She would like to be added to a future agenda to explain their situation in detail. She also requested to meet with City staff.

Al Alvarado said that he has concerns that City personnel are not helping with their property situation. He is asking for right of way access to the home they are building that will be ready in July 2022. Councilmember Hurtado said that the City Council’s travel expenses are very well tracked. She said that she will gain experience at the conference to bring back to better the City.

Mayor Pro Tem Martinez said that each Councilmember has a travel budget of $4,000.

Karen asked if the travel amount is voted on, and that it is good practice to follow the budget amounts. She said that if the conference is for leadership, the best way to learn leadership skills is to work with community members to learn more.

City Attorney Hilda Montoy commented that as long as requirements are met, the travel is permissible, noting that the out of state travel will not exceed the budget line item.

Unidentified member of the public, via Zoom, said that he sees no reason why Councilmember Hurtado should not attend the out of state conference. He said that he supports her attending the conference to bring back information to the City, just as other Councilmembers have attended out of state travel conferences to Texas and Nevada.

The City Council by motion of Councilmember Hurtado and seconded by Councilmember Garza, authorized out of state travel for Councilmember Hurtado to attend the NALEO 39 th Annual

The 45 reported crimes represent the highest total for a single month this calendar year, although it should be noted the 32 reported crimes in June represent the lowest single-month total this calendar year.

SIGNIFICANT CALLS FOR SERVICE (July 2022)
• On S
aturday, July 2, 2022, at approximately 1:30 PM, a Sanger Reserve Officer made a vehicle stop at Jensen and Bethel for a seatbelt violation. The vehicle was driven by 17-year-old male. There was also a 17-year-old female passenger in the vehicle, who was later turned over to her mother. Upon contact, the Reserve Officer smelled the odor of marijuana coming from within the vehicle. The male was found to have two marijuana vape pens in his pocket. He was detained, and a search of his vehicle was conducted. The Officer located two pistols (One Glock “upper” on a ghost gun “lower” full size .40 cal and one sub-compact ghost gun/.40 cal). One pistol was under the driver's seat, and the other was in a red backpack behind the driver's seat. Both pistols had loaded magazines but nothing in the chamber. The male suspect also possessed mushrooms, pills, marijuana, and other marijuana paraphernalia for sale. Additionally, he had $459 in his possession. All the property and money were taken and booked as evidence. The vehicle was turned over to the suspect’s father at the scene. The suspect was transported to Sanger PD and booked.

60 • On Thursday, July 7, at approximately 9:15PM, Officers were initially dispatched to 731 Faller Avenue on a report of an injured person. Upon arrival they contacted a male subject with major burns to the upper portion of his body. He was conscious but only referenced that a female set him on fire at the Sanger City Park. The victim was immediately turned over to EMS and transported to CRMC.

Follow-up led to the identification of the two (2) suspects involved in this incident, their arrest, and a pending court case where both face attempted murder charges.

• On Monday, July 18, 2022, at approximately 12:30AM Officers were dispatched to Phat Al’s Bar on a report of a victim suffering from a gunshot wound. Upon arrival officers learned that a 28-year-old female had been driving northbound on Academy Avenue just south of Central Avenue (outside of the City limits) when she came upon a black colored sedan (possibly Toyota) stopped directly in front of her. When the female stopped her vehicle two young Hispanic males exited both the driver side and passenger side of the suspect vehicle, armed with unknown type(s) of handguns. The suspects ordered the female to exit her vehicle but she refused and as she sped away the unknown suspects fired approximately two rounds at her vehicle. One bullet struck the females trunk and another struck the top frame of the rear windshield, then ricocheted through the driver side head rest, and into the back of the victim’s head (possibly coming to rest behind her right ear). The victim was transported to CRMC for medical treatment and based on jurisdictional boundaries, the investigation was turned over to the Fresno Sheriff’s Office.

• On Friday, July 22, 2022, at approximately 5:30AM, a female victim (employee of AM/PM) was walking to her vehicle when she was attacked on the driver’s side of her vehicle. A possibly tall, thin younger white male took the victim’s keys and glasses during the attack and dropped them nearby after fleeing the scene. Prior to fleeing, the suspect forced the female into the driver’s side of her vehicle, but could not get her into the vehicle. The male then sexually assaulted her. The male then fled the scene northbound on Academy Ave. The female was insistent that she not be examined. Detectives were notified.

TRAFFIC ENFORCEMENT

• There was no fatal collision during this reporting period. There was a total of eleven (11) collisions, a decrease from eighteen (18) in the month of June. Nine (9) of the total collisions were non-injury. ARRESTS

• Officers made a total of seventy-five (75) arrests, twenty-nine (29) felony, forty- six (46) misdemeanor, including twelve (12) DUI & nine (9) Domestic Violence- related arrests.
61 ANIMAL CONTROL

Eleven (11) animals were reclaimed. There were two (2) reports involving dog bites during the month, and one (1) animal was euthanized (injured – run over by a truck).

