RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No o) -o authorizing a grant application to the California Department of Water Resources for the Sanger Water Storage Enhancement Project, and authorizing acceptance of grant and execution of agreement by the City Manager.
EXECUTIVE SUMMARY:
The California Department of Water Resources (DWR) has released a Proposal Solicitation Package for the 2022 Urban Community Drought Relief Grant Program. Staff recommends a request for funding of Water Storage Tank No. 4 as well as temporary portable water storage tanks for future City use.
BACKGROUND:
In June 2022, the California legislature amended the Budget Act of 2021(Stats. 2021, ch. 240, $ 80) to allocate an additional $545 million to DWR to award grants for drought relief. These grants are intended to provide water to communities that face the loss or contamination of their water supplies, to address immediate impacts on human health and safety, to secure the future of Califomia's water supply, Prepared by: Approved by:

58 and to protect fish and wildlife resources. The minimum project size under this grant program is $3 million and eligible project types are listed as follows:
o Projects that support immediate drought response;
o Projects that enhance local supply and climate resilience through source watershed improvements, consistent with Water Code section 108.5, that defines source watersheds; r Drought resilience planning;
o Water conservation activities, including but not limited to; education, outreach, direct installation programs, fixture replacement incentives and rebate programs, and other activities that provide reductions in water consumption or improvements to water supply reliability;
o Turf replacement with drought tolerant landscaping: i.e., replacing turf (traditional grass lawns) with native and drought tolerant plants andlor climate appropriate turf species for functional turf; . Hauled water;
o Installation of temporary or permanent community water tanks; o Bottled water;
o Water vending machines;
o Emergency water interties;
o New wells or rehabilitation of existing wells;
o Construction or installation of permanent connection to adjacent water systems, recycled water projects that provide immediate relief to potable supplies, and other projects that support immediate drought response;
. Fish and wildlife rescue, protection, and relocation.
Staff has been actively working on improvements to City's water system including two different well projects, a funding application for a third, and rehabilitations to multiple existing wells. While these projects, once completed, would improve the City's water supply capacity, Staff recommends that enhancements to the City's water storage capacity be developed. Prior to the construction of Water Storage Tank No. 3, located at Church Avenue and J Streets, the City's water storage capacity has historically been comprised of its two elevated water towers at Jensen/Academy and at Greenwood/9th.
The total combined storage capacity of these two towers is 135,000 gallons. The storage capacity of Tank No. 3 is 750,000 gallons. When the Tank No. 3 site was developed, it was planned for the future construction and integration of a second 750,000 gallon tank, or Tank No. 4 (see Attachment 2). It was planned that this combined 1.5 million gallons of water storage would allow the City to retire the two water towers, which are more than 100 years old and require significant ongoing maintenance, and to provide a stable reserve of water for peak demand situations and fire flow conditions.
In addition to this planned permanent tank, Staff also proposes to include in the funding application the purchase of several temporary water storage tanks with portable pumps and accessories. If funded, these tanks could be used to mitigate low water flow and pressure conditions for the time period that it takes to complete all these planned permanent water system improvements. Staff would coordinate with local businesses and multi-family housing representatives to best utilize any temporary storage facilities in the interim condition.
The grant requires an authorizing resolution or the application submittal, as well as to approve and execute a funding agreement. The affached resolution authorizes the City Manager for these actions. \\nas l\shared\Forms & Templates
59 REASON FOR RECOMMENDATION:
Funding from this program would allow the City to continue its aggressive approach to making critical water infrastructure system improvements, in this case focusing on emergency water storage.
FISCAL IMPACT:
No fiscal impact is anticipated for the submittal of the application. There is no local match requirement. If successful, the program could bring in up to $4 million for the construction of the new water tank (estimated at approximately $3.5 million alone) and the procurement ofthe temporary, portable tank systems.
ALTERNATIVES:
None recommended.
ACTIONS FOLLOWING APPROVAL:
Staff will continue working with the City's contract grant writer to prepare and submit the grant application by the end of January 2023.

65 The proposed ordinance adopts the new 2022 CBC and adds new articles regarding Electric Vehicle Charging Stations Procedures and Safety Assessment Placards.
BACKGROUND:
The model codes update every three years to improve and adjust to the newest materials, methods of construction, and technological advances in the industry. The California Building Standards Commission adoption of the 2022 California Building Code (CBC) comes after a comprehensive multi-state agency and stakeholder update of the 2019 California Building Code.
The objective is to produce a practical building code that ensures public safety first and foremost, while implementing the most efficient technology available to conserve the State's natural resources and energy use. Califomia's Building Code applies to every commercial and residential structure in the State.
