February 10, at approximately 11:30pm, Officers responded to a bar in the 1300 Block of 7th Street regarding a Security Officer from the bar calling to report that a male had brandished a firearm at him before driving off in a white Dodge Charger. After contacting the victim, it was determined the male had been at another bar for about one hour before he came outside to meet up with friends.
Some people in that group had open containers and attempted to get into the bar but were denied re-entry. They then tried to enter another establishment but were rejected because of the open containers. The male then went to a car, grabbed a gun, and placed it in his waistband while yelling at the victim, “What’s up.” The victim confirmed the gun was never pointed towards him but was still able to see it. City cameras were checked, which captured the Charger driving off. Still, no license plate information was obtained due to distance and lighting. • On
February 21st, at approximately 1:45pm, officers responded to a residence near JFK park for a report of a possible kidnapping. Upon arrival, the reporting party advised her 9-year-old daughter was pulled into a vehicle, while she was walking home from school in the area of Edgar and Faller. During that time, a white SUV/VAN being driven by a female pulled up next to her in the vehicle. Once the vehicle came to a stop an unknown person wearing all black clothing exited the vehicle. The juvenile was then pulled into the vehicle by the unknown person.
The vehicle drove a short distance and during that time the juvenile began to cry and scream. The vehicle then pulled over and allowed the juvenile to exit. The juvenile then ran home and told the RP about the incident.

RE: FIRE DEPARTMENT REPORT FOR FEBRUARY
For the month of February, there were 270 calls for service for ambulance services within our area and within surrounding areas. Crews were also dispatched to 48 requests for services for fire calls, including house fires, trash and warming fires, building fires, vehicle fires and unintentional or false alarm calls. This total equates to 318 calls for service in February, or just about 11 calls per day.
Chute times are measured from the time the station is notified of an alarm to the time the unit goes enroute.
For the month of February our average chute time was measured at 66 seconds, well below our benchmark of 90 seconds. Approximately 83% of the time our crews have a chute time of less than 90 seconds. Our travel time is measured from the time the unit is enroute to the time that we arrive on scene. For February our median enroute time was 5 minutes, 37 seconds within the City. This meets our benchmark of under 6 minutes within the City. Our total call time for the month of January at the 90th percentile was measured at 1 hour and 28 minutes per call. It is also important to note that this time for January equates to about 15 hours outside of the station in a 24-hour period, or 63% of the day crews are on a call for service.
In February the Fire Department conducted Department Head interviews for Firefighter and for a part-time Clerical Aide. Unfortunately, there was only one candidate for Firefighter and two vacancies, so another recruitment was conducted. A recruitment was opened and a total of 44 candidates applied, with three removed for not meeting the minimum requirements. A written test is scheduled for March 12 with an oral board to follow. Additionally, we have opened another recruitment for Non-Safety Paramedic. We anticipate at least two vacancies at Firefighter in the next month or two with another vacancy at Non-Safety Paramedic.
Administratively we have completed the move out of the administrative offices at the Fire Department and are now located at temporary offices at 1533 7th Street, across from United Health Center and the American Legion office. The Fire Station remodel continues to progress forward, plans were completed to 90% and have since return to the Design/Build Team Diede Construction. They still anticipate permits being pulled and work to start the first of April. They continue to remain on pace to complete the project toward the end of November this year, barring any approved delays.
I am of course always available to answer any questions you have.

