Subject: Remote City Council Meetings Under New Brown Act Requirements (AB 361) Attachments: Resolution Reauthorizing Remote Teleconference Meetings RECOMMENDATION:

If Council wishes to Continue with Remote Teleconference Meetings, Council needs to adopt the attached Resolution No. 2023-01 Reauthorizing Remote Teleconference Public Meetings by the City Council and All Boards, Commissions, and Standing Committees of the City in Accordance with Assembly Bill 361.

EXECUTIVE SUMMARY:

On September 16,2021, Governor Gavin Newsom signed AB 361 into law. AB 361 amends the Brown Act to allow for remote public meetings without having to comply with standard provisions and restrictions for remote meetings under the Brown. AB 361 temporarily writes into the Brown Act some remote meeting requirements the City has already met and implemented under the Governor's prior Executive Orders issued during the COVID-19 pandemic. AB 361 includes additional requirements in the form of an initial authorizing resolution (effective forupto 30 days) and subsequentresolutionsto extend the use of remote meetings for additional periods of 30 days thereafter. The bill included an urgency provision making the law immediately effective upon signature by the Governor.

At its December 16,2021, meeting the Council adopted Resolution No. 2021-72 authorizing remote meetings in accordance with AB 361. If the City wishes to continue to utilize remote meetings under AB 361, the City will have to adopt a reauthorizing resolution such as that attached to this staff report.

RECOMMENDATION:

That the City Council approves the out of state travel and training for the Fire Department Administrative Secretary and Billing Clerk to attend the National Conference on Ambulance Revenue Cycle, Management and Compliance (abc360) in Las Vegas, Nevada from MarchT -9,2023.

EXECUTIVE SUMMARY:

The abc360 Conference is the Nation's largest and most comprehensive educational event for ambulance industry billing, coding and compliance and administrative professionals. This is the west coast event that is the closest to Sanger. As the City has returned to ambulance billing in-house, the information obtained from these classes will be invaluable in ensuring that our staff have the most up to date knowledge on the intricacies of ambulance coding and billing.

BACKGROUND:

In the summer of 2018 the responsibility of ambulance billing was returned to the City after several decades of contracting out this service. The process of ambulance billing and working with Federal, State and private insurance companies for proper and responsible billing of patients is dynamic, with laws and statutes changing frequently, especially in the areas of compliance and patient privacy. 20 event will be held in the Las Vegas Convention Center in Nevada. Community Development Director Brletic, Mayor, and Mayor Pro Tem attended ICSC LAS VEGAS in May 2022. Staff is proposing attendance by City Manager Chapa, Community Development Director Brletic, and Mayor Gorualez.

Attendance by three representatives will provide some flexibility for staffto schedule as many meetings as possible. The City currently has marketing needs to address business within the existing City limits, including the newly annexed North Academy Area.

REASON FOR RECOMMENDATION:

Job ueation and expanding and strengthening the economic development within the City of Sanger remains a high priority and goal of the City Council. Attending the conference provides the opportunity for the City of Sanger representatives to meet shopping center industry executives and retail developers to inform them of the opportunities and incentives to build or relocate to Sanger.

The attendance to the ICSC LAS VEGAS 2023 was authorized and approved through the 2022-23 budget adoption process. The City's Travel Policy requires any travel that occurs out of state be brought before the City Council for approval. The ICSC LAS VEGAS 2023 Conference will be held in Las Vegas, Nevada, therefore requires out of state travel approval.

FISCAL IMPACT:

The total estimated fiscal impact related to this travel is $6,400-$7,200 which covers the expense of food, lodging and travel for all three city staff representatives/members. Sufficient travel funds have been budgeted for this cost within the202212023 fiscal budget.

ALTERNATIVES:

1. Do not attend ICSC LAS VEGAS 2023.

2. Authorize a reduced number of attendees to attend.

ACTIONS F'OI, G APPROVAL:

1. Confirmation of travel arrangements and accommodations. 21 For the Meeting of: January 5,2023

29 This project consisted of the construction of concrete sidewalk and curb ramps at various locations in the City to close gaps where sidewalk was missing. Specifically, this project focused on Faller Avenue between JFK Park and Annadale Avenue and along the frontage of Lincoln Park, on Park and Cherry Avenues and P Street.

See Attachment 2 for more project location information and Attachment 3 for some project completion photos.

