CITY OF SANGER

REPORT TO THE CITY COUNCIL
To: Mayor and Councilmembers
From: Nathan Olson, City Manager
Subject: Approval of Memorandum of Understanding (MOU) with the Fresno County Rural Transit Agency (FCRTA) for Affordable Housing and Sustainable Communities (AHSC) Program Improvements and Micro transit Services
A
ttachments: (1) Memorandum of Understanding between the City of Sanger and Fresno County Rural Transit Agency
CO
NFLICT OF INTEREST:

None known
RE
COMMENDATION:

That the City Council authorize the City Manager to execute a Memorandum of Understanding with the Fresno County Rural Transit Agency for capital improvements and micro transit services funded through the Affordable Housing and Sustainable Communities (AHSC) Program.

EXECUTIVE SUMMARY:

The City of Sanger has been awarded Affordable Housing and Sustainable Communities (AHSC) Program funding from the California Department of Housing and Community Development for improvements associated with a housing project located at 1310 Faller Avenue. The proposed MOU establishes the terms under which FCRTA will serve as a subrecipient of these funds to provide capital improvements and microtransit services at the project site.

Under the agreement, FCRTA will install a microgrid system, procure an electric vehicle, and provide microtransit services or transit passes for residents. The City will reimburse FCRTA up to $800,000 upon completion of eligible work. The MOU term is three years, with the option for extension of up to two additional years by written amendment.

PAGE 21

BACKGROUND:

The AHSC Program supports projects that reduce greenhouse gas emissions by integrating affordable housing with transportation and energy improvements.

The City of Sanger was awarded AHSC funding as the primary recipient for a housing development project at 1310 Faller Avenue. As part of the project, transportation and energy infrastructure improvements are required to enhance mobility options for residents and support sustainable operations.

FCRTA will act as a subrecipient to implement the transit-related components of the project, which include:
- Installation of a localized battery energy storage system (“microgrid”) and Level 2 electric vehicle charging station
- Procurement of one electric vehicle for service at the project site - Provision of micro transit services and/or transit passes for residents - Ongoing operations beginning no later than January 1, 2027 and continuing through the term of the agreement
REASON FOR RECOMMENDATION:

Approval of the MOU is necessary to implement required transit and energy components associated with the AHSC grant award. FCRTA possesses the operational expertise and infrastructure necessary to deliver micro transit services and associated capital improvements efficiently and in compliance with grant requirements.

Entering into this agreement will ensure compliance with State funding conditions, advance the City’s sustainability and mobility goals, improve transportation access for residents, and support long-term reduction in greenhouse gas emissions.

FISCAL IMPACT:

The City will reimburse FCRTA up to $800,000 for eligible work completed under the MOU. Funding for this reimbursement is provided through the AHSC Program and is included in the project’s approved funding allocation. No additional impact to the City’s General Fund is anticipated.

ALTERNATIVES:

Do not approve the MOU, which could jeopardize compliance with AHSC funding requirements and delay or prevent implementation of the transportation components of the project.

ACTIONS FOLLOWING APPROVAL:

City staff will execute the MOU and coordinate with FCRTA to administer funding, oversee implementation of capital improvements, monitor service delivery, and ensure compliance with AHSC Program requirements.

CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and Council Members
From: Dr. Joshua Goggins, Community Development Director Subject: Agreement between the County of Fresno and City of Sanger to permit limited development of property in process of annexation (Tentative Tract Map No. 6493).

Attachments:

1. County-City Agreement

2. Resolution No. 2026-14

3. Project Site Map

4. Resolution No. 2025-05

5. Resolution No. 2025-06

6. Resolution No. 2025-81

RECOMMENDATION:

That the City Council authorize the City Manager to execute the “Agreement Between County of Fresno and City of Sanger to Permit Limited Development of Property in Process of Annexation,” specifically for the project identified as Tentative Tract Map No. 6493, pursuant to Fresno County Ordinance Code Section

15.04.140.

EXECUTIVE SUMMARY:

The City of Sanger is currently in the final stages of annexing a residential development project known as Tentative Tract Map No. 6493. While the City Council has already approved the project’s entitlements (General Plan Amendment, Rezoning, and Tentative Map), the legal annexation process with the Fresno County Local Agency Formation Commission (LAFCo) is still pending recordation.

To prevent a significant delay in construction, the developer has requested to begin “ limited PAGE 28

development” activities. Because the property is technically still under County jurisdiction until the LAFCo process is finalized, Fresno County requires this formal agreement. This document serves as a legal bridge, allowing the developer to proceed with grading and infrastructure installation under City standards while indemnifying the County from liability. This is a standard procedural step used to ensure housing projects remain on schedule during the transitional period of annexation.

BACKGROUND:

On October 16, 2025, the City Council took formal action to approve Resolution No. 2025-80. This action was comprehensive, adopting a Mitigated Negative Declaration in compliance with the California Environmental Quality Act (CEQA) and approving the primar y entitlements for Tentative Tract Map No. 6493. Following that approval, City staff initiated the reorganization and annexation request to bring the project site officially into the City of Sanger’s corporate limits.

The Fresno County Ordinance Code (Section 15.04.140) recognizes that the time required to complete a formal annexation can often stall shovel -ready housing projects. To mitigate this, the County allows for limited development permits to be issued if the City and County enter into a specific agreement.

