CITY COUNCIL STAFF REPORT
DATE: February 14, 2023
TO: City Council/City Manager
FROM: Kelly Sessions, Administrative Services Director
By: Miaoxia Joe, Administraive Analyst
SUBJECT: City of San Ramon Quarterly Investment Report (Period Ending December 31, 2022)
RECOMMENDED ACTION
Staff recommends that the City Council review and accept the Quarterly Investment Report for the Period Ending December 31, 2022.
BACKGROUND/DISCUSSION
On February 6, 2023, the Finance Committee reviewed and accepted the December 31, 2022 Investment Report. State law requires that City Council review the City Investment Report at least quarterly. A copy of the FHN Financial-Main Street Advisors Investment Report for the period ending December 31, 2022, the Investments Held by Trustees, and the Summary of Cash and Investments are attached for your review.
The December 31, 2022 Investment Report was prepared by FHN Financial-Main Street Advisors, the City’s investment manager. The Investment Report is maintained on a daily basis to track investment yield, maturities, call dates, and market values. The Investments Held by Trustees and the Summary of Cash and Investments were prepared by staff.
The City’s investments are carried at fair value, as required by generally accepted accounting principles. In accordance with GASB Statement No. 31, Accounting and Financial Reporting for Certain Investments and for External Pools, the City adjusts the carrying value of its investments to reflect their fair value at each fiscal year end, and it includes the effects of these adjustments in income for that fiscal year.
FISCAL ANALYSIS
The balance of the City’s demand deposit accounts held with JP Morgan Chase Bank, as of December 31, 2022 totaled $16.7 million. This account is used for daily City operations.
Total funds managed by FHN Financial-Main Street Advisors, as of December 31, 2022 totaled $63.5 million at book value. The portfolio consists of $28.0 million in federal agency securities,
5.5 Packet Pg. 15
$21.0 million in treasury securities, $3.1 million in supranationals, $5.5 million in corporate notes, $2.7 million in FDIC insured CD’s, $1.0 million in municipal bonds, and $2.2 million in commercial paper. The weighted average yield to maturity on investments is 1.87% and the weighted average days to maturity is 641 days, which is 23 days shorter than last quarter. Interest rates are 30 basis points higher than the previous quarter.
The overall objective in managing the City’s investment portfolio is to generate favorable longterm results relative to the City’s benchmark, the ICE BofAML 30-month average (MMA) custom benchmark, while maintaining safety of principal and appropriate liquidity. To accomplish these objectives, FHN Financial-Main Street Advisors is directed to maintain a strategy designed to keep the portfolio’s results in line with the established benchmark, while actively managing the portfolio’s duration relative to the benchmark, sector allocation and yield curve placement to enhance performance.
The balance of the City’s Fidelity U.S. Government Money Market account held with US Bank, as of December 31, 2022 totals $6.6 million and makes up 9.3% of the portfolio. The current rate is 4.06%. This account is available on a daily basis for immediate cash flow requirements.
The City of San Ramon has $0.6 million invested with the State Treasurer’s Office (Local Agency Investment Fund). The current interest rate is 2.17% and makes up 0.9% of the portfolio.
This account is available on a daily basis for immediate cash flow requirements.
The “Investments Held by Trustees” report was prepared by staff and is required supplementary information in the quarterly report to the City Council. Funds held with the trustee total $3.4 million. The 2019 Certificates of Participation (COP) investments managed by FHN FinancialMain Street Advisors total $0.3 million and are available for designated capital projects. The remaining $3.1 million of investments managed by the trustee pertain to City pension obligation bonds and are not available for general City purposes.
This Investment portfolio is in conformity with the City of San Ramon’s adopted “Investment Policy.” The Treasurer’s cash management program provides sufficient liquidity to meet estimated future expenditures for a period of six months. FHN Financial-Main Street Advisors provides market values for securities under their management; market prices of securities held by trust are obtained from the trustees’ monthly account statements.

