REPORT TO THE CITY COUNCIL
To: Mayor and Councilmembers
From: Becky Ramirez, City Clerk
Hilda Cantu Montoy, City Attomey
Subject: Remote City Council Meetings Under New Brown Act Requirements (AB 361) Attachments: Resolution Reauthorizing Remote Teleconference Meetings RECOMMENDATION:

If Council wishes to Continue with Remote Teleconference Meetings, Council needs to adopt the attached Resolution No.2022-65 Reauthorizing Remote Teleconference Public Meetings by the City Council and All Boards, Commissions, and Standing Committees of the City in Accordance with Assembly Bill36l.

EXECUTIVE SUMMARY:

On September 16, 2021, Governor Gavin Newsom signed AB 361 into law. AB 361 amends the Brown Act to allow for remote public meetings without having to comply with standard provisions and restrictions for remote meetings under the Brown. AB 361 temporarily writes into the Brown Act some remote meeting requirements the City has already met and implemented under the Governor's prior Executive Orders issued during the COVID-I9 pandemic. AB 361 includes additional requirements in the form of an initial authorizing resolution (effective for up to 30 days) and subsequent resolutions to extend the use of remote meetings for additional periods of 30 days thereafter. The bill included an urgency provision making the law immediately effective upon signature by the Governor.

At its December 16, 2021, meeting the Council adopted Resolution No. 2021-72 authorizing remote meetings in accordance with AB 361. If the City wishes to continue to utilize remote meetings under AB 361, the City will have to adopt a reauthorizing resolution such as that attached to this staff report.

FIRE DEPARTMENT REPORT FOR SEPTEMBER
To:

From
RE:

For the month of September, the Fire Department continued to remain busy both with the Fire Division and EMS Division. ln September there were 318 calls for service for ambulance services within our area and within surrounding areas. last year in September we ran a total of 285 medical-aid calls for service.

Crews were also dispatched to 53 requests for services for fire calls, including grass fires, building fires, vehicle fires and unintentional or false alarm calls. This total equates to 371 calls for all services in September, or just over 12 calls per day. Last year in September crews responded to 59 fire calls for service for the month.

Chute times are measured from the time the station is notified of an alarm to the time the unit goes enroute. For the month of September our chute time was measured at 59 seconds, well under our benchmark of 90 seconds. Our travel time is measured from the time the unit is enroute to the time that we arrive on scene. For September our enroute time was 6 minutes, 42 seconds within the City. ln September, the Fire Department joined the Police Department in hosting the National Night Out at Sanger Park. The event was a large success that showcased both public safety departments as well as other non-profit and community-based organizations. The Fire Department also participated in 9/11 memorial ceremonies at the VFW, Sanger High Schooland the California Memorial in Clovis. Lastly the Fire Department provided an ambulance standby at the football games at Tom Flores Stadium, held a monthly training day for our Fire Explorers and continued meeting with our allied partners on upcoming City events, including the Veterans and Holiday Parades, Farme/s Markets and the varies other holiday events in the month of December.

Purchase of New Police Vehicles
Price Quotes from Vendor
CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That City Council authorize the City Purchasing Agent to purchase two (2) new police vehicles for patrol purposes from Fahmey Automotive Group in Selma for a total cost of $106,456.28 from the Measure S Fund.

EXECUTIVE SUMMARY:

During the 2022-'23 budget development and approval, the Police Department allocated frrrds from the Measure "S" account to purchase these vehicles. This request was presented to the Measure S Citizens Oversight Committee. After hearing this matter, the Committee determined this expenditure was an appropriate use of Measure S Funds.

Section 2-214 of the Sanger City Code authorizes the Purchasing Agent to "participate in, and purchase supplies, materials, equipment and services under the authority of, any govemmentally-sponsored cooperative purchasing program. This process is commonly known as "piggybacking." Here, the City would be piggybacking on the state governmentally-sponsored cooperative purchasing program that it has with Fahrney Automotive meaning that Fahrney is offering the City the exact same pricing that it provides under the state procurement program.

