RE: FIRE DEPARTMENT REPORT FOR OCTOBER
For the month of October, there were 282 calls for service for ambulance services within our area and within surrounding areas. Crews were also dispatched to 67 requests for services for fire calls, including house fires, trash and warming fires, building fires, vehicle fires and unintentional or false alarm calls. This total equates to 354 calls for service in October, or just over LL calls per day.
Chute times are measured from the time the station is notified of an alarm to the time the unit goes enroute.
For the month of October our average chute time remained at 59 seconds, well under our benchmark of 90 seconds. Approximately 84% of the time our crews have a chute time of less than 90 seconds. Our travel time is measured from the time the unit is enroute to the time that we arrive on scene. For October, our median enroute time was 5 minutes, L7 seconds within the City. This meets our benchmark of under 6 minutes within the City. Our total call time for the month of October at the 90th percentile was measured at t hour and 35 minutes per call. lt is also important to note that this time for October equates to L7 hours and 35 minutes outside of the station in a 24-hour period, or72% of the day crews are on a call for service.
Administratively we started a new fire academy in October with four new firefighters to our suppression staff and we are expecting them to be finished with their academy training in mid-November and take their places on shifts. We continue to recruit for the single-role program and while only two candidates applied for the Paramedic position, we are hopeful that one will be able to move forward in the process. ln October we hosted our annual Fire and PD Open House where we welcomed a few hundred of our community members into the station to learn more about their public safety officers. Our neighbors were able to ask questions and be involved in several different educational presentations from both departments. We attended the annual Job and Resource Fair in an effort to attract local talent into our public safety departments and lastly, we were able to host several station visits from entities such as the CSN Early Education program and Bethel Christian School ending with participating in the very successful Trunk-or-Treat in Brehler Square.

63 Constitution preserves the ability of members of the public to criticize and question government and government officers. However, the right to speak is not absolute. A City Council may adopt reasonable regulations to protect its legitimate interest in conducting an orderly public meeting, and to ensure that in the exercise of the right to speak and the right to attend a meeting, a person does not impinge on the rights of others.
A City Council Meeting is a governmental process with a governmental purpose. The Council has an agenda to be addressed with a result, the City Council has a legitimate interest in conducting efficient, orderly meetings. Members of the public may speak on action agenda items and also on non-agenda items for matters under the City's jurisdiction. Per Government Code Section 54954.3(b) of the Brown Act, the City Council is authorized to adopt reasonable regulations to effectuate the legislative intent that public comments at meetings be limited to items matters within the subject matter jurisdiction of the City including, not limited to the total amount of time allocated for public testimony on particular issues and for each individual speaker.
The proposed ordinance is in keeping with the City Council's desire to ensure its business is conducted in an orderly, efficient and fatt manner and to ensure that members of the public have an oppotunity to be heard on matters within the City subject matter jurisdiction. Disruptive conduct prevents the Council from accomplishing its business in an otdedy, efficient, and falr manner. It also interferes with the right of other individuals to be heatd.
The ptoposed otdinance:
o Assists the Council in preventing and addtessing disruptive conduct at meetings, . Applies to persons addtessing the Council and persons attending the meeting, o Descdbes the authority of the Presiding Officer at meeting whether it is the Mayor, Mayor Pro Tem or othet person so designated,
o Descdbes the rules that must be observed including getting the floor, directing remarks to the Council, staying within time allowed, not distutbing the peace of the meeting by loud and unreasonable rules, making comments televant to an agenda item, not engaging in conduct which distupts, distubs, impedes or renders infeasible the otdetly conduct of the meeting, or is likely to provoke others to violent ot tiotous behavior.
The term "disrupting behavior" is defined as (i) failure to comply with the reasonable and lawful regulations adopted by the Council and (ii) engaging in behavior that constitutes the use of force or a true threat of force. The ordinance provides for an enforcement warning to be made by the Presiding Officer followed by an order to leave if necessary. In the event, a person does not leave, the Presiding Officer may order removal. No waming is required for conduct relating to use of force or a true threat of force. Finally, the ordinance provides for penalties including prosecution under the Sanger Municipal Code or the Penal Code.
The Council may also adjourn a meeting if it becomes infeasible to restore order.

Proposed Revisions to Employee Recognition Program
Resolution No. 2,OZl -Ag
Attachment A - Revised Employee Recognition Program Administrative Policy CONFLICT OF INTEREST:
None known.
RECOMMENDATION:
That the City Council approve Resolution No[OZJ-US-to revise the Employee Recognition Program Administrative Policy.
EXECUTIVE SUMMARY:
On October 2I,2016, the City Council approved an Employee Recognition Program that provides a process in which to honor employees with Employee of the Year Award and Special Recognition Awards on an annual basis. Additionally, the Policy memorialized the City's process for recognizing employees for their length of service (Service Award), which has been a practice since the 1990s. City staff wishes to make a change to the means of recognition for Service Awards.
BACKGROUND:
The Employee Recognition Program aims to acknowledge and reward the achievements and contributions of staff members through various forms of recognition. For instance, Special Recognition awardees receive a plaque and letter of commendation, and the Employee of the Year awardee receives a plaque, $100 VISA gift card provided by the Executive Staff, and a floating holiday. Employees honored for their years of service receive a service pin. The Service Awards, Special Recognition Awards, and Employee of the Year Prepated by: Becky Padron Approved by:

35+ years of service

If the revised Policy is approved, the online gifting platform will be implemented this year for the 2023 Service Award recognitions. Employees who reached a five-year milestone in2023 will receive a link via email that will provide access to a catalog of gifts within the assigned value. The gift would be mailed directly to the employee. Ten employees will be recognized this year: three 5-year awards, two l5-year awards, four 20-year awards, and one 25-yeat award.
REASON FOR RECOMMENDATION:
The online gifting platform will provide more options and flexibility for the Service Award that suit the preferences and needs of different employees.

Participation in the Medi-Cal Intergovernmental Rate Range Program Contract for Intergovernmental Agreement for the Transfer of Public Funds between City of Sanger and Department of Health Care Services CONFLICT OF INTEREST:
None known.
RECOMMENDATION:
That the City Council approve the contract for the Intergovemmental Agreement for the Transfer of Public Funds between the City of Sanger and the Department of Health Care Services (DHCS).
This contract commits the City of Sanger Fire Department to participate in the Medi-Cal Intergovernmental Transfer Rate-Range Program for the recovery of unreimbursed ambulance service costs provided to Medi-Cal Plan patients.
EXECUTIVE SUMMARY:
Since 2006 the California Department of Health Care Services (DHCS) has offered local governments that provide health care the opportunity to secure additional Medi-Cal revenues by participating in a voluntary Intergovernmental Transfer (IGT) Program with their local Medi-Cal managed care plans. In Fresno County the two managed care plans are Anthem Blue Cross and CalViva. The Sanger Fire Department provides EMS ambulance transport, a Medi-Cal covered service to Medi-Cal plan members, therefore is eligible to participate in the IGT Program. In summary, the IGT process will result in the two Medi-Cal Managed Care Plans paying governmental providers of health care services additional Medi-Cal revenues to offset previously unreimbursed charges for serving Medi-Cal plan members. The payment amounts are determined by the provider's unreimbursed charges, the number of other local government Ptepated by: Gres Tatascou Approved by:

Approve Award of Consultant Services Agreement for Financial Analysis and Rate Study of the Solid Waste Disposal Operation
Attachment:
1. Consultant Services Agreement
CONFLICT OF INTEREST:
None known.
RECOMMENDATION:
Staff recommends that the City Council:
1. Approve a Consultant Services Agreement for the Financial Analysis and Rate Study of the Solid Waste Disposal Operation to Interstate Gas Services; and
2. Authorize the Interim City Manager to sign the agreement on behalf of the city.
EXECUTIVE SUMMARY:
The city has not adjusted disposal rates since 2011. Since then, Mid Valley Disposal (MVD) purchased the contract from Sunset Waste. The current contract with MVD includes a Consumer Price Index escalator so the fees have increased annually but the rates have remained static. Another factor affecting therateswasthepassageof SenateBill 1383 in2016. SB 1383 setstrictemissionreductiontargets throughout the State of California. One of the requirements of the bill is that the existing franchise agreements with waste haulers need to be updated to reflect the new requirements. These new requirements necessitate that solid waste rates be increased. Staff is recommending utilizing Interstate Gas Services, Inc. (IGS) to provide the hnancial analysis and rate setting. The city recently utilized IGS for water and sewer rate analysis and Prop. 218 compliance.

77 BACKGROUND:
The City of Sanger operates three separate Enterprise Funds, Sewer, Water, and Disposal, respectively.
The user rates for disposal have not been increased in over ten years. The last rate increases for disposal was performed by City staff and did not include in-depth analysis of the operations, users, and rate structures. The proposed financial services will include a thorough analysis of the operations and current rate structures to determine if they are not only fair and equitable but also sufficient to cover the growing operational and capital expenses. The consultant will also assist the City with meeting the complex legal requirements of Proposition 218 andattend related City Council meetings to ensure that the City Council and the public understand the need for rate increases.
IG Service has prior experience working for the City of Sanger performing required annual financial services related to all the City's outstanding bond debt. The Principal for IGService is well versed in the financials of the enterprise funds and has been reviewing the audited financials since 2013. IGService has also recently assisted staff with providing data for the recent bond refinancing. With the extensive prior experience with the City of Sanger, the total billed hours should be lower than the other three f,rrms.
The proposal included total hours and rates as well rates for additional meetings and direct costs such as mileage and a contingency. The not-to-exceed amount is $23,600.
REASON FOR RECOMMENDATION:
IGService has been providing financial services for the City for nearly a decade and is well versed in analyzing the enterprise funds. This will allow the project to move quickly while minimizing stafftime providing data and feedback. The Principal for IGService will also attend all meetings in person rather than virtual. Due to the impact of the SB1383 regulations, the franchise cost will increase to meet the new tougher standards. Staff is currently re-negotiating the franchise agreement with MVD.
FISCAL IMPACT:
The services provided under this agreement will be funded by the Disposal Enterprise Fund. The hourly rate for IG Service is $225 per hour plus direct costs such as travel, andal}Yo contingency. The total cost is not-to- exceed $23,600 which would come from Professional Services - 6290 in the FY 23124 budget. This will be a not-to-exceed amount and the billing will be detailed with time and tasks on each invoice like the scope in the Agreement.
ALTERNATIVES:
The City Council can reject the staff s recommendation and direct Staff to circulate an RFP ACTIONS FOLLOWING APPROVAL:
The attached Consultant Services Agreement will be executed, subject to the consultant providing the required insurance information.