Staff recommends that the City Council approve this resolution authorizing the Mayor to execute Amendment No. 1 to the Revenue Sharing Agreement with Joyce Bonasera for Tennis Instruction, in an amount not to exceed $59,000, for a total cumulative contract amount of $249,000.
BACKGROUND/DISCUSSION
The City began offering tennis classes through a revenue sharing agreement with instructor, Joyce Bonasera (dba Bonasera Tennis), in 2017. The program has been very successful and continues to generate high rates of participation. The Bonasera Tennis programs will exceed the current agreement amount due to an unanticipated increase in participation in the tennis programs this year. The Parks and Community Services Department requests an Amendment to the one-year revenue sharing agreement, in an amount not to exceed $59,000, for a total cumulative contract amount of $249,000, and no extension of the term of the contract.
Resolution No. 2022-058 (Fee Resolution) authorizes the Parks and Community Services Department to charge fees for participation in classes, programs, activities, and events based on:
● Comparable fees in other cities, recreation districts, and colleges ● Session length and length of class time per meeting
● Revenue sharing agreements with contracted instructors ● The cost to the City for providing such services
● The value and benefit of such services to the San Ramon Community Fees are collected for the classes and split with the contractors on a percentage basis. Currently, the revenue split is 50% Bonasera Tennis, 50% City.
FISCAL ANALYSIS
5.7 Packet Pg. 51
Due to the success of these programs, the annual contracted payments exceed the $100,000 annual limit for City Manager authorization and therefore, require approval of the City Council.
Staff is recommending Amendment No. 1, in an amount not to exceed $59,000, for a total cumulative agreement amount of $249,000. The original agreement is a revenue sharing agreement and as such, no expenditures are incurred by the City for Tennis Instruction. The Parks and Community Services Department’s budget excludes expenditures related to instructor contract services and only shows the net revenue. The FY 2022/23 Parks and Community Services Department’s budget includes the projected revenue for this amendment.
STEPS FOLLOWING APPROVAL
Staff will prepare an amendment for this instructor revenue sharing agreement per the established Purchasing and Procurement Policy.

CITY COUNCIL STAFF REPORT
DATE: February 14, 2023
TO: City Council/City Manager
FROM: Kathi Heimann, Parks & Community Services Director By: Mae Mlyniec, Administrative Analyst
SUBJECT: RESOLUTION NO. 2023-019 - Authorizing the Mayor to Execute Amendment No. 4 to the Agreement with CivicPlus, Inc. for Software Licensing and Hosting Services Extending the Term to February 20, 2024 and Authorizing Additional Funds of $62,500 for a Cumulative Contract Amount Not to Exceed $421,875
RECOMMENDED ACTION
Staff recommends that the City Council approve this resolution authorizing the Mayor to execute Amendment No. 4 to the agreement with CivicPlus, Inc. for software licensing and hosting services and authorizing additional funds of $62,500 for a cumulative contract amount not to exceed $421,875.
BACKGROUND/DISCUSSION
In 1995, the Parks and Community Services Department implemented the previous registration software (CLASS). It was a licensed software, installed on individual machines and maintained by the Parks and Community Services staff with assistance from the Information and Technology (IT) Division. Active Network, which owned CLASS, began phasing out the product and discontinued support and maintenance completely in November 2017.
In order to replace the CLASS product, the Parks & Community Services Department conducted extensive research into current providers and developers of software products used in the recreation field both in the public and private sectors. On July 27, 2017, an RFP for Registration and Facility Booking Software was posted and sent to over 20 vendors. The City received qualified proposals from six vendors: ActiveNet, CivicRec (offered by CivicPlus), Tyler Technologies, US eDirect, Vermont Systems, and Perfect Mind.
After evaluation of the qualified proposals, CivicRec (offered by CivicPlus) was selected. The Parks and Community Services Department found that CivicRec presented the best overall solution due to it being the highest qualified proposal and lowest cost. Representatives from the IT and Finance Departments participated in the review and endorsed CivicRec as the best solution for San Ramon.
