By: Mike Dodds, Program Manager
SUBJECT: RESOLUTION NO. 2024-089 - Authorizing the Mayor to Execute Amendment No. 2 to the Agreement with Rodan Builders, Inc (C2023-042) for Construction Services for the San Ramon Olympic Pool and Aquatic Park Renovation (CIP 200006) - Interior Improvements for an Additional Amount Not to Exceed $117,964 for a Total Cumulative Amount Not to Exceed $1,519,045, through September 30, 2024

EXECUTIVE SUMMARY
On May 28, 2024, Council adopted Resolution No. 2024-060, authorizing Amendment No. 1 to the Agreement with Rodan Builders, Inc. (Rodan) for an additional amount not to exceed $125,281 for a total cumulative amount not to exceed $1,401,081, through July 31, 2024. On July 30, 2024, a punch list walk with the California Division of the State Architect (DSA) identified additional work to be completed, which included the need for extra anchoring for the locker system and the placement of an ADA seat in the locker room showers. As a result, the costs for construction and inspections have increased, and the Project's completion date has been extended to September 30, 2024. This additional work requires an increase in the contract of $117,964, bringing the total cumulative contract amount to $1,519,045, through September 30, 2024.

RECOMMENDED ACTION
Staff recommends adoption of this Resolution authorizing the Mayor to execute Amendment No. 2 to the Agreement with Rodan Builders, Inc. (C2023-042) for construction services for the San Ramon Olympic Pool and Aquatic Park Renovation (CIP 200006) - Interior Improvements for an additional amount not to exceed $117,964, for a total cumulative amount not to exceed $1,519,045, through September 30, 2024.

BACKGROUND/DISCUSSION
On May 23, 2023, City Council adopted Resolution No. 2023-058 authorizing the Mayor to enter into an agreement with Rodan for construction services for the San Ramon Olympic Pool and Aquatic Park Renovation (CIP 200006) - Interior Improvements in the amount of $1,275,800.

mitigation for the floor in the coach's office (Room #106), new epoxy flooring in the classroom, hallway, lifeguard office, and maintenance office, new carpet in the lobby, and lighting upgrades in the Aquatic Center in compliance with the Americans with Disabilities Act (ADA) and latest codes and regulations. An Initial Notice to Proceed was issued on August 7, 2023, to allow Rodan to procure long-lead materials and equipment prior to construction. A Construction Notice to Proceed was issued on October 9, 2023, with project construction anticipated to be completed in January 2024 and project acceptance in February 2024.

Amendment No. 1 to the Agreement with Rodan was approved on May 28, 2024 (Resolution No. 2024-060) for construction services for the San Ramon Olympic Pool and Aquatic Park Renovation (CIP 200006) - Interior Improvements for an additional amount not to exceed $125,281 for a total cumulative amount not to exceed $1,401,081 through July 31, 2024. This amendment provided the additional funding required to cover the increased project costs resulting from necessary design and construction revisions to meet DSA requirements.

On July 30th, 2024, a punch list walk with DSA identified additional work to be completed by Rodan, including the need for extra anchoring for the locker system and the placement of an ADA seat in the locker room showers. As a result, the costs for construction and inspections have increased, and the project's completion date has been extended to September 30, 2024. This additional work, including outstanding invoices, requires an increase in the project budget, not to exceed $117,964, and increases the total cumulative amount not to exceed to $1,519,045, through September 30, 2024.

FISCAL ANALYSIS
CIP 200006 has sufficient funds to complete the additional work due to an appropriation of $227,108 from the Infrastructure Maintenance Fund (618), as authorized by Resolution No. 2024-060. Rodan’s original contract is for an amount not to exceed $1,275,800. Amendment No. 1 increased this amount by $125,281. The additional cost to complete the project, including the recent work identified and outstanding invoices is $117,964, increasing the total cumulative amount not to exceed to $1,519,045.

EXECUTIVE SUMMARY
The City Council adopted Resolution No. 2022-150 authorizing the Mayor to enter into an Agreement with Integra Construction Services, Inc. (Integra) in the amount of $2,063,600 for construction services at the Dougherty Station Community Arts Center Renovation Project (CIP 200004). The project involved finishing upgrades to the facility and expanding the dance studio.

Change orders for flooring and site conditions, along with other product substitutions, caused delays in project completion. The extra expenses require an appropriation to CIP 200004 in the amount of $16,856 from the Infrastructure Maintenance Fund (IMF). Several IMF CIP projects have been completed, allowing the release of a portion of their remaining budgets to the IMF to provide for this appropriation, with identified work deferred to future years. With the remaining construction change orders, the total due to Integra is $78,457. Staff is requesting to amend the contract for an additional amount of $40,610 for a total cumulative amount not to exceed $2,104,210, through August 31, 2024.