CITY OF SANGER
REPORT TO THE CITY COUNCIL
To: Mayor and City Council
From: Esperanza Rosales, Deputy Public Works Director Subject: CalRecycle SB 1383 Local Assistance Grant Program Attachments: 1) Resolution No. 2024-10 & Exhibit A – Budget Adjustment
CONFLICT OF INTEREST:
None known.
RECOMMENDATION
Staff recommends that the City Council approve Resolution No. 2024-10 approving a budget adjustment to the Fiscal Year 2023-2024 budget to record the receipt and appropriation of $76,049 from the Department of Resources Recycling and Recovery (CalRecycle) for the SB 1383 Local Assistance Grant Program.
EXECUTIVE SUMMARY
The California Department of Resources Recycling and Recovery (CalRecycle) has established the SB 1383 Local Assistance Grant Program to provide one-time funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383.
BACKGROUND
In 2016, then-Governor Jerry Brown signed SB 1383 to reduce emissions of short-lived climate pollutants through mandatory recycling of organic waste. The regulations for SB 1383 require jurisdictions to 59 implement a variety of organic waste recovery programs including curbside collection, education and outreach, contamination monitoring, edible food recovery, and inspection and enforcement.
CalRecycle announced the availability of the SB 1383 Local Assistance Grant Program intended to provide jurisdictions with grant funds to assist in implementing the various programs. The Public Works Department staff has been working to create and implement required program activities. Staff has proposed that the grant funds can be used more effectively to meet the procurement objectives of the program.
REASON FOR RECOMMENDATION
The State mandate to comply with SB 1383 requires several programs to be implemented. These funds will help with achieving program requirements.
F
ISCAL IMPACT
Accepting the grant funds would not result in any anticipated fiscal impacts and the grant program does not have a matching requirement.
ALTERNATIVES
Do not approve the resolution and forfeit the funds. City will then use Disposal Enterprise funds to implement SB 1383 requirements.
ACTIONS FOLLOWING APPROVAL
City staff will record the budget amendment.

CITY OF SANGER
REPORT TO THE CITY COUNCIL
To: Mayor and City Council
From: Josh ua Rogers, City Engineer
Subject: Bethel and Annadale Traffic Signal Improvements Contract Award
Attachment:
1. Contract
CONFLICT OF INTEREST:
None known.
RECOMMENDATION:
Staff recommends that the City Council:
1. Award the contract for the project to St. Francis Electric, LLC., 975 Carden Street, San Leandro, CA 94577, in the amount of $81,900.00, as lowest responsive and responsible bidder; and
2. Approve a construction contingency for change orders in the amount of $ 8,200 (10%) for this project; and
3. Authorize the City Manager to sign contract documents on behalf of the City.
EXECUTIVE SUMMARY:
This locally-funded project will construct minor upgrades to an existing traffic signal that does not currently conform to the standards required for traffic signals within the City.
BACKGROUND:
The traffic signals in the Ci ty of Sanger are maintained and operated under a Maintenance Agreement 64 \\nas1\shared\Forms & Templates
with the City of Fresno, executed by both agencies in 1986. The Agreement stipulated that the City of Fresno would operate and ma intain the existing signals at the time as well as future signals needed by the C ity of S anger, as long as the signals meet all the requirements of Caltrans and Ci ty of Fresno Specifications and Tests. The responsibility with the C ity of Fresno is designated to the ir Traffic Signals and Street Lights (TSSL) Division.
The signal at the subject intersection has existed since around the late 1990s and was installed when Sanger High School was built at Bethel and Annadale. C ity of Fresno TSSL has mai ntained it since then, and not much has changed at the intersection in that time . With a recent project to constru ct sidewalk along the east side of Bethel Avenue and a new curb ramp at the intersection, TSSL performed some inspections of traffic signal detection loops and othe r mi nor work and made a determination that some of the signal infrastructure needed to be updated in order to me et current City standards and conform to the Maintenance Agreement. T hey provided a punchlist to City staff which was developed into a set of plans and specifications to construct the improvements.
The work primarily relates to minor adjustments to electric pull boxe s and detector lo op placements, but also includes the removal of the existing advance warning beacon for northbound traffic, l ocated just north of A lmond Avenue. This be acon is not needed, nor recommended per the Manual on Uniform Traffic Control Devices (MUTCD) and is c urrently i mproperly wired through the traffic signal controller. Instead of spending additional funding on a device that is unnecessary, Staff has elected to just remove it. It is a possibility that the similar beacon for SB traffic, locat ed just south of the Walmart shopping center may be removed as well, although modifications to that beacon were not a requirement of the TSSL punchlist.
During the project bidding phase, the Notice Inviting Bids was advertised in the Mid Valley Times and circulated in the local builders’ exchanges. Additionally, other reputable contractors experienced with this type of construction were made aware of the project and invited to bid on the project as well.
On February 28, 2024 the City Engineer received and opened one bid proposal for this project:
C
ontractor B id
1. St. Francis Electric, LLC $81,900.00
E ngineer’s Estimate $75,000.00
The bid w as analyzed and it was determined that St. Francis submitted a responsive and responsible bid and as such, Staff recommends that they be awarded the contract.
REASON FOR RECOMMENDATION:
Award of the contract will allow the City to proceed with the project.
FISCAL IMPACT:
The estimated cost for the construction phase of the project is $102,500, as detailed below:
• Construction - $81,900
• Construction Contingency - $ 8,200
• Construction Management/Inspection/Testing/Admin - $ 12,400 65 \\nas1\shared\Forms & Templates
The project is being funded by Transportation Development Act (TDA) Funds, which are considered part of the City’s Local Transportation Fund revenue. The budget for the project is proposed to be adjusted from $75,000 to $150,000 with the mid-year budget adjustments, based on the Engineer’s Estimate prior to bid opening. With the low bid received, this adjusted budget would be sufficient to cover the current projected costs.
ALTERNATIVES:
The Council may reject all bids and re-advertise.
ACTIONS FOLLOWING APPROVAL:
The contract will be executed, subject to the Contractor providing performance security satisfactory to the City. After issuance of the Notice to Proceed, the Contractor will have 15 working days to complete the project.

