Agenda Item No.: F.2.

City of Sanger
Report to the City Council
To: City Council
From: Doug Bolton, Parks & Rec Director
Subject: Budget Adjustment for Parks and Recreation Master Plan Conflict of Interest:

None
Recommendation:

Recommendation: That the City Council adopt Resolution No. 2026-92 authorizing an amendment to the FY 2026-27 Annual Budget in the amount of $23,961 to complete payment for the Parks and Recreation Master Plan project pursuant to the existing agreement.

Executive Summary:

Staff recommends a budget amendment of $23,961 to the FY 2026-27 Annual Budget to complete payment for the Parks and Recreation Master Plan project.

Background:

In adopting the FY 26-27 budget the transfer of the purchase order funds for the master plan was not included in the final adoption presented to the City Council. This action corrects accidental omissions and allocates appropriate funding to complete payment of the master plan project and agreement.

Reason for Recommendation:

Currently, there is no allocation for payment of the master plan within the Parks and Recreation Department, so charges for the master plan would necessitate budget amendments or intra-fund transfers to appropriately pay to complete payment of the master plan project and agreement.

Fiscal Impact:

Staff recommend allocating approximately $23,961 to the General Fund Parks and Recreation budget (101-060-901-7701). These funds will be allocated from the remaining funds from the FY 2025-26 budget. There will be no additional funds needed to be added to the FY 2026-27 budget.

Alternatives:

None

Page 12 of 97 ends

Actions Following Approval:

Following approval, the Finance Director will process the budget amendment and establish the necessary purchase order for the remaining project expenses.

For the Meeting of: October 1, 2026
Agenda Item No.: F.3.

City of Sanger
Report to the City Council
To: City Council
From: Virginia Harmon, Finance Director
Subject: Budget Adjustment – MGT Impact Solutions, LLC – Full Cost Allocation Plan, Comprehensive Fee Study, and Development Impact Fee Study Conflict of Interest:

None known.

Recommendation:

Recommendation: That the City Council approve a budget adjustment to carry forward and reappropriate funding originally budgeted in Fiscal Year 2024-25 (FY2025) for the MGT Comprehensive Fee Study and Development Impact Fee Study, with the projects now anticipated to be completed in Fiscal Year 2026-27 (FY2027).

Executive Summary:

The City originally budgeted $160,000 in FY2025 for the MGT Full Cost Allocation Plan, Comprehensive Fee Study, and Development Impact Fee Study under account 712-020-101- 6290.

The studies were originally anticipated to be completed within the FY2025 budget cycle.

However, completion of the studies has been delayed, and staff now anticipates that the work will be completed in FY2027.

To ensure that the remaining funding is available when the studies are completed, staff is requesting that the unspent balance be carried forward from FY2025 to FY2027.

The requested budget adjustment does not represent a new project or a change in the intended purpose of the original appropriation. Rather, it updates the timing of the expenditure to reflect the revised project completion schedule.

Background:

The City entered into an agreement with MGT of America Consulting, LLC on April 4, 2024.

The City originally budgeted funding in FY2025 for three related financial and cost-recovery studies:

Page 18 of 97 ends

• Full Cost Allocation Plan;
• Comprehensive Fee Study; and
• Development Impact Fee Study.

The City completed the Cost Allocation Plan in FY2025 and paid $30,410 for those services.

The other two agreed-upon services were still in progress at the end of FY2025.

These studies are intended to provide the City with updated information regarding the full cost of providing municipal services, appropriate user fees and charges, and development impact fees necessary to support infrastructure and service demands associated with new development.

The studies were originally anticipated to be completed within the FY2025 budget cycle.

However, the work was not completed within the originally anticipated timeframe, and the projects remain necessary to support the City's ongoing financial planning and cost-recovery efforts.

Staff now anticipates completion of the studies in FY2027. Accordingly, a budget adjustment is necessary to align the City's current budget with the revised project schedule and ensure that the previously authorized funding remains available for completion of the work.