53 The Police Department requires adding patrol vehicles to its aging fleet. As police cars age, maintenance and operation costs increase substantially. The extent of mechanical breakdowns becomes costly to repair. The Police Department seeks to add two additional patrol vehicles to the fleet, preventing higher mileage vehicles from being used regularly. Those higher mileage vehicles can be utilized when assigned cars are down for service or repair, extending the useful life of the aging vehicles in the fleet.

Adding the two new hybrid cars will reduce the overall maintenance and fuel costs.

The Police Department is seeking to add two Ford Police Interceptor SUV Hybrid police vehicles. The Ford SUV has served the department well and has proven to be a reliable and sturdy vehicle for police use. While Hybrid cars have a slightly higher purchase price, the savings in ongoing fuel costs are substantial. This request includes two marked police vehicles for patrol use. The cars for patrol use will be marked appropriately as emergency vehicles with the necessary equipment patrol equipment. The Police Department allocated funds for these purchases in the development of the 2022-'23 fiscal year budget and presented the proposed budget to the Measure S citizens oversight commiffee, which determined this expenditure was an appropriate use of Measure S funds.

BACKGROUND:

The Police Department is seeking to add police vehicles to the police fleet. The Ford Police Interceptor SUV has proven to be a reliable and effective vehicle for policing the community. With this purchase, the Police Department will be able to reassign police vehicles within the fleet, allowing the police department to extend the life of older, higher mileage vehicles. In the 2022-'23 fiscal year, the Police department proposed to purchase two police vehicles.

The Ford Motor Company notified dealers on August 29th thatthe close date to order2023 models was September 16m. Due to the limited time frame available for ordering, staff sought out quotes from dealerships we've worked with in the past. Fahmey Automotive Group in Selma responded and has piggybacked on the state govemmentally-sponsored cooperative purchasing progftlm and offering the same pricing. Additionally, because of the professional relationship staff created with the Fahrney Automotive Group, they agreed to pre- order the needed vehicles to meet the ordering deadline.

Due to the limited time frame to reserve vehicle orders for 2023, the govemmentally-sponsored purchasing program Fahmey adhered to, and the lack of timely response from other dealerships, staff identified Fahmey Automotive Group through the state procurement program.

It is vitally important that police department staff have good, safe, and reliable vehicles to perform their policing duties. This purchase furthers this effort and improves overall efficiency and effectiveness.

TOTAL CITY COSTS: s106.459.28
REASON FOR RECOMMENDATION:

The purchase of these vehicles will meet the Police Department's needs for emergency police vehicles for our first responders. During the 2022:23 budget development and approval, the Police Department allocated fimds from the Measure "S" account to purchase these vehicles. This request was presented to 54 the Measure S Citizens Oversight Committee. After hearing this matter, the Committee determined this expenditure was an appropriate use of Measure S Funds.

The department chose Fahrney Automotive Group in Selma, CA, which matched state contract pricing to obtain the lowest price possible, and could pre-order 2023 models without a signed Purchase Order.

FISCAL IMPACT:

The cost to purchase the two new police vehicles is $ 1 06,459.28. The firnds to procure these police vehicles will come from the Measure "S" Fund.

ALTERNATIVES:

The City Council could deny the request to procure this equipment or deny the request to use Measure S Funds to make the purchase, in which case an altemative funding source would be required.

ACTIONS FOLLOWING APPROVAL:

Amended Firefighter I Joblescription
CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That the City Council adopt Resolution No.2o aZ. - f a approving the amended job description for the Firefighter I position.

SUMMARY:

The City currently has vacancies at the position of firefighter. Prior to opening a recruitment, labor and management met to discuss the current job description and minimum requirements, most notably the physical agility test. The City is proposing that instead of an in-house physical agility test to have candidates obtain a certificate of completion from the Candidate Physical Ability Test (CPAT) procedure prior to the time of hire. The CPAT is the recognized standard for measuring an individual's ability to handle the physical demands of a firefighter.

BACKGROUND:

The current in-house physical agility test is a continuous evolution that has several "stations" where a candidate performs a physical skill that mirrors those skills on the fireground. For example, there is a Prepared by: Becky Padron, City Clerk/Deputy Personnel Approved by:

This time is measured and the candidate is assigned points based off of their particular time which is factored into their overall testing procedure.

