Re: Requests for Reasonable Modifications for Individuals with Disabilities
Dear Mayor Amezcua, Councilmembers:
We write on behalf of homeless individuals with disabilities, who rely on the Mental Health Association of Orange County's South Main Street Center ('MHA-OC") to manage their conditions. The City of Santa Ana's efforts to shut down this site effectively deprive these individuals of the essential services they need to survive. We request that the City provide comparable or better services and collaborate with the County of Orange to keep MHA-OC open until a suitable alternative location or service is available. The services at MHA-OC are uniquely tailored to serve chronically homeless individuals with severe mental health disabilities and are the only ones of their kind in Santa Ana and the County of Orange. Our clients have nowhere else to go for these services if MHA-OC closes at its projected end-of-year date.
Request for Reasonable Accommodation
Requests for Reasonable Modifications
Specifically, we request that:
1. The City provides an accessible center where our clients can manage their disabilities - including mental health services for chronically homeless individuals with severe mental health disabilities - and access life-sustaining resources like food, hygiene, and rest.
2. The City collaborate with the County of Orange to keep MHA-OC open until a suitable alternative location or service is provided.
3. The City ensures these individuals are connected to permanent housing options that provide mental health and essential services.
This request for reasonable modifications is made under Title Il of the Americans with Disabilities Act ("ADA"), Section 504 of the Rehabilitation Act, California Disabled Persons Act, Gov. Code Section 11135, and all other applicable state and federal laws. Notably, the Ninth Circuit has recognized that when specialized medical services are closed to individuals with disabilities who need them, it deprives those individuals of an equal opportunity to benefit from services, effectively denying them access to government-provided services due to their unique needs and is a violation of the ADA. Rodde v. Bonta, 357 F.3d 988, 998 (9th Cir. 2004).
Facts Relating to Individuals Clients
We represent the following individuals with disabilities and their requests for reasonable modifications:
E.A. is a 72 year old woman with physical and developmental disabilities. After the recent death of her husband, she became unhoused and was introduced to MHA-OC by a friend. She attends MHA-OC daily for a sense of community, access to mental health services, and relies on the staff to help her manage her medical appointments. E.A. also has limited mobility. Because of this, MHA-OC provides her with transportation, meals, a shower, and safe place to rest. These services are crucial for her mental and physical well-being as she waits for placement into a housing program.
Request for Reasonable Accommodation
E.H. is a 55-year-old man with physical disabilities. He visits MHA-OC daily, where he receives housing navigation services, meals, clean clothes, and showers. These services help E.H. maintain his dignity and connection to the community. He also utilizes the on-site mobile health clinic. MHA-OC is the only place where he can access barrier-free services. Without MHA-OC, he would lose vital support that sustains his life.
S.M. is a 37-year-old lifelong Orange County resident with mental and physical disabilities, including ADD, anxiety, PTSD, paranoia with suicidal ideation, and sleep apnea. His sleep apnea leaves him vulnerable, as he frequently falls asleep in public and has his belongings stolen. MHA-OC provides him a safe place to rest, psychiatric care, medication management, and transportation to appointments. The support he receives at MHA-OC has significantly reduced his suicidal ideations. If the South Main Street Site closes, he will be left without a safe place to manage his disabilities.
Conclusion
Our clients lack the income to afford housing and the ability to access essential services anywhere other than at MHA-OC. Without MHA-OC, our clients would be denied access to a homeless program that meets their vital needs, helping them survive and manage the symptoms of their disabilities.

Orange County Power Authority (OCPA) Board
Members; Tammy Kim & Kathleen Treseder from the
Irvine City Council, Fred Jung, Mayor of Fullerton, and Joe Mosca, OCPA CEO, have a very recent open
California Public Utilities Commission investigation into their spending practices while sitting on the board of the OCPA.
This is a short list of what the Orange County Power Authority has been spending its ratepayers funds on. The majority of these charges have not gone before the OCPA board for approval. Some of these charges are board members funding activities in their city, something their city should be funding and NOT OCPA ratepayers! Then we have a OCPA board member, Tammy Kim, who consistently uses the funds she is allotted in the City of Irvine, through the Community Grant Program, to fund specific organizations that either help to fund her election campaigns, or organizations that give her a platform in which to speak. Tammy Kim then uses ratepayer funds from the OCPA to fund these same organizations. In fact, members on the Irvine council refused her request for one organization because it was found to be going to overseas businesses in Korea. So Tammy Kim turned around and got what she could for that organization through the ratepayers of the OCPA. 1 There are excessive costs for hotels, airfare and meals whenever board members or the CEO decide to go to conventions, most of which have nothing to do with clean energy. I sent a public document request for the item listed below and the first time was told to contact the hotel. When I explained it was a payment listed on THEIR check register, and attached proof of this, they responded back and said they transferred it to the "appropriate" department... whatever that means.
$14,684- Signia San Jose Hotel - Unknown Reason - 03/07/24 If the CPUC finds the OCPA and its board members have abused funds, they may seek action on their own, or refer it to the Deputy District Attorney, or both.
Please do not contribute to this organizations corruption. Irvine residents want our council to get out from under this because the City of Irvine's electricity bill from the OCPA is $100,000 MORE a MONTH than it was when they were with SCE. This was confirmed by the City Manager, Oliver Chi, (949)724-6246. Irvine is enrolled in the 100% renewable plan and residents asked them to, at the very least, opt down to basic choice, and in a 3 to 2 vote, the option was denied. Mayor Farrah Khan, council members Tammy Kim and Kathleen Treseder voted not to get out and not to opt down ... not surprising!
They have essentially voted to throw away our tax dollars! They know that each plan gets them the same percentage of renewables because it comes from SCE. Yet they choose to pay more for 2 something they are not even receiving. I guess that's what OCPA means when they say you have a choice!