Under the terms of the attached agreement , the City of Sanger must certify in writing that all onsite and offsite improvements (such as, but not limited to, streets, sewers, and water lines) satisfy the City of Sanger’s municipal ordinances and engineering standards. Furthermore, the City agrees to enforce these standards throughout the construction process and assume full responsibility for the project once the annexation is officially recorded. Finally, the agreement includes a hold harmless provision tha t protects the County from any claims or liabilities arising from development activities that occur before the land officially changes jurisdiction.

REASON FOR RECOMMENDATION:

Authorizing this agreement is critical for maintaining the momentum of Sanger’s residential growth.

Construction seasons in the Central Valley are often dictated by weather windows; delaying grading and underground utility work until the final LAFCo recordation could push the project back by several months or even a full year. By executing this document, the City ensures that the project is built to Sanger’s specific municipal standards from day one, even while the land is technically under County oversight. This eliminates the risk of “substandard” infrastructure being built and later handed over to the City.

Furthermore, it demonstrates the City's commitment to supporting developers who are actively working to increase the local housing supply.

FISCAL IMPACT:

No fiscal impact.

ALTERNATIVES:

An alternative is denial of authorization, in that, the City Council could decline to sign the agreement.

This would force the developer to wait until the LAFCo annexation is fully recorded (which could take several more months) before pulling any permits. This is not recommended as it unnecessarily delays the project. An additional alternative is for the City Council to request agreement modifications. More specifically, the City Council could request specific changes to be made to certain facets of the agreement; however, this is a standard County form, and significant changes would likely require additional legal review by both City and County Counsel, further delaying the project.

PAGE 29
ACT
IONS FOLLOWING APPROVAL:

U
pon City Council authorization, the City Manage r and City Attorney will execute the Agreement. Once executed, these documents will be forwarded to the Fresno County Department of Public Works and Planning.

At that point, the City’s involvement is complete, and the County will facilitate the necessary approvals for the developer to begin site work for Tentative Tract Map No. 6493.

WHEREAS, the Planning Commission of the City of Sanger did conduct a duly noticed public hearing in the Council Chambers of the Sanger City Hall in Sanger, California, on July 24, 2025, to consider a recommendation of approval to the City Council for ANX 2024-01, GPA 2024-01, ZOA 2024-05, and the MND prepared for the Project, at which time all interested parties were given an opportunity to be heard and present evidence; and

WHEREAS, after due consideration of all the items before it, the Planning Commission now desires to recommend the City Council i) approve the Mitigated Negative Declaration prepared for the Project, and ii) approve GPA 2024-01, and iii) approve ZOA 2024-05, and iv) approve ANX 2024-01, initiating annexation proceedings with Fresno LAFCo.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Sanger as follows:

1. Recitals. The Planning Commission hereby finds that all of the facts set forth in the recitals above are true and correct and incorporated herein.

2. CEQA Findings: Pursuant to the authority and criteria contained in the California Environmental Quality Act (CEQA) of 1970, the City, as the Lead Agency, has analyzed the proposed Project, including ANX 2024-01, GPA 2024-01, ZOA 2024-05, CUP 2024-01, and TTM 2024-01, and has prepared a Mitigated Negative Declaration as described above to evaluate the environmental effects of the Project, including development of the proposed tentative map area. The Planning Commission has fully considered the MND, and recommends the City Council find that the Project is not located on a site which is included on any of the lists enumerated under Section 65962.5 of the Government Code including, but not limited to, lists of hazardous waste facilities, land designated as hazardous waste property, hazardous waste disposal sites and others, and the information in the Hazardous Waste and Substance Statement required under subdivision (f) of that Section. Additionally, the proposed Project will not result in any adverse effects which fall within Guidelines. Finally, with the mitigation imposed, there is no substantial evidence in the record that this Project may have any direct, indirect or cumulative effects on the environment that are significant.

3. General Plan Findings, GPA 2024-01. The Planning Commission finds, and recommends the City Council find, that the proposed amendment is consistent with the goals, objectives, and policies of PAGE 70
the Sanger General Plan. Specifically, Growth Management Land Use Policy III on Page 2-47 of properties which are closer to the existing built-up area or which are in-fill parcels. The Project is proposed adjacent City Limits and existing residential subdivision. The 14.27 acre reduction in Park/Open Space designation proposed by GPA 2024-01 allows for compact development preventing urban sprawl by increasing the density of residential units. This is supported also by Policy II of Growth Management on Page 2-
The Planning Commission
recommends the City Council find that public necessity, convenience, general welfare, and good practices justify adoption of General Plan Amendment 2024-01 and approval is in the public interest.

4. General Plan Consistency for ZOA 2024-05. The Planning Commission finds that ZOA 2024-05 is consistent with the goals, objectives, and policies of the Sanger General Plan, as modified by GPA 2024-01. In this regard, the Planning Commission recommends the City Council find that public necessity, convenience, general welfare, and good zoning practices justify approval of ZOA 2024-05. Specifically, the pre-zoning change is consistent with the General Plan goals and policies, any operative plan, or adopted policy, and implements the planned land uses in the Project area.

The change is also consistent with the purpose of the Development Code to promote the growth of the city in an orderly and sustainable manner, and to promote and protect the public health, safety, peace, comfort, and general welfare. The change is also necessary for good zoning practices to achieve the balance of land uses desired by the City and to provide sites for needed residential, parks, opens space, trails, and a recharge basin consistent with the General Plan.

5. Recommendation for Approval of MND, ANX 2024-01, GPA 2024-01, and ZOA 2024-05 for Tract 6493. The Planning Commission recommends to the City Council approve the Mitigated Negative Declaration, GPA 2024- -05 as shown in Exhibit -01 initiating annexation proceedings with LAFCo for the Project area, including APNs 322-020-18S and 322-020-08.