The current standard in the Central Valley is to utilize the CPAT physical testing as certification of a firefighter candidate's ability to perform the strenuous work of a firefighter. This certificate can be obtained at a firefighting testing center and is valid for one year from the date of issuance. It is proposed that in the job description, candidates must have their card of completion from the CPAT center before their letter of appointment for the position of firefighter.

City representatives met with representatives of the Sanger Firefighters Association and they have agreed to the changes to the job description.

REASON FOR RECOMMENDATION:

This testing procedure is a valid, certified industry standard to measure the physical aptitude of a firefiglrter candidate. The City currently uses an in-house testing procedure that is a similar program but is not certified or validated.

FISCAL IMPACT:

None. There are no recommended changes to the salary and benefits for the position.

64 BACKGROUND:

The City is working on a required Zoning District Amendment to update the zoning map for consistency with the 2035 General Plan update, adopted in2020.

Sanger City Code Section 90-994 requires the City to notice "all persons, including businesses, corporations, or other public or private entities, whose names and addresses appear on the latest equalized assesstnettt roll as owuitrg real property within the territory covered by such proposed change, and within 300 feet of the outer boundaries thereof." This requirement is intended to ensure that any nearby property owners are aware of any proposed change in the zoning. Therefore, under the current Code, the City would have to mail notices to all properties within the City. The Code requires the City to meet these noticing requirements without exception, which is unusual because many cities include an exemption for zoning amendments that would otherwise be required to notice an inordinate quantity of property owners.

Typically, an exemption would require the City to take out an advertisement in the local newspaper broadcasting the public hearing notice for the amendment at the expense of the applicant, for any project which would otherwise be required to notice a specific number of property owners. The number of notices required to trigger the exemption is often a function of the population of the City.

The proposedZoning Ordinance Amendment has been initiated by staff to amend the Zoning Ordinance Section 90-994 to streamline the noticing requirements process by adding an exemption for projects that would otherwise require three hundred (300) or more notices. This limit represents roughly 3o/o of households and/or businesses in Sanger, and also stands as a reasonable limit for the number of individual notices sent based on the staff time needed to generate and transmit those notices.

Changes in text are shown in bold, see below the text amendment as proposed:
"(c) Notices of hearings
(1) For the purposes of this section, any amendment to the provisions of this chapter which is for the purpose of changing particular property from one zoning district to another, or changing the boundary of any particular zoning district, shall be referred to as a "change of zoning district amendment," and all other amendments to the provisions of this chapter shall be referred to as a "general amendment."
(2) Notice of the time and place of any public hearing on the matter of any general amendment shall be given by the director by at least one publication in a newspaper of general circulation, published and circulated in the city, not less than ten calendar days prior to such hearing and by such other means as the director may deem necessary or desirable. The notice shall contain a general explanation of the matter to be considered and a general description of the area or areas affected by the general amendment.
(3) Notices of changes of zoning district amendments.

Notice of the time and place of any public hearing on the matter of a change of zoning district amendment shall be given by the director by mailing in the United States mail a written notice thereof, not less than ten calendar days prior to such hearing, to all persons, including businesses, co{porations or other public or private entities, whose names and addresses appear on the latest equalized assessment roll as owning real property within the territory covered by such proposed change and within 300 feet of the outer boundaries thereof. If the number of properties to be noticed under this requirement exceeds three hundred (300), 65 the City of Sangern in lieu of a notice that is mailed or delivered as described immediately above, may provide written notice to the property owner, and (i) provide a notice by placing a display notice of at least one-eighth page in at least one newspaper of general circulation at least ten (10) calendar days prior to such a hearing and (ii) provide notice by posting a notice of the public hearing notice on the City's website. The notice shall contain a general explanation of the matter to be considered and ageneral description of the area affected by the change of zoning district amendment." A review of existing planning applications indicated that this change in noticing requirements would be rclcvant for the City-wide rezone project which has been undeftaken to update the zoning map for consistency with the 2035 General Plan update, adopted in2020.