Otherwise, the statement will be deemed to have been accepted.

All warranties express or implied, from subcontractors, manufacturer, or suppliers, of any tier, for the materials furnished and work performed shall be assigned, in writing, to the Owner, and such warranties shall be delivered to the Engineer prior to acceptance of the 73 Contractor’s performance of the Contract.
The Contractor shall replace or repair defective materials and workmanship in a manner satisfactory to the Engineer, after notice to do so from the Engineer, and within the time specified in the notice. If the Contractor fails to make such replacement or repairs within the time specified in the notice, the Owner may perform the replacement or repairs at the Contractor’s expense. If the Contractor fails to reimburse the Owner for the actual costs, the Contractor’s Surety shall be liable for the cost thereof.
9. L
IQUI DATED DAMAGES.
Failure of the Contractor to complete the Work within the time allowed will result in damages being sustained by the Owner. Such damages are, and will continue to be, impracticable and extremely difficult to determine. For each consecutive calendar day in excess of the time specified for completion of the Work, as adjusted in accordance with Section 7 above, the Contractor shall pay to the Owner, or have withheld from monies due it, the sum of $500.00, unless otherwise specified in the Special Provisions.
Execution of the Contract shall constitute agreement by the Owner and the Contractor that $500.00 per day is the minimum value of the costs and actual damage caused by the failure of the Contractor to complete the Work within the allotted time. Such sum is liquidated damages and shall not be construed as a penalty, and may be deducted from payments due the Contractor if such delay occurs.
10. IN
DEMNIFICATION

