Recommendation to decline determination of Public Convenience or Necessity (PCN)
ABC Letter 8P23958.4
CONFLICT OF INTEREST:
None known.
RECOMMENDATION
That the City Council decline to make Determinations of Public Convenience or Necessity (PCN) for persons/premises applying for an ABC license and have the PCN determination made by the Department of Alcoholic Beverage Control.
EXECUTIVE SUMMARY
Pursuant to Section 23958 of the California Business and Professions Code, the Department of Alcoholic Beverage Control (ABC) shall deny any application for a license if issuance would result in or add an undue concentration of licenses. Section 23958.4 of that code defines what constitutes an "undue concentration" of licenses.
Notwithstanding the above, under Section 23958.5, ABC may issue a license as follows:
(i) if the local governing body (City Council) of the area in which the applicant premises are located, or its designated subordinate officer or body, determines within 90 days of notihcation of a completed application that public convenience or necessity would be served by the issuance; or (ii) if the local governing body, or its designated subordinate officer or body, does not make a Preoared bv: Cmdt lason Boust Aootoved bv:

14 determination within the 90-day period, then ABC may issue a license if the applicant shows the department that public convenience or necessity would be served by the issuance.
Pursuant to the above referenced code, the ABC has requested that the local governing body for each jurisdiction make the determination as to who will make the determination of Public Convenience or Necessity (PCN).
As noted above, the local governing body can elect to make that determination, can designate a subordinate officer or body to make that determination, or the governing body can decline to make that determination and that determination will revert to the ABC.
It is the recommendation of the Police Department that the Council decline to make the determination and allow the ABC to make the determination of PCN.
BACKGROUND:
The State of Califomia Department of Alcoholic Beverage Control (ABC) is charged with the responsibility under state statute to review and issue licenses for the sale and/or manufacture of alcoholic beverages. State law provides that ABC shall deny an application for a license if the issuance of that license would either create a law enforcement problem, or result in or add to an undue concentration of licenses, unless a determination is made that PCN would be served by the issuance of that license.
It is the responsibility of the applicant to justifu the Public Convenience or Necessity for alcohol sales.
REASON FOR RECOMMENDATION:
By allowing the local jurisdiction to make the determination, any decision could be construed as bias. The City will always have an opportunity to comment on any proposed ABC license should a concern arise.
FISCAL IMPACT:
None
ALTERNATIVES:
To submit a response to ABC either allowing the City Council to make the PCN determination or designate a subordinate officer or body to make that determination.
ACTIONS FOLLOWING APPROVAL:
That the attached letter be completed to sent back to the Department Alcoholic Beverage Control for filing and implementation.

BACKGROUND:
On January I0,2022, the California Commission on the Status of Women and Girls released its grant application for the 2022 CCSWG Women's Recovery Response Grant Funding Opportunity. Foi more than 50 years, the California Commission on the Status of Women and Girls has identified and worked to eliminate inequities in state laws, practices, and conditions that affect California's women and girls. This grant opportunity allowed the Commission to distribute $5M throughout the State for the following funding categories:
o Engage and strengthens existing local women's commissions to ultimately inform the statewide Women's Economic Recovery Blueprint.
o Development of new local commissions to improve representation of all women's voices throughout California.
o Increase resources for community-based organizations providing direct services to support immediate needs for women through an economic security lens.
The Commission awarded funds ranging from $25,000 up to $250,000 maximum depending on the proposed activities for each funding category. The application required partnerships with thi goveming body authorization (i.e., the City of Sanger) to establish new local commissions to improve representation and input on issues that impact women and girls. A local advocate, Eve Castellanos, Ed.D., ..tb-itted un application on behalf of the City on February 04,2022, and the City was advised that it was awarded the grant funds on March 15,2022.
On May 19,2022, the City accepted grant funds in the amount of $25,000 as a resource to establish a local Commission on the Status of Women, to provide for recruitment, marketing, and development of the Board. Development activities would include implementation of activities (e.g., stakeholder interviews, focus groups, and surveys) to determine what the priorities for this Board should be based on the needs of women and girls in Sanger. The purpose of this Commission is act in an advisory capacity to the Sanger City Council.
Since the last meeting, the appointment process has been clarified consistent with the By-Laws and state law. The By-Laws provide that four members shall be residents of the four Council Districts, and two members shall be atlarge members. One of the at-large members is required to be a woman between the ages of 16 and 24, attending high school, college, or university.
Per the Commission By-Laws, the Mayor may seek nominations for appointments from each Council Member and the Mayor may make direct appointments for the at-large seats. The Mayor's appointments require the City Council's approval.
At the February 2, 2023, City Council meeting the Council considered applicants and nominees from Council Members and tabled the matter. The Mayor has considered nominees by Council Members who are residents of their respective Council districts and the at-large applicants. \\nas l\shared\Forms & Templates

To whom it may concern,
I would like to recommend BreAnna Trelo for the Commission for the Advancement of Women and Girls. She would be perfect for this commission.
Ms. Trejo did not ask me to write this letter for her. I believe that she would be an addition to this commission so much that I asked her if I could write this recommendation for her.
BreAnna is an up and coming leader in Sanger. She has taken it upon herself to join the Sanger Wornan! Club, be active in her church (Grace Community Church and others) and volunteer with the Sanger Depot Museum She is also becoming a regular at city council meetings all the while working.
On top of all of that I find BreAnna to be an excellent communicator. A benefit to any committee. And as young woman and a recent graduate from Fresno Pacific University she will be a great advocate and voice for the women of Sanger.
Thank you for your consideration. lf you have any other questions regarding my recommendation feel free to reach our to me.
God bless,

RE: Reglna Urlbes
letter of Recommendatlon for Clty of Sanger Commission on the Status of Women and Girls Dear Sirs,
It is with immense pleasure that I am submitting a letter of recommendation on behalf of Regina Uribes.
I serve as a leader and primary coordinator for the Stephen Ministry Program through the Holy Spi.at church in Fresno, California. lt is through the Stephen Ministry program that we recruited, selected, and curently work with Regina and have been able to recognize the skills she has that will contribute to your commission.
Regina joined the Stephen Ministry program in 2018. She was selected to participate in a So-hour training coursa to become a Stephen Minister" Stephen Ministry is a caring Christian ministry in which a Stephen Minister is asslgned a "care receive/' to support through challenging times. These are one on one relationships and often invofue at least one hour together per week. The intense training includes active listening skills, confidentiality, boundary setting, referrals to other community resources, and more. Regina has been asslgned several care receivers over the years and demonstrates the ability to listen and support others through difficulties.
ln addition, Regina is a health coach. We have referred several clients through the Stephen Ministry program to Regina to further support care receivers who need health coaching. Regina has a very "down to earth" approach with her clients. She is exceptionally good at listenlng to the concerns of the clients and addressing individual concerns. She is caring and concerned for all whom she may encounter. She is also highly creative in her approach to various issueslproblems/concerns, Regina's resume speaks to her educational background, her experience as a Peer Counselor and Career Pathway Leader. She has an extensive educational background that is suited to this role.
Regina connects so well to women of all ages and has a pa*icularly youthful persona that will lend itself to working with women of all ages. I highly recommend Regina Uribes to serve on your Commission on the Status of Women and Girls in Sanger California. I can be reached at 559-284-3621 with further questions or concerns.
Most Sincerely,
Laurie Primavera RN, MSN, FNP