On December 13, 2022, the City Council adopted Resolution No. 2022-150 authorizing the Mayor to enter into an agreement with Integra Construction Services, Inc. for construction services for the Dougherty Station Community Center Renovation Project (CIP 200004) in the amount of $2,063,600. The project includes finishing upgrades and updates to the facility, expanding the dance studio to accommodate larger classes, replacing the flooring throughout the facility, and upgrading most of the LED lighting. Additional upgrades included an on-demand hot water system, automatic entry doors, and gender-neutral restrooms on the second floor. The restrooms in the main lobby were completely remodeled with all new plumbing fixtures and stall dividers. The green room, previously located on the second floor, was relocated closer to the theater and six offices were converted into rentable studios for music and arts. A Construction Notice to Proceed was issued on January 27, 2023, with project construction originally anticipated to be completed in June 2023. The Grand Opening of the Dougherty Station Community Arts Center occurred on August 14, 2023. However, there was still outstanding work that was not completed, but delaying the opening any further was avoided to allow the public to start utilizing the facility as soon as possible. Substantial completion of construction was achieved on December 18, 2023. The delay in acceptance was due to the completion of the final punch list and project closeout documentation. The City is still waiting for as-built drawings and final inspection. Project acceptance is targeted for September 10, 2024.

Due to construction change orders on the Dougherty Station Community Arts Center Renovation Project (CIP 200004), additional construction services were required in the amount of $78,457.

Additional expenses include alternate dance floor mirrors, a change in the wood flooring material in the dance studio, and a custom-built theater console for lighting and sound control.

FISCAL ANALYSIS
Integra’s contract is for an amount not to exceed $2,063,600. The total amount remaining on Integra’s contract is $37,847. Therefore, the additional increase in contract amount is $40,610.

Total Remaining Contract Work $ 78,457
Contract Balance to Date $ (37,847)
Contract Budget Shortfall $ 40,610
Original Contract Amount $ 2,063,600
Proposed Contract Increase $ 40,610
Revised Contract Amount $ 2,104,210
City Council Resolution No. 2024-059 authorized an appropriation of $63,457 to the Dougherty Station Community Arts Center Renovation Project (CIP 200004), which increased the project balance to $81,442. The additional appropriation of $63,457 includes the $57,688 required for Amendment No. 6 with Roebbelen Contracting, Inc. (C2018-071) for CIP 200004. In order to close the gap in funding the Project, an appropriation of $16,856 from the Infrastructure Maintenance Fund (IMF) is being requested as a result of the Project balance relative to the additional expenses and Integra’s contract increase:

To provide for this appropriation, and due to the minimal funds available in the IMF, the San Ramon Olympic Pool (SROP) Equipment Replacement Project (CIP 925479) has released a portion of its budget to the IMF, with identified work deferred to future years.

TOTAL IMF TRANSFER TO CIP 200004 $ 16,856
The balance of this IMF project to be transferred includes funds from prior and current fiscal years, with work still identified for completion. However, to allocate funds to CIP 200004, work for CIP 925479 has been prioritized and deferred to ensure sufficient funds are available for appropriation to the DSCAC Renovation Project.

Staff recommends an appropriation of $16,856 to the Dougherty Station Community Arts Center Renovation Project (CIP 200004) from the Infrastructure Maintenance Fund (618) and Amendment No. 1 to Integra for construction services for CIP 200004 for an additional amount of $40,610, for a total cumulative contract amount not to exceed $2,104,210 through August 31, 2024.

CITY COUNCIL STAFF REPORT
DATE: August 13, 2024
TO: City Council/City Manager
FROM: Brian Bornstein, Public Works Director
By: Darin Fitzpatrick, Program Manager
SUBJECT: RESOLUTION NO. 2024-091 - Authorizing the Mayor to Execute an Agreement with Precision Emprise LLC Dba Precision Concrete Cutting for On-Call Horizontal Concrete Saw-Cutting and Shaving Services in an Amount Not to Exceed $750,000 through February 28, 2025, with the Option to Renew the Agreement for Up to Three Additional Succeeding One-Year Terms

EXECUTIVE SUMMARY
The City of San Ramon requires on-call horizontal concrete saw-cutting and shaving services to help eliminate trip hazards, improve water flow, or improve appearance of public sidewalks, curb ramps, pathways, driveways, valley gutters, curbs, flatwork, and gutters at various locations throughout the City. The current Agreement expired on June 30, 2024, triggering the need for a new Agreement. Staff has selected Precision Emprise LLC dba Precision Concrete Cutting (Precision) in an amount not to exceed $750,00 through February 28, 2025, with the option to renew the Agreement for up to three additional succeeding one-year terms based on the purchasing cooperative agreement between Central Susquehanna Intermediate Unit (CSIU) dba Keystone Purchasing Network (KPN) and Precision. The actual work will be performed on an on-call, as-needed basis and is anticipated to include work for the Sidewalk Repairs Project 2024/2025 (CIP 400009), Pavement Management 2024 and 2025 (CIPs 000013 and 000015), Pedestrian Enhancement Devices (CIP 975413), Dougherty Valley Tree Management Program (CIP 935564), and other projects.