CITY OF SANGER
REPORT TO THE CITY COUNCIL
TO: MAYOR AND COUNCILMEMBERS
FROM: Becky Padron, City Clerk/Deputy Personnel Officer SUBJECT: Consideration of ordinance updating Council District 1 Boundaries to include property annexed into the City (North Academy Corridor Annexation)
Attachments: A. Ordinance amending 2-29 the Sanger City Code and adopting revised district boundaries
B. Map Depicting Added Territory to Council District 1
RECOMMENDATION: Waive full reading and introduce by title only Ordinance No. 2024-01 of the City Council of the City of Sanger amending Section 2 -29 of the Sanger City Code Adjusting the Boundaries for City Council Election District No. 1 t o Add the Annexed North Academy Corridor Area To Council District 1 As Required By Law.
SUMMARY:
The City Council has held five public hearings to receive public input on district boundaries to account for property annexed to the City and has selected a map which now includes the North Academy Corridor annexed property to Council District 1. To complete this process, the Sanger City Code must be amended to reflect the new boundaries for District 1. The proposed ordinance reflects the changes to District 1.
While all four districts are part of Sanger City Code Section 2-29, only District 1 boundaries are being amended.
BACKGROUND:
As explained in greater detail in the five public hearings relating to redistricting, s ince the adoption of the current Council district boundary maps, there has been a significant annexation , the North Academy Corridor Annexation in the northwest portion of the City, adjacent to Council District 1. While the area is now in the City, it is not within a Council district; thus the Council District boundaries must be modified to incorporate the annexed area.
83 DISCUSSION:
State laws set strict criteria for the updates of the district boundaries in such circumstances. Specifically, the City Council is required to add the new territory "to the nearest existing Council district” without changing the boundaries of other Council district boundaries. As a result, the City’s discretion is limited regarding the present annexation.
The City has held five public hearings to receive public comment as required by the Elections Code. The next step is to amend the Sanger City Code to formally add the annexed territory. This is done by first introducing the ordinance, and then approving the ordinance at a subsequent regular meeting of the Council.
As District 1 is the “nearest existing Council d istrict” to the annexed property, the ordinance proposes to add the annexed territory to District 1 consistent with the mandatory requirements of State law.
ALTERNATIVES:
Decline to introduce the Ordinance at this time or continue the matter to a future meeting.
REASON FOR RECOMMENDATION:
To comply with state law which requires that Council districts be redrawn to account for annexed territory.
FISCAL IMPACT:
There is no fiscal impact to modifying the boundaries other than staff time to prepare the necessary staff reports and modify the district boundary maps.
ACTIONS FOLLOWING APPROVAL:
The City Clerk will submit the ordinance and GIS shape files to the Fresno County Elections Office. 84

RECOMMENDATION:
That the City Council receive staff’s report and conduct the public hearing ; waive the full reading and introduce, by title only, Ordinance No. 2024 -02, an Ordinance of the City Council of the City of Sanger approving Zoning Ordinance Text Amendment 2024-01 amending Sections 90-23 and 90-887, and adding Section 90-901, to the Sanger City Code relating to electric vehicle charging station permit streamlining and associated CEQA finding under CEQA Guidelines 15061(b)(3).
EXECUTIVE SUMMARY:
The State of California adopted Assembly Bill 1236, which requires local agencies to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging systems. The State of California also adopted Assembly Bill 970, which requires local agencies to deem an application complete and approved within a certain timeframe if all requirements are met. The proposed Zoning Ordinance Amendment would change electric vehicle parking standards to be in accordance with Assembly Bill 1236 and Assembly Bill 970.
90 BACKGROUND:
On October 8, 2015, the State of California adopted Assembly Bill 1236, which requires local agencies to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging systems. The State of California also adopted Assembly Bill 970, which requires local agencies, including charter cities, to deem an application complete and approved within a certain timeframe if all requirements are met.
Assembly Bill 1236 amended Government Code Section 65850.7 to require jurisdictions with a population less than 200,000 residents to establish procedures for expedited, streamlined processes for permitting electric vehicle charging stations. Additionally, Assembly Bill 970 requires local agencies, including charter cities, to deem an application complete and approved within a certain timeframe if all requirements are met.
The amendments to Section 65850.7 include the requirement for a jurisdiction to adopt an ordinance for the expedited, streamlin ed process. The ordinance must include a requirement that a jurisdiction adopt a checklist of requirements with which a permit application for an electric vehicle charging station will be eligible for expedited review.
The proposed Zoning Ordinance Amendment has been submitted by city staff to change electric vehicle parking standards to be in accordance with Assembly Bill 1236 and Assembly Bill 970. In essence, the proposed amendment provides for:
• Definitions and technical parameters specific to electric vehicles, including the various levels of EV ready space;
• An expedited, streamlined permitting process for electric vehicle charging stations and creation of a checklist of all requirements which electric vehicle charging stations shall comply with in order to be eligible for expedited review.
• The availability of the checklist, applications, and other relevant materials on the City’s website to promote public access, etc.,
• Requirements for electrical vehicle charging stations, • An application, permit, and administrative review process, and • EV parking requirements based on various types of land uses.
At the regular meeting of the City of Sanger Planning Commission held on January 25, 2024, the Planning Commission adopted Resolution No. 2024-05 recommending approval by the City Council of an ordinance streamlining the electric vehicle charging station permit process.
REASON FOR RECOMMENDATION:
Adopting the proposed Ordinance brings the City’s zoning ordinance into compliance with state mandated requirements regarding streamlined electric vehicle charging station permit process.
FISCAL IMPACT:
No fiscal impact.
ALTERNATIVES:
The City Council may choose not to introduce the proposed Ordinance. If so, the City Council should provide any requested edits to the Ordinance or reasons for doing so.

