CITY COUNCIL STAFF REPORT
DATE: March 22, 2022
TO: City Council/City Manager
FROM: Debbie Chamberlain, Community Development Director By: Cindy Yee, Senior Planner
SUBJECT: Joint City Council and Planning Commission Workshop: Housing Element Housing Sites Inventory
RECOMMENDED ACTION
Staff recommends that the City Council and Planning Commission receive the staff report, receive public comments and give direction to staff and the consultant team regarding the Housing Element Housing Sites Inventory.
BACKGROUND/DISCUSSION
Applicant: City of San Ramon
Property Owner: Various
Location: Citywide
Housing Element Background and Schedule
Since the kick-off of the General Plan, Housing Element and Climate Action Plan Update in 2021, the City has been working to gather background data, identifying existing City conditions and trends and engaging the community to receive input on the vision of San Ramon. One of the drivers of the General Plan Update (GPU) schedule is the statutory requirement for adoption of a certified Housing Element (HE) by January 2023.
Assembly Bill 215 (AB 215), which went into effect January 1, 2022, requires preparation of the Housing Element component of the GPU to move at a quicker pace than originally scheduled in order to allow more time for public review and the State Department of Housing and Community Development (HCD) review before the January 2023 deadline. Public review of first draft - minimum of 30 days
Incorporation of public comments - minimum of 10 business days o Incorporation of public comments must be done before submitting to HCD
2.1 Packet Pg. 3
Subsequent drafts must be posted for the public for at least seven days before submitting revised public review draft to HCD
HCD has 90 days to review first draft; 60 days to review subsequent drafts San Ramon will need to release the first public review draft in Spring 2022 to allow adequate time for submittal to HCD in Summer 2022 for the review of the first and subsequent drafts of the HE. The City must also factor in the Measure G requirement to hold three Planning Commission and three City Council public hearings before the City can adopt the General Plan amendment. Jurisdictions could face potential penalties as early as May 2023 for not adopting a certified HE.
Housing Element Sites Inventory
The purpose of the HE’s site inventory is to identify and analyze specific land (sites) that is available and suitable for residential development in order to determine the City’s capacity to accommodate residential development and reconcile that capacity with the City’s Regional Housing Need Allocation (RHNA). San Ramon’s RHNA for the 2023-2031 housing element period is identified in Table 1.

The site inventory enables cities to determine whether there are sufficient housing opportunity sites (HOS) to accommodate the RHNA by income category. A site inventory and analysis determines whether program actions must be adopted to “make sites available” with appropriate zoning, development standards, and infrastructure capacity to accommodate the new development need.
The first step of the site inventory work is to determine what current HOS in the Housing Element (5th cycle) can be carried over into our new Housing Element (6th cycle). A number of sites have not been developed on or will not be fully developed before June 30, 2022. The remaining capacity on current opportunity sites can be carried over into the 6th cycle. Several sites from the 5th cycle have been removed as HOS for a variety of reasons including site constraints, existing land uses, fragmented ownership, location outside of City limits, etc.
The second step in the site inventory analysis is determining the projects we have in the “pipeline” and could expect to have building permits issued after June 30, 2022. State law allows these projected pipeline projects to be counted towards the City’s RHNA obligation as they are likely to be built during the 6th cycle if their development applications are in the entitlement review phase or have been formally approved.
A significant number of pipeline projects will aid the City in meeting our RHNA. After the carry-over from 5th cycle (1,416 units) and pipeline projects (2,498 units), Table 2 identifies how
2.1 Packet Pg. 4
many more units (by income category) have to be added in the 6th cycle to meet our minimum RHNA. The totals in the table include an assumption of 70 accessory dwelling units (ADUs) that are projected to be permitted in the 6th cycle using HCD’s guidelines for past production performance. Attachment A provides a list of the 5th cycle carryover sites and pipeline projects.
