CITY COUNCIL STAFF REPORT
DATE: July 11, 2023
TO: City Council/City Manager
FROM: Kelly Sessions, Administrative Services Director
By: Megan O'Donoghue, Human Resources Manager
SUBJECT: RESOLUTION NO. 2023-078 - Authorizing the Fiscal Year 2023/24 Salary Schedule as Provided for in the Police Officers’ Association Memorandum of Understanding and the Unrepresented Miscellaneous Employees Salary and Benefits Resolution

RECOMMENDED ACTION
Staff recommends approval of the Resolution authorizing execution of the updated FY 23/24 Salary Schedule for all Police Officer’s Association (POA) employees and for Police Lieutenants, effective July 1, 2023.

BACKGROUND/DISCUSSION
On August 24, 2021, by Resolution No. 2021-104, the City approved and executed a Memorandum of Understanding (MOU) with the San Ramon POA for a term of July 1, 2021 through June 30, 2024. The POA MOU provides for increases to salary ranges effective July 1, 2023, based on the results of a total compensation survey of comparable agencies for the job classifications of Police Officer and Police Sergeant, to bring the top of the range for both salary ranges to the 75th percentile of the City’s comparator agencies, with the Police Corporal salary range to be set ten percent (10%) below the top of the salary range for Police Sergeant. The total compensation survey indicated an increase of 10.8709% to the Police Officer salary range and an increase of 10.1160% to the Police Sergeant range effective July 1, 2023.

On July 12, 2022, by Resolution No. 2022-111, the City Council approved and executed a Salary and Benefits Resolution outlining terms and conditions of employment for Unrepresented Miscellaneous Employees, which states that the classification of Police Lieutenant must maintain a twenty percent (20%) salary differential with Police Sergeant. To maintain that salary differential, the Police Lieutenant salary range will be increased by 10.1659% effective July 1, 2023.

Please note that at the City Council Meeting on June 27, 2023, the City Council previously authorized increases to the salary ranges for all other unrepresented employees and employees represented by the Service Employees International Union (SEIU), Local 1021 effective July 1, 2023, in accordance with the SEIU MOU and the Unrepresented Miscellaneous Employees Salary and Benefits Resolution.

5.3 Packet Pg. 13
The attached and updated FY 23/24 salary schedule incorporates the increases outlined above for all POA employees and Police Lieutenants.

FISCAL ANALYSIS
All items covered in this Resolution are already included in the FY 23/24 operating budget.

Therefore, no additional funding is needed.

STEPS FOLLOWING APPROVAL
This action will ratify and execute the updated FY 23/24 salary schedule for all POA employees and Police Lieutenants effective July 1, 2023. Human Resources staff will work with Payroll staff to implement the new salary schedule, which will also be posted on the City’s Intranet and external web page for access by others.

CITY COUNCIL STAFF REPORT
DATE: July 11, 2023
TO: City Council/City Manager
FROM: Kathi Heimann, Parks & Community Services Director By: Mae Mlyniec, Administrative Analyst
SUBJECT: RESOLUTION NO. 2023-079 - Authorizing the Mayor to Execute Amendment No. 4 to the Revenue Sharing Agreement with Tri Valley Basketball for Youth Basketball League Services, Extending the Term to June 30, 2024, and Authorizing Additional Funds of $43,369 for a Cumulative Contract Amount Not to Exceed $252,869

RECOMMENDED ACTION
Staff recommends that the City Council approve this resolution authorizing the Mayor to execute Amendment No. 4 to the revenue sharing agreement with Tri Valley Basketball for Youth Basketball league services, extending the term to June 30, 2024, and authorizing additional funds of $43,369 for a cumulative contract amount not to exceed $252,869.

BACKGROUND/DISCUSSION
The Parks and Community Services Department offers youth basketball leagues during the fall and winter of each year for children in grades K-12. The department operates the K-2 divisions utilizing City staff during October-December. A contract instructor, Tri Valley Basketball, provides the grades 3-12 divisions during January-March. Both leagues are recreational in nature focusing on skill development and utilizes volunteer coaches to coach the teams. All practices and games are held at the Iron Horse Community Gym and Pine Valley Community Gym.

