SIGNIFICANT CALLS FOR SERVICE (Sept 2022)
• On Tuesday,
November 15, 2022, at approximately 5pm, Officers responded to the11000 Block of North Ave to assist Fresno County Sheriff’s Office personnel regarding an assault with a deadly weapon call. Sanger PD units assisted FSO units and contacted the female suspect. The female was uncooperative and began walking away. An FSO deputy used “less-lethal” bean bag rounds several times however, she continued to walk away and got into a parked vehicle. Once in the vehicle she doused herself with an unknown liquid. The female then got out of the vehicle and complied with the officer/deputy orders. A Sanger officer and a Deputy handcuffed the female and the officers were exposed to a strong chemical.
It was later learned that the female had doused herself with ammonia. The Sanger officer and the Deputy were later transported to the hospital for treatment. Neither were injured.
• On Tuesday,
November 21, 2022, at approximately 10pm, a Sanger officer was patrolling the 900 block of “L” Street when he noticed a red van parked at the S/E corner of 10
th and L Street. As the officer drove by the van, he conducted a record check on the plate using his in-car computer. The van had one working head light and was occupied by an unknown driver. The officer conducted a U-turn to check on the van due to non-working head lamp, he heard a commotion coming from the front of the apartment complex. The officer drove towards the apartment and located a male in his 40’s laying on his back. During that time, the officer observed a male wearing a red sweater running toward and entering into the van.
The van was last seen traveling southbound K Street from 10 th Street. The officer
F-3
54 checked the male on the ground and noticed a kitchen knife penetrated in the left side of his lower abdomen. Sanger EMS arrived on scene. The male was later identified and transported to CRMC. The knife was later removed from the male’s body and his medical condition was listed as stable.
While canvassing the scene detectives located a blood trail that led from where the victim was laying towards the direction of where the van was parked.
Detectives later interviewed the victim, who disclosed that he was inside of his apartment when a male entered the apartment and a physical fight ensued. During the altercation the male (suspect) retrieved a kitchen knife and the fight continued outside in front of the apartment. The victim lost his balance and fell to the ground and was stabbed by the male. The victim is not from Sanger and the incident does not appear to be gang related at this time.
• On November 26, 2022, at approximately 11:30pm, Officers were dispatched to the 100 block of Cottle Avenue regarding a shooting that had just occurred.
Officers interviewed the reporting party and determined a silver vehicle (2 door convertible) was driving behind the victim on Greenwood Avenue, just south of Cherry Avenue. As the victim came to a stop on Greenwood Avenue at Cherry Avenue, the suspect vehicle pulled up beside his driver’s side, on the opposite lane, and the passenger of the vehicle tried getting the victim’s attention. The suspect vehicle drove off, westbound Cherry Avenue, and the front passenger stuck his body out of the window, shooting several rounds into the driver’s side door of the victim’s vehicle. Officers confirmed the victim’s vehicle was struck three times and recovered three (3) 9 MM shell casings at the scene of the shooting. No suspect leads were developed during officers’ initial investigation.
City surveillance camera footage found that the suspect vehicle was a silver coupe with a black convertible top. The investigation is on-going.

Ten (10) of the total collisions were non-injury. There were four (4) collisions involving injury, and two (2) involving DUI. 154 traffic citations were issued in November, with 93 moving violations and 61 non-moving violations.

CITY OF SANGER
REPORT TO THE CITY COUNCIL
To: Mayor and Council members
From: Greg Tarascou, Fire Chief
Subject: Contract for Services with Grant Mercantile Agency Attachments: Professional Services Agreement
Business Associate Agreement
CONFLICT OF INTEREST:
None known.
RECOMMENDATION:
That the City Council approve the contract for Professional Services and related Business Associate Agreement with Grant Mercantile Agency (GMA) , authorize the City Manager to sign the contract on behalf of the City; and authorize the Fire Chief to sign the Business Associate Agreement.