6. Effective Date. This Resolution shall become effective upon adoption. * * * * *

WHEREAS, after due consideration of all the items before it, and at the request of the developer, the Planning Commission now to desires to contingently approve TTM 2024-01 and CUP 2024-01 such that no decision of approval of TTM 2024-01 and CUP 2024-01 becomes final and effective until immediately after the City Council adopts the MND for the Project and approves ANX 2024-01, GPA 2024-01, and ZOA 2024-05, and if no such approval occurs within 180 days of the adoption of this Resolution, then the Planning Commission intends that TTM 2024-01 and CUP 2024-01 be returned to the Planning Commission for further consideration and a final decision by the Planning Commission.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Sanger as follows:

1. Recitals. The Planning Commission hereby finds that all of the facts set forth in the recitals above are true and correct and incorporated herein.

2. CEQA: Pursuant to the authority and criteria contained in the California Environmental Quality Act (CEQA) of 1970, the City, as the Lead Agency, has analyzed the proposed Project, including ANX 2024-01, GPA 2024-01, ZOA 2024-05, CUP 2024-01, and TTM 2024-01, and has prepared a Mitigated Negative Declaration as described above to evaluate the environmental effects of the Project, including development of the proposed tentative map area. The Planning Commission has fully considered the MND, and has concurrently recommended it for approval by the City Council.

The Planning Commission finds that CUP 2024-01 and TTM 2024-01 are consistent with, and has been fully assessed by, the MND, and that CUP 2024-01 and TTM 2024-01 are entitlements specifically anticipated for the proposed Project in the MND, and are consistent with the purpose and intent of the MND. As such, CUP 2024-01 and TTM 2024-01 have been fully environmentally assessed, and no further assessment is required by CEQA.

3. Conditional Use Permit Findings: The Planning Commission finds that all findings necessary for the approval of CUP 2024-01 for a PUD can be made, and has reviewed the CUP for compliance with Sanger City Code Section 90-1016(4), including the following:

a. Finding 1: That the proposed location of the planned unit development is in accordance with the objectives of this chapter.

The site is a large agricultural property that has previously and is currently been agricultural in use. The location of the site is adequate in size and shape to accommodate the proposed use. This finding can be made.

b. Finding 2: That the proposed location of the planned unit development and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the PAGE 75
vicinity.

The project site is pre-zoned for residential use, and has been designed and conditioned to be operated or maintained in a manner that will not be detrimental to the public health safety or welfare, or be materially injurious to properties or improvements in the vicinity.

This finding can be made.
c. Finding 3: That the proposed planned unit development will comply with each of the applicable provisions of this section.

The Project proposes only uses permitted in the districts of the zoning districts of the planned unit development. The site is 78 acres, meeting the five-acre minimum for a Planned Unit Development. The Applicant has demonstrated by the design proposal that the objectives of Sanger Municipal Code Sec. 90-1014 through 90-1017 will be achieved.

This finding can be made.
d. Finding 4: That the standards of population density, site area and dimensions, site coverage, yard spaces, heights of structures, distance between structures, off-street parking and off-street loading facilities and landscaped areas will produce an environment of stable and desirable character consistent with the objectives of this chapter.

The standards of population density, site area and dimensions, site coverage, yard spaces, height of structures, distance between structures, off-street parking and off-street loading facilities and landscaped areas were all considered to ensure the project will produce a more functional, aesthetically pleasing, and harmonious living and working environment.

This finding can be made.
e. Finding 5: That the standards of population density, site, area and dimensions, site coverage, yard spaces, heights, of structures, distance between structures, off-street parking and off-street loading facilities will be such that the development will not generate more traffic than the streets in the vicinity can carry without congestion and will not overload utilities.

The conditions of approval regulate the construction and operation of the proposed subdivision Project and are intended to allow the proposed use to operate harmoniously with surrounding uses. The proposed Project completed a Traffic Impact Study as part of their environmental review, and will be required to construct traffic improvements to ensure that the development will not generate more traffic than the streets in the vicinity can carry without congestion, nor overload utilities. This finding can be made. f. Finding 6: That the combination of different dwelling types and/or variety of land uses in the development will complement each other and will harmonize with existing and proposed land uses in the vicinity.

The Project proposes small lot and more traditionally sized single-family lots integrated with a large community park space. These uses and dwelling types will complement each other and harmonize with existing and proposed land uses in the vicinity. This finding can be made.

4. Approval of CUP 2024-01: Based on the aforementioned findings, the Planning Commission hereby approves CUP 2024-01 subject to the conditions set forth in A attached hereto, PAGE 76
which approvals are contingent upon the following:

The approval of CUP 2024-01 shall become final and effective immediately only after the City Council of the City of Sanger i) adopts the Mitigated Negative Declaration for the Project; and ii) approves ANX 2024-01, initiating the annexation process with LAFCo; and iii) approves GPA 2024-01, redesignating 14.27 acres of Park/Open Space Land Use to the Residential Medium Density Land Use; and iv) approves ZOA 2024-05, pre-zoning the annexation area to R-1-6 (Single Family Residential) and RSC (Resource, School, and Conservation), collectively adoption of this Resolution, then CUP 2024-01 shall be returned to the Planning Commission for further consideration and a final decision. If Council Approvals are made within 180 days of the adoption of this Resolution, but any change is made by the Council to any of the Council Approvals in a manner that could reasonably affect the findings of the Planning Commission herein, or require a modification or addition of a condition of approval to be consistent with a Council Approval, then CUP 2024-01 shall be returned to the Planning Commission for further consideration and a final decision.