Table 2: Summary of Unit Need for 6th Cycle
To assist in the development of the City’s Housing Element Site Inventory and HE update, the City is working with a consultant team and utilizing a General Plan Ad Hoc Committee made up of two Planning Commissioners to receive input in shaping the draft HE through early feedback on housing opportunity sites, policies, and programs. The Ad Hoc Committee has held two meetings to discuss and provide insight on housing opportunity sites. Additionally, study sessions on housing opportunity sites took place on February 15th as a joint Housing Advisory Committee and Planning Commission meeting and on March 15th with the Planning Commission.
To achieve our remaining RHNA after credits are applied for 5th cycle remaining capacity and pipeline projects, the City has identified 26 new HOS to accommodate the lower and moderate income RHNA. In order to count these sites for rezoning, the State will require a minimum starting density of 20 dwelling units per acre, a minimum of 30 du/ac as the upper limit of the density range, and limited discretion for development approval. Attachment B shows each proposed new HOS and the attributes of how many units are expected from each site and an aerial map of each site. These proposed new HOS have been reviewed by the Ad Hoc Committee/Planning Commission; a summary of their feedback is provided below.
January 25, 2022 Ad Hoc Committee Summary
At the January 25th General Plan Ad Hoc meeting, staff provided information on the Housing Element Schedule and process of developing the Housing Sites Inventory for the 6th cycle Housing Element. The Committee provided feedback on the preliminary list of housing opportunity sites. The Committee also requested additional information on criteria for site selection, parcel level data for each HOS, aerial images of potential opportunity sites, and an explanation of how cities can designate 5th cycle and 6th cycle parcels towards meeting the lowerincome RHNA. This information was provided to the Committee in February.
2.1 Packet Pg. 5
Regarding the question of how cities can meet the majority of its lower income RHNA with 5th cycle HOS and proposed 6th cycle rezone sites even though San Ramon’s Inclusionary Housing Ordinance only requires a 15% affordability commitment, it is important to understand that the Sites Inventory’s estimate of affordability is more of a conceptual exercise than an actual scenario. The City must demonstrate that there is (or will be through programs and rezoning) capacity to accommodate lower income units at density thresholds that affordable housing developers would consider potentially viable to develop individual sites. The City cannot guarantee that these identified sites will actually be developed, or if they are developed, that any of the sites will contain the projected units at each income level. The rough calculation of 75% affordable income units only demonstrates there is potential for up to 75% of units developed this cycle to be affordable to lower income households. The City’s Inclusionary Ordinance helps achieve a minimum of affordable units, while the Housing Element provides opportunity for more affordable units.
The method by which HCD determines if a site can support lower income development is based on the residential density allowed on that site and the size of the parcel, not on other factors like development trends or inclusionary housing ordinance obligations. HCD sites inventory guidance states: "The statute allows jurisdictions to use higher density as a proxy for lower income affordability, as long as certain statutory requirements are met. Parcels must be zoned to allow sufficient density to accommodate the economies of scale needed to produce affordable housing. To make this determination, the statute allows the jurisdiction to either demonstrate that the zoning allows a specific density set forth in the statute (default density) or to provide an analysis demonstrating the appropriateness of the zoned densities of the site identified to accommodate the lower RHNA." In San Ramon, the "Default Density" required to facilitate lower income housing is at least 30 units per acre. For example, if a jurisdiction has a default density of 30 units per acre and the zone allows for range of 24 - 35 units per acre, the zoning is considered appropriate to accommodate the RHNA for lower income households.
For the purposes of the housing sites inventory, HCD is looking for evidence that San Ramon has 1) enough developable land under its current zoning and proposed rezoning at the default density required to facilitate lower income development, 2) those identified parcels are between
0.5 and 10 acres in size, and 3) those identified parcels are likely to redevelop in this housing cycle.