There was one executed change order (see Attachment 4) to modifu the contract documents to construct Type I curb ramps at the southwest and southeast corners of Lincoln Park instead of Type II ramps which were either existing or proposed with the original contract. The change to Type II ramps was to better accommodate Sanger Unified School District's ultimate plans for Lincoln Park, which they own. They have since constructed a perimeter fence to surround the park, and the fence corners aligned better with Type I ramps than Type II ramps. The total change order cost was $2,859.00.

REASON FOR RECOMMENDATION:

The project construction work has been completed by the Contractor to the satisfaction of the City Engineer.

FISCAL IMPACT:

The final construction contract cost is $179,430.02. Total construction phase costs, including construction management, inspection and material testing, were approximately $210,000. The project was funded by a combination of CMAQ Lifeline and TDA Article 8 funds.

Purchase of Patient Gurney Loading Systems
Quote from Stryker
CONFLICT OF INTEREST:

None known.

RECO ATION:

That the City Council approves the sole source purchase of four patient gurney loading systems in the amount of $11 1,859 and related installation costs estimated at $13,000 and authorize the Purchasing Officer to approve the sole source purchase in the amount not to exceed $125,000.

This item will be heard at the January 3,2023 Citizens Oversight Committee meeting to affirm the purchase to be an appropriate use of Measure "S" funds. The Committee's recommendation will be reported to the City Council in writing during presentation of this item at the January 5, 2023 City Council meeting.

EXECUTIVE SUMMARY:

In the delivery of advanced life support services, the Fire Department utilizes Stryker gurneys to transport patients within our ambulances. The Department currently has four ambulances, each one with these specialized gurneys to deliver patients from the scene of an emergency to the appropriate destination. This request is to enhance the operation of these gumeys, utilizing specific Stryker equipment to assist emergency crews in lifting the loaded gurney into the ambulance, increasing patient safety and reducing the risk of injury to emergency personnel.

56 BACKGROUND:

Over the last two decades, Stryker gumeys have met the Fire Department's specifications for patient delivery systems. The Department currently has four of these gumeys, that now operate on an electrical and pneumatic system where once the patient is loaded onto the gumey, emergency crews activate the mechanism and the gumey raises on its own power. This feature to patient gumeys was introduced over ten years ago, reducing the risk of back injuries to our emergency crews from lifting both the weight of a patient, the attached equipment and the gumey itself. Now, technology has advanced to where this lifting of the gurney into the ambulance has expanded. Using a mechanical device, the gurney is wheeled to the back ofthe waiting ambulance where it is affached to the gumey loading system. This loading system then elevates the gurney off ofthe ground, where the legs are lifted and the patient is loaded into the ambulance.

This loading system locks the gumey into the ambulance and also provides charging power to the gurney's battery system in transit.

The City currently utilizes Stryker gurneys for the delivery and transportation of patients within City ambulances. This proposed equipment is Stryker gumey-specific only, meaning no other manufacturer of gumey loading systems are compatible with these gumeys. Additionally, the current maintenance agreements in place for the gumeys would add this proposed equipment into those maintenance schedules creating a necessary standardization of equipment. Therefore, this purchase would constitute a sole source purchase.

REASON FOR RECOMMENDATION:

There are three phases of moving a patient during an emergency call for transport to a receiving facility:
putting the patient onto the gurney, lifting the gurney into a position to safely move the patient and gumey to the ambulance, then lifting the gurney into the ambulance and locking it into place. All of these steps require teamwork, communication and physical strength to safely perform this task for both the patient and the emergency crews. Technological advances such as the current gurneys and this proposed lifting system reduces this risk by 213, providing a safer environment for crews to operate in and stay healthy while still providing for patient safety.

FISCAL IMPACT:

The cost to upgrade four ambulances with this equipment, including the floor plates, gumey modifications and related equipment is $111,859. The units will have to be taken to Oakdale for installation and those costs are estimated at $13,000 for four ambulances.

ALTERNATIVES:

Do not approve the purchase in which case the City will continue to utilize the gurneys without this specialized equipment.

ACTIONS APPROVAL:

The Purchasing Officer will sign the documents on behalf of the City \\nas l\shared\Forms & Templates

Adoption of Side Letter Agreement with SPOA re: Language Changes for Police Lieutenant Position Title and Watch Commander Assignment Side Letter Agreement between City of Sanger and Sanger Police Officers Association
CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

That City Council adopt a Side Letter Agreement between the City of Sanger and the Sanger Police Offtcers' Association (SPOA) regarding a language change to the position title of Police Lieutenant and the assignment of Watch Commander.