5. Tentative Tract Map Findings: The Planning Commission finds that all findings necessary for the approval of TTM 2024-01 can be made, and has reviewed the tentative map for compliance with Sanger City Code Section 62-75, and finds that all findings therein can be made including assessment of the following:
a. Environmental impacts of the project.

The proposed Tentative Tract Map is considered a project by California Environmental Quality Act (CEQA). The lead agency has prepared a Mitigated Negative Declaration for the proposed project as further described in Section 2 of this Resolution, above. b. Applicable provisions of this chapter.

Sanger City Code Section 62-75 establishes the procedures for the processing of Tentative Maps and Final Maps. The application has been processed in accordance with the requirements of Sanger City Code and meets all of the applicable requirements set forth therein.
c. Applicable provisions of the map act.

TTM 2024-01 has been reviewed and is in compliance with the State Subdivision Map Act and with the conditions of approval that are applicable to the project. Further, TTM 2024- 0 as amended by and contingent upon approval
of GPA 2024-01, which contemplated development on the Project site as proposed. d. Applicable provisions of the zoning ordinance.

The proposed parcels all meet the development standards for lot size, lot frontage, lot depth, and other requirements of the R-1-6 (Single-family Residential) and RSC (Recreation, Schools, and Conservation) District with the application of a PUD, to the extent required .
e. Where a planned unit development has been approved or tentatively approved subject to approval of a tentative map, the commission shall consider whether the tentative map PAGE 77
conforms to such planned unit development.

The proposed tentative map conforms to the requirements of the planned unit development.

The reduction in development standard requirements has resulted in a layout and development that incorporates harmonious features and a functioning overall design. f. Report and recommendation of the planning director.

Staff presented the Project to the Planning Commission as subject to conditions of approval and the Planning Commission has considered the same.
g. Comments received by the public in conjunction with the public hearing.

The Planning Commission has considered any public testimony or comments, written or oral, offered to the Planning Commission prior to the close of the public hearing.

6. Approval of TTM 2024-01: Based on the aforementioned findings, the Planning Commission hereby approves TTM 2024-01 ( B ) subject to the conditions of approval ( C ) attached hereto, which approvals are contingent upon the following:

The approval of TTM 2024-01 shall become final and effective immediately only after the City Council of the City of Sanger i) adopts the Mitigated Negative Declaration for the Project; and ii) approves ANX 2024-01, initiating the annexation process with LAFCo; and iii) approves GPA 2024-01, redesignating 14.27 acres of Park/Open Space Land Use to the Residential Medium Density Land Use; and iv) approves ZOA 2024-05, pre-zoning the annexation area to R-1-6 (Single Family Residential) and RSC (Resource, School, and Conservation), collectively adoption of this Resolution, then TTM 2024-01 shall be returned to the Planning Commission for further consideration and a final decision. If Council Approvals are made within 180 days of the adoption of this Resolution, but any change is made by the Council to any of the Council Approvals in a manner that could reasonably affect the findings of the Planning Commission herein, or require a modification or addition of a condition of approval to be consistent with a Council Approval, then TTM 2024-01 shall be returned to the Planning Commission for further consideration and a final decision.

7. Effective Date. This Resolution shall become final and effective immediately after the Council Approvals become effective, unless an appeal is timely filed with the City Clerk in accordance with the provisions of the Sanger City Code.

CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: CITY COUNCIL
From: Nathan Olson
Citizen’s Oversight Committee
Subject: Public Safety Sales Tax Gang/Drug Prevention/Intervention Services Grant Program Awards
Attachments: Grant Application Score Card

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

Select and approve grant recipients for Public Safety Sales Tax Gang Intervention/Prevention award and authorize the City Manager to execute an agreement with each recipient.

DISCUSSION:

City received five grant applications; five applications were received as complete. The complete applications were from Set Free Sanger, New Beginnings, SAM Academy, the Boys & Girls Club, and Young Life. The Application Review Committee (ARC) was comprised of Police Chief John Reynolds, Fire Chief Greg Tarascou, COC Member Lyn Anderson, and COC Vice -Chair Elizabeth Gonzalez. Each ARC member scored all four applications. The scores were tabulated and discussed during an ARC meeting on February 3, 2026.

The ARC decided to recommend to the Citizen’s Oversight Committee the selection of Set Free Sanger, the Boys & Girls Club, and Young Life as the grant award recipients.

PAGE 102

Because the combined request from all recipients exceeds the $100,000 budget amount for the grant program in 2025-2026, the ARC recommended $31,000 for Set Free Sanger, $33,000 for Young Life, and $36,000 for the Boys & Girls Club. The COC is meeting on March 3, 2026 to consider the recommendations, and staff will update the city council regarding that recommendation and decision of COC.

REASON FOR RECOMMENDATION:

The Citizen Oversight Committee makes a recommendation regarding the selection of grant recipients and grant allocation amounts to City Council. City Council considers the recommendation as it finalizes the City’s budget.

ALTERNATIVES

a.) Allocate an equal amount to each qualifying organization

b.) Reject the COC recommendation in its entirety and create a new award distribution

ACTIONS FOLLOWING APPROVAL:

Accept and adopt the COC recommendations for the FY 2 5-26 Public Safety Sales Tax Gang Prevention/Intervention funding, or modify COC recommendation, to reject the recommendation in its entirety and create a new award distribution.