February 15, 2022 Joint Planning Commission and Housing Advisory Committee Meeting Summary
On February 15, 2022, the Planning Commission and Housing Advisory Committee held a joint study session to discuss the Housing Sites Inventory. In addition to addressing comments received from the Ad Hoc Committee in January 2022, staff also introduced the recommendation to exclude 300 Deerwood Rd. (self-storage facility), and Bishop Ranch 3 (office buildings) from the 6th cycle. At the joint session, the PC and HAC generally supported the location of future HOS within the walkable core area of the City and wanted to incorporate policies to balance the mix of retail and residential uses.
2.1 Packet Pg. 6
The PC and HAC provided the following specific feedback on the recommended 6th cycle rezone sites and staff has prepared responses in italics:
1) Bishop Ranch 8 (3000-5000 Executive Parkway)-is this viable? Response: In light of property owner input, these three parcels would be good candidates for redevelopment and should be included in the 6th cycle. 2) Club Sport (500 Bollinger Canyon Rd.)-has the property owner been consulted? Response: Yes, in light of property owner input, the tennis court and vacant parcel adjacent to the court would be good candidates for redevelopment and should be included in the 6th cycle.
3) Crow Canyon Commons (3100 to 3211 Crow Canyon Rd.)-concerned about further reducing retail opportunities.
Response: Crow Canyon Commons (south of Crow Canyon Rd/west of Camino Ramon), previously a HOS in the 4thand 5th cycle has been removed as a 6th cycle HOS and will not count towards the City’s RHNA obligation, in light of property owner input and the suggestion of the Committee. The site still retains its MU designation as the site is within the NCRSP and could include residential in the future potentially beyond 2031. 4) North of Crow Canyon Rd., east of Crow Canyon Pl. (2001/2005 Crow Canyon Pl., 3120-3130 Crow Canyon Rd.)-recent gas station development in the area may not make good residential neighborhood.
Response: In light of property owner input and recent consolidation of property ownership, these parcels would be good candidates for redevelopment and should be included in the 6th cycle.
5) Staples and Vacant Parcel (2710/2730 Crow Canyon Rd.)-concerned about further reducing retail opportunities.
Response: A number of property owners have inquired about smaller office and retail footprints on Crow Canyon Rd. west of the freeway for conversion to residential, citing the quieter neighborhood settings and a shift to lower demand for retail and office away from the City core. With a lower improvement-to-land value ratio and recent changes to online sales, these sites have a realistic opportunity for redevelopment during the 6th cycle and would be suitable for the minimum 20 du/ac. That said, if these two parcels are removed from the 6th cycle inventory, it would result in a reduction of 22 lower income units and 11 moderate income units for a total reduction of 33 units in our 6th cycle HOS capacity.
6) Theater and 2-Story Retail/Office (2551/2525 San Ramon Valley Blvd.)-concerned about further reducing retail opportunities.
2.1 Packet Pg. 7
Response: In light of property owner input, the parcels are currently zoned MU and have a high possibility for redevelopment in the near future. 2551 San Ramon Valley Blvd. where Erik’s Deli is located already exceeds 40% non-retail uses in the building. Due to the parcels’ site access and entry as well as to create a more cohesive redevelopment opportunity, staff recommends both parcels should be included in the 6th cycle towards meeting the City’s RHNA. If 2551 San Ramon Valley Blvd. were to be removed as a HOS, it would result in a loss of 69 lower income units in our 6th cycle HOS capacity. The theater site would result in a loss of 37 lower income units. 7) Tech Center (4550/4600 Norris Canyon Rd.)-should be included as HOS.
Response: 4600 Norris Canyon Rd. is already identified as a 5th cycle HOS (no. 6) and is recommended to remain as a HOS in the 6th cycle. As explained above 4550 Norris Canyon Rd. is not a near term HOS, but could be redeveloped beyond 2031. 8) PG&E Learning Center (3301 Crow Canyon Rd.)-should be included as HOS.
Response: 3301 Crow Canyon Rd. is already identified as a 5th cycle HOS (no. 7) and is recommended to remain as a HOS in the 6th cycle.