Reason for Recommendation:

The recommendation is necessary because the MGT Full Cost Allocation Plan, Comprehensive Fee Study, and Development Impact Fee Study originally budgeted in FY2025 were not completed as anticipated and are now expected to be completed in FY2027. Of the original $160,000 appropriation, $30,410 has been spent, leaving $129,590 available. Carrying forward the remaining funds will preserve the existing budget authority and ensure sufficient funding is available to complete the studies in FY2027 without increasing the total project budget.

In conjunction with the requested carryforward, staff has prepared a Budget Adjustment Resolution for City Council consideration, Resolution No. 2026-93.

The resolution will authorize the transfer and reappropriation of the remaining $129,590 in account 712-020-101-6290 from the FY2025 budget to the FY2027 budget. Adoption of the resolution will provide the necessary budget authority for the City to continue and complete the MGT Full Cost Allocation Plan, Comprehensive Fee Study, and Development Impact Fee Study.

The proposed resolution will also authorize the Finance Director, or designee, to make the necessary accounting and budget entries to implement the approved adjustment.

Fiscal Impact:

The requested budget adjustment is summarized in Attachment 4.

The adjusted budget for this expenditure will be funded through Internal Service Fund 712. The cost of services will also have an allocation impact on other participating funds, which will be

Page 19 of 97 ends

calculated at year-end in accordance with the applicable allocation methodology.

The adjusted appropriation shown in Attachment 4 represents an estimate of the allocation associated with this expenditure and is intended to provide sufficient budget authority for the anticipated costs. The final allocation to the applicable funds will be determined at year-end based on the actual expenditure and the established allocation methodology.

There is no increase to the total previously approved project budget. The request transfers the remaining $129,590 of existing budget authority from FY2025 to FY2027.

Alternatives:

Actions Following Approval:

operating (or receiving) deparfrnents:
o Centml service functions will be determined based ontimesheets, assignnents, activities, or other allowed methods. Once staff membsrs and their conesponding salaries are disbibuted into functions, otlrer department costs such as materials and supplies will also be dishibuted into the same functions. This task breaks a department into functional cost pools, which can then be allosated throughout the organizational sfucture using meaningfirl, measurable, and auditable allocation bases. o Distribute the allowable costs within each cenfral service department into tlre functions determined in Task 6.0. The dishibution of allowable deparhnent costs and incoming costs will determine ttre total cost of providing each distinct service within each cental service deparhnont.

This step usos n feeture in MGTCAFTM that ls not rvailable in most other CAP software, The MGT proprietary cost allocation software has the ability to analyze, display, and allocate the indirect costs of each cental seryice departnent in great detail. This detail facilitates review, explanation, and understanding of incoming costs which leads to reduced errors, fewer reruns of r€ports, and the ultimate acceptance and approval of the CAP.

TASK 8.0: DEVaLOP ALLOCATION BASES FOR CENTRAL SERVICE

I'EPARTMENT FUNCTIONS
Detennine an appropriate allocation base for each firnction in sach cental senrice department.

This determination will serye as the basis for allocating the allowable costs in eaoh function to the recipients of the service. Project consultants will request conesponding tuansaotion data from central servicc deparhnent personnel,

8.1 Central service departments will allocate costs to all departments and funds. This allocation methodology ensures the fairest and most aocuraie distribution of costs as opposed to a methodology that singles out departments or funds for maximum allocation.

TASK 9.0: PROCESS DRAFT CAPS
Process the draft CAPs using MGTCAPTM. The CAPs will inolude sumlrary and detail reports.

Summary reports in the CAPs will provide infomration on the dollar amounts allocated from each cental service department to every receiving department. The detailed reports in the CAPs provide information on the expenditures, allowable costs, incoming costs, porsonnel distribution, functions, and allooation bases for every central servico department.