CITY OF SANGER
REPORT TO THE CITIZEN’S OVERSIGHT COMMITTEE

To: Citizen’s Oversight Committee
From: Nathan Olson
Application Review Committee (ARC)
Subject: Public Safety Sales Tax Gang/Drug Prevention/Intervention Services Grant Program Awards
Attachments: Grant Application Score Card

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

The Application Review Committee (ARC) recommends the Citizen’s Oversight C ommittee approve the recommendation to the Sanger City Council select Set Free Church ($31,000), Young Life ($33,000), Boys and Girls Club ($36,000) as the approved grant recipients for Public Safety Sales Tax Gang Intervention/Prevention award and staff recommends that Council authorize the City Manager to execute an agreement with each recipient.

SUMMARY:

This item was originally considered by the Committee on February 3, 2026. After public comment, the item was tabled so Staff could address what options were available to the Citizen’s Oversight Committee regarding the selection and scoring of applicants. Staff have confirmed with the City Attorney’s Office there is no legal mechanism that would allow the Citizen’s Oversight Committee to meet together privately to score the applicants. However, there are other options as outlined below.

DISCUSSION:

PAGE 105

01484.0007 2097071.1
ARC has scored and recommended Set Free Sanger, the Boys & Girls Club, and Young Life as the grant award recipients.

The Citizen’s Oversight Committee is subject to the Brown Act. The Brown Act is a California “sunshine” law that guarantees the public’s right to attend, participate in, and monitor the meetings of local legislative bodies, ensuring that deliberations and actions are conducted openly to promote transparency and accountability in local government. While there are some exceptions that allow private meetings in closed session, these are narrowly defined and are not applicable here. As a result, the Citizen’s Oversight Committee cannot privately meet to determine, score - or even discuss - an award to potential grant recipients. Instead, those deliberations are required to be held in a publicly-noticed meeting.

There are several options available to the Citizen’s Oversight Committee that are consistent with the requirements of the Brown Act:

1. Request ARC re-assess its recommendation in light of additional information, if any, received as a result of public comment, and continue the meeting. I f there is no relevant new information, or if an applicant simply does not meet the criteria, then ARC is required to recommend denial in order to be compliant with the process approved by the voters and City Council.

2. Reject the ARC recommendation in whole or in part, and provide a substitute recommendation to the City Council. While it is technically an option, ARC recommendation is an integral part of the checks and balances built into the Measure R process approved by the voters and the City Council.

If the Citizen’s Oversight Committee were inclined to reject the recommendation of ARC, it should identify specific reasons as to why the recommendation is being rejected. Further, the Citizen’s Oversight Committee should articulate how any new applicant meets the qualifications to receive an award. These grounds will then be provided to the City Council for final evaluation, along with the recommendation of ARC.

3. Provide an additional assessment through an ad hoc committee. While not expressly contemplated by Measure R, the Citizen’s Oversight Committee may appoint up to two members of the Committee (i.e., less than a majority) to independently assess applicable grant awardees. The members of the ad hoc committee should not have spoken to any other members of the Committee on this issue outside of the public meeting. (If this is not possible, then an ad hoc committee is not an option.) The ad hoc committee can then meet privately to develop its recommendation, but then must report (either orally or in writing) any recommendation to the Citizen’s Oversight Committee at a public meeting. Further, to the extent the recommendation is different that the ARC recommendation, the ad hoc committee should specifically identify the basis for the change, and any new grant awardees meet the eligibility criteria . Additionally, public comment should be re -opened to allow for comments regarding the new information being submitt ed to the Citizen’s Oversight Committee.

The Citizen’s Oversight Committee may then deliberate and determine whether to accept the ad hoc recommendation, ARC recommendation, etc. If the Citizen’s Oversight Committee decides to reject the ARC recommendation in whole or in part, it should specifically identify the grounds for doing so. (See the option immediately above.) The recommendation will then be forwarded to the Cit Council for evaluation, along with the ARC recommendation.

4. No recommendation. The Measure R contemplates the Citizen’s Oversight Committee as having a key role in the process of assessing applicants, and providing a well -reasoned recommendation to the City Council for action. However, in the unlikely event the Citizen’s Oversight Committee cannot reach a recommendation (such as a tie vote, etc.), the Citizen’s Oversight Committee should affirmatively vote on a motion confirming it is unable to reach a consensus. This information will PAGE 106

01484.0007 2097071.1
then be provided to the City Council, along with the ARC recommendation, for appropriate action.

5. Adopt the ARC recommendation. In the alternative the Citizen’s Oversight Committee can simply adopt the ARC recommendation. The public hearing does not need to be re -opened as the matter was continued from the prior meeting where the public already had the opportunity to provide comments.

ARC recommended $ 31,000 for Set Free Sanger, $ 33,000 for Young Life, and $36,000 for the Boys & Girls Club.

REASON FOR RECOMMENDATION:

The Citizen Oversight Committee makes a recommendation regarding the selection of grant recipients and grant allocation amounts to City Council. City Council considers the recommendation as it finalizes the City’s budget.

ALTERNATIVES

Alternatives are noted above.

ACTIONS FOLLOWING APPROVAL:

The Citizen’s Oversight Committee recommendations will be provided to the City Council for evaluation and inclusion into the upcoming fiscal budget.

Priority will be given to programs that implement identified best practices to address youth/gang violence. Applicants are required to include materials that support the identified model as well as expected outcomes.