On June 20, 2019, a Request for Proposal (RFP) for Youth Basketball league services was posted and sent out to twenty (20) youth sports organization in California. The City received qualified proposals from two (2) vendors: National Academy of Athletics and Tri Valley Basketball. After evaluation of the qualified proposals, Tri Valley Basketball was selected. The Parks and Community Services Department found that Tri Valley Basketball presented the best overall proposal due to experience within the community and proposed resident participation fees.

On August 27, 2019, the City Council approved Resolution 2019-083, authorizing the Mayor to execute a contract with Tri Valley Basketball for a one-year revenue sharing agreement with the option to renew for four successive one year terms, for an amount not-to-exceed $123,160. On October 13, 2020, the City Council approved Resolution 2020-095, authorizing the mayor to execute Amendment No. 1 to the contract with Tri Valley Basketball for additional funds of $48,030, for a total two-year cumulative contract amount not to exceed $171,190.

5.4 Packet Pg. 20
Due to the impact of COVID-19, no services were rendered by Tri Valley Basketball during the 2020-21 Fiscal Year. However, prior to the COVID-19 shutdown, Tri Valley Basketball was providing adequate services. On June 8, 2021, the City Council approved Resolution 2021-077, authorizing the mayor to execute Amendment No. 2 to the contract, extending the term, with no additional funds, to June 30, 2022. On June 28, 2022, the City Council approved Resolution 2022-101, authorizing the mayor to execute Amendment No. 3 to the contract, adding $38,310 in funds, and extending the term to June 30, 2023.

Staff anticipates additional services and therefore recommends authorizing Amendment No. 4 to extend the term to June 30, 2024 and authorizing additional funds of $43,369 for a cumulative contract amount not to exceed $252,869.

FISCAL ANALYSIS
The City entered into the revenue sharing agreement with Tri Valley Basketball for Youth Basketball league services starting in October of 2019. The revenue from participant fees are split with 60% going to Tri Valley Basketball and 40% being retained by the City. The initial contract provided for a not to exceed amount of $123,160 for one year.

Amendment No. 1 to the original contract allowed for additional funds of $48,030, for a total two-year cumulative contract amount not to exceed $171,190. Amendment No. 2 extended the original contract, but did not necessitate additional funds as no revenue was generated by Tri Valley Basketball in the 2020-21 fiscal year due to COVID-19. Am. No. 3 extended the agreement to June 30, 2023 and necessitated $38,310 in additional funds.

To date, $187,868.78 has been paid to Tri Valley Basketball as part of the revenue sharing agreement. Staff anticipates the 23-24 expenses to be $65,000 and recommend requesting this amount, minus the funds remaining on the contract, $21,631, for a total of $43,369 for Amendment No. 4 for a cumulative contract amount not to exceed $252,869. There are sufficient funds collected via participant fees to cover the additional revenue sharing contract costs.

STEPS FOLLOWING APPROVAL
Staff will prepare an amendment to the contract for Tri Valley Basketball per the established Purchasing and Procurement Policy.

CITY COUNCIL STAFF REPORT
DATE: July 11, 2023
TO: City Council/City Manager
FROM: Maria Fierner, Public Works Director
By: Jon Bell, Public Works Program Manager
SUBJECT: RESOLUTION NO. 2023-080 - Declaring the Results of the Assessment Ballot Tabulation Under Proposition 218 for the Landscape and Lighting District No. 1984-1 – Zone 4; Confirming the Landscape and Lighting District No. 1984-1 – Zone 4, Vista San Ramon Assessment Diagram and Assessments; Setting the Maximum Assessment at $385 Per Assessment Unit, Which Shall be Increased Annually by the February Consumer Price Index for the San Francisco Bay Area, All Urban Consumers; and Levying an Assessment of $385 Per Assessment Unit for Fiscal Year 2023/24

EXECUTIVE SUMMARY
Operating and replacement costs for Landscaping and Lighting District No. 1984-1 - Zone 4, Vista San Ramon, have gradually increased over the years with the result that the Zone will no longer be able to afford the desired level of service in the near future. In order to maintain the desired service levels, an increase in the maximum assessment for the Zone is needed. On May 9, 2023, the City Council approved the Engineer’s Report and ordered that ballot proceedings be conducted in accordance with Article XIII D (Proposition 218) of the California Constitution the “Right to Vote on Taxes Act” and set a public hearing and tabulation of ballots for June 27, 2023.