EXECUTIVE SUMMARY:
In the normal course of business, the City utilizes Grant Mercantile Agency for its bad debt collection services, most notably with utility services. The proposed contract with GMA extends this service to ambulance billing, where services that remain unpaid and that are allowable to be sent to collections are sent after all avenues for payment for services rendered have been exhausted by the City.
BACKGROUND:
The Fire Department currently performs in -house ambulance billing for services that are delivered to patients in the field. Much like going to a doctor’s office or a clinic, the Fire Department bills the patient’s insurance as a courtesy for ambulance services rendered. Depending on the patient’s particular insurances, the bill is either paid in full after being adjusted by the insurance company, or there is a 58 \\nas1\shared\Forms & Templates
balanc
e owed by the patient. This balance can be a result of a deductible that is passed down to the Fire Department for collection, or an uncovered insurance benefit that is owed by the patient. Fire Department staff utilize several mechanisms for collection of this unpaid debt, including sending invoices, searching available insurance benefits, guiding patients on how to apply for emergency insurance, and finally setting up reasonable payment plans. However, despite these services there are still accounts that remain unpaid and need to move to a collection service for potential reconciliation.
REASON FOR RECOMMENDATION:
The City currently utilizes Grant Mercantile Agency for collection services, so migration of these accounts will be seamless. Additionally, GMA has expanded their service to include ambulance and medical-related collection services so they are familiar with this type of program.
FISCAL IMPACT:
This impact would be difficult to assess as patient insurances and benefit opportunities can be variable year to year. Unfortunately, the yearly amount of bad debt owed by non-payment can represent approximately 25% of our payor mix. For context, in calendar year 2021 there were 463 open accounts that were unpaid, representing approximately $339,587 of unpaid debt. This would be the primary responsibility of the collection agency to recover this debt. Lastly, it is important to note that this is not uncommon in ambulance or medical billing as every medical provider struggles with attempting to recover this bad debt.
ALTERNATIVES:
Do not accept the contract in which case the City will continue to seek alternative sources of increased revenues.
ACTIONS FOLLOWING APPROVAL:
The City Manager will sign the documents on behalf of the City.

RECOMMENDATION:
That City Council adopt a Side Letter Agreement between the City of Sanger and the Sanger Police Officers’ Association (SPOA) regarding a language change to the position title of Police Lieutenant and the assignment of Watch Commander.
EXECUTIVE SUMMARY:
Authorized representatives of the City and the Association have met and consulted to discuss a proposed permanent title change for the position (rank) of “Police Lieutenant” to “Police Commander” and change in term of “Watch Commander” to “Shift Supervisor”. The parties agreed to the changes and as such, found it necessary to make modifications to the MOU. Currently the Sanger Police Department Policy Manual references the position of Police “Lieutenant” as a “Division Commander” and the assignment of “Shift Supervisor” as “Watch Commander.” The inconsistency in terms creates issues when dealing with other agencies, when authorizing training based on position title, and in the preparation of documents were both the Police “Lieutenant” position is referenced with the assignment of Watch “Commander.” Currently, the Sanger Police Department Policy Manual refers to assignments held by the current “Police Lieutenant” position as “Division Commanders,” and the 74 \\nas1\shared\Forms & Templates
assig
nment of “Watch Comman der” is associated with the ranks of “Police Sergeant” or “Police Corporal.” As the position of “Commander” is a higher “rank” than “Lieutenant,” the designations of Sergeants and Corporals as “Watch Commanders” is incorrect, and can be confusing. This is also the case when assigning staff to Executive Level training courses, usually comprised of attendees holding the rank of “Commander” or higher.
Adopting the Side Letter of Agreement changing the position of Police “Lie utenant” to Police “Commander,” and changing the designation of Watch “Commander” to “Shift Supervisor” in the current Memorandum of Understanding (MOU) will eliminate any potential confusion, and standardize the designations with those of other allied agencies that have adopted this langua ge (Reedley and Selma Police Departments). The language changes will have no impact of any other provisions of the current Memorandum of Understanding, including all references to salary or other outlined benefits.