TASK 4.0: DEVEL0P METHoDoLocY FoR CALCULATING NEw FEE

AMOUNTS
Activities
This task entails developing the methodology used to establish the fee amount for each fee component to the extent appropriate, There are two critical issues that must be considered in developing a fee program. The fee program must generate revenues in a timely manner and the methodology must meet the nexus or benefit requirements of AB 1600. Since fees of any sort me controversial, it is critical that any fee established be legally defensible.

The project teamos fee study rnethodology must meet nexus or benefit requirements of AB 1600, which requires that there be a nexus befween the fees imposed, use of the fees, and development projects on which the fees are imposed. Furthermore, there must be a relationship between the amount of the fee and tho cost of the irnprovements. To impose a fee as a condition for a development projeot, the methodology must accomplish the following:
. Identify the purpose of the fee;
' Determine the use to which the fee is to be put (if the use is financing public facilities, the facilities must be identified);
' Establish if there is a reasonable relationship between the fee's use and type of development project on which the fee is imposed; and ' Ascertain if there is a reasonable relationship between the need for the public facility and the type of development project on which the fee is being imposed.

Implicit in these requitements is a stipulation that a public agency cannot impose a fee to cwe existing deficiencies inpublic facilitiss or improve public facilities beyond whai is required based on the specific impacts of new developrnent. The benefit methodology established in this task will be documented in the Final Report.
the project team shall prepare a memo to be submitted to City staff summarizing available methodologies and their respective pros and cons and providing detailed examples of other cities', counties', or agencies' impact fee programs. The (nemo will also discuss, as applicable, contextsensitive adjustments and "credits" for capital improvements required as part of a project application. The team will reoommend a Fee Expenditure Plan to ensure that projects can be fully funded and implemented within any required time limits for expenditures of such funds, as weil as possible flexibility to allow collected fees to be used to provide the City with a match for grant applications. Finally, the memo will include recommendations for methodology and next steps. upon review and discussion by city staff, a methodology will be selected.

RESOLUTION NO. 2026-93

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANGER APPROVING A BUDGET

ADJUSTMENT TO CARRY FORWARD FUNDS FOR THE MGT FULL COST ALLOCATION PLAN,

COMPREHENSIVE FEE STUDY, AND DEVELOPMENT IMPACT FEE STUDY FROM FISCAL YEAR 2024-25 TO FISCAL YEAR 2026-27
WHEREAS, the City of Sanger Annual Budget requires amendments to adjust the estimated revenues and appropriations to reflect the City’s financial plan; and WHEREAS, the Annual Budget contains the estimated revenues and appropriations necessary to implement the City Council’s policies, goals and objectives; and WHEREAS, after the adoption of the Annual FY 2026-27 City budget, it was discovered that necessary appropriations for MGT’s remaining agreed-upon services were inadvertently omitted; and
WHEREAS, the City Council of the City of Sanger does hereby find that it would be in the best interest of the City to revise the estimated revenues and appropriations; and WHEREAS, budget amendment appropriating funds in the amount of $129,590 is necessary because the MGT Full Cost Allocation Plan, Comprehensive Fee Study, and Development Impact Fee Study originally budgeted in FY2025 were not completed as anticipated and are now expected to be completed in FY2027. Of the original $160,000 appropriation, $30,410 has been spent, leaving $129,590 available. Carrying forward the remaining funds will preserve the existing budget authority and ensure sufficient funding is available to complete the studies in FY2027 without increasing the total project budget.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANGER DOES HEREBY RESOLVE AS FOLLOWS:

1. The City Council hereby approves a budget amendment in the amount of Onehundred twenty-nine thousand, five hundred ninety dollars ($129,590) for the completion of MGT’s remaining agreed-upon services as outlined in the contract.

2. Authorize Finance to make all necessary budget and accounting entries to implement the approved budget adjustment.

3. This resolution shall take effect immediately upon its adoption. * * * * * * * * * * * * * * * * *
I hereby certify that the foregoing was duly passed and adopted by the City Council of the City of Sanger, Fresno County, State of California, at its regular meeting thereof held on October 1, 2026, by the following vote:

City of Sanger
Report to the City Council
To: City Council
From: Josh Rogers, City Engineer
Subject: Chavez Park Lighting Improvements Project - Amendment to Agreement for CDBG Project No. 22611
Conflict of Interest:

None known.