9) San Ramon Golf Course (Fircrest Ln./Alcosta Blvd.)-is there potential opportunities for residential development?
Response: The golf course has a land use designation of Golf Course, which was specifically re-designated by the City from ‘Park’ in order to preserve the golf course use and maintain this recreational and open space setting surrounding existing homes. It is not recommended for conversion as a HOS. Staff has currently proposed adequate sites to accommodate the 6th cycle RHNA.
February 28, 2022 Ad Hoc Committee Meeting Summary and Responses At the February 28th General Plan Ad Hoc meeting, staff provided additional information on the Sites Inventory. The Committee was provided a copy of the background data and graphics for each of the proposed opportunity sites. The Committee provided additional feedback on the recommended list of housing opportunity sites and a summary is provided as follows. Staff’s comments to the feedback are in italics:
1) The Committee would like to consider the removal of 2551 San Ramon Valley Blvd. (Erik’s Deli parcel), 2710 Crow Canyon Rd. (Staples location) and 2730 Crow Canyon Rd. (parking lot adjacent to Staples) from the 6th cycle rezone sites. They would like to consider replacing these sites with non-retail sites such as 18 Crow Canyon Ct. (Centerpoint offices) or increasing density ranges in order to avoid the loss of retail parcels.
2.1 Packet Pg. 8
Response: To replace the 91 lower income and 11 moderate income HOS units from these three sites, increases in density ranges can be made to the Norris Canyon Tech Center site to 20-40 du/ac. Additional mixed-use sites from previous cycles can also be rezoned to this higher density range (currently 14-30 du/ac). Furthermore, the original assumptions for housing unit potential on mixed use sites was that half of the site would be developed as commercial and half as residential. Given the types of mixed-use developments proposed in San Ramon and the region, the assumptions can be amended to a 40/60 commercial/residential mix to be less conservative and more realistic. This adjustment would 1) simplify our capacity estimates across all mixed-use sites and 2) increase the residential capacity we assume for each site. 18 Crow Canyon Ct. (Centerpoint) is not needed to show additional capacity, but could be added to the 6th cycle rezone sites list and net approximately 65 units. 2) How many units are proposed within existing retail shopping centers and what policies can the City use to maintain retail uses in these centers? Response: As it stands, beyond 2551 San Ramon Valley Blvd. (Erik’s Deli), 2710 Crow Canyon Rd. (Staples location) and 2730 Crow Canyon Rd. (parking lot adjacent to Staples), three current retail centers will be listed as HOS:

As a means to preserve some of the retail center, the 6th cycle HOS inventory tables presented at the joint meeting already removed the following parcels as HOS and are not currently yielding units to meet the RHNA:
Residence Inn hotel
Valero Gas Station (Bollinger Canyon Rd.)
Library (Market Place)
8 acres at Country Club Village (including the Walmart grocery store at Country Club and smaller in-line tenants)
2.1 Packet Pg. 9
The shopping center parcels that are in the 6th cycle HOS list account for 217 units. If these units are removed, the City may potentially need to make up the reduction on other parcels while also rezoning these sites to a retail zone to prevent the loss of retail land uses.
If a City is proposing to accommodate greater than 50% of lower income housing units on mixed-use sites, it triggers the requirement from HCD that mixed use zoning allows 100% residential projects and requires a minimum of 50% of the total floor area of the project be dedicated for residential use. Any zoning code updates to accommodate lower income housing on mixed use sites must include a clause allowing 100% residential and requiring at least 50% residential.
3) How is realistic capacity estimated for HOS?
SRVSP Residential Overlay and other sites zoned for 100% residential:
Response: Buildable area developed at 75% of max density. SRVSP Village Mixed Use:
Response: Buildable area developed at minimum density
Bishop Ranch Mixed Use:
Response: Based on discussion with property owners and other Bishop Ranch residential projects in the pipeline, capacity is assumed to be 75% of maximum density.