Purpose:

Reflecting the city's efforts to make Sanger a more livable place, this program is designed to provide a coordinated community response to youth gangs in the City of Sanger. CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and Councilmembers
From: Dr. Joshua Goggins, Community Development Director Subject: Initiation of Annexation of Real Property for Regional Storm Drain Facility – Property located on the South S ide of North Avenue B etween Indian ola and Bethel Avenues (APN 332-080-40).

Attachments:

1. 2035 General Plan Land Use Map

2. Aerial and Street View of Project Area

3. Location Map – Tract 6493 and Proposed Regional Storm Drain Basin

4. City Council Ordinance No. 2026-02

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

1. Waive the full reading and adopt by title only, Ordinance No. 2026-02 an ordinance of the City Council of the City of Sanger approving Zoning Ordinance Map Amendment No 2026-01 for pre-annexation zoning from Fresno County’s AE-20 (Exclusive Agriculture) to the City’s RSC (Recreation, Schools, and Conservation) zone district for approximately 11.42 acres located on the south side of North Avenue between Indianola and Bethel Avenues (APN 332-080-40)

PROJECT BACKGROUND:

The project site consists of approximately 11.42 acres of land and associated public right -of-way generally bounded by East North Avenue to the north, South Indianola Avenue to the west, and South Bethel Avenue to the east. The subject property is located within Fresno County and within the City of Sanger’s Sphere of Influence.

At its meeting of October 16, 2025, the City Council issued final approvals, including initiation of PAGE 133

01484.0005 2092427.1
annexation, for the subdivision known as Tentative Tract 6493, being developed by Lennar Homes of California (Lennar). One of the conditions of approval of that project is to acquire and construct (at least initially) the master-planned storm drainage basin facility for the Southwest Drainage Area, as defined by the City’s Storm Drain Master Plan (“Basin Condition”). The location of this regional basin facility has been planned for almost a quarter of a century and was defined as early as 2003 with the 2025 General Plan and was also included with the City’s current 2035 General Plan. This regional stormwater drain facility is anticipated to serve a 450- acre area, including Phase 1 of the Lennar development, which is approximately 40 acres. See Attachment 1 for the adopted Land Use Map where the basin area is highlighted and see Attachment 2 for aerial and street views of the project area.

The property of the location of the proposed regional stormwater drain facility is owned by Choolijian Farms (“Choolijian”). The City Council previously authorized an agreement to transfer title of the property to the City.

As previously flagged for the Council, the property for the regional stormwater drain facility is currently outside of City limits, but within the City’s sphere of influence. As a result, this property will need to be pre-zoned and annexed into the City. Additionally, the California Government Code requires a finding of General Plan conformity and review for the same by the Planning Commission, and a CEQA assessment for the project as may be appropriate.

This staff report addresses the required pre-zoning and initiation of annexation proceedings with the Fresno Local Agency Formation Commission ( Fresno LAFCO) to allow implementation of storm drainage facilities and to ensure consistency with the City’s 2035 General Plan and zoning regulations upon annexation.

INITIATION OF ANNEXATION:

The basin property is located outside of City limits, consisting of approximately 11.42 acres generally located on the south side of North Avenue between Indianola and Bethel Avenues (APN 332-080-40). Per the Memorandum of Understanding between the City and County, specific procedures must be taken to in order to change jurisdiction of property from County to City. The Fresno Local Agency Formation Commission (Fresno LAFC O) is the authority in decisions on change of organization boundaries (City Limits), including annexations. Planning Commission recommended initiation to City Council at a public hearing held on January 29, 2026. The first step in this process is initiation of annexation by the City via resolution directing staff to proceed with application to Fresno LAFCO.

GENERAL PLAN CONFORMITY:

California Government Code Section 65402 requires that the City cannot acquire real property for public purposes until the matter has been submitted to the Planning Commission for a report as to conformity with the adopted General Plan. This matter was considered by the Planning Commission at its meeting on November 10, 2025, and the Planning Commission found that the proposed regional stormwater drain facility on the Choolijian property was consistent with the City’s adopted 2035 General Plan.

As stated earlier, Attachment 1 shows the Land Use Map from the adopted 2035 General Plan and depicts a “Storm Drain Facility” within the Choolijian property. Attachment 3 shows the planned location of the actual basin, which aligns more or less with the existing topography of the site, which can be seen in the street and aerial views in Attachment 2. The low-lying topography, as well as the location relative to the 450-acres being served by the proposed basin, were part of the initial site determination for the facility. As a result, the proposed location is in substantial conformance to the 2035 General Plan.

PAGE 134

01484.0005 2092427.1

ZONING ORDINANCE CONFORMITY:

The subject property is outside of the city limits. Therefore, prezoning is required to match the General Plan Land Use. The subject property will go from County of Fresno: AE-20 (Exclusive Agricultural) to City of Sanger RSC (Recreation, Schools and Conservation) zone district. The RSC zone district is consistent with the 2035 General Plan designation of Storm Drain Facility.

ENVIRONMENTAL ANALYSIS

Staff have evaluated the proposed project in accordance with CEQA Guidelines section 15183, which allows streamlined environmental review for projects that are consistent with the development density and policies of an adopted General Plan for which an EIR has been certified.