Recommendation:

Recommendation: That the City Council approve Amendment I to the CDBG Agreement for the Chavez Park Lighting Improvements Project with Fresno County to provide an additional $110,000 in CDBG funding to fully fund the project.

Executive Summary:

Amendment I to CDBG Agreement No. 23-543 will provide additional CDBG funding to cover all project expenditures, instead of utilizing other City funding sources.

Background:

At the City Council meeting of 09/17/26, Staff recommended that the Council accept the improvements for the subject project and approve a budget amendment for $105,000 to fully fund the total project costs. The staff report stated as follows regarding the budget overage:
“City and County Staff have discussed shifting future appropriations of CDBG funding which have not yet been assigned to any specific project to cover this overage, but it is possible that newer changes to the CDBG requirements (specifically the Build America-Buy America (BABA) program) which did not apply to the Chavez Park Lighting project may make this proposed shift infeasible. While this is still being researched, Staff is asking for approval of a Budget Amendment to fund the overage from a combination of Area 2 Parks and Recreation Impact Fees and TDA Article 8 fund balance……. If the shift of CDBG funding is determined to be allowed, then Staff will instead use this funding, but if not then the Finance Department will execute the attached amendment.”
Following that meeting, County staff made a determination that it could use program income which had been allocated to its CDBG program to make additional allocation to the City of Sanger’s project, which would not rely on the newer funding which is now subject to the BABA

Page 74 of 97 ends

requirements. The attached amendment has been provided for approval by the City Council.

Following that approval, it will be presented to the County Board of Supervisors for final approval at their meeting on 11/17/26. If approved, the funding will be added prior to closing out the financials on the project. It should be noted that the amendment is for $110,000, slightly more than the $105,000 noted in the City Council staff report from the 09/17/26 meeting.

Additionally, while the Agreement Amendment states that the funding will come from the Sanger JFK Trail Lighting Improvements, Phase II, it should be noted that Staff had previously coordinated with the County to add funding to that project which is not anticipated to be necessary to fully construct that project, to provide flexibility to potentially shift that funding to the Chavez Park project. As currently projected, all CDBG projects currently in development by the City are anticipated to be fully funded following this amendment approval. Any unused CDBG funding for this project will remain in the City’s allocation for use on future CDBG projects.

Reason for Recommendation:

Approval of the amendment will allow for all project expenditures to be covered by CDBG funds.

Fiscal Impact:

Approval of the amendment will allow for all project expenditures to be funded through the CDBG program, allowing the TDA Article 8 and Parks and Recreation Impact Fees to be utilized for other needs by the City.

Alternatives:

The Council can elect not to accept the additional funding, instead contributing its Parks and Recreation Impact Fee and TDA Article 8 fund balances to fund the expenditures.

Actions Following Approval:

City Staff will complete all final expenditure reporting to the County. Following the 11/17/26 Board of Supervisors hearing, County staff will issue reimbursement payment for all remaining project expenditures from CDBG funds.

City of Sanger
Report to the City Council
To: City Council
From: Greg Tarascou, Fire Chief
Subject: Second Reading and Adoption of the 2025 California Fire Code Conflict of Interest:

None known.

Recommendation:

Recommendation: That the City Council conduct the second reading, by title only, and adopt Ordinance No. 2026-06, an Ordinance of the City of Sanger, California, Adopting the California Fire Code with Amendments in Article III of Chapter 30, and Updating Fire and Safety Definitions in Section 38-24.2 of Article I of Chapter 38, of the Sanger Municipal Code and incorporating and adopting the Express Findings of Necessity.