RECOMMENDED ACTION
Staff recommends adoption of this Resolution authorizing the Mayor to execute an Agreement with Precision Emprise LLC dba Precision Concrete Cutting, for on-call horizontal concrete saw-cutting and shaving services in an amount not to exceed $750,000 through February 28, 2025, with the option to renew the Agreement for up to three additional succeeding one-year terms.

BACKGROUND/DISCUSSION
The City of San Ramon requires on-call horizontal concrete saw-cutting and shaving services to help eliminate trip hazards, improve water flow, or improve appearance of public sidewalks, curb

ramps, pathways, driveways, valley gutters, curbs, and flatwork and gutters at various locations throughout the City. The current Agreement for on-call horizontal concrete saw-cutting and shaving services expired on June 30, 2024, triggering the need for a new contract. The extent and nature of this work is difficult to predict and, therefore, is best handled through an on-call contract. The scope of work may include elements for various Capital Improvement Projects (CIPs), including the Sidewalk Repairs Project 2024/2025 (CIP 400009), Pavement Management 2024 and 2025 (CIPs 000013 and 000015), Pedestrian Enhancement Devices (CIP 975413), Dougherty Valley Tree Management Program (CIP 935564), and other projects.

Precision Emprise LLC repairs and eliminates trip liabilities on curbs, gutters, sidewalks, and pavement which are of a safety concern within the City’s right-of-way. Staff evaluates reports of damaged curb, gutter, driveway, valley gutter, curb ramp, or sidewalk, and determines if it is a routine repair, such as patching and/or grinding, or an on-call concrete maintenance repair, such as shaving, saw-cutting and/or removal and replacement. Staff creates a master list and ranks and prioritizes the locations.

On February 28, 2023, The Central Susquehanna Intermediate Unit (CSIU) dba Keystone Purchasing Network (KPN) through a nationwide trip hazard removal category (KPN Contract # KPN-202201-04) extended the contract agreement with Precision Emprise LLC until February 28, 2028. KPN is a national purchasing cooperative that reduces the cost of acquisition for education and local government. KPN awards contracts based on competitively bid purchasing contracts that satisfy the City of San Ramon’s Purchasing Ordinance. The work for the City of San Ramon will be completed based on the rates included with the KPN Agreement through the City’s full contract term.

FISCAL ANALYSIS
Work identified under this contract will be funded through operating or CIP budgets, as appropriate. It is anticipated that there will be sufficient funding in Capital Improvement Projects (CIPs), including the Sidewalk Repairs Project 2024/2025 (CIP 400009), Pavement Management 2024 and 2025 (CIPs 000013 and 000015), Pedestrian Enhancement Devices (CIP 975413), Dougherty Valley Tree Management Program (CIP 935564), and other projects to complete the work under this contract.

STEPS FOLLOWING APPROVAL
The City Attorney’s Office will forward the contract Agreement to Precision Emprise LLC for execution. Upon receipt of the executed contract documents, the required bonds, certificates of insurance, and a copy of a current City business license from the contractor, the City Attorney’s Office will send a copy of the executed contract documents and all attachments to the Public Works - Public Services Division. Staff will issue work orders to Precision Emprise, as needed.

Staff will monitor the performance of the contractor throughout the term of the Agreement.

CITY COUNCIL STAFF REPORT
DATE: August 13, 2024
TO: City Council/City Manager
FROM: Scott Koll, Deputy City Manager
By: Megan O'Donoghue, Human Resources Manager
SUBJECT: RESOLUTION NO. 2024-092 - Authorizing Execution of the FY 2024/25 Salary Schedule as Provided for in the Unrepresented Miscellaneous Employees Salary and Benefits Resolution and Memorandum of Understanding with the Service Employees International Union, Local 1021

RECOMMENDED ACTION
Staff recommends approval of the Resolution authorizing execution of the FY 2024/25 Salary Schedule for all SEIU and applicable Unrepresented Miscellaneous Employees effective July 1, 2024.