EXECUTIVE SUMMARY:
GPA 2022-02 and ZMA 2023-02 have been submitted by the applicant, Mike Aziz, to revise the General Plan Land Use and Zone District of the subject property. The request is a partial redesignation and rezoning of the site, amending the northern portion of the property to conform with the existing use. The applicant is proposing to keep the residential land use and zoning of the southern portion of the property unchanged. The project h as been determined to be consistent with the Environmental Impact Report (EIR) prepared for the 2035 General Plan Update. It is recommended the City Council adopt a finding of consistency with the 2035 General Plan EIR.
BACKGROUND:
The City has received an application for a General Plan and Zoning Map Amendment for a property located on the south side of Jensen Avenue, between Bethel and Lyon Avenues, 2431 Jensen Ave. State law requires that the zone district and land use of property be consistent with each other as designated in the Land Use Element of the General Plan. Without consistent land use and zoning, future development, expansion, or changes in use are limited.
The Land Use Element of the General Plan currently designates the property as Commercial Office. Under this land use designation, the only zone district consistent would be the existing zone district, C -P. In the C-P zone district, restaurant uses are not permissible. This would mean the existing restaurant (Big Mama’s) located on the northern portion of the property is not a permitted use, and would be referred to as legally existing, non- conforming. A property with a use that is legally existing, non -conforming cannot be expanded and has limited future development potential. The project as proposed would result in redesignating the land use and rezoning the northern portion of the property to achieve consistency with the current use of the property as a restaurant. This is also to facilitate future expansion of the existing use, and allow for new development of the property.
The land use proposed for the northern portion of the property is Neighborhood Commercial (GPA 2022- 02). The General Plan describes th e Neighborhood Commercial land use designation to “… allow for the development of small-scale commercial developments within or nearby residential areas, that are designated to serve the daily needs of residents…”. Due to the property’s close proximity to existing residential uses , it can be found this is an appropriate land use.
As mentioned above, the current use of the property as a restaurant is not permitted in the C-P zone district.
However, with the proposed land use designation changed to Neighborhood Commercial, the only Subject Property,
2431 Jensen Ave
106
consistent zone district is C -1. Under the C -1 zone district, the current use would be permissible with a conditional use permit. It would also allow future expansion and development, which the owner has expressed interest to staff in pursuing. This leads to the need of rezoning the property from C -P to the C-1 zone district (ZMA 2023- 02). Any future expansions or new development would be required to comply with the development standards of the C-1 zone district.
The City of Sanger has conducted an environmental analysis of the proposed General Plan and Zoning Ordinance Amendment, and this project has been determined to be consistent with the 2035 General Plan and Environmental Impact Report (EIR) (SCH #2018031047) certified by the City for the General Plan.
Staff recommends the City Council adopt a Finding of Consistency with the EIR for this project.
Planning Commission Resolution No. 2024-04 (Attachment 3) was adopted by the City of Sanger Planning Commission on January 25, 2024. This resolution recommends the City Council adopt a resolution and ordinance changing the land use and zone district of the property as proposed.