Executive Summary:

Every three years the California Building Code (CBC) is reviewed and modified, where applicable, and adopted by the California Building Standards Commission. In January of 2026 the 2025 version of the California Fire Code went into effect Statewide and is currently used as the guiding document for all fire prevention activities. Currently, the City of Sanger Municipal Code contains the 2016 standards, which have been adopted and have been modified as necessary to ensure the safety of the community. Staff is presenting the second reading of the proposed Ordinance to be considered for adoption to bring the Municipal Code with reasonably necessary modifications.

Background:

The 2025 California Building Code incorporates the 2024 edition of the International Fire Code, as amended with necessary California amendments. The 2025 California Building Code became effective on January 1, 2026, and is mandated by the California Building Standards Commission for statewide adoption and enforcement.

The City of Sanger has the authority to make necessary modifications to the State Code.

Modifications that are administrative in nature do not require expressed findings and a summary of proposed administrative amendments to the 2025 California Fire Code are attached to this staff report. However, non-administrative modifications to the California Fire Code must be based on express findings of necessity relating to local climatic, geological or topographical

Page 82 of 97 ends

conditions.

FINDINGS REGARDING LOCAL CLIMATIC, TOPOGRAPHICAL AND

GEOLOGICAL CONDITIONS
The express findings relating to local climatic, geological and topographical conditions, including an analysis of the modifications, may be found in the proposed Resolution and Ordinance. The following is a brief summary of the local climatic, topographical and geological conditions which make the local amendments to the California Fire Code reasonably necessary, including extreme temperatures, limited water supply and pressure, poor air quality and sunny days, and lower density development facilitated by local topography.

Climatic Conditions – Extreme Temperatures
During the summer months, the City of Sanger experiences periods of what can only be described as extreme heat. For example, Exhibit 1 to the attached Resolution is a summarized chart setting forth the high temperatures in Sanger, San Francisco and San Diego from CY 2022 to the end of CY 2025 as reported by the National Weather Service.

As an example, during a 31-day period in July 2025, the average high temperature in Sanger was 106 degrees, while the mean high temperature over the four years was reported at 110 degrees.

As a corollary, the average high temperature in San Francisco was 76 degrees and the average high temperature in San Diego was 82. Furthermore, during this 31-day period, Sanger experienced 6 days when the maximum temperature exceeded 100 degrees, while neither San Francisco nor San Diego experienced such temperatures at any time during the 31-day period.

Though Health & Safety Code Section 17958.7 does not require the local conditions to be unique to a particular jurisdiction, the temperature chart demonstrated the temperatures experienced in Sanger are extreme as compared to temperatures experienced in other parts of California.

Due to the extreme heat Sanger experiences during the summer months, Sanger Firefighters responding to fires and other incidents requiring the evacuation of a building are regularly exposed to temperatures in excess of 105 degrees and, when accounting for the protective gear, expose them to the high probability of heat cramps, heat exhaustion and possibly heat stroke.

Geological – Limited Water Supply and Water Pressure
The Sanger area is an arid area which has received in the last three years an average of 11 to 12.5 inches of precipitation annually, occurring primarily in the winter months[1]. Furthermore, the Sanger area relies primarily on groundwater for its municipal water supply.

Due to the hot, dry summers in the Sanger area, domestic water demand substantially reduces the ability of the public water system to dependably meet the larger fire flow demand in many areas of the City.

Climatic/Topographical – Poor Air Quality Caused by Topography of San Joaquin Valley Air Basin, Large Number of Sunny Days and Inversions That Form During Winter Months
As a result of the San Joaquin Valley’s climate and topography, the San Joaquin Valley Air Basin (SJVAB) is predisposed to poor air quality. High mountain ranges surrounding the Valley frequently create air layer inversions, which prevent mixing of air masses. The large number of

Page 83 of 97 ends

sunny days per year and high temperatures in the summer favors the formation of ozone. The area is so sunny that the City of Fresno was ranked as the highest major California city for sunshine, with an estimated 79 percent annual average of possible sunshine for more than a 30- year period.[2] In the winter, inversions form that often trap particulate matter.