The Parks and Community Services Department’s current amendment to the agreement with
5.8 Packet Pg. 54
CivicPlus is due to expire on February 20, 2023 and includes an option to renew for a final oneyear term. Staff recommends exercising this option to renew the agreement for one year as CivicPlus’s performance has been satisfactory and the software was successfully implemented for Department use.
FISCAL ANALYSIS
The City entered into the agreement with CivicPlus for software licensing and hosting starting in February of 2018. The initial contract provided for a not to exceed amount of $171,875 for two years. Included in that total was the initial setup of the software, data integration, on-site/webbased training, and the first and second year annual fees. Amendment No. 1 to the original agreement provided for an additional $62,500 for a not to exceed amount of $234,375.
Amendment No. 2 to the original agreement provided for an additional $62,500 for a not to exceed amount of $296,875. Amendment No. 3 to the original agreement provided for an additional $62,500 for a not to exceed amount of $359,375.
Per the original agreement with CivicPlus, renewal term annual fees are set at $62,500. Staff is requesting that an additional $62,500 be added to the contract value to allow for a cumulative contract amount not to exceed $421,875. The Parks & Community Services proposed FY23/24 budget will include the necessary funds for this contract amendment, which is billed annually at the beginning of each fiscal year.
STEPS FOLLOWING APPROVAL
Staff will prepare an amendment to the contract for CivicPlus, Inc. per the established Purchasing and Procurement Policy.

FROM: Maria Fierner, Public Works Director
By: Gloria Lee, Associate Civil Engineer
SUBJECT: RESOLUTION NO. 2023-020 - Accepting the Work by ETIC for Construction of the Mill Creek Culvert Repair and Creek Restoration Project Phase II as Part of the Citywide Drainage Infrastructure Repair Project (CIP 915548-K) as Complete and Authorizing the City Clerk to File a Notice of Completion with the Contra Costa County Clerk Recorder's Office
EXECUTIVE SUMMARY
The Mill Creek Culvert Repair and Creek Restoration Project (CIP 915548-K) is the second phase of the 36-inch Storm Drain Culvert Repair Project completed in 2016 that lined the upstream section of the pipe. The work completed under this Project included: 1) removing the existing failed culvert remnants and manhole; 2) stabilizing the outfall pipe by connecting a new short section of culvert pipe; 3) providing outlet protection by building a riprap apron at the new outfall; 4) reconstructing the streambed with Engineered Streambed Material (ESBM) to provide a stable streambed profile and dissipate energy to prevent erosion; and 5) enhancing the riparian corridor with native plants to compensate for disturbance to fish and wildlife resources due to Project activities.
The work was performed by the City’s As-Needed Earthwork, Maintenance, General Contracting and Emergency Response Services Contractor, ETIC, who completed the work on time and within the authorized Project budget with a final contract amount of $426,184.
Approval of this Resolution will result in the posting of a Notice of Completion and the subsequent release of retained funds to the contractor.
RECOMMENDED ACTION
Staff recommends approval of this Resolution accepting the work by ETIC for construction of the Mill Creek Culvert Repair and Creek Restoration Project Phase II as part of the Citywide Drainage Infrastructure Repair Project (CIP 915548-K) as complete and authorizing the City Clerk to file a Notice of Completion with the Contra Costa County Clerk Recorder’s Office (Attachment A).
5.9 Packet Pg. 58
BACKGROUND/DISCUSSION
The Mill Creek culvert is located south of Crow Canyon Road, approximately 200 feet east of the intersection with Deerwood Road. In 2015, Public Services Division staff discovered an exposed concrete manhole structure and a failed section of corrugated metal pipe (CMP) in the drainage channel. The soils over and under the manhole had eroded away and the CMP downstream of that manhole had severely corroded.