The new 2022 CBC contains twelve parts that incorporate public health, life safety, and general welfare standards used in the design and construction of buildings in California. These parts incorporate the latest national standards in the International Building, Residential and Fire Codes, California Green Building Code, California Energy Code, National Electrical Code and the Uniform Mechanical and Plumbing Codes.
Health and Safety Code Section 18941.5 mandates that the Building Standards contained in the 2022 CBC shall be effective 180 days after publication by the California Building Standards Commission. If these codes are not adopted by Ordinance, they become effective by default without any amendments. All construction and development projects submitted to the City on or after January 1,2023 will be required to comply with the new CBSC, as part of the adoption process this department has made every effort to notifr all affected parties ofthe proposed changes
The proposed ordinance adopts the new 2022 CBC and adds new articles regarding Electric Vehicle Charging Stations Procedures and Safety Assessment Placards.
Along with the usual Energy and Green Code updates, below are a few noteworthy updates Permit expirationhas been extended from 6-months to l2-months. Every permit shall remain valid if the work on the site is commenced within 12 months after its issuance.
Aging-in-place design and fall prevention has been added for new residential construction. Added to address specific design elements to facilitate access to operational features and to allow people to stay longer in their homes as they age.
Expanding Electric Vehicle Charging requirements to install EV charging receptacles and chargers to new multifamily dwellings, hotels, and motels.
REASON FOR RECOMMENDATION:
The model codes update every three years to improve and adjust to the newest materials, methods of construction, and technological advances in the industry. SECTION 13. Article XVII titled "Electric Vehicle Charging Station Permitting Procedures" is added to Chapter 14 of the Sanger City Code to read as follows:
PageT of12
74 CHAPTER 14 BUILDINGS AND BUILDING REGULATIONS
ARTICLE XVII
ELECTRIC VEHICLE CHARGING STATION PERMITTING PROCEDARES Sec. 14-651. Purpose.
The City seeks to encourage the use of fuel-efficient electric vehicles by streamlining the process for obtaining a building permit for electric car charging stations. Section 65850.7 of the California Government Code provides that, on or before September 30,2017, every city, county, or city and county, with a population less than 200,000, shall adopt an ordinance creating expedited, streamlined permitting process for electric vehicle charging stations.
Sec. 14-652. Definitions.
rrCECrr means California Code of Regulations title 24, part 3, also known as the California Electrical Code.
"Electric vehicle charging station" or "charging station" means any level of electric vehicle supply equipment station that is designed and built-in compliance with article 625 of the CEC and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle.
"Electronic submittal" means the utilization of one or more of the following: e-mail; the internet; facsimile.
"Specific, adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions, as they existed on the date the application, was deemed complete.
Sec. 14-653. Checklist.
(a) The building official shall adopt a checklist of all requirements for an expedited building permit application for electric vehicle charging stations. The checklist shall substantially conform to the checklist and standard plans contained in the most current version of the "Plug-In Electric Vehicle Infrastructure Permitting Checklist" of the "Zero-Emission Vehicles in California: Community Readiness Guidebook" published by the govemor's office of planning and research.
(b) The checklist, application form, and any other documents required by the city building official shall be published on the city's website.
Sec. 14-654. Expedited building permit process for electric vehicle charging stations. (a) Prior to submifting an application for processing, the applicant shall veriff that the installation of an electric vehicle charging station will not have specific, adverse impact to public health and safety, and building occupants. Verification by the applicant includes but is not limited to: electrical system capacity and loads; electrical system wiring, bonding, and overcurrent protection; building infrastructure affected by charging station equipment and associated conduits; areas of charging station equipment; and vehicle parking.
75 (b) A permit application that satisfies the information requirements in the city's adopted checklist shall be deemed complete and be promptly processed. Upon confirmation by the city building official that the permit application and supporting documents meet the requirements of the city-adopted checklist, and is consistent with all applicable laws, and health and safety standards, the city building official shall approve the application and issue all necessary permits. Such approval does not authorize an applicant to energize or utilize the electric vehicle charging station until approval is granted by the city. (c) If the application for an expedited building permit is incomplete, the city building official shall provide a written correction notice of the deficiencies and the additional information required to be eligible for expedited building permit issuance. (d) The city building official shall not condition the approval for any electric vehicle charging station permit on the approval by an association, as that term is defined by California Civil Code section 4080.
Sec. 14-655. Electronic submission.
The city building official shall allow for electronic submittal of permit applications covered by this article and associated supporting documentation. In accepting permit applications, the city building official shall also accept electronic signatures on all forms, applications, and other documentation in lieu of a wet signature by any applicant.
Sec. 14-656. Installation.
(a) Electric vehicle charging station equipment shall meet the requirements of the CEC, the society of automotive engineers, association, and accredited testing laboratories such as underwriters' laboratories, and rules of the public utilities commission regarding safety and reliability.