REASON FOR RECOMMENDATION:
Adopting City Council Resolution No. 2024-11 and Ordinance No. 2024-03 brings the existing use into consistency and would allow for future expansion and development of the property.
FISCAL IMPACT:
No fiscal impact.
ALTERNATIVES:
The City Council may choose not to adopt City Council Resolution No. 2024-11 and introduce Ordinance No. 2024-03. If so, the subject property would remain a legally existing, non-conforming use.
ACTIONS FOLLOWING APPROVAL:
The General Plan Land Use Map will be revised to reflect City Council Resolution No. 2024- 11. If introduced, Ordinance No. 2024-03 will be placed on the next regular meeting’s agenda for adoption.

Recitals. The City Council hereby finds that all of the facts set forth in the recitals above are true and correct and incorporated herein.
S
ection 2 . CEQA. The City Council finds the project is consistent with the Environmental Impact Report (EIR) (SCH #2018031047) certified by the City for the 2035 General Plan and is fully within the scope of the same. The EIR analyzed the impacts of development anticipated in the General Plan area. The 2035 General Plan and its EIR contemplated refinement of zone designations for properties. The impacts associated with both the proposed project were previously analyzed in the EIR. The City Council finds that there is no substantial new evidence in the record that this project may have additional significant impacts that were not analyzed as significant adverse effects in the EIR. Additionally, there is no substantial new evidence of potentially significant off-site impacts and cumulative impacts that were not discussed in the EIR, and no potentially significant adverse effects peculiar to the project. Finally, the City Council finds that there are no previously identified significant effects, which as a result of substantial new information which was not known at the time the EIR was certified, that have a more severe adverse impact than assessed in the EIR. Given the forgoing, a Finding of Consistency is warranted for this project.
S
ection 3 . CEQA Approval and Mitigation Monitoring and Reporting Program. Based on the foregoing, the City Council adopt s a Finding of Consistency for the project, including the associated Mitigation Monitoring and Reporting Program, as the project will not result in any significant, adverse, env ironmental impacts greater than that assessed by the EIR with the mitigation imposed by the EIR. The City of Sanger Community Development Department located at 1700 7th Street, Sanger, CA, 93657, is designated as the custodian of the documents and other materials that constitute the record of proceedings upon which the decision is based. The City Councils authorize the Director, or designee, to execute and file with the Fresno County Clerk, as appropriate, a Notice of Determination for approval of the project.
S
ection 4. General Plan Findings. The City Council finds that the proposed amendment is consistent with the goals, objectives, and policies of the Sanger General Plan. In this regard, the City Council finds that public necessity, convenience, general welfare, and good practices justify adoption of General Plan Amendment No. 2022-02.
S
ection 5. Approval of General Plan Amendment No. 2022-02. T he City Council approves General Plan Amendment No. 2022-02 for specified land use designations identified in Exhibit “A” attached hereto and incorporated herein.

The change is also necessary for good zoning practices to achieve the balance of land uses desired by the City and to provide sites for needed retail, commercial, and public facilities, consistent with the General Plan. SUBJECT: REVIEW COC APPLICATIONS
Sanger Fire Chief Greg Tarascou and I had an opportunity to review the applications received for consideration to fill vacancies on the Measure S Citizen’s Oversight Committee (COC), Below is a summary, in no particular order, of our review of their applications:
Applicant: Chaided Bouasavanh
Chaided, a resident of Sanger, listed 14yrs in the United States Army in the “training, experience, and/or education” portion of the application. The only other information Chaided supplied in the application was a statement in the “Briefly state why you wish to serve on the City of Sanger Citizen’s Oversight Committee,” which read: “To continue my service to this country and local communities.”
Applicant: Hector Madrigal
Mr. Madrigal has been a resident of Sanger for nineteen (19) years. He served 29yrs with the California Highway Patrol prior to retiring. He has an AA Degree in Administration of Justice from the College of the Sequoias. He has participated in multiple community activities and states his interest in joining the COC is to be a part of the “future growth of our city and ensure safety services are sufficient for public order.”
Candidate Bouasavanh presented limited information on the submitted application but indicated a background of service based on tis time in the US Army.
