CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and Councilmembers
From: Becky Ramirez, City Clerk
Hilda Cantú Montoy, City Attorney
Subject: Public Hearing No. 3 to Present Draft Map Options to Rebalance the Population of the Current Council Districts

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That the City Council conduct a public hearing to: 1) receive a presentation from the City’s demographic consultant of draft map options to rebalance the population of the current Council districts and discuss potential revisions; and 2) to receive public input.

EXECUTIVE SUMMARY:

Every ten years, cities with by -district election systems must use new census data to review and, if needed, redraw district lines to reflect how local populations have changed. This process, called redistricting, ensures all districts have nearly equal population. The redistricting process for the City of Sanger must be completed by April 17, 2022.

BACKGROUND:

The City adopted its current district boundaries on June 21, 2012, based on 2010 census data as required by law. The districts must now be redrawn using the 2020 census data and in compliance with the FAIR MAPS Act (“Act”), which was adopted by the California legislature as AB 849 and took effect January 1, 2020.

Under the Act, the Council shall draw and adopt boundaries using the following criteria in the listed order of priority (Elections Code 21601(c)) for general law cities:

4 1. Comply with the federal requirements of equal population and the Voting Rights Act

2. Geographically contiguous

3. Undivided neighborhoods and “communities of interest” (socio -economic geographic areas that should be kept together)

4. Easily identifiable boundaries

5. Compact (do not bypass one group of people to get to a more distant group of people)

6. Shall not favor or discriminate against a political party

Once the prioritized criteria are met, other traditional districting principles can be considered, such as:

1. Minimize the number of voters delayed from voting in 2022 to 2024

2. Respect voters’ choices / continuity in office

3. Future population growth

By law, the City must hold at least four public hearings that enable community members to provide input on the drawing of district maps:

• At least one hearing must occur before the city or county draws draft maps • At least two hearings must happen after the drawing of draft maps • The fourth hearing can happen either before or after the drawing of draft maps • City or county staff or consultants may hold a public workshop instead of one of the required public redistricting hearings

To increase the accessibility of these hearings, cities and counties must take the following steps:

• At least one hearing must occur on a Saturday, Sunday, or after 6 pm on a weekday • If a redistricting hearing is consolidated with another local government meeting, the redistricting hearing portion must begin at a pre-designated time
• Local public redistricting hearings should be made accessible to people with disabilities

The Council conducted Public Hearing No. 1 on September 2, 2021, and Public Hearing No. 2 on October 7, 2021. The purpose of this Public Hearing No. 3 is to allow the City’s demographic consultant to present draft map options to rebalance the population of the current Council districts, and to discuss any potential revisions. Draft map options include two maps submitted by a member of the public and two options created by the City’s consultant. The draft maps are posted on the City’s website.

Next Steps

On March 3, 2022, the City Council will conduct Public Hearing #4 to discuss and select final map and to discuss and determine election sequence.

CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and City Council Members
From: Greg Tarascou, Fire Chief
Subject: Declaration of City Vehicles as Surplus Property Attachments: 1) Resolution and Attachment “A”

CONFLICT OF INTEREST:

None known

RECOMMENDATION:

That the City Council approve Resolution No. 2022-01 declaring certain property as surplus property and authorizing the City Purchasing Agent to dispose of said property.

EXECUTIVE SUMMARY:

The equipment and vehicles listed in Attachment “A” have reached their useful life and due to age, wear, and/or mechanical condition, are no longer functional for City use. Due to the condition of the equipment and vehicles, it would not be prudent to continue to expend City funds to make repairs and try to keep these items operational. Upon being declared surplus property, staff will coordinate the sale with a local auction company. The auction company will receive a percentage of the proceeds from the sale, with the remainder going to the City of Sanger’s General Fund. The Interim Director of Administrative Services (designated as the City Purchasing Agent) has been consulted and concurs with the recommendation to dispose of the vehicle.