COMMUNITY EVENTS

• Planning is underway for the years’ joint (with the Fire Dept) Open House, (10/8) and “National Night Out’ (9/18) in September and October this year.

• A Pop-Up Cop event was held at Blossom Commons Apartments.

• Follow-up meeting with the Sanger Ministerial Alliance. A date has been chosen (Oct. 9, 2022) and location (Greenwood Park) for the National Faith-in-Blue Weekend.

CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and City Council members
From: Greg Garner, Police Chief
Subject: Purchase of 10 Kenwood NX5200K2 Police radios Attachments: Vendor quotes (3)
Cooks Communication Invoice

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That the Sanger City Council:

1) Approve the purchase of 10 new Police Radios to outfit new hires, and replace some of our aging handheld radios.

2) Approve the expenditure of $ 11,116.71 from Measure “S” to complete this project as authorized by the Citizens Oversight Committee (COC) on August 4, 2022.

EXECUTIVE SUMMARY:

Our police officers rely on handheld radios to communicate with each other and dispatch. Our current Kenwood Radios are no longer being manufactured and have been replaced with the NX5200K2. This radio is a Public Safety Grade radio that meets the current and future needs of the Department. With our new hires, new positions, and progress we need to purchase more radios to keep pace with growth.

65 \\nas1\shared\Forms & Templates

BACKGROUND:

The Sanger Police Department needs to purchase more radios to keep pace with technology and hiring.

We have not purchased radios since 2017. In addition, the DOJ now requires all Police Transmissions to be encrypted. With the impending new dispatch center, we need to ensure our radios can meet that standard. These radios are P25 Capable so they can be upgraded when the time comes to meet that DOJ AES encryption (advanced encryption standard).

REASON FOR RECOMMENDATION:

The City received three written quotes for this procurement. We have selected Cooks Communications to supply the radios. They have the most competitive price, they work with all local law enforcement agencies, can program and maintain them as they have our programming files, and have them available. They have 10 in stock and with supply chain issues we wanted to secure the radios as soon as possible so t he purchase was made. Sanger PD just hired 4 officers and will be hiring at least 4 more in the coming months so it is critical that we secured the equipment so we could outfit our new officers immediately.

FISCAL IMPACT

The purchase price of these items and related accessories is $11,116.71. If approved, the funds used to implement this project will come from the Measure “S” Fund. Should the Council not approve the expenditure from the Measure S Fund, the cost will be absorbed by savings from the FY21/22 budget.

CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and Councilmembers
From: Joshua Johnson, Police Lieutenant
Subject: Approve Agreement with Regents of University of California Attachments: (1) Grant Agreement
(2) Resolution

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That the City Council adopt Resolution No. 2022-67 Approving Services Agreement with Regents of the University of California Relating to Statewide Animal Assistance Program.

EXECUTIVE SUMMARY:

The funds received from California for All Animals UC Davis Welcome Grant will expand the City of Sanger’s ability to care for impounded animals, assist with solutions in the field that will decrease owner surrenders or abandonments, and create a fund for waiving impound fees when owners agree to spay or neuter their pets upon reclaim. These funds will essentially increase our community’s animals in custody and owned animals the ability to access better care. Funding will allow the City to continue its efforts in reducing the number of dogs and cars that are euthanized and contribute to the state’s goal.

The City of Sanger has been awarded a grant amount of $5,000. In exchange, the City will provide the UC Davis Koret Shelter Medicine Program with annual data reports and surveys for the life of the program as detailed in the Services Agreement attached to the Resolution as Exhibit A. The City is already collecting historical data for quarterly reports and will not need additional staff to fulfill the requirements of this grant.

73 BACKGROUND:

In the FY 2020- 21 California State budget, Governor Newsom proposed $50 million in one -time General Fund dollars for the UC Davis Koret Shelter Medicine Program to develop a program that provides expertise, support, and local assistance grants for a five-year period to help local communities achieve the state’s policy goal that no adoptable or treatable dog or cat should be euthanized. With the assistance of CrisCom, the Police Department applied for the California for all Animals grant opportunity, and was awarded a Welcome Grant for the open Grant Proposal.

REASON FOR RECOMMENDATION:

These funds will be used to help offset costs associated with record keeping relating to the annual intake and outcome data required of the animal shelter.

FISCAL IMPACT:

The acceptance of the $5,000 will be added to the Annual Animal Control Budget of $9,600. Increasing the total Animal Control Budget to $14,600.

ACTIONS FOLLOWING APPROVAL:

Upon approval of the grant award the City will receive $5,000.

ALTERNATIVES:

If these funds are declined, the Animal Control Budget will remain at $9,600.