To: Mayor and Council Members
From: Patrick Chaffee, Administrative Services Director Subject: Proposed RFP for Comprehensive Fee Study, Development Impact Fees Study, and Cost Allocation PIan
CONFLICT OF INTEREST:
None.
RECOMMENDATION:
That the City Council approve releasing an RFP for a Comprehensive Fee Study, Development Impact Fees Study, and Cost Allocation Plan.
BACKGROUND:
The City's current Master Fee Schedule was updated in 2021 and includes various fees for services provided by different departments, such as city clerk, administrative services, police, fire, public works, community development, parks and recreation. The fees are based on different methods of cost allocation, such as personnel effort, headcount, square footage, experiments performed, etc. However, the City has not conducted a comprehensive review and update of its cost allocation methodology and fee structure since 1993.
A Comprehensive Fee Study is a process of analyzing the costs of providing services and determining the appropriate fees to charge for those services. A Comprehensive Fee Study covers all types of fees, including user fees, regulatory fees, permit fees, fines, and charges. A Comprehensive Fee Study aims to ensure that the fees are consistent with the City's policies and goals, reflect the full cost of service delivery, and comply with legal requirements.
Development Impact Fees are one-time charges levied by the City on new development projects to pay Preoared bv: Patrick Chaffee Apptoved by:

89 for all or a portion of the costs of providing public infrastructure and services to the new development.
Public infrastructure and services include roads, schools, parks, recreational facilities, water and sewerage, among other things. Development Impact Fees are intended to reduce the financial burden on the existing taxpayers and residents who would otherwise have to pay for the increased demand for public facilities and services generated by the new development. The last comprehensive study on development impact fees was conducted in2007.
A Cost Allocation Plan is a document that describes how the City allocates its indirect costs to its various programs and activities. Indirect costs are costs that are not directly attributable to a specific program or activity, but benefit more than one program or activity. Examples of indirect costs are human resources, accounting, legal, and administrative services. A Cost Allocation Plan identifies the indirect cost pools, the allocation bases, and the allocation methods used to distribute the indirect costs to the programs and activities. A Cost Allocation Plan ensures that the City recovers its indirect costs in a fair and equitable manner, and that the City complies with state and federal regulations regarding cost allocation. The last time a Cost Allocation Plan was developed for the city was in 2019.
Staff is asking Council to consider seeking proposals from qualihed consultants to conduct a Comprehensive Fee Study, Development Impact Fees, and Cost Allocation Plan for the City. The purpose of the study is to ensure that the City is capable of charging fees that reflect the full cost of providing services, and that the fees are fair and equitable to the fee payers. The study will also help the City comply with state and federal laws and regulations regarding cost recovery and fee setting. By requesting all three sections in one RFP, the City could save time and resources, ensure consistency and compatibility, and facilitate communication and coordination.
FISCAL IMPACT:
The cost for a qualified consultant is unkown, but is one-time in nature, and therefore may be drawn down from the general fund balance without affecting the ongoing operating position of the City. The most qualified respondent will be presented to council for ratification at a later date. This document will provide a defensible base in which to manage city fees over time, and provide an alternative to increasing fees incrementally without reviewing actual costs. The expectation is that the study will present a breakdown of the true cost of services and let council decide where to achieve full cost recovery for services and where to subsidize programs with general fund tax revenue.
ACTIONS FOLLOWING APPROVAL:
Staff will release an RFP for a Comprehensive Fee Study, Development Impact Fees, and Cost Allocation Plan.

Consider Closure of City Hall December 26 through December 29 CONFLICT OF INTEREST:
None.
R TION:
That the City Council consider closure of City Hall between the Christmas and New Year Holidays.
EXECUTIVE SUMMARY:
Historically, there has been very little demand for public services in City Hall during the Christmas and New Year Holidays and it is anticipated that the trend will continue this year.
BACKGROUND:
City Hall will be closed on Monday, December 25th in observance of Christmas Day and on Monday, January 1't in observance of New Year's Day. The proposed closure would keep City Hall closed for four days, Tuesday, December 26 through Friday, December 29.
If the closure is authorized, employees will have the option of taking time off using their accrued leave, or may opt to work their normal schedules.
This would apply to non-sworn public safety and non-emergency fire/EMS staff. Public Works will follow the normal on-call procedures to handle any emergencies that may arise. The Police Department's Public Counter and other Public Safety emergency services will be operational and will function as normal.