Upon this finding, staff consulted with the San Francisco Bay Regional Water Quality Control Board (RWQCB), U.S. Army Corp of Engineers (USACE), and California Department of Fish and Wildlife (CDFW) to develop an acceptable scope of work for the repair. Based on their feedback, it was concluded that the failed CMP should not be repaired. Rather, the pipe should be abandoned in favor of daylighting the creek. To reduce the potential for additional damage, the Project was broken down into two phases: Phase I consisted of repairing the corroded, but still buried and mostly intact portion; and Phase II consisted of repairing the area where the pipe was exposed and completely failed.
In 2016, the Phase I work was performed by Garney Construction who repaired the corroded 36- inch CMP upstream of the failed manhole. The repair was conducted using an in-situ lining technique, which minimized delays, environmental impacts, permitting, and construction costs.
The contractor successfully completed the Phase I work and the work was accepted by the City Council in the spring of 2017.
Following completion of the Phase I work, staff worked with the City’s geotechnical engineering consultant, Atlas, to develop a design concept for the Phase II portion of this Project. There were two objectives for the Phase II work: 1) to stabilize the outfall to accommodate the increased flow velocity from the pipe that was lined in 2016, while improving the long-term stability of the creek channel; and 2) to ecologically enhance the channel. To accomplish these goals, the scope of work for Phase II was developed to:
remove the existing CMP and the failed concrete manhole from a culvert outfall; stabilize the outfall pipe by connecting a new short section of 36-inch dual wall high density polyethylene (HDPE) pipe;
provide outlet protection by building a riprap apron at the new outfall; reconstruct the streambed with Engineered Streambed Material (ESBM) to provide a stable streambed profile with a step-pool system and dissipate energy to prevent erosion; and
enhance the riparian corridor with native plants to compensate for disturbance to fish and wildlife resources due to Project activities.
In 2019, Restoration Design Group (RDG), which is a subconsultant to Atlas, completed the design plan for the scope of work described above. Using this plan, the Project initiated the application process to obtain the necessary regulatory permits to perform the Phase II work, which included the U.S. Army Corps of Engineers, California Department of Fish and Wildlife,
5.9 Packet Pg. 59
and San Francisco Bay Regional Water Quality Control Board. In 2022, all the required regulatory permits and agreements were obtained to complete the Project.
On August 29, 2022, staff authorized the City’s As-Needed Earthwork, Maintenance, General Contracting and Emergency Response Services Contractor, ETIC, to begin the Phase II work.
The Project site begins immediately downstream of Crow Canyon Road and on the east side of Boardwalk Place in an area that is extremely inaccessible for construction due to mature riparian vegetation and steep banks that descend over 30-feet from the top of slope. Due to the severely limited access to the site, a crane was used to deliver a small excavator to the creek channel to perform the work and to remove the culvert remnants and debris from the channel. The crane was also used to transport the new pipe and ESBM material. Areas that were disturbed by the Project were enhanced with small to large native plantings. On October 7, 2022, ETIC successfully completed the work within the approved budget for $426,184 while complying with all regulatory permit requirements. Acceptance of the Project will initiate the 30-day Stop Notice period after the recording of the Notice of Completion, as required by law.
FISCAL ANALYSIS
The Five-Year 2022-2027 Capital Improvement Program authorized a total Project Budget of $3.2M for the Citywide Drainage Infrastructure Repair Project (CIP 915548), which included $500,000 for the Mill Creek Culvert Repair Project (CIP 915548-K). This Project is funded by the 2019 Certificate of Participation Debt Financing (COP).
The construction work by ETIC was completed under Contract C2022-007 As-Needed Earthwork, Maintenance, General Contracting, and Emergency Response Services Agreement executed on February 14, 2022 in the amount of $499,999, which expires on December 31, 2024.
ETIC completed the Project for $426,184 leaving a remaining contract balance of $73,815.