Following the public hearing, the ballots were tabulated by the City Clerk with the result in favor of increasing the maximum allowable assessment to $385 per assessment unit with an annual increase at the rate of inflation. The next steps in the process are to certify the ballot results, confirm the assessment diagram, and levy the assessment for Fiscal Year 2023/24.

RECOMMENDED ACTION
Staff recommends the City Council approve this resolution declaring the results of the assessment ballot tabulation under Proposition 218 for the Landscaping and Lighting District No. 1984-1- Zone 4; confirming the Landscaping and Lighting District No. 1984-1 - Zone 4, Vista San Ramon Assessment Diagram and Assessments; setting the maximum assessment at $385 per assessment unit, which shall be increased annually by the February Consumer Price Index for the San Francisco Bay Area, All Urban Consumers; and levying an assessment of $385 per assessment unit for Fiscal Year 2023/24.

BACKGROUND/DISCUSSION

5.5 Packet Pg. 34
Zone Funding and Compliance with the “Right to Vote on Taxes Act” (Proposition 218) Landscaping and Lighting District No. 1984-1 (District) includes two Citywide Zones and seventeen Special Zones. Property owners within each Zone pay an annual assessment, which funds the maintenance of public landscaping and street lighting within the Zone. The assessment rates are different for each Special Zone, as they are based upon the cost to maintain landscaping and amenities specific to each Zone, divided by the number of units in the Zone. Assessment revenues from a Special Zone may only be spent on specified services for that Zone. Any unspent revenues in each fiscal year are held in a reserve fund specific to each Zone.

In accordance with Proposition 218, the maximum assessment rate for each Zone can only be increased through a majority vote of the property owners within that Zone. Property owners set a maximum assessment rate, and the City then has the authority to levy the assessment, up to the maximum rate, depending upon the projected expenditures of the Zone for each upcoming fiscal year. If there are cost savings in one fiscal year, they are allocated back to the reserve fund for that Zone.

The process to increase an assessment in a Landscaping and Lighting District is governed by the California Streets and Highway Code Section 22500, and the "Right to Vote on Taxes Act" (Proposition 218). These processes require the preparation of an Engineer’s Report that includes a description of the services to be provided by the Landscaping and Lighting District, or assessed Zone, the costs that are anticipated, and a discussion of the assessment methodology. The Engineer’s Report is the basis for the determination of the assessment and was approved by the City Council on May 9, 2023. Balloting was conducted by a mail-in ballot per Proposition 218.

The assessment increase and adoption were subject to a Public Hearing that was held on June 27, 2023. Following close of the hearing, the ballots were tabulated by the City Clerk. The results were 36 votes in favor of the assessment increase and 19 votes opposed.

With the approval of the ballot measure, the City Council may now levy an assessment up to the maximum voter approved amount of $385 per assessment unit. Each home in Zone 4 is assessed one unit. This maximum assessment rate may be increased each year in the future by the February Consumer Price Index for the San Francisco Bay Area, All Urban Consumers.

NEXT STEPS

1. File the final Engineer’s Report, together with the assessment roll and the assessment diagram, with the Contra Costa County Assessor’s Office by August 10, 2023.

2. Implement the program described in the Engineer’s Report and prepare for a long-term replacement program which will maintain and enhance the landscaping in the Zone.

CITY COUNCIL STAFF REPORT
DATE: July 11, 2023
TO: City Council/City Manager
FROM: Maria Fierner, Public Works Director
By: Maria Fierner, Public Works Director
SUBJECT: RESOLUTION NO. 2023-081 - Authorizing the Temporary Appointment of Jeff Gault as a CalPERS Annuitant and an Interim Division Manager for the Public Works Department, Per Government Code 21221(H)

EXECUTIVE SUMMARY
The position of Division Manager (commonly referred to by the working title of Public Services Division Manager) in the Public Works Department has been vacant since April 10, 2023. This critical position oversees 81.75 authorized positions, manages a budget of $31.45M, and operates and maintains all of the City’s public infrastructure and amenities. Jeff Gault served as a Public Services Division Manager in the Public Works Department for 17.5 years and retired on December 30, 2019. Due to the critical need to continue the responsibilities of the Public Services Division Manager during the recruitment and hiring process for a new Public Services Division Manager, staff is requesting that Mr. Gault be temporarily appointed as a CalPERS Annuitant and the Interim Public Services Division Manager, per Government Code 21221(h).

