Mayor Carbone called the meeting to order at 4:32 p.m.

4:34 P.M. The Mayor opened the floor to public comment for items on Closed Session and seeing none, closed the floor to public comment.

3A. City Council/Successor Agency Board adjourned to Closed Session regarding:
1) Initiation of Litigation pursuant to Government Code 54956.9(d)(4) (one case). The Agency is considering initiating litigation against the California Department of Finance on its determination to not recognize and require repayment of a $6,308,552 loan by the City as an enforceable obligation. 2) Conference with Real Property Negotiators pursuant to Government Code Section 54956.8

3B. Readjourned to Open Session to report any action taken at the conclusion of Closed Session in accordance with California Government Code Section 54957.1 Agenda item 3A (1) The City Council gave direction on a 4-0 vote to litigation Counsel to initiate litigation against the California State Department of Finance to declare that a loan made by the City is an enforceable obligation. Litigation Counsel looks forward to filing the matter and pursuing on behalf of the Agency.

There was consensus of the Council to adjourn the meeting at 5:22 p.m. to the next regularly scheduled meeting on Tuesday, October 18, 2022 at 5:30 p.m. _______________________________