BACKGROUND:

The City equipment and vehicles identified in Attachment “A,” has been evaluated and deemed to have reached its useful life to the city. For the Police Department vehicles, they would require extensive and costly repairs to keep the vehicles in safe, operable condition for use by City personnel. 6 \\nas1\shared\Forms & Templates

REASON FOR RECOMMENDATION:

Staff recommends the listed equipment and vehicles be decommissioned from the Fire and Police Department equipment cache and fleet and declared surplus property, through the established procedures and in accordance with the law. Pursuant to recent practices, City staff will coordinate with a local auction company to sell the surplus equipment and vehicles, with any proceeds going to the City General Fund.

FISCAL IMPACT:

Upon turning the equipment and vehicles over to the auction company, the City can expect to receive some proceeds from the sale of the equipment and vehicles at auction. The auction company will deduct a percentage of the proceeds for their work in selling and transferring the equipment and vehicles.

ALTERNATIVES:

If no action is taken, the equipment and vehicles will remain in the City’s fleet and stored.

ACTIONS FOLLOWING APPROVAL:

All preparations for transfer of the listed equipment and vehicles and surplus property will be made by staff.

7 RESOLUTION NO. 2022-01

A RESOLUTION OF THE CITY OF SANGER

DECLARING CERTAIN PROPERTY AS

SURPLUS AND AUTHORIZING THE SANGER

PURCHASING AGENT TO DISPOSE OF SAID PROPERTY

WHEREAS, the City of Sanger has accumulated various firefighting equipment and police vehicles which is no longer needed or in use for City purposes; and

WHEREAS, in that said property is no longer operable, or in use for City purposes, the City council is authorized to declare said property surplus and allow for its disposal; and

WHEREAS, said procedure is authorized pursuant to Sanger City Code Section 2-212 and Government Code Section 37350;

NOW THEREFORE, IT IS HEREBY RESOLVED, that the City Council of the City of Sanger, State of California:

1. The property listed in Attachment “A,” which is attached hereto and incorporated herein by reference, is hereby declared surplus and no longer needed for municipal purposes by the City of Sanger.

2. The City Council hereby authorizes the City’s Purchasing Agent to dispose of said property in the manner and form determined by law.

3. The Purchasing Agent is hereby authorized to take any necessary steps to accomplish this purpose under the guidelines set forth herein and the general law of the City.

Subject: Side Letter Agreement between the City of Sanger and t he I.U.O.E.

Stationary Local 39 regarding Salary Increase

Attachments: 1. Written Proposal from Local 39 Business Representative

2. Side Letter Agreement

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That the City Council approve the Side Letter Agreement between the City of Sanger (City) and the I.U.O.E. Stationary Local 39 (Local 39) implementing a 1% salary increase effective July 1, 2021, a

3.5% salary increase effective July 1, 2022, and an additional 3.5% salary increase effective July 1, 2023.

EXECUTIVE SUMMARY:

Pursuant to Article 19.3 of the Local 39 MOU, Local 39 representatives requested a change to the approved salary increases in their July 1, 2021 through June 20, 2024 MOU. Representatives of the City’s negotiating team and Local 39 representatives have tentatively agreed to the attached Side Letter Agreement amending Article 19.1 to implement a 1% salary increase effective July 1, 2021, a 3.5% salary increase effective July 1, 2022, an additional 3.5% salary increase effective July 1, 2023, and rescinding Article 19.2 regarding an Off-Schedule Pay Adjustment.

16 \\nas1\shared\Forms & Templates

BACKGROUND:

The City and Local 39 entered into an MOU effective July 1, 2021 through June 30, 2024 in which the parties agreed to a 2.5% salary increase effective July 1, 2021, an additional 2.5% salary increase effective July 1, 2022, and a 2.5% Off-Schedule Pay Adjustment effective July 1, 2023, contingent upon General Fund revenues received in FY 2021-2022 and FY 2022-2023.

A long-standing provision in the Local 39 MOU is Article 19.3, which states, “If a cost of living increase is given to any other group or association, Local 39 will receive that same increase during the term of their agreement if the increase given to any other group or association is not in exchange for an increase in an employee’s contribution to CalPERS.” This language is commonly known as a “me too” clause.

On November 18, 2021, the City and the Sanger Police Officers Association (SPOA) entered into an MOU effective July 1, 2021 through June 30, 2024, that implements a 3.5% salary increase effective July 1, 2021, a 3.5% salary increase effective July 1, 2022, and an additional 3.5% salary increase effective July 1, 2023. As such, pursuant to Article 19.3 of the Local 39 MOU, Local 39 submitted their request for similar increases.