BACKGROUND/DISCUSSION
On July 12, 2022, by Resolution No. 2022-111, the City Council approved and executed a Salary and Benefit Resolution outlining terms and conditions of employment for Unrepresented Miscellaneous Employees, including scheduled increases to salary ranges. The Unrepresented Miscellaneous Employees Salary and Benefit Resolution provides for increases to the salary ranges of unrepresented miscellaneous job classifications effective July 1, 2024, based on the results of a total compensation survey of comparable agencies. Based on the results of that survey, increases were made to the salary ranges for unrepresented miscellaneous job classifications that fell below the seventy-fifth (75th) percentile to bring them to the seventy-fifth (75th) percentile; salary ranges for unrepresented miscellaneous job classifications that were at or above the seventy-fifth (75th) percentile were not adjusted. Unrepresented miscellaneous job classifications that were not surveyed were benchmarked to an appropriate and similar job classification that was surveyed to determine an equivalent increase to their salary range, as necessary.

There are two exceptions to the salary range increases for unrepresented miscellaneous job classifications. First, because the salary range for Police Lieutenant is based on the City maintaining a twenty percent (20%) salary differential with Police Sergeant, the salary range for Police Lieutenant was adjusted effective July 15, 2024, to coincide with increases to the salary range for Police Sergeant, effective on that same date. Second, salary range increases for the job classifications of Department Director, City/District Engineer, Police Chief, Police Captain, Assistant City Attorney, and Deputy City Manager will be deferred while the City conducts an

5.7 Packet Pg. 26
organizational audit and analyzes the impacts of the recently approved Memorandum of Understanding (MOU) between the City and the San Ramon Police Officers Association.

The current Memorandum of Understanding (MOU) with SEIU was approved on July 12, 2022, by Resolution No. 2022-110, for a term of July 1, 2022, through June 30, 2026. The SEIU MOU provides for increases to salary ranges effective July 1, 2024, based on the change in the Consumer Price Index (CPI) from June 2023 through June 2024 using the San FranciscoOakland-San Jose region (Urban Wage Earners and Clerical Workers) as published by the Bureau of Labor Statistics; the maximum adjustment for SEIU classifications based on CPI shall be no greater than three and one-half percent (3.5%). The change in the CPI from June 2023 through June 2024 was three percent (3%), so the salary ranges for job classifications represented by SEIU have been adjusted accordingly.

The FY 2024/25 salary schedule incorporates the increases outlined above for all unrepresented miscellaneous job classifications, as well as job classifications represented by SEIU.

FISCAL ANALYSIS
Any associated budgetary impacts will be absorbed by department vacancy savings within the current appropriations of the Fiscal Year 2024-25 adopted budget. Future costs associated with these adjustments will be included in the mid-year budget amendment process anticipated for Council review in January 2025.

STEPS FOLLOWING APPROVAL
This action will ratify and execute the FY 2024/25 salary schedule as identified in Attachment A for all unrepresented miscellaneous job classifications and all job classifications represented by SEIU effective July 1, 2024. Staff will implement the new salary schedule, which will also be posted on the City’s Intranet and external web page for access by others.

UNDERSTANDING WITH THE SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 1021
WHEREAS, by Resolution No. 2022-110, the City executed a Memorandum of Understanding (MOU) with the Service Employees International Union (SEIU), Local 1021 for a term of July 1, 2022 through June 30, 2026; and
WHEREAS, the SEIU MOU provides for increases to salary ranges for represented job classifications effective July 1, 2024, based on the change in the Consumer Price Index (CPI) from June 2023 through June 2024 using the San Francisco-Oakland-San Jose region (Urban Wage Earners and Clerical Workers) as published by the Bureau of Labor Statistics, not to exceed three and one-half percent (3.5%); and
WHEREAS, the change in the CPI from June 2023 through June 2024 using the San Francisco-Oakland-San Jose region (Urban Wage Earners and Clerical Workers) as published by the Bureau of Labor Statistics was three percent (3%); and WHEREAS, by Resolution No. 2022-111, the City Council approved and executed a Salary and Benefit Resolution for Unrepresented Miscellaneous Employees providing for increases to the salary ranges of unrepresented miscellaneous job classifications effective July 1, 2024, based on the results of a total compensation survey of comparable agencies; and WHEREAS, the Unrepresented Miscellaneous Employees Salary and Benefit Resolution states that the salary range for Police Lieutenant must maintain a twenty percent (20%) salary differential with Police Sergeant; and
WHEREAS, the salary ranges for certain unrepresented miscellaneous job classifications will be deferred pending an organization audit and further analysis by City staff.

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of San Ramon does hereby authorize the execution of the new salary ranges, effective July 1, 2024, for all job classifications represented by SEIU and all unrepresented miscellaneous job classifications, as outlined in Attachment A.