The Federal EPA and California Air Resources Board have classified the SJVAB as serious for 8-hour ozone, non-attainment (Federal) and non-attainment (State) for PM2.5[3]. Ozone is formed by a complex series of chemical reactions between reactive organic gases (ROG), oxides of nitrogen and sunlight. PM2.5 is suspended particulate matter that is less than two and one-half microns in width. Given its small size, PM2.5 can remain airborne for long periods and can be inhaled, pass through the respiratory system and lodge in the lungs. In general, non-attainment means the federal standard has been exceeded more than twice per year.

Smoke is composed primarily of carbon dioxide, water vapor, carbon monoxide, particulate matter, hydrocarbons, and other organic materials, nitrogen oxides, trace minerals and several thousand other compounds. Particulate matter is the principal pollutant of concern from some because of the relatively short-term exposures (hours to weeks) typically experienced by the public. Particulate matter in wood smoke has a size range near the wavelength of visible light (0.4-0.7 micrometers). Because these particles can be inhaled into the deepest recesses of the lungs, they are thought to represent a greater health concern than larger particles. Another pollutant of concern during some events is carbon monoxide.[4] The San Joaquin Valley Air Pollution Control District states, “Emissions from burning include fine particulate, hydrocarbons, oxides of nitrogen, oxides of sulfur, carbon monoxide, and toxic air contaminants that contribute to our air quality problems.”
Topographical – Sanger’s Development Pattern
Due to the relatively low-density growth pattern in the Sanger area, the one and only fire station is situated almost centrally in the City of Sanger, with an average of a two-mile travel distance for the fire company. This average two-mile travel distance increases the response time to fires, which results in an increase in the size and intensity of fires.

Findings Regarding the Reasonable Necessity of the Proposed Amendments to the California Fire Code Given Local Climatic, Topographical and Geological Conditions As set forth in detail in the attached proposed Resolution and Ordinance, each of the amendments requiring express findings of necessity to the California Fire Code are reasonably necessary because of these local climatic, topographical and geological conditions. The amendments may be generally characterized as relating to fire sprinkler systems. The other amendments proposed to the California Fire Code would be considered administrative in nature and therefore do not require express findings.

Fire Sprinkler Systems
Fire sprinkler systems have proven effective in suppressing and extinguishing structural fires using a small fraction of the water used with traditional fire suppression methods and resulting in smaller fires or shorter duration and thus in the generation of far less smoke that affects the air quality. Furthermore, because the fire sprinklers will limit the size and duration of fires, fewer fire personnel may be used to perform a direct attack on the fire. This reduces the number of fire

Page 84 of 97 ends

personnel who would be exposed to the health risk associated with sustained exposure to high temperatures and also addresses extended run time due to a topography-related low density growth pattern in the City of Sanger. The modifications proposed in this category maintain existing amendments approved by Council in 2016, which continues a proactive fire sprinkler installation emphasis for community fire protection that commenced in 1979. Local amendments proposed for adoption are limited to those felt essential to effectively administer Code responsibilities in daily operations and to maintain previous amendments approved by Council relating to fire and life safety. Staff recommend adoption of the standards as proposed.

Fiscal Impact:

No fiscal impact noted.

Alternatives:

Do not adopt Title 24, in which case it may be impossible to carry out mandated enforcement and utilize legal processes. State law mandates that local governments enforce the California Building Standards Code as published by the California Buildings Standards Commission in Title 24 of the California Code of Regulations. However, there is no mandate that local governments adopt Title 24; just that it be enforced. Title 24 applies where no local adoption ordinance exists. To carry out enforcement activities, it is the general practice for a city, county or city and counties to enact adoption ordinances making Title 24 the applicable code.

Actions Following Approval:

Should the City Council adopt this Ordinance, it will become legally effective on the thirty-first (31st) day following its adoption, pursuant to Section 6 of the attached proposed Ordinance.