BACKGROUND:
The Sanger Police Department is constantly looking for ways to improve its methods of operations and conform to the standards of the industry. Adopting the aforementioned language changes to the MOU will continue that effort, without impacting any other MOU provision.
REASON FOR RECOMMENDATION:
Add a s tandardization of language to the current MOU with the SPOA with reference to the position/assignment of “Commander” within the Sanger Policy Department.
FISCAL IMPACT:
None.
ALTERNATIVES:
None.
ACTIONS FOLLOWING APPROVAL:
Adoption of the Side Letter.

EXECUTIVE SUMMARY:
On October 20,2022, the City Council adopted Resolution No. 2022-84 stating its intention to annex certain territory into City of Sanger Community Facilities District 2005-l (public services), setting a time and datc for thc public hcaring thcrcon (Dcccmbcr 15, 2022) and adopting boundary map showing territory proposed to be annexed to Community Facilities District 2005-l (Annexation No. 3).
At tonight's meeting, after the close of the public hearing, the Council has two resolutions to consider and an annexation election. The hrst resolution sets forth the Council's approval to annex tenitory to CFD 2005-1 and to levy a special tax and calls for an election. The second resolution is for adoption by the Council after the results of the election are announced by the City Clerk. This resolution also directs the filing of the Notice of Special Tax Lien against the annexed property to provide authority for City to collect the special tax.
BACKGROUND:
On July 7,2005, by Resolution No. 3758, the City Council established CFD 2005-1, a Mello Roos Community Facilities District with the intention that future development within the City would annex into this District. The special taxes collected from the property owners within the District are collected and used pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982", being Chapter 2.5,Part 1, Division 2,Title 5 of the Government Code of the State of Califomia, as amended (the "Act") to provide funding to offset the increased cost for public safety and open space and parks maintenance created by new development, specifically listed as follows:
(a)
(b)
(c)
(d)
(e)
fire protection and suppression services;
emergency medical services including ambulatory services; community information with regard to public safety;
earthquake and other emergency relief programs;
other public safety services, including police protection services, authorized to be funded under Section 53313(a) or (b) of the Act;
park operation and maintenance expenses;
repair and replacement of park facilities;
direct and indirect expenses incurred by the City in carrying out its duties with respect to the District, including the costs incurred by the City and or County in formation of the district, annexation and annual contract administration. (0
(e)
(h)
Property owner assessments are paid as a component of the property tax collection process. As was originally envisioned with the establishment of the CFD, future residential projects not included in the initial formation process are required to go through an annsxation process in order to be included in CFD 2005-01. Projects may be annexed one at a time, or in a group if they are ready at the same time.
The subdivision known as Phase I of Tract Map No. 5826 makes up Annexation No. 3 and is owned by D.R. Horton CA3, Inc. The Project includes the development of 71 single family residential units located at the southwest corner of North and Greenwood Avenues. The boundaries of the Project consist of the area within assessor's parcel number 332-090-21as depicted on Attachment A to the Resolution. As with all residential subdivisions, conditions of approval for the subdivision require annexation into CFD 2005- 85 01 prior to recordation of the final subdivision map.
REASON FOR RECOMMENDATION:
The CFD 2005-l assessment is utilized to offset the costs of public safety and open space and parks maintenance created by new development. As development occurs in Sanger, annexing the property to the CFD will help ensure that the City can continue to provide these services. Annexation is also a necessary component to allow for the development of 7l new single-family residences, as conditioned upon the tentative map.