CalPERS recommends approval of such an appointment via City Resolution.

RECOMMENDED ACTION
Staff recommends approval of this Resolution authorizing the temporary appointment of Jeff Gault as a CalPERS Annuitant and the Interim Public Services Division Manager for the Public Works Department.

BACKGROUND/DISCUSSION
As of April 10, 2023, the Public Services Division Manager position has been vacant. The recruitment process to fill the position began on July 6, 2023. The Division consists of: 81.75 authorized positions; a Division operating budget of $31.54M; and contract management of over 70 contracts managed at one time. The Division’s responsibility is to operate and maintain all of the City’s public infrastructure and amenities.

Jeff Gault was a City employee for 30 years and served as Division Manager in the Public Works Department for 17.5 years. Mr. Gault retired on December 30, 2019, after a 30-year career with the City, all of which was spent in Public Services. As a Public Services Division Manager, he was responsible for a multitude of specialized assignments that touched on a wide range of

5.6 Packet Pg. 41
divisional functions:
• Performed administrative duties and policy interpretation related to the management within the Public Services Division;
• Managed the day-to-day operations of the following programs: Facilities, Parks, Landscaping, Lighting, Streets/Drainage/Signals, and Fleet/Equipment Maintenance, and Solid Waste;
• Developed Division goals and objectives;
• Managed staff directly and through subordinate supervisors; • Developed policies and procedures related to Division activities; • Developed and administered Division budgets; and
• Conducted short- and long-range planning, including succession planning and trainings.

Mr. Gault’s specialized expertise is particularly needed in the near term in the following areas:
• Manage the day-to-day operations of the Division.
• Assist the Director in the hiring process for the Public Services Division Manager. • Assist the Director with succession planning due to the number of recent and upcoming retirements occurring in the Public Services Division.

Staff recommends that the Council approve temporarily appointing Jeff Gault as a CalPERS Annuitant to the position of Division Manager to perform the majority of the functions described above and other comparable projects for which he is uniquely qualified. Temporarily appointing Mr. Gault to the position will allow coverage of the day-to-day operations of the Division, which has currently been handled by the Public Works Director since April. Recruitment and selection of a permanent Public Services Division Manager has been initiated with a current deadline to submit applications by August 14, 2023. There is typically a period of at least several months before a new hire appointment is made and the new hire is in place.

Mr. Gault’s appointment can be terminated at any time by either party; however, Mr. Gault’s appointment as the Interim Public Services Manager will terminate when the current vacancy is filled. (If necessary and/or desired, the City may appoint Mr. Gault as an “extra help” CalPERS Annuitant when the current vacancy is filled to allow for training and knowledge transfer for the new, permanent Public Services Division Manager.) Mr. Gault’s number of hours will not exceed 960 in a fiscal year. Effective July 1, 2023, the maximum base salary for Division Manager is $16,275.39/month, and the hourly equivalent is $100.1562/hour; the minimum base salary for Division Manager is $12,209.60/month, and the hourly equivalent is $75.1360/hour. Mr. Gault will be paid an hourly rate of $90.00.

Mr. Gault is agreeable to the terms and conditions of the proposed temporary employment.

FISCAL ANALYSIS
There is no net fiscal impact to this appoint. The proposed salary rate is covered by the Public Services Division Manager salary currently budgeted for FY 2023/24. No benefits or additional compensation beyond an hourly salary rate would be paid. The total number of hours will not

5.6 Packet Pg. 42
exceed 960 hours in FY 2023/24. The need for this temporary appointment is estimated to be three to six months, working on a part-time basis.

STEPS FOLLOWING APPROVAL
If approved by the City Council, staff will complete the necessary documents for this temporary appointment, ensuring that all Government Code requirements are met related to retiree employment.
