18. Permanent and Portable PA System Fees
Fiscal impact: Estimate revenue increase of $250.00
(1) Propose adding the Vista Grande Room permanent PA system to be included in existing permanent PA rental fees.
The Vista Grande Room previously used a portable PA. Now that a new permanent AV system is installed, staff recommends adding the Vista Grande Room to the options for permanent PA systems. Permanent PA systems are currently $75.00/ day in the Fountain Room, Terrace Room, Ridgeview Room, and Bella Vista Room.
19. San Ramon Olympic Pool and Aquatic Park and Dougherty Valley Aquatic Center Special Event and Lane Use Fees
Fiscal impact: Estimated revenue increase of $24,400
(1) Propose to increase the Combined Lane Rental and Lifeguard for 25-yard Course Fees to better align with the market rate based on a fee survey of similar facilities. This would account for increases in expenses to operate the facilities and an adjustment for the increase in minimum wage.
For Co-Sponsored Groups, fees would increase from $8.00 to $9.00 For Residents, fees would increase from $10.70 to $12.00 For Non-Residents, fees would increase from $13.40 to $15.00 (2) Propose to increase the Combined Lane Rental and Lifeguard fees for 50-meter Course Fees.
For Co-Sponsored Groups, fees would increase from $12.90 to $14.00 For Residents, fees would increase from $17.20 to $19.00 For Non-Residents, fees would increase from $21.50 to $24.00 Staff conducted a fee survey of similar agencies throughout the State of California. The conclusion of the survey is that City 50-meter Course Fees were lower on average than the standard.
50-Meter Course Current San Ramon Hourly
Rates
Fee Survey Average Hourly
Rates
Co-Sponsored $12.90 $18.98
5.2 Packet Pg. 27
Resident $17.20 $23.67
Non-Resident $21.50 $29.67
Based on the information collected through fee surveys and analysis of other similar facilities, staff recommends establishing a new yearly increase plan for hourly 50-meter course rates over the next five years. The first year, the resident fee would be increased to $19.00 and increase by roughly $1.00 yearly until reaching $25.00. Non-resident and Co-sponsored fees are determined on the Resident rate at plus or minus 25% respectively. Below is a table outlining the five-year plan.
Fiscal Year Co-Sponsored Resident Non-Resident
FY 2022/23 $14.00 $19.00 $24.00
FY 2023/24 $15.00 $20.00 $25.00
FY 2024/25 $16.00 $22.00 $27.00
FY 2025/26 $17.00 $23.00 $29.00
FY 2026/27 $18.00 $25.00 $31.00
By instituting this multi-year method of increasing hourly 50-meter course rental fees, the user groups are able to plan and budget as necessary and the City sees a steady and predictable increase in yearly revenue to offset maintenance costs, increased staff wages and align with market rates. This is equitable with the multi-year rate increase plan for field users and employs the same methodology and reasoning as the City’s Field Maintenance and Sustainability Plan.
The City reserves the right to revise annual increases to the proposed 5-year plan based on uncontrollable economic factors.
(3) Propose to increase special event and private rental lifeguard fees by $1.00. Special Event Lifeguard Fee would increase from $21.00 per hour to $22.00 per hour. These fees are applied to special events, Swim Meets and Water Polo Tournaments at the aquatic facilities.
Private Rental Group Lifeguard Fee would increase from $21.00 per hour to $22.00 per hour.
The proposed increase is necessary to offset the rising pay rates due to increased minimum wage.
The hourly staff fees were last increased in 2021.
(4) Propose eliminating the current Water Polo Tournament fees that are based on half-day and daily rates and establishing an hourly Water Polo Tank fee at $75.00 per hour per tank + Guard Fee.
The current Water Polo Tournament fees (ranging from $324/half day plus Guard Fee for 1 tank / half pool to $649/day plus Guard Fee for 2 tanks / full pool) are rarely used. By eliminating the current fees and establishing an hourly fee per water polo tank, it will simplify user understanding and administration of the fees. The proposed Water Polo Tank fee is consistent with the Recreation Swim Team Meet fee due to the similarity in pool space and amenities utilized.