Subject: Property Acquisition – Wells 19 and 22

Attachments: 1. Resolution No. 2022-68

2. Resolution No. 2022-69

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 2022-68 and 2022-69, which:

1. Approve the Purchase and Sale Agreement s for real property from D.R. Horton CA3, Inc. and Surf Thru, Inc., respectively; and

2. Make findings as to General Plan consistency and public interest with respect to the propose d purchase of said re al prop erty for the purpose of construction of new city water wells, identified as No. 19 and 22, respectively; and

3. Authorize the City Manager to sign the Agreements on behalf of the City and open escrow for the sales.

EXECUTIVE SUMMARY:

BACKGROUND:

As the City Council is aware, Staff has been working on multiple f ronts to make improvements to the City water system. Wh ile some of thes e improvements include rehabilita tions and /or operational improvements at existing well si tes, two new well sites are proposed to increase t he total supply capacity of the water system. These two n ew sites are iden tified as Well No. 19, along Greenwood Avenue about ¼ mile south of North Avenue and Well No. 22, along Jensen Avenue just east of the Fowler Switch Canal Crossing. T hese identification numbers were established in the City of Sanger’s Water System Master Plan, adopt ed by the Sanger City C ouncil in 2004, when the proposed system improvements to support the build- out of the C ity sphere of influence were identified. Following the adoption of the recent 2035 General Plan U pdate, Staff began preparing updates to i ts Utility Ma ster Plans for water, sewer and storm drain infrastructure. T his effort is consistent with the General Plan which states on page 2-73 under Issue 11, “Infrastructure”:

“The City shall prepare an update to its water, sewer and storm drainage master plans in order to properly and efficiently serve future development provided for by the Land Use Element.”

While Well No. 22 is planned to be located in basically the exact same location as previo usly indicated, the location of Well N o. 19 has been shifted due east by a bout a quarter mile from the location depicted on the last adopted Master Plan. The reasons for this shift are:

1. The location planned previously has not yet been annexed into the City of Sanger;

2. No supporting infrastructure exists in this area at this time;

3. The updated location along Greenwood Avenue provides the ability to connect directly to an existing 12” water line that will provide capacity both to the existing City system as well as to the Tombstone Territory community upon completion of the State -funded water system improvements planned under that project;

4. The updated location provides access along a major collector street to be used by City staff and equipment an d material vendors servicing t he site, as well as to existing ele ctrical infrastructure owned and operated by PG&E;

5. The updated location fits within a planned subdivision, being undertaken by D.R. Horton home builders; and

6. Intended well locations with in planning documents are flexibl e based on future development patterns, and are more of a function of proper spacing from other well sites, connection to large diameter water mains and more detailed analysis on a project -by-project basis of hydrogeological conditions and suitability for the location of a production well. C ity staff and its consultants have analyzed the new location based on water system computer modeling, existing well logs, and available soil data and find that the loca tion appears suitable for a well site. Actual data will be collected thr ough the drilling and sampling of a test well an d further approvals will be needed following that phase of the project.

Bas
ed on the above, and based on the fact that the acquisition of land is a necessary component of a capital improvement project, Staff recommends that the C ouncil make the findings stated in each of the attached Resolutions that the proposed property purchases are c onsistent with the General Pla n.

Because it has been made clear that the expansion to the C ity’s water system is also critical for the City’s health, safety and growth, S taff also recommends that the C ouncil make the findings that the proposed property purchases are in the best interest of the City.

As mentioned, the property planned for Well 19 is currently owned by D.R. H orton CA3, Inc. (“D.R.

Horton”) and the property planned for Well 22 is currently owned by S urf Thru, Inc. (“Surf Thru”). 81 \\nas1\shared\Forms & Templates

City staff has ne gotiated the land purchases for both sites and the Sellers have signed the agreements.

The City will pay $100,000 for the property purchase from D.R. Horton and $254,030 for the property purchase from Surf Thru. If approved, the City Manager will sign th e agreements on behalf of the City and an escrow will be opened. Upon c lose of escrow, the C ity will take possession of the properties for its use.

Staff is currently soliciting bids for test wel ls at both sites and hopes to start construction on the tes t wells in October or November of this year, pending availability of contractors.

REASON FOR RECOMMENDATION:

The property is required and necessary for the construction of the planned water well i mprovements, which are in conformance to the Water Master Plan and General Plan of the City.

FISCAL IMPACT:

The costs for property purchase will be paid out of the City’s ARPA allocation.

ALTERNATIVES:

None recommended based on the extended timelines associated with land acquisition.

ACTIONS FOLLOWING APPROVAL:

The City Manager will sign the agreem ents, and escrow s will be opened. The City will deposit the amounts identified in the agreements into the escrow account s and the escrow s will close when all conditions are satisfied or waived and the Title Company is able to record the grant deeds conveying title or right of use from seller to the City. Once re corded, the City will receive copies of the deeds for the properties and will take possession of the properties for its use. 82 \\nas1\shared\Forms & Templates
