Subject: City Council public comment -- OC Animal Care
Attention: This email originated from outside of City of Santa Ana. Use caution when opening attachments or links.

This Op-Ed below just appeared. The city must demand transparency on the OC animal shelter's Strategic Plan. The county covers only 6% of the shelter's budget, the cities 94%. If the county doesn't give you an itemized report on the shelter's Strategic Plan IMMEDIATELY, you should not renew the contract.

Is the County Working to Fix the Animal Shelter's Problems? If so, Why Haven't Any Progress Reports Been Released?
https://voiceofoc.org/2025/12/vaughn-is-the-county-working-to-fix-the-animal-shelters-problems-if-so-why-havent- any-progress-reports-been-released/
While there's some positive change in the shelter, serious problems remain. OC needs to be transparent about the implementation (or not?) of the shelter's taxpayer-funded Strategic Plan. It also needs to value its experienced volunteers, instead of restricting them to crowded walkways and yards deteriorating into mud pits.

SAPD On Trial: Ramirez Wins Retaliation Case Against City, $2.9M Awarded A unanimous jury verdict found that the city of Santa Ana retaliated against one of its top managers during then-ongoing feuds between two police factions.

Ben Camacho
Dec 10, 2025
Excerpts from article:
"A jury unanimously found that the city of Santa Ana retaliated against Rita Ramirez for her refusal to participate in the Santa Ana Police Department's (SAPD) gang-like loyalty tests and for speaking up about the misogynistic treatment of women during her time as the highest ranking civilian employee at the police department. The jury also unanimously found that the city failed to take steps to correct misconduct by current and former SAPD top brass. Last Friday, the court awarded Ramirez $2.9 million in damages stemming from the retaliation that ultimately pushed Ramirez out of her job as the Police Administrative Manager. "The jury's decision marked the end of a trial that lasted over a month, which came after the three year long civil lawsuit Ramirez filed on October 21, 2022 in the Orange County Superior Court. "The case was one of several pending against the city of Santa Ana filed by current and former SAPD officers that also allege retaliation, harassment or other workplace-related claims. "Ramirez hopes that the verdict "serves as a wake up call to the city of Santa Ana to correct the endemic, systemic problems that they have, to this day, failed to address." "At the trial, testimony from Valentin, Rodriguez, former Deputy Chief Jose Gonzalez, Commander Maria Lopez and others proved to the jury to be, literally, unbelievable." "While Valentin was on the stand, Barber revealed that Valentin, who retired in October 2023, has a contract with the city that gives him $300 per hour to cooperate in the ongoing cases. The contract is not listed on the city's public documents portal. Barber revealed that an amendment to the contract was made specifically for Ramirez's case, where his hourly rate for cooperation was increased to $350 per hour. On the stand, Valentin stated he had not billed the city for any time yet."
"Mayor Valerie Amezcua and council members Thai Viet Phan, David Penaloza and Phil Bacerra did not respond to repeated requests for comment."

Hello,
I am an OC resident and researcher on animal shelter issues. I am uniquely qualified to offer City Council members information on how OC Animal Care, a shelter that has faced numerous problems in recent years, could be A paper of mine just came out in AJVR (research journal of the American Veterinary Medical Association) https://doi.org/10.2460/ajvr.25.09.0335
This is my third paper on animal sheltering... The other two were published in JSMCAH (the research journal of the Association of Shelter Veterinarians) and pertained directly to OC Animal Care:
https://doi.org/10.56771/jsmcah.v4.123
https://doi.org/10.56771/jsmcah.v3.85
The key is the application of the shelter's existing Strategic Plan, as highlighted in a recent community opinion piece:

Subject: Proposed Lighting Ordinance
Attention: This email originated from outside of City of Santa Ana. Use caution when opening attachments or links.

Dear Alvaro Nunez, City Manager, and City Council, Santa Ana, California, Government agencies operate on policy. Where an agency has failed to publish clear standards, its actions often result in arbitrary and capricious decision-making. Currently, the primary reason for the widespread hazards created by the introduction of LED light sources is this distinct lack of public policy.

To bridge this gap and provide a legally robust set of standards, the Soft Lights Foundation has published a Proposed Lighting Ordinance for California municipalities.

This document serves as a comprehensive framework to address light pollution, light trespass nuisance, workplace safety, and disability access-issues that are increasingly relevant to the environmental and public health goals of cities across our state. We are currently sharing this with government agencies across California for formal review and adoption.

You may review the proposed lighting ordinance here: (https://www.softlights.org/wp- content/uploads/2026/01/Proposal-for-Lighting-Ordinance-Anytown-California-4.pdf) We invite the City of Santa Ana to review this model ordinance for consideration and adoption. By implementing a rigorous, ready-to-adopt framework, Santa Ana can lead in mitigating the risks posed by unregulated light sources and ensure a higher standard of health and safety for all its residents and visitors.

