Approve a Resolution Authorizing the City
Manager to Allocate Coronavirus State
and Local Fiscal Recovery Funds in the
Amount of $95,449
76 City of Sand City
STAFF REPORT
TO: Honorable Mayor and City Council
FROM: Vibeke Norgaard, City Manager
SUBJECT: Allocation of Coronavirus State and Local Fiscal Recovery Funds DATE: March 5, 2024
_______________________________________________________________________ BACKGROUND/DISCUSSION:
The American Rescue Plan Act of 2021 (ARPA) established the Coronavirus State and Local Fiscal Recovery Funds program under sections 602 and 603 of the Social Security Act which allocated $350 billion in emergency funding to help states and local government address the economic and health consequences of the COVID-19 pandemic.
Of the $350 billion allocated, the City received $95,449.
ARPA funds need to obligated by December 31, 2024 and spent by December 31, 2026 or the City will lose the funding. Current regulations allow local governments to utilize the funds to cover certain expenses including: to respond to the public health and negative economic impacts of the pandemic, including assisting small businesses with facade improvements; funding to provide government services up to the amount of revenue lost due to the pandemic; investments in water, sewers, and broadband infrastructure, and providing premium pay for essential workers who continued to provide services during the pandemic.
In March 2020, the County of Monterey issued a proclamation of a local emergency directing, among other things, that all non-essential functions within the County be cancelled. On March 13, 2020, the City Manager declared a local emergency pursuant to Sand City Municipal Code (SCMC §2.12.020) which was ratified by Council on March 17, 2020 (Res. 20-20). During that unusual and challenging time, Staff adapted to constant and rapidly changing circumstances and continued to provide essential City services in person and remotely, including: police patrol, police dispatch and records, public works emergency response, the maintenance of City streets and sidewalks; public information and City Council support, and the internal services necessary to support essential services.
77 The recommendation to Council is therefore to apply one-half of the ARPA funds ($47,245.50) to provide pro-rated bonuses to current City workers who were employed during the pandemic (March 19, 2020, to May 11, 2023). The provision of pandemic bonuses to employees is a practice that has been followed by several other local communities, including the cities of Watsonville, Salinas, Hollister and San Juan Bautista.
The other half of the ARPA funds ($47,245.50) is recommended to be allocated to start the façade improvement program currently in the City’s five-year Capital Improvement Program but which does not yet have any funds allocated to it. The façade improvement program will provide some assistance to small businesses in Sand City which are presumed to have suffered financial hardship during the pandemic. The way these programs tend to work is to encourage qualified participants to improve and enhance the physical appearance of their building storefront by providing a façade improvement reimbursement. The funds help building owners and tenants get a portion of their maintenance, repair and construction costs reimbursed. Attached as Attachment 2 to this staff report is a sample program from the City of Pacific Grove. Staff will create a Sand City façade improvement program and bring it back to Council for its approval at a future meeting.
CEQA:
This action does not constitute a "project" as defined by the California Environmental Quality Act (CEQA) guidelines section 15378.
FISCAL IMPACT:
Upon City Council approval of the allocation of ARPA funding, staff will include the $95,449 appropriation in the mid-year budget adjustment.
RECOMMENDATION:
It is recommended that the City Council approve the attached Resolution to approve the allocation of one half ($47,724.50) of the ARPA funds to be distributed towards a onetime premium payment to eligible employees and one half ($47,724.50) towards the establishment of a façade improvement program for Sand City businesses.

Discussion and Direction to Staff
Regarding Remote Participation in City
Council Meetings
83 City of Sand City
STAFF REPORT
TO: Honorable Mayor and City Council
FROM: Vibeke Norgaard, City Manager, and Adam Lindgren, Interim City Attorney SUBJECT: Discussion and Direction to Staff Regarding Remote Participation in City Council Meetings
DATE: March 5, 2024
______________________________________________________________________ DISCUSSION:
In response to recent incidents of “Zoom-bombing” during public meetings in the region, the City Manager and City Attorney are requesting that the City Council discuss and provide direction regarding whether it desires to discontinue the use of AB 2449 teleconferencing for City Council meetings and other meetings of the City subject to the Brown Act, except under limited circumstances where it is required for emergency or for just cause participation or for Staff and consultants to continue to participate remotely.