EXECUTIVE SUMMARY
Authorized representatives of the City and the Association have met and consulted to discuss a proposed permanent title change for the position (rank) of "Police Lieutenant" to "Police Commander" and change in term of "Watch Commander" to "Shift Supervisor". The parties agreed to the changes and as such, found it necessary to make modifications to the MOU. Currently the Sanger Police Department Policy Manual references the position of Police "Lieutenant" as a "Division Commander" and the assignment of "Shift Supervisor" as "'Watch Commander." The inconsistency in terms creates issues when dealing with other agencies, when authorizing training based on position title, and in the preparation of documents were both the Police "Lieutenant" position is referenced with the assignment of Watch "Commander." 61 assignments held by the current "Police Lieutenant" position as "Division Commanders," and the assignment of 'oWatch Commander" is associated with the ranks of "Police Sergeant" or "Police Corporal." As the position of o'Commander" is a higher oorank" than "Lieutenant," the designations of Sergeants and Corporals as "Watch Commanders" is incorrect, and can be confusing. This is also the case when assigning staff to Executive Level training courses, usually comprised of attendees holding the rank of "Commander" or higher.

Adopting the Side Letter of Agreement changing the position of Police "Lieutenant" to Police "Commander," and changing the designation of Watch "Commander" to "Shift Supervisor" in the current Memorandum of Understanding (MOU) will eliminate any potential confusion, and standardize the designations with those of other allied agencies that have adopted this language (Reedley and Selma Police Departments). The language changes will have no impact of any other provisions of the current Memorandum of Understanding, including all references to salary or other outlined benefits.

BACKGROUND:

The Sanger Police Department is constantly looking for ways to improve its methods of operations and conform to the standards of the industry. Adopting the aforementioned language changes to the MOU will continue that effort, without impacting any other MOU provision.

REASON FOR RECOMMENDATION:

Add a standardization of language to the current MOU with the SPOA with reference to the position/assignment of "Commander" within the Sanger Policy Department.

Sole Source Contract for Purchase of Additional Body Worn Cameras and Data Storage
(1) Axon Body Worn Cameras Price Quote
(2) Sole Source Letter
CONFLICT OF INTERE,ST:

None known.

RECOMMENDATION:

That the City Council approve an additional contract with Axon for purchase of 10 additional cameras and data storage on a sole source basis beginning December 2022 until April 2025 and authorize execution of contract by the City Manager.

EXECUTIVE SUMMARY:

The Police Department desires to implement 10 additional Body Worn Cameras (BWC) in the Patrol Division. This is due to the recent addition of personnel. This will allow the outfitting for every patrol officer with a BWC for use during all law enforcement contacts with the public. BWCs have proven successful in recording police actions and assisting in the prosecution of criminal suspects. BWCs are being implemented in police agencies across the country and have been highly beneficial in countless ways, especially in resolving controversial incidents or police contacts. During the City's initial deployment of BWCs in Fiscal Year 2018-20l9,the Police Department contracted with Axon to provide the BWCs and to provide video storage.

The budgeted amount for BWC equipment and storage for FY 2022-2023 was approved by the COC and City Council previously for $58,000 annually per a current agreement with Axon. Under the new Ptepared by: T.t- Iason Approved by:

71 proposed agreement, the additional costs for the 10 new cameras will be $14,176.67 per year beginning in December 2022 and ending in April 2025. The total for the additional agreement will be $56,706.74 over 4 years ($ I 4, 17 6.67 per year). This new agreement will run concurrent with our current agreement and we will receive one invoice each April in the amount of $72,176.67 ($58,000 + $14,176.67).

The Citizen's Oversight Committee (COC) will review the proposed additional purchase of the cameras at their January 3,2023 meeting and determine their recommendation regarding the appropriate use of Measure "S" funds. The COC recommendation will be reported to the Council during presentation of this item at the January 5,2023 City Council meeting.

BACKGROUND:

The Sanger Police Department needs an additional 10 cameras to assign to new and current employees.

Currently Detectives do not have permanently assigned cameras and they are need for the service of search warrants, special details, etc. This will allow each assigned BWC user to be assigned their own camera.