FISCAL IMPACT:
The 2022123 Fiscal Year CFD 2005-l assessment for single family residential development is approximately $594.24 per dwelling unit. Based on this figure, the estimated annual revenue that will be received by the City for all Tl units will be $42,191.04. Because CFD 2005-l includes an annual CPI adjustment, this amount will grow over time. The process for annexation is funded by the developer and no General Fund monies are used for this effort.
ALTERNATIVES:
One alternative would be to deny the application and not annex the property into CFD 2005-1. That would result in the inability to record the final Map and for the Applicant to complete the Project. In this case, the Council should also provide direction whether or not it intends to relieve the Applicant of condition of approval No. 52 for Vesting Tentative Tract Map No. 5826, which requires the annexation in order to approve the Final Map.
ACTIONS FOLLOWING APPROVAL:
Staff anticipates that the City Clerk will file the diagram and assessment with the Fresno County Auditor- Controller concurrently with the recording of the final map. 86 RESOLUTION NO. 2022-T06

T
his public hearing is for the purpose of annexing property in Phase I of Tract 5826 to LLMD No. 2 per the Diagram attached to the proposed resolution. On October 20, 2022, the City Council i nitiated the process for an nexation with the adoption of Resolution No. 2022-85 and setting of a public hearin g for December 15, 2022. year. G
oing forward, the a nnexed property will be subject to the annual levy approved by the City Council every year for all property within LLM D No. 2, Ar ea 1. Approval of the proposed Resolution will conclude the process by annexing the lots of a new residential subdivision into LLMD No. 2 being developed by D.R. Horton CA3, Inc. (“Applicant”) and setting a levy at the same rate as other properties in LLMD No. 2, Area 1.
B
ACKGROUND:
Th
e Landscaping and Lighting Act of 1972, California Streets and Highways Code Section 22500 et. seq. was designed to allow local governments the ability to collect assessments to defray the cost of maintaining street lighting, and landscaped areas within the public right -of-way. T hese costs were recognized as costs, wh ich direct ly benefit prope rty o wners by increasing the value of their proper ty.
Adequate street lighting increases safety and decreases crime. Well -kept landscaped areas enhance the quality of life in neighborhoods and directly affect the marketability and value of property.
Th
e City of Sanger has two established Landsca ping and Lighting Maintenance Districts to maintain City parks, landscaped areas, block walls, and streetlight operation and maintenance. Sanger Landscaping and Lighting Maintenance District No. 2 (“ LLMD No. 2”) was established in 2004 to cover the cost o f maintaining all streetlights, landscaping, and irrigation systems within the LLMD No. 2 City public right- of-way, and to cover the cost of maintaining special amenities located within the LLMD No. 2 City public right-of-way or easements, including, but not limited to, maintaining maso nry walls, storm water holding ponds, and roundabouts.
A
pplicant is currently seekin g to devel op a 71- lot subdivi sion l ocated southeast of North Avenue and Greenwood Avenue as part of P hase 1 of Vesting Tentative Tract Map No. 5826 (“P roperty”). The Applicant submitted a Final map for Phase 1 of Tract 5826 for approval by the City Council, whic h was approved on November 3, 2022. on A condition of approval for Tract 5826 requires that the lots in Tract 5826 annex into LLMD No. 2. Co nsistent with that requirement , the Applicant has submitted a petition and waiver to the City, requesting an nexation into LLMD No. 2 and agreeing to the initial assessment amount of $116.00 pe r for the fiscal year. Thereafter, the property would be subje ct to the annual levy amounts approved by Council for LLMD No. 2 for each fiscal year.
Th
e A pplicant has also (i) waived certain resolutions, report, notices of hearing, and right of majority protest, and consent ed to a public hearing and adoption of a Re solution by the City Council or dering annexation and levy of the Proper ty; a nd (ii) e xpressly waived any requi rement to have a ballot and majority protest proceeding per Government Code Section 53753 or as may be permitted by the Act.
As a result of this w aiver, the annexation process can be expedited as no report by the City Engi neer is required to be prepared, nor is a ballot and majority protest required. ..