Last year the OCPA Board said they would include all correspondence/emails from the public regarding Agendized and Non-Agendized items in the meeting minutes. We are well into 2024 and NO correspondence has been attached to any of the minutes. I find this very concerning. I now had to do a public document request for this information which adds needless time for the OCPA staff. I hope you will get this corrected.

I would be very interested to hear your justification for taking funds in this way. Tammy Kim had already received funds from the City of Irvine for the World Korean Business Convention, which had been objected to because it ONLY supported overseas Korean businesses, but Mayor Khan gave in to her and gave her half of what she wanted. So, greedy Tammy Kim comes to the OCPA TO GET THE REST! This is unconscionable!

While I appreciate you responding to my email, I wish you would have addressed my concerns. Instead you basically said I should be fortunate to get these check registers now because the prior council did not provide them. And you neglected to "blame" yourself too, as you were also part of that prior council.
You also stated that the OCPA "regularly" publishes the expense register. No, they/you don't. And the evidence on your website proves that it is posted every quarter in your Treasury Reports. Let me ask you a dumb question. How is the public suppose to voice their concerns about the board expenditures when they are not posted until 3 months AFTER the fact? Where is the transparency, Fred? You don't even list these expenditures on the agendas.
So, back to my concern. How do you justify these expenditures where the majority come from YOU, TAMMY KIM, and KATHLEEN TRESEDER? How are they benefitting the ratepayers of the OCPA in providing renewable energy? $5,000 for Tommy Lasorda Day in Fullerton, and $2,500 of ratepayer funds going specifically to support Korean businesses overseas, as just 2 examples. Airfare, hotels, one for over $14,000, lots of dinners, expensive dinners... are the ratepayers paying for alcohol at these events? Fred, there is no transparency with this organization, and frankly, it is worse off than it was when it started. You still have the same legal agency, and the same consultants, which Treseder promised to replace or she would vote to get out of the OCPA, but the temptation must have been too much for her. She had to give $30,000 to Ayn Cracuin's campaign for city council. This is abuse of public funds, Fred, in case you didn't know.
Also, why is the 2nd quarter Treasury Report not posted on the OCPA website? The quarter ended in June in case you were not aware. And why didn't you address my concern about your promise to put public emails regarding the agenda attached to the minutes?
This agency is being funded by the ratepayers and it demands transparency in spending, and not after the fact! Dee Fox

I now had to do a public document request for this information which adds needless time for the OCPA staff. I hope you will get this corrected.

Hello my name is Mark A Neri And I am a long time living resident at the city of Santa Ana. My address is CA 92706 and In this area, it is one of the most beautiful area you can live in in the city of Santa Ana. Unfortunately, we are plagued with gang activity and Homelessness and drug activity. This area has so much potential to be above and beyond. What the city has to offer? But the Santa Ana police department and u city council members. Unfortunately, tried to brush a lot of these issues under the rug which is unacceptable. Because we as residents pay taxes and contribute to this society. How it's supposed to be. But when we ask for help to have police officers patrol our area from time to time make themselves visible.
It seems that it's not happening. And it is so unfortunate that I Call the police department all the time. And they show up or don't show up 20 minutes. 30 minutes an hour goes by and nobody or body shows And it is not just in this area, but it is all over the city that it is happening when X Mayor Miguel Pulido Left I!! He left an amazing legacy and under his leadership. This city was thriving like it was supposed to be. And there was no homelessness. Yeah, there was gang activity, but it was very minimal.
And unfortunately, the new mayor is all promises, but no deliveries. That is why not just the council members.
But the mayor itself need to be replaced with younger more ambitious. Leadership that are willing to make the necessary sacrifices and changes for the good of the city. Yes, mirror Polito might have had his issues. But it is far minimal than what we are paying right now an. D unfortunately, our kids are gonna pay the consequences.
For the actions of the council members and the mayor of the city and even boiling down to the San. Ta Ana unified school district. There's a lot of issues within the city. That wasn't happening 10,15 years ago. Maybe 20, it so unfortunate that we have to go through these times But this is the time where we as residents need to unite and battle these issues. Because nothing's been done, nothing is being done. TBH its time for Conservatives and republicans to run the city. I