EXECUTIVE SUMMARY:

The attached resolution will initiate the proceedings for the annexation of the development project known as Phase 1 of Vesting Tentative Tract Map No. 5826 (the "Project") into Community Facilities District ("CFD") 2005-1. The conditions of approval for the Project require it to annex into CFD 2005-1, which was established as an annexable district to provide funding to offset the increased cost for public safety and open space and parks maintenance created by new development.

81 BACKGROUND:

On July 7,2005, by Resolution No. 3758, the City Council established CFD 2005-1, a Mello Roos Community Facilities District with the intention that future development within the City would annex into this District. The special taxes collected from the property owners within the District are collected and used pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982", being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of Califomia, as amended (the "Act") to provide funding to offset the increased cost for public safety and open space and parks maintenance created by new development, specifically listed as fbllows:
(a) fire protection and suppression services;
(b) emergency medical services including ambulatory services; (c) community information with regard to public safety; (d) earthquake and other emergency relief programs;
(e) other public safety services, including police protection services, authorized to be funded under Section 53313(a) or (b) of the Act;
(f) park operation and maintenance expenses;
(g) repair and replacement of park facilities;
(h) direct and indirect expenses incurred by the City in carrying out its duties with respect to the District, including the costs incurred by the City and or County in formation of the district, annexation and annual contract administration.

Property owner assessments are paid as a component of the property tax collection process. As was originally envisioned with the establishment of the CFD, future residential projects not included in the initial formation process are required to go through an annexation process in order to be included in CFD 2005-01. Projects may be annexed one at a time, or in a group if they are ready at the same time.

The subdivision known as Phase I of Vesting Tentative Tract Map No. 5826 makes up Annexation No. 3 and is owned by D.R. Horton CA3, Inc. The Project includes the development of 7l single family residential units located at the southwest corner of North and Greenwood Avenues. The boundaries of the Project consist of the area within assessor's parcel number 332-090-21 as depicted on Attachment A to the Resolution. As with all residential subdivisions, conditions of approval for the subdivision require annexation into CFD 2005-01 prior to recordation of the final subdivision map.

Adoption of the resolution represents the first steps that must be taken in the annexation process and also establishes December 15,2022 as the public hearing date for the hnal consideration of the annexation of the property into CFD 2005-1.

REASON FOR RECOMMENDATION:

The CFD 2005-1 assessment is utilized to offset the costs of public safety and open space and parks maintenance created by new development. As development occurs in Sanger, annexing the property to the CFD will help ensure that the City can continue to provide these services. Annexation is also a necessary component to allow for the development of 71 new single-family residences, as conditioned upon the tentative map.

FISCAL IMPACT:

The 2022123 Fiscal Year CFD 2005-l assessment for single family residential development is approximately $594.24 per dwelling unit. Based on this figure, the estimated annual revenue that will be 01236.0t051768780.1
82 received by the City for all TI units will be $42,191.04. Because CFD 2005-1 includes an annual CPI adjustment, this amount will grow over time. The process for annexation is funded by the developer and no General Fund monies are used for this effort.

ALTERNATIVES:

One altemative would be to deny the application and not annex the property into CFD 2005-1. In this case, the Council should also provide direction whether or not it intends to relieve the Applicant of condition of approval No. 52 for Vesting Tentative Tract Map No. 5826, which requires the annexation in order to approve the Final Map.

ACTIONS FOLLOWING APPROVAL:

Staffanticipates that the City Clerk will file the diagram and assessment with the Fresno County Auditor- Controller concurrently with the recording of the final map. 01236.0t05/768780.1

That the City Council approve Resolution No2g:tr!5 a Resolution Initiating Proceedings Pursuant to the Landscaping and Lighting Act of 1972 for the Annexation of Property into Sanger Landscaping and Lighting Maintenance District No. 2, Area 1, to Review the Improvements and Assessments for Fiscal Year 2022-2023, and to Set a Public Hearing for a Future Date.