RE
ASON FOR RECOMMENDATION:
Th
e LLMD No. 2 assessment is utilized to offset the costs of streetlight and right of way maintenance and operations within the established LLMD No. 2 area. Street lighting and well-maintained landscaping increases safety and the q uality of life and directly aff ects the actua l property values of home s and businesses located in the City of Sanger. As new development occurs in Sanger, annexation of the property to LLMD No. 2 will help ensure that property is maintained. Annexation is also a necessary 111
01236.0105/769318.1
componen
t to allow for the development of 71 new single-family residences, and to help assist with the City’s housing stock.
F
ISCAL IMPACT:
E
ach lot that is annexed will pay the current rate of $116 for the Fiscal Year, or $8,236. T hereafter, the City Council will approve assessment amounts for Area 1 of LLMD No. 2, which may be adjusted to reflect increases based on the consumer price index.
AL
TERNATIVES:
O
ne alternative would be to deny the application and not annex the property i nto LLMD No. 2. T hat would result in the inability to record the final Map and for the Applicant to complete the Project.
ACT
IONS FOLLOWING APPROVAL:
S
taff will prepare the necessary documents to notify the public of the hearing. 112

E
XECUTIVE SUMMARY:
T
he City Council considered this item at the December 1, 2022 City Council meeting. T he City Council did not take action. Instead, it requested staff provide the date of approval of the projects funded under the $800,000 from the FY 2021-2022 Budget. Staff has attached Resolution No. 2022-23, approved March 17, 2022.
T
he City Council allocated $100,000 to fund a Facade Improvement Program with the intent of enhancing the appearance of downtown. Following City Council approval of the program, the City Council then directed staff to request a recommendation from the Planning Commission for on Design Standards and Guidelines for the downtown. Staff introduced the City Council request to the Planning Commission at the September 22, 2022, Planning Commission meeting. The Planning Commission, at their October 27, 2022 meeting, 130
recommended the City Council move forward with implementation of the Facade Improvement Program and that the City Council not entertain redirection of the allocated funds to development/ revision of Design Standards and Guidelines.
BACKGROUND:
P
revious Program through Sanger Redevelopment Agency:
The Sanger Redevelopment Agency previously administered a Facade Improvement Program. The program ended with the dissolution of the Sanger Redevelopment Agency.
T
he Sanger Redevelopment Agency Facade Improvement Program was created in 1997. The program was developed to enhance the appearance of downtown. The program provided five-year, no interest loans of up to $10,000 to qualified businesses located in the downtown. From 1997 to 2001, the Facade Improvement Loan Program awarded six (6) loans totaling $60,000.
The Sanger Redevelopment Agency Facade Improvement Program was modified in 2001. The allowable project area was expanded to include Academy Avenue, the maximum loan amount was increased from $10,000 to $15,000, and the program was changed to provide combination loan/grant. Up to 50% grant of the maximum $15,000 could be provided as a grant ($7,500 grant and $7,500 loan).
Program Funded in 2022:
The City Council has allocated $100,000 to fund a Facade Improvement Program. The program is intended to enhance the appearance of downtown. The matching grant program is limited to $10,000 for street side exterior improvements for projects located within the Central Commercial District. Property owners would be required to repay pro rata share of the grant if the subject property is sold within five (5) years.
Following City Council approval of the program, the City Council directed staff to go to the Planning Commission for recommendation on Design Standards and Guidelines for the downtown. At the September 22, 2022, Planning Commission meeting, staff introduced the City Council request to the Planning Commission. The Planning Commission, at their October 27, 2022 meeting, recommended the City Council move forward with implementation of the Facade Improvement Program and that the City Council not entertain redirection of the allocated funds to development/revision of Design Standards and Guidelines.
Recommended Facade Improvement Program:
- 50% matching grant, up to $10,000 (total project cost of $20,000 or more eligible to receive $10,000 grant).