5.2 Packet Pg. 28
(5) Propose to increase all remaining San Ramon Olympic Pool and Aquatic Park and Dougherty Valley Aquatic Center Special Event by 3.8% and rounded to simplify user group understanding and administering of fees.
The only fees that this increase would not be applied to are:
i. The equipment fee for the rental of the Colorado Computer as this is related to a fixed cost for use of the equipment.
ii. The parking permit fee for the San Ramon Olympic Pool as this is related to a fixed cost for materials and resources required to issue permits.
iii. The private rental group fees as there is little demand for this service and City prices are comparable to the industry standard.
The proposed increase will help keep pace with required maintenance costs of the facilities, continued increases in utility costs, and increased staff rates due to increased minimum wage. A fee survey conducted of similar agencies throughout the State of California, concluded City Pool or Aquatic Center Special Event fees are higher on average than the standard. However, the services and amenities provided are of greater value than comparable facilities. The proposed increase of 3.8% is in line with the Bay Area CPI-U for October 2021.
20. Increase Hourly Gymnasium Fees
Fiscal impact: Estimated revenue increase of $7,500
(1) Propose to increase all Gymnasium Rental fees by 3.8% and round to the nearest whole dollar.
For Residents, individual Floor hourly rates would increase from $66.00 to $69.00 For Residents, Main Floor, hourly rates would increase from $129.00 to $134.00 For Non-Residents, individual Floor hourly rates would increase from $91.00 to $95.00
For Non-Residents, Main Floor, hourly rates would increase from $179.00 to $186.00
For Co-Sponsored, individual Floor hourly rates would increase from $41.00 to $43.00
For Co-Sponsored, Main Floor, hourly rates would increase from $79.00 to $82.00
Staff recommends a 3.8% increase to keep pace with required maintenance costs associated with the facilities, as well as to offset rising staff rates due to increased minimum wage.
There is heightened demand for gym use, especially over the past 6 months when the City of San Ramon re-opened the gymnasiums after the COVID-19 pandemic. During Fall and Winter of 2021, the gymnasium was booked with very limited space available Monday through Friday.
5.2 Packet Pg. 29
21. Gymnasium Special Event Fee
Fiscal impact: Estimated revenue increase of $6,000
(1) Propose addition of a Gymnasium Special Event fee rate of Special Event Daily Rate + hourly rate fee.
For Residents, Floor A, B or C, hourly rates would increase from $66.00 to $69.00 + $221.00 Special Event Daily Rate
For Residents, Main Floor, hourly rates would increase from $129.00 to $134.00 + $221.00 Special Event Daily Rate
For Non-Residents, Floor A, B or C, hourly rates would increase from $91.00 to $95.00 + $221.00 Special Event Daily Rate
For Non-Residents, Main Floor, hourly rates would increase from $179.00 to $186.00 + $221.00 Special Event Daily Rate
For Co-Sponsored, Floor A, B or C, hourly rates would increase from $41.00 to $43.00 + $221.00 Special Event Daily Rate
For Co-Sponsored, Main Floor, hourly rates would increase from $79.00 to $82.00 + $221.00 Special Event Daily Rate
Currently, Gymnasium Special Events are required to pay 20% of their gross revenue per event.
Obtaining validated registration and financial records of each private event has been unsuccessful. In an attempt to simplify this process for staff and users, Staff is recommending to eliminate the 20% fee and replace it with a Special Event Daily rate. In addition to the Special Event Daily rate, users will be required to pay the hourly rate for each floor reserved. The proposed fees follow the same pricing methodology as events held on the fields and will allow users to know the cost prior to the event and staff to ensure the correct total is collected for each rental. Staff believes that the proposed fees will increase usage and make the process more effective for users and the City.
STEPS FOLLOWING APPROVAL
Staff recommends the Finance Committee accept the report and provide staff with any additional direction prior to forwarding the Resolution to the City Council in order to schedule a public hearing and recommendation of adoption of the Resolution.