Sanger police officers currently wear the BWCs on their uniforms throughout their shift and turn it on and off as they engage in contacts with persons in the community. At the end of their shift, they place the cameras on a docking station to download all video recordings and to recharge. The video recordings are stored on the Cloud in a system specifically developed for police agencies with proven security. Access to the videos is exclusive to law enforcement agencies and District Attorney's Offices that have been granted approval for use. In addition to assisting with the prosecution of criminal suspects, camera recordings contribute to increased police transparency and can clariff factually what occurred when allegations against the police are made.

The Police Department is seeking to enter into an additional 4-year commitment for 10 additional BWCs and storage with the Axon Company. Axon will provide the department with a full warranty for cameras during the contract term. Additionally, Axon will provide new replacement cameras and docking stations after Year 2.5 and in Year 5. The department has assessed the needs for storage and determined that an Unlimited Plan is the most cost effective. The cost for this BWC project is:
o Dec 2022:
o April2023:
o April2024:
o April2025:
$r4,t76.67
$14,r76.67
$r4,176.67
$r4,176.73
Total at end of new contract $56,706.74
The purpose of this memorandum is to designate Axon as Sole Source Vendors for the Axon BWC and equiptment. Axon is the sole supplier of their BWC platform. There are suppliers that sell individual cameras and accessories, but the Sanger Police Department has been using Axon Cameras since the inception of our program and we are able to get bundled pricing, free equipment upgrades, and use them for the storage of the vast amounts of data we compile by dealing with them directly. They are our source for video storage and by purchasing the hardware and storage together we are able to get free upgrades on cameras, docking startions for download, and technical support.

In addition, the Fresno District Attomey's office is linked to the AXON system in order to review videos and obtain evidence from our downloads.

72 REASON FOR RECOMMENDATION:

More and more law enforcement agencies across the United States are using BWCs. They offer effective and valuable evidence in the prosecution of criminal suspects. They also offer improved transparency for the police agency and such video recordings have proven invaluable in determining factual differences when allegations ofpolice misconduct have been raised. The addition of body worn cameras will continue to serve to improve the overall professionalism of the department and prove highly beneficial to police operations. They have become a staple of our profession.

FISCAL IMPACT:

The total cost of the contract will be an additional $56,706.74 over 4 years. The Measure S COC has already determined that this is an appropriate expenditure for Measure S Funds. The COC approved this specific purchase at their meeting of December 6,2022. See attached recommendation. This will bring the total to 872,176.67 ayear for BWC through 2025.

ALTERNATIVES:

Option l: The City Council could approve the contract with Axon for the additional BWCs and the ongoing data storage.

Result l: All patrols and specialty units would have BWC footage of all public interactions, arrests, and use of force incidents.

Option 2: The City Council could decline to approve the contract with Axon for additional BWCs and the ongoing data storage.

Result 2: All patrols and specialty units would not have BWC footage of all public interactions, a.rrests, and use of force incidents, and we would not be able to keep pace with our growth as a Dept. Staff would need additional direction from Council.

82 is being funded by grant funding from the Department of Water Resources Drought Relief program. As part of the project development, the City must comply with CEQA. Since September of 202I, Staff has been operating under the authority granted by the City Council under Resolution No. 2021-58, which declared a municipal water emergency in response to declining production in the water well system. This emergency declaration is in addition to other drought-related emergency declarations made by the Governor and under these declarations, the proposed water well project satisfies the criteria for CEQA Statutory Exemption 15269. Adoption of the attached resolution will authorize Staff to prepare and file the Notice of Exemption to comply with CEQA. The plans and specifications for the drilling and development of Well No. 22 will be advertised for bid and the project construction commenced subsequent to the environmental clearance.

REASON FOR RECOMMENDATION:

Adoption of Statutory Exemption 15269 will satisfr CEQA and allow the City to continue with the project development.

FISCAL IMPACT:

There is no appreciable fiscal impact resulting from approval of the resolution. There is a $50.00 recording fee for the Notice of Exemption and all project costs are anticipated to be covered under the DWR grant funding. The total project cost is estimated at just under $4 million.

Project Location and Setting
The proposed new municipal water well (Well #22) would be located on approximately 0.35 acres of vacant land located north of Jensen Avenue and west of Bethel Avenue in Sanger, CA ("Project"). The proposed site is located at the west end of an existing commercial shopping center. The site is near the western edge of the City in an area that consists of commercial establishments, roadways, the Fowler Switch canal, residential subdivisions and vacant land. The proposed Project site is currently vacant and is void of trees or other vegetation.