Based on staff review of the 2035 General Plan and the certified General Plan EIR, the proposed storm drain basin project is proposed to be found to be consistent with the General Plan and within the scope of the impacts analyzed in the General Plan EIR, for the following reasons:

1. The project is consistent with the development density established by existing zoning, community plan or general plan policies for which an EIR was certified. • The project site is designated “Storm Drain Facility” under the 2035 General Plan. Storm drainage basins and related public utility infrastructure are allowed uses within this designation.

2. There are no project specific effects which are peculiar to the project or its site. • The proposed storm drain basin directly implements these policies and does not conflict with any General Plan objectives.
• There are no unique features or other unusual conditions of the property that would give rise to specific effect peculiar to the site; this is a property of a type generally found throughout the 2035 General Plan planning area and common to the area.

3. There are no project specific impacts which the EIR for the General Plan failed to analyze as significant effects.
• The project is within the development intensity and infrastructure assumptions considered in the EIR.

4. There are no potentially significant off-site and/or cumulative impacts which the GPU EIR failed to evaluate. There is no substantial new information which results in more severe impacts than anticipated by the EIR for the General Plan Update.
• There are no substantial changes to the project, circumstances, or regulatory environment that would trigger the need for a subsequent or supplemental EIR. The project qualifies for reliance on the General Plan EIR under CEQA Guidelines §15183, and preparation of additional CEQA documents is not required.

As a result, no further analysis is required by CEQA, and the City Council may adopt an exemption for this project pursuant to Public Resources Code Section 21083.3 and CEQA Guidelines Section 15183.

REASON FOR RECOMMENDATION:

The property has been planned for a regional storm drain facility for decades and is designated as such in the 2035 General Plan. The acquisition and construction of the basin is a condition of approval of Tract 6493, which has been approved by the Planning Commission and the City Council. The basin will provide a regional benefit and the acquisition of real property for this use will be in substantial conformance to the 2035 General Plan.

PAGE 135

01484.0005 2092427.1

FISCAL IMPACT:

No fiscal impact.

ALTERNATIVES:

The City Council may choose not to adopt the resolution. If so, staff requests the Council provide direction on next steps.

ACTIONS FOLLOWING APPROVAL:

The acquisition of the property is contingent upon close of escrow and transfer of the property to the City.

As part of the process, staff will submit the annexation resolution to Fresno LAFCO.

present evidence; and

WHEREAS, the City Council now desires to approve Zoning Ordinance A mendment 2026-01,

NOW, THEREFORE, the City Council of the City of Sanger does ordain as follows:

Section 1. Recitals. The City Council hereby finds that all of the facts set forth in the recitals above are true and correct and incorporated herein.

Section 2. CEQA. The City Council finds the project is consistent with the 2035 General Plan, and that all potentially significant impacts were addressed in the 2035 General Plan EIR (SCH#2003011060). Therefore, the project is exempt from further environmental review under CEQA Guidelines Section 15183.

Section 3. General Plan Consistency for ZOA 2026-01. The City Council finds that ZOA 2026-01 is consistent with the goals, objectives, and policies of the 2035 General Plan. In this regard, the City Council find that public necessity, convenience, general welfare, and good zoning practices justify approval of ZOA 202 6-01.

Specifically, the pre-zoning change is consistent with the 2035 General Plan goals and policies, any operative plan, or adopted policy, and implements the planned land uses in the Project area. The change is also consistent with the purpose of the City’s zoning ordinance to promote the growth of the city in an orderly and sustainable manner, and to promote and protect the public health, safety, peace, comfort, and general welfare. The change is also necessary for good zoning practices to achieve the balance of land uses desired by the City and to provide sites for needed residential, parks, opens space, trails, and a recharge basin consistent with the 2035 General Plan.

Section 4. Approval of ZOA 2026-01 for a Regional Storm Drain Facility . The City Council adopts this ordinance approving Zoning Amendment ZOA 2026-01 as set forth in Exhibit “A” to this Ordinance.

Section 5. Severability. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions, or applications of this Ordinance that can be given effect without the invalid provision or application, and to this end, the provisions of this Ordinance are severable. The City Council hereby declares that it would have adopted this Ordinance irrespective of the invalidity of any particular portion thereof.

Section 6. Publication. CITY OF SANGER

REPORT TO THE CITY COUNCIL

To: Mayor and City Council
From: Joshua Rogers, City Engineer
Subject: Highway Safety Improvement Program Project
Proposed Crosswalk Removals – Jensen & Hawley Avenues and Jensen & Oatman Avenues
Attachments:

1. Photos

2. Notice of Planned Crosswalk Removals

CONFLICT OF INTEREST:

None known.

RECOMMENDATION:

Staff recommends that the City Council conduct a public hearing and, at the conclusion of the hearing, authorize Staff to remove the existing marked crosswalks at two intersections as part of the Highway Safety Improvement Program (HSIP) Cycle 11 project, which is going to construction this Spring/Summer. The intersections are Jensen & Hawley and Jensen & Oatman.

EXECUTIVE SUMMARY:

Staff have completed the engineering design for the HSIP project, and the bid documents are currently being advertised. As part of this effort, Staff is recommending the elimination of existing marked crosswalks along Jensen Avenue at the Hawley & Oatman intersections.

BACKGROUND:

The HSIP Cycle 11 project includes the installation of Rectangular Rapid Flashing Beacon (RRFB) assemblies at various intersections along Jensen Avenue, along with crosswalk striping improvements PAGE 144

to enhance pedestrian safety along the Jensen Avenue corridor. These improvements were identified by a Systemic Safety Analysis Report (SSAR) prepared and adopted by the Council back in 2019.