Meetings of the City Council of Sand City and the City's other legislative bodies, with the exception of closed session meetings, are open and public, as required by the Brown Act (Government Code Section 54950, et seq.). Any member of the public may attend, participate, and watch the City's legislative bodies conduct their business.
The Brown Act requires local government to conduct business at a noticed public meeting—with limited exceptions. The Brown Act also includes numerous meeting procedures regarding location, attendance, agendas, and public participation.
On March 17, 2020, in response to the COVID-19 pandemic, Governor Newsom issued Executive Order N-29-20 suspending certain provisions of the Brown Act to allow legislative bodies to conduct virtual meetings to slow the spread of COVID-19. As a result, Sand City offered virtual meetings for the City Council and other bodies subject to the Brown Act.
Throughout 2021 and 2022, Governor Newsom signed Assembly Bill 361 (AB 361) and Assembly Bill 2449 (AB 2449), which allowed local legislative bodies to continue to conduct meetings via teleconference under specific conditions and requirements. The City Council of Sand City has utilized remote participation in accordance with these laws.
Brown Act meetings include a legislative body's regular meetings, special meetings, emergency meetings, and adjourned meetings. Because the Brown Act does specify requirements to conduct meetings via teleconference, the decision to use teleconferencing technology is entirely discretionary by the legislative body. 84 Pre-COVID-19 Public Meeting Model in Accordance with the Brown Act:
• Legislative body, public, staff, and others participate in meetings onsite and in-person. • Public meetings generally convene in the Council Chambers or at another location within the City's jurisdiction.
• Ability for a member of the legislative body to teleconference using audio or video conference software into a meeting from a remote location must be identified in the meeting notice and agenda, the agenda must be posted at the remote meeting location, and the public must have the opportunity to physically attend and participate in the meeting from the remote location.
• Public comments can be received via email or in-person.
Post-COVID-19 Public Meeting Teleconference Model in Accordance with the Brown Act:
• In addition to the pre-COVID-19 method for a member of the legislative body to participate remotely, there are additional provisions for "emergency" or "just cause" circumstances that allow a member of the legislative body to participate by teleconference without complying with the teleconferencing requirements that each teleconference location be identified in the notice and agenda and that each teleconference location be accessible to the public.
• Until January 1, 2026, teleconferencing may also be used on a limited basis where a member indicates their need to participate remotely for "just cause" (e.g., childcare or a contagious illness) or due to "emergency circumstances" (e.g., a physical or family medical emergency).
• At least a quorum of the legislative body must be present from a location within the City's jurisdiction when hosting a teleconference.
• Public, staff, and others may participate in-person or remotely. • The agenda must provide the opportunity for the public to address the legislative body.
Local government agencies in California have relied upon technologies such as Zoom and telephone to provide accessibility to meetings and to increase public engagement.
Use of Teleconferencing for Disruptive Speech: “Zoom bombing” Zoom-bombing is a method that has recently been widely used in the region and state by individuals to disrupt a teleconferenced public meeting during public comment with offtopic, hateful, offensive, or intimidating speech. 85 Several local government agencies in the region have made the decision to discontinue the use of teleconferencing or use teleconferencing on an as-needed basis for City Council meetings due to Zoom-bombing, including:
• City of Pacific Grove
• City of San Jose
• City of Capitola and
• City of Watsonville
Other local agencies have made the decision to continue hybrid meetings, such as the City of Monterey and agencies such as MST and TAMC.
FISCAL IMPACT AND FUNDING SOURCE:
There is no fiscal impact associated with this discussion item.
RECOMMENDATION:
The City Manager and City Attorney are requesting that the City Council discuss and provide direction whether Council wishes to:
1. Continue remote participation;
2. Discontinue it entirely; or
3. Generally, discontinue remote participation but allow it sometimes on an asneeded basis or only for emergency circumstances and just cause when Council members unexpectedly need to participate remotely.