Project Description
The Project consists of construction and operation of a new municipal water well (Well #22), chlorination building, supporting electrical and controls infrastructure and installation of water treatment vessels, if needed. The facility will include perimeter block wallfencing, roadway frontage improvements on Jensen Avenue and a minor amount of new onsite lighting for nighttime security. The new well will connect to the City's existing water infrastructure for distribution. Construction is expected to begin in early 2O23 or as soon as approvals and authorizations are received.

Severe drought conditions are impacting water supplies and early rains in October and December 2O27 gave way to the driest January, February and March in recorded history for the watersheds that provide much of California's water supply. On April L2,2O2L the Governor issued a proclamation of a state of emergency under the California Emergency Services Act based on drought conditions and then issued a proclamation of a continued state of emergency on May IO,2O2L, July 8, 2O27, and October 79,2O2L. On January 4,2022, the California State Water Resources Control Board ("SWRCB") adopted the First Water Conservation Emergency Regulation of 2O22 which went into effect on January 18,2022, directing state agencies to take immediate action to preserve critical water supplies, mitigate the effects of drought, and ensure the protection of health, safety, and the environment. On March 28, 2022, Governor Gavin Newsom further proclaimed that a state of emergency exists in all California counties due to severe drought conditions, adding to his previous drought proclamations.

On March 28, 2022 per Executive Order N-7-22, the Governor directed the SWRCB to consider adopting the Second Water Conservation Emergency Regulation of 2O22 ("emergency regulation") for water conservation. On May 24,2022, the SWRCB adopted the emergency regulation which went into effect on June LO,2022 and will remain in effect for one year unless modified, readopted, or ended before then. ln addition, in response to declining production in its existing water well network, the City of Sanger under Resolution No. 2021-58 declared a municipal water emergency in September 202L, severely limiting the use of water within the City. lf there are insufficient water supplies to address this emergency, it could result in significant impacts to public health, safety, and welfare, including sufficient water for drinking, consumption, and maintaining water pressures necessary to continue to ensure fire protection for the community, as well as resulting economic impacts potentially giving rise to a reduced tax base that is critical to maintain other public services. The Project (new municipal Water Well #22) is necessary to repair or replace facilities damaged as a result of the drought emergency, and emergency repairs are necessary to maintain service essential to the public health, safety, or welfare. (c) Specific actions necessory to prevent or mitigote on emergency. This does not include long-term proiects undertaken for the purpose of preventing or mitigoting a situotion that hos a low probobility of occurrence in the short-term, but this exclusion does not apply (i) if the anticipoted period of time to conduct an environmental review of such a long-term project would creote a risk to public health, sofety or welfare, or (ii) if octivities (such as fire or cotastrophic risk mitigation or modificotions to improve facility integrity) ore proposed for existing focilities in response to an emergency ot o similor existing focility.

Response: This exception is also applicable to this Project. Please see response (b) above, which is incorporated here. ln addition, the proposed Project has an immediate need to begin construction of 2oL236.OtOIl842548.L
90 the new well in order to alleviate existing insufficient water supply conditions which manifest in low water pressure in periods of peak demands. The continued drought will further exacerbate the situation, thus the well is needed to mitigate both short term and long term water shortages. (d) Projects undertoken, carried o.tt, or approved by a public ogency to mointoin, repoir, or restore on existing highway domaged by fire, flood, storm, earthquake, land subsidence, gradual earth movement, or londslide, provided thot the project is within the existing right of way of thot highwoy and is initiated within one year of the damage occurring. This exemption does not opply to highways designated as official stdte scenic highwoys, nor ony project undertaken, corried out, or opproved by o public ogency to expond or widen o highwoy damaged by fire, flood, storm, eorthquake, land subsidence, graduol earth movement, or londslide.

Response: This subsection is not applicable to the Project. (e) Seismic work on highwoys ond bridges pursuont to Section 780.2 of the Streets and Highwoys Code, Section 780 et seq.

Response: This subsection is not applicable to this Project.

Determination
The City has evaluated the project within the context of CEQA and has determined that the project qualifies for Statutory Exemption t5259 (b) and (c). The City will adopt the Project's Statutory Exemption through a resolution.