Other Mixed Use:
Response: 60% of site area developed at maximum residential density. Where there are substantial surface parking lots and discussion with the property owner, residential capacity is based on the area of the parking lot developed to maximum residential density - this includes, part of the west side of the Country Club Village Shopping Center, the Canyon Commons Corporate Building, the Norris Canyon Technology Center, and the Church of the Valley site.
4) How do we determine what HOS are allocated to lower or moderate incomes? Response: Based on HCD’s guidance memorandum on best practices for determining capacity on housing opportunity sites:
If sites are zoned at least 30 units per acre, between 0.5 and 10 acres in size, and can support at least 15 units they are counted as lower income If sites are zoned 15 to 29 units per acre, or smaller than 0.5 acres, they are counted as moderate income
It is generally good practice to limit the use of sites from previous cycles to meet lower income RHNA. If a site used in a previous cycle has an improvement to land value ratio greater than 1, the sites were designated for moderate income units.
2.1 Packet Pg. 10
Sites larger than ten acres are assumed to support 15% lower income and 85% above-moderate income per the city's inclusionary housing ordinance - this includes BR 11, BR 7, and the Toyota Site
Summary of Potential Housing Opportunity Sites (HOS)
To aid in the visualization of the availability of parcels for HOS, Attachments C and D are provided to show HOS opportunities in San Ramon and where new HOS could be considered.
The location of existing residential homes, open space, parks and public facilities are shown in yellow on the map and account for the majority of land in San Ramon. The areas in yellow are not targets as 6th cycle HOS. The primary area remaining in the City that is non-residential, nonopen space, or public parcels is within the central core of San Ramon and along the major arterial roadways of San Ramon Valley Blvd., Crow Canyon Rd., Alcosta Blvd. and Bollinger Canyon Rd. As shown on the map, there are limited areas remaining in San Ramon to accommodate the 6 th cycle RHNA. The map also identified future HOS for beyond the 6th cycle in teal green color that are not expected to be developed before 2031 and would not be counted towards the City’s 6 th cycle HOS. Parcels identified as “Beyond 2031 Housing Opportunity Site” include sites within the North Camino Ramon Specific Plan area, previous HOS from the 4th and 5th cycle, and parcels identified through property owner input and stakeholder interviews as long-term potential mixed use opportunities. The “Beyond 2031” parcels would be located in the core area of the City which aligns with growth management policies to focus growth within the urban core.
In Table 3 below, staff is showing based on the list of 26 rezone sites yielding an estimate of 3,524 housing units, that the City will be able to meet our RHNA with an appropriate buffer.
Staff has not modified the recommended sites inventory list since the joint meeting and is requesting continued feedback on the list of HOS in light of the additional information provided.
On March 22nd, staff will provide a verbal report of any new comments or recommendations received at the March 15th Planning Commission meeting.
Table 3: Summary of 6th Cycle Site Inventory with 26 Recommended HOS Incorporated
2.1 Packet Pg. 11
Staff recommends the Planning Commission and City Council consider the following questions to guide their discussion and provide confirmation to move forward with the proposed list of HOS in the preparation of the Draft Housing Element:
1. Are there any further refinements that should be considered for inclusion or exclusion as a 6th cycle housing opportunity site? Is the density proposed appropriate for the site?
2. Should the proposed three HOS at 2551 San Ramon Valley Blvd. (Erik’s Deli), 2710 Crow Canyon Rd. (Staples location) and 2730 Crow Canyon Rd. (parking lot adjacent to Staples) be removed as 6th cycle HOS?
NEXT STEPS
Staff will review and incorporate input into the Site Inventory and prepare the draft Housing Element based on tonight’s feedback. The draft HE is expected to be released for Public Review in Spring 2022, and culminating with adoption by the City Council and submission of the HE to HCD for certification before January 2023. Certification of the City’s Housing Element is important to be eligible to secure grant funding and return to source funds necessary to provide City services and maintain infrastructure.