That report was used to secure funding through HSIP to implement the improvements. In developing the SSAR , Staff reviewed all existing marked crosswalks on Jensen Avenue between Indianola and Academy Avenues. Regarding the subject crosswalks at Hawley & Oatman Avenues, they are uncontrolled, meaning they are not controlled by a stop sign, yield sign, or traffic signal. Neither is currently accompanied by any signage alerting motorists to pedestrian crossings. See attached photos in Attachment 1.

It appears from old aerial photos that these crosswalk s were installed at least 20 years ago, and most likely longer, prior to many of the updated traffic control standards from the late 1990s on, and the California Manual on Uniform Traffic Control Devices (MUTCD) has specific guidelines and requirements for marked crosswalks on public roadways.

Section 3B.18.08 of the MUTCD states: “Crosswalk lines should not be used indiscriminately. An engineering study should be performed before a marked crosswalk is installed at a location away from a traffic control signal or an approach controlled by a STOP or YIELD sign. The engineering study should consider the number of lanes, the presence of a median, the distance from adjacent signalized intersections, the pedestrian volumes and delays, the average daily traffic (ADT), the posted or statutory speed limit or 85 - percentile speed, the geometry of the location, the possible consolidation of multiple crossing points, the availability of street lighting, and other appropriate factors.”

The SSAR analyzed each pedestrian crossing in the Jensen Avenue corridor for geometrics, sight distance, pedestrian usage rates, etc. , and recommended a consolidation of some of the crossings to specific locations, at which safety improvements would be made. Based on the relatively long lengths of the crossings, the availability of crossings at other nearby locations, the relatively low usage of these crossings, and the heavy volumes and high traffic speeds on Jensen Avenue, Staff recommends that the existing marked crosswalks at Jensen & Oatman and Jensen & Hawley Avenue be removed with the HSIP project. Under Section 21950.5 of the CA Vehicle Code, the City is required to provide notice to the public when a marked crosswalk is identified for removal to ensure the public is notified and has an opportunity to comment. The notice and opportunity to be heard must be given at least 30 days prior to the scheduled removal. It is anticipated that the removal will occur in late April or early May of 2026. In addition to publishing the notice of public hearing in the Mid Valley Times , the attached notice (see Attachment 2) has been posted at each of the sites

REASON FOR RECOMMENDATION:

It is Staff’s opinion that the costs and the pedestrian safety risk of leaving and improving the existing crosswalk at Jensen & Hawley and Jensen & Oatman are not justified by their low usage.

FISCAL IMPACT:

There is positive fiscal impact resulting from Staff’s recommendation. There would be recurring costs to continue to maintain the crosswalk striping as is and additional incurred costs to enhance the crosswalks with high-visibility markings and signage.

ALTERNATIVES:

The City Council can direct Staff to:

1. Keep the crosswalks as they currently exist; or

2. Re-establish the crosswalks, but enhance with high-visibility markings and warning signage.

Neither of the aforementioned alternatives were included in the adopted SSAR, nor are they included in the budget for the HSIP Project.

ACTIONS FOLLOWING APPROVAL:

The City’s contractor for the project (once determined and procured from a competitive public bidding process) will remove the crosswalk as identified in the project bid documents, along with performing the other project construction work.

NOTICE OF PUBLIC HEARING

PUBLIC HEARING
March 5, 2026 at 6:00 p.m.

Sanger City Hall
1700 7th Street, Sanger CA.

PURPOSE
To hear public comments prior to the elimination of a marked crosswalks at the following locations for the City of Sanger HSIP Cycle 11 – Jensen Avenue Pedestrian Crossing Improvements Project:

1. Jensen Avenue and Hawley Avenue

2. Jensen Avenue and Oatman Avenue

BACKGROUND
The City plans to begin construction in April of 2026 for a pedestrian safety improvements project at various intersections along Jensen Avenue from Lyon Avenue to N Street. The project locations and improvements were determined based on the City of Sanger Systemic Safety Analysis Report (SSAR) which was adopted by City Council under Resolution No. 2019-55. The goal of the SSAR was to identify potential safety improvements along the Jensen Avenue corridor for vehicles and pedestrians. Among the improvements identified and recommended in the SSAR which are to be implemented with this project are the removal of two uncontrolled crosswalks located at Jensen Avenue/Hawley Avenue and Jensen Avenue/Oatman Avenue. Pedestrian traffic will be consolidated to nearby crosswalks which are more desirable for use due to shorter crossing lengths, better sight distance, and/or controlled by a traffic signal. The remaining crosswalks, if not already controlled by a traffic signal, will be upgraded with pedestrian rectangular rapid flashing beacons (RRFB) and high visibility crosswalks for increased safety.

The City is required to provide notice to the public under Section 21950.5 of the CA Vehicle Code when a crosswalk is identified for removal to ensure the public is notified and has an opportunity to comment. Notice has been posted at the site as required.

All interested persons will be provided the opportunity to present oral comments to the City Council at the hearing prior to final Council action. Written comments may be submitted prior to the hearing on March 5, to Lina Martinez, City Clerk, at 1700 7
th Street, Sanger, CA 93657 or by email at [email protected]. At the public hearing, Staff will summarize any comments received and present a final recommendation for City Council consideration. At the conclusion of the hearing, the City Council may choose to eliminate these crosswalks as part of the HSIP Cycle 11 – Jensen Avenue Pedestrian Crossing Improvements Project.

If you have any questions, contact Josh Rogers, City Engineer at (559) 876-6300 or send an email to [email protected].