(b) Installation of electric vehicle charging stations and associated wiring, bonding, disconnecting means, and overcurrent protective devices shall meet the requirements of article 625 of the CEC, and all applicable provisions under California Code of Regulations, title 24, part 3.
(c) Installation of electric vehicle charging stations shall be incorporated into the load calculations of all new or existing electrical services and shall meet the requirements of the CEC. Electric vehicle charging equipment shall be considered a continuous load. (d) Anchorage of either floor-mounted or wall-mounted electric vehicle charging stations shall meet the requirements of the California Building or Residential Code as applicable per occupancy, and the provisions of the manufacturer's installation instructions.
Mounting of charging stations shall not adversely affect building elements.
Sec. 14-657. Technical review.
This article aims to encourage the installation of electric vehicle charging stations by removing obstacles to permitting for charging stations, so long as the action does not supersede the city building official's authority to address higher priority life-safety situations. If the city building official finds, based on substantial evidence, that an electric vehicle charging station could have a specific adverse impact upon the public health or safety, the city may require the applicant to apply for a conditional use permit.
76 Sec. 14-658 to 660. Reserved.
SECTION 14. Article XVIII titled "Safety Assessment Placards" is added to Chapter 14 of the Sanger City Code to read as follows:
CHAPTER 14 BUILDINGS AND BUILDING REGULATIONS
ARTICLE XVIII. SAFETY ASSESSMENT PLACARDS
Sec. 14-661. Intent.
This article establishes standard placards to be used to indicate the condition of a structure for continued occupancy. The article further authorizes the building official and his or her authorized representatives to post the appropriate placard at each entry point to a building or structure upon completion of a safety assessment.
Sec. 14-662. Application of provisions.
The provisions of this article are applicable to all buildings and structures of all occupancies regulated by the city. The City Council may extend the provisions as necessary.
Sec. 14-663. Definitions.
Safety assessment is a visual, non-destructive examination of a building or structure for the purpose of determining the condition for continued occupancy.
Sec. 14-664. Placards.
(a) The following are verbal descriptions of the official jurisdiction placards to be used to designate the condition for continued occupancy of buildings or structures. Copies of actual placards are attached.
(1) INSPECTED - Lawful Occupancy Permitted is to be posted on any building or structure wherein no apparent structural hazard has been found. This placard is not intended to mean that there is no damage to the building or structure. (2) RESTzuCTED USE is to be posted on each building or structure that has been damaged wherein the damage has resulted in some form of restriction to the continued occupancy. The individual who posts this placard will note in general terms the type of damage encountered and will clearly and concisely note the restrictions on continued occupancy.
(3) UNSAFE - Do Not Enter or Occupy is to be posted on each building or structure that has been damaged such that continued occupancy poses a threat to life safety.
Buildings or structures posted with this placard shall not be entered under any circumstance except as authorized in writing by the building official, or his or her authorized representative. Safety assessment teams shall be authorized to enter these buildings at arry time. This placard is not to be used or considered as a demolition order. The individual who posts this placard will note in general terms the type of damage encountered.
77 (b) Each placard shall include the following permanently affixed thereto: ordinance number from which this section derives and text including the City of Sanger, its address, and phone number.
(c) Once it has been attached to a building or structure, a placard is not to be removed, altered or covered until done so by an authorized representative of the building official. It shall be unlawful for any person, firm or corporation to alter, remove, cover or deface a placard unless authorized pursuant to this section.
SECTION 15. CEQA. The City Council finds this ordinance is exempt pursuant to Califomia Environmental Quality Act (CEQA) Guidelines section 15061(b)(3) as there is not a reasonable possibility that the amendments may have a significant adverse impact on the environment as i) California law mandates that on January l, 2023, all portions of the 2022 California Code of Regulations Title 24 will be effective within the City regardless of whether the City takes any action, which regulations thereby serves as a baseline for the purposes of CEQA; ii) previously approved amendments to said regulations that are being carried forward without change also constitute the existing environmental baseline, and it will not add any additional significant adverse impact to the environment to continue to use said amendments; iii) to the extent that previously approved amendments are modified, said modifications are primarily related to the administration of said regulations, and such ministerial processes will not result in a signihcant, adverse impact to the environment; and iv) any remaining proposed amendments, additions, or deletions will not result in a significant, adverse impact to the environment given the environmental baseline. As such, no further analysis is required under CEQA.
SECTION 16. Effective Date. This ordinance shall become effective thirty days after its adoption. ilt

78 SECTION 17. Publication. The City Clerk is authorized to cause this ordinance or a summary of this ordinance to be published in a newspaper of general circulation in the City of Sanger, within fifteen days after its adoption.