EXECUTIVE SUMMARY:

The City of Sanger has two established Landscaping and Lighting Maintenance Districts to maintain City parks, landscaped areas, block walls, and streetlight operation and maintenance. Sanger Landscaping and Lighting Maintenance District No. 2 ("LLMD No. 2") was established in 2004 to cover the cost of maintaining all streetlights, landscaping, and irrigation systems within the LLMD No. 2 City public right- of-way, and to cover the cost of maintaining special amenities located within the LLMD No. 2 City public right-of-way or easements, including, but not limited to, maintaining masonry walls, storm water holding Prepared by: Approved by:

99 ponds, and roundabouts. Approval of the proposed Resolution will start the process to allow annexation of the lots in a new residential subdivision into LLMD No. 2 being developed by D.R. Horton CA3, Inc. ("Applicant").

BACKGROUND:

The Landscaping and Lighting Act of 1972, California Streets and Highways Code Section 22500 et. seq. was designed to allow local governments the ability to collect assessments to defray the cost of maintaining street lighting, and landscaped areas within the public right-of-way. These costs were recognized as costs, which directly benefit property owners by increasing the value of their property.

Adequate street lighting increases safety and decreases crime. Well-kept landscaped areas enhance the quality of life in neighborhoods and directly affect the marketability and value of property.

Applicant is currently seeking to develop 7l-lot subdivision located southwest of North Avenue and Greenwood Avenue as part of Phase 1 of Vesting Tentative Tract Map No. 5826 ("Property"). The Applicant has submitted a final map for Phase I of Tract 5826 for approval by the City Council, which will be considered by the City Council as part of a subsequent Agenda item at this meeting. A condition of approval for Tract 5826 requires that the lots in Tract 5826 annex into LLMD No. 2. Consistent with that requirement, the Applicant has submitted a petition and waiver to the City, requesting annexation into LLMD No. 2 and agreeing to the initial assessment amount of $l 16.00 per for the fiscal year. Thereafter, the property would be subject to the annual levy amounts approved by Council for LLMD No. 2 for each f,rscal year.

The Applicant has also (i) waived certain resolutions, report, notices of hearing, and right of majority protest, and consented to a public hearing and adoption of a Resolution by the City Council ordering annexation and levy of the Property; and (ii) expressly waived any requirement to have a ballot and majority protest proceeding per Government Code Section 53753 or as may be permitted by the Act.

As a result of this waiver, the annexation process can be expedited as no report by the City Engineer is required to be prepared and filed with the City Clerk, nor is a ballot and majority protest required.

The attached Resolution initiates the proceedings for Annexation of the Property in Sanger Landscaping and Lighting Maintenance District No. 2, Area 1, and sets a public hearing date for the proposed annexation and levy for December 15, 2022.

Approving the Resolution does not annex the Property implement the assessment; it only starts the process and allows for further discussion. The Council will make a final decision on this matter at the December 15, 2022 hearing.

REASON FOR RECOMMENDATION:

The LLMD No. 2 assessment is utilized to offset the costs of streetlight and right of way maintenance and operations within the established LLMD No. 2 area. Street lighting and well-maintained landscaping increases safety and the quality of life and directly affects the actual property values of homes and businesses located in the City of Sanger. As new development occurs in Sanger, annexing the property to LLMD No. 2 will help ensure that property is maintained. Annexation is also a necessary component to allow for the development of 7l new single-family residences, and to help assist with the City's housing stock.
0 1236.0 I 0s/768780.1
100
FISCAL IMPACT:

Each lot that is annexed will pay the current rate of $1 16.00 for the Fiscal Year, or $8,236 total for all 7l proposed lots. Thereafter, the City Council will approve assessment amounts for Area 1 of LLMD No. 2, which may be adjusted to reflect increases based on the consumer price index.

ALTERNATIVES:

One altemative would be to deny the application and not annex the property into LLMD No. 2. In this case, the Council should also provide direction whether or not it intends to relieve the Applicant of condition of approval No. 51 for Vesting Tentative Tract Map No. 5826, which requires the annexation in order to approve the Final Map.

ACTIONS FOLLOWING APPROVAL:

Staffanticipates that the City Clerk will file the diagram and assessment with the Fresno County Auditor- Controller concurrently with the recording of the final map. 0 1236.01 0s/768780. l