Sincerely,
Mark Baker

Today I was assured you would never be of service to me. After all these years, you offer me nothing, not even a return phone call. As our City Attorney, you can't be bothered.

You are hereby put on notice. You are no longer my city attorney.

Never did you provide services for me‹.

Never did you counsel me or guide me in matters regarding the City of Santa Ana.

This is the acknowledgement.

This morning I showed up to your front desk to get a meeting with you. They at the front desk assured me their protocol is I would never get a meeting with you and that you do not speak to the general public. They assured me you would never call me back, so they didn't even bother to take a message. They know you do not care about us or our well-being, they are well trained.

Following protocol, I called again and left a message this morning. They said you were not in office. Out of office.

On a third conference call this morning to your office, of the staff I requested a simple 30 minute meeting with you, the entire office assured me you don't represent me, you were never my city attorney.

Today I filed a formal complaint with the Police Oversight Commission against the entirety of the Santa Ana Police Department for the agency's involvement in a horrific pay-to-play scheme, domestic terrorism act, also known as "The Las Vegas Shooting", touted as the "deadliest mass shooting in US history" on October 1st, 2017.

Phil Bacerra @OCFA Orange County lets multi-county firefighting helicopter contract expire
"That partnership expired on Jan. 1, 2026, in what Edison officials and OCFA's Fire Chief Brian Fennessy say was not a mutual decision, but one that came about when the department's board of directors failed to vote on the matter before the end of 2025.
"I am extremely disappointed that the Quick Reaction Force... ended on January 1, 2026," Fennessy said in a statement. "OCFA staff and I made every effort possible to ensure our 2026 QRF agreement with SCE was renewed before the January 1, 2026 deadline."
These actions raise serious concerns about transparency and integrity in the decision-making process. Any board member or representatives from Local 3631, including Chris Hamm, are welcome to publicly respond." https://www.cbsnews.com/losangeles/news/orange-county-fire-authority-socal- edison-quick-reaction-force-contract-expire/

Phil, I am writing because the time is getting short to have a special meeting on what seems like an important issue. Chief Fennessy has written, and I was contacted by Chris Hamm, but I have heard nothing from you. As Chair of our Board, it seems you hold a lot of sway over Board members desire to attend or not. By your silence, you are certainly indicating your point of view. But, it is our decision to make as a Board, not just one member. I want to vote on this and not see it die for lack of discussion. That's not fair to any of us on the Board.

I am asking you to please reach out and encourage other Board members attendance and at least try to allow a discussion on this. Please.

"Oof. The QRF program is no more. A very highly-effective night-flying aerial fire attack platform that saved countless homes...being disbanded because 6 dorks on the OCFA board refused to support it. LA County and SCE will "salvage a portion" of the fleet for LAC and VC. Rough."

My apology for sending this out once again. The previous submittal included only the cover letter, without the data. This attachment has the 21 pages of data that I obtained and organized for easier reading.

Jennifer...Please add attached file to the 2026-01-20 City Council meeting public comments.

Subject: City Council Special Event Sponsorship Policy
On October 7th I spoke at the City Council meeting regarding the distribution of discretionary funds approved by City Councilmembers. At that time, I committed to request related information from the City and provide Council an analysis of the data received and the policy itself. The results of this analysis, addressing distributions from FY2021 thru FY2025, were separated by councilmember and Mayor and sent to each individual on November 9th. You have had two months to provide corrections and input to my conclusions and some of you did. I made the corrections you requested. For those who did not respond, I came to the conclusion you read my statement that said, "No response required if you agree with the information." I am now providing a final version of how those funds were distributed by all on the Council along with my assessment of whether the distributions were made in accordance with the City Council Special Event Sponsorship Policy, adopted and revised on February 5, 2019.

The purpose of this policy is "To establish a City Council Special Event Sponsorship Policy and guidelines for disbursement of discretionary funds approved by City Councilmembers to sponsor city programs, services, and special events produced by qualified nonprofit organizations and/or City recognized neighborhood associations."
Attached you will find how $274,517 of discretionary funds were distributed from FY2021 thru FY2025. Out of all these disbursements, the outlier to the policy was the $3000 provided to the Latino Muslim Unity - EID Fair by Councilmember Lopez. In her closing remarks on October 7h, she defended her actions on the the basis of promoting diversity, implying that I don't. Nothing could be further from the truth. What I don't support is using discretionary funds in a way that falls outside approved policy.

There is nothing wrong with supporting events in other cities. That is done regularly and should continue, but the policy is clear in stating the "distribution of discretionary funds" is limited to "city programs, services, and special events". The Latino Muslim Unity - EID Fair, an event held outside of Santa Ana, did not qualify for the disbursement. Councilmember Lopez should be directed to refund the $3000 of Santa Ana taxpayer money that was donated outside of policy guidelines.