REASON FOR RECOMMENDATION:

Article 19.3 of the Local 39 MOU provides that if an increase is given to any other group or association, Local 39 will receive the same increase during the term of their agreement.

FISCAL IMPACT:

Approximate cost:

Additional 1% salary increase effective 7/1/21 $14,000 Additional 1% salary increase effective 7/1/22 $14,700

3.5% salary increase effective 7/1/23 $54,022

ALTERNATIVES:

Not approve the Side Letter Agreement and provide further direction to Staff.

ACTIONS FOLLOWING APPROVAL:

CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and Councilmembers
From: Tim Chapa, City Manager, Director of Emergency Services Subject: Confirmation of Executive Order

Attachments: 1. Resolution 2022-02

2. Executive Order 21-05 – Mandate of Indoor Masking

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

Staff recommends that the Council adopt Resolution No. 2022-02 confirming Executive Order 21-05 issued by the Director of Emergency Services for the City of Sanger initiating a mandate of indoor masking for all public buildings within the City of Sanger.

EXECUTIVE SUMMARY:

In response to Federal, State and County official and health agency guidance, on behalf of the City of Sanger, the City Council for the City of Sanger declared a local State of Emergency on March 17,2020 due to the COVID-19 pandemic. As the City’s Director of Emergency Services, the City Manager has issued a total of 23 executive orders, with specific regulations and policies to protect the health and safety of the City of Sanger and its residents, workers, businesses and visitors. On August 6, 2020, the City Council directed that confirmation of executive orders be submitted to the City Council at its next regular meeting or at a special meeting. The proposed resolution is to confirm the latest executive order No. 22-05 issued on December 14, 2021.

BACKGROUND:

22 The novel coronavirus (COVID-19) has spread across the globe since the first cases were reported in January. The Center for Disease Control and Prevention stated that certain populations are at particular risk from COVID-19 and that widespread transmission would result in large numbers of people needing medical care at the same time, affecting our healthcare systems and other critical infrastructure. The World Health Organization (WHO) described the outbreak as a “public health emergency of international concern” on January 30, 2020. Since that time, the virus has spread from China to every continent but Antarctica.

In response, federal, state and local jurisdictions began to take action. On March 4, 2020, Go vernor Newsom declared a state of emergency to make additional resources available, formalize emergency actions already underway and help the State prepare for the broader spread of COVID-19. On March 14, 2020, Fresno County declared a state of emergency following the confirmation of two coronavirus cases.

On March 17, 2020, the City Council for the City of Sanger declared a local state of emergency setting in place the City Manager as the Director of Emergency Services to help establish local orders and to further address the health and safety of the Sanger community and its residents, workers and businesses.

On December 13, 2021 the Governor’s Office announced that an indoor mask mandate, regardless of vaccination status, for all Californians within public buildings will begin on December 15, 2021 and extend until January 15, 2022. This mandate was a result of t he increased case counts of the COVID - 19 virus since the Thanksgiving holiday, where positivity rates per capita in California have increased 47% and hospitalizations had increased by 14%. As a result, the Governor’s Office with the California Department of Public Health announced this indoor mask mandate to take effect on December 15, 2021.

REASON FOR RECOMMENDATION:

Under Section 26-6(a)(8)(a), the Sanger City Code authorizes the Director of Emergency Services to make and issue rules and regulations on matters reasonably related to the protection of life and liberty as affected by the local emergency. That section also requires that the City Council confirm any such rules and regulations within 7 days thereafter. Confirmation of this executive order will allow it to remain in effect until altered, changed or removed as needed based upon the changing direction from the State of California, the California Department of Public Health and/or the Fresno County Health Department. If denied, the City of Sanger will still be required to comply with State and County orders.

FISCAL IMPACT:

None.

ALTERNATIVES:

The Council may deny confirmation of the proposed Executive Order 21-05 or ask staff to revise the order.

ACTIONS FOLLOWING APPROVAL:

No additional actions will be needed if the City Council confirms the existing executive order.