Additional expenditures tied to the Phase II portion of the Project included biological monitoring, design consulting services, and permitting fees for the design and construction of the identified projects in the Citywide Drainage Infrastructure Repair Project (CIP 915548-K). To date, the total expenses for this Project are $493,044, and are as follows:
Design Consultant $ 34,072
Permitting $ 10,666
Environmental Consultant $ 22,122
ETIC Construction $426,184
Any unused funds will remain in the Project to address future creek repairs under the Citywide Drainage Infrastructure Repairs Project (CIP 915548). Approximately $76,353 remains available in CIP 915548 for other drainage infrastructure repair projects.
STEPS FOLLOWING APPROVAL
With approval of this Resolution, the City Clerk will file a Notice of Completion with the Contra Costa County Clerk Recorder’s Office. Upon completion of the posting period, the City will

BACKGROUND
On November 19, 1985, the San Ramon Planning Commission adopted Resolution No. 35-85 and conditionally approved the development of a 51,000 sq. ft. two-story office building with associated parking lot and landscape areas. The development was approved with minimal parking based upon the proposed digital recovery data center facility because the project demonstrated the ability to construct additional parking (land-banked parking) on-site if needed.
On February 15, 2022, the Applicant submitted a Development Plan application for a 61-unit townhome development on the existing 4.4-acre parcel. The proposal includes the consideration of a General Plan Amendment (GPA) and a Rezone to change the existing Office use to a Residential and Open Space use as well as Major Subdivision, Architectural Review, Tree Removal Permit, and Environmental Review. Over the past 9 months the Architectural Review Board, Planning Commission and Council have had several meeting on the project. The following is a list of prior meetings with links to the related Agenda packets:

The current office building shared drainage facilities with the residential community that are established by a drainage easement. The HOA has concerns regarding potential drainage increase from the proposed residential project. Staff is aware of the HOA concerns and the analysis of the proposed stormwater control measures required for the site results in a reduction in stormwater discharge from the existing condition. Staff will continue to work with the applicant and HOA to address their concerns as a part of the final Planning Commission review.
9.1 Packet Pg. 67
Following Council discussion, the hearing was closed and additional project review was set for the February 14, 2023 meeting.
DISCUSSION/ANALYSIS
The proposed 61-unit townhome community would consist of ten, 3-story buildings with one project entry point on Deerwood Drive. The Applicant is proposing to create a separate parcel and designate the unbuildable slope area at the south side of the proposed development area as open space. The Project is required to satisfy the City’s Inclusionary Housing Ordinance requirements with 15% of the total housing units available to Low, Very Low and Moderate income households. The City Council is considering the General Plan and Rezone portions of the project. Following completion of the Councils review, the Planning Commission will consider the subdivision map and development applications consistent with the new General Plan and Zoning designations,
Figure 1: Site Plan and Amenities
General Plan Amendment and Rezone
The Applicant is proposing to change the existing Office designation to Multiple Family-High Density Residential (MFH) and Open Space (OS) and rezoning the site from Administrative Office (OA) to High Density Residential and Open Space 2 (OS-2) to facilitate the proposed project. The proposed development project meets the development standards for the site based on the proposed land use changes.
9.1 Packet Pg. 68
Further, the subject site is identified as a Housing Opportunity site in the Draft 2023-2031 Housing Element currently under review by the State and will ultimately be designated for residential uses. Rather than wait for the City process to be completed before filing development applications, the Applicant opted to pursue the General Plan Amendment, Rezone and development applications independent of the City process for more certain timing of the proposed changes. Once the approvals are complete, the site will be consistent with the proposed Housing Element once adopted.
Figure 2: Existing and Proposed General Plan Designations Figure 3: Existing and Proposed Zoning
9.1 Packet Pg. 69
The Rezoning of a property is a two-step process that requires the introduction of the ordinance followed by a second meeting for the action for adoption. As such, Staff has provided the draft ordinance for introduction at the February 14, 2023 meeting and requesting that it be set for adoption and the City Councils February 28, 2023 meeting along with the General Plan Amendment and Mitigated Negative Declaration.
