GOVERNMENT CODE §84308 APPLIES: Yes

DISCUSSION
The subject properties located at 217 S. Bristol (APN 008-225-23), 219 S. Bristol Street (APN 008-225-24), and 223 S. Bristol Street (APN 008-231-25) were acquired as part of the Bristol Street Improvements projects using Orange County Transportation Authority (OCTA) grant funding (Exhibit 1). The City has since completed the widening improvements in this area and remnant parcels remain. The remnant parcels are ready to be sold in accordance with the requirements of the California Surplus Land Act (Government Code Section 54220).

On October 16, 2025, the City Council adopted Resolution No. 2025-045 declaring various City-owned properties as surplus land and directing the City Manager to comply Appropriation Adjustment and Sale of Remnant Land at 217, 219, and 223 S. Bristol Street.

with the requirements of the California Surplus Land Act. The subject properties are among those declared surplus and, as a result, the City has since completed all statutory requirements and is authorized to proceed with disposition of the property.

On March 20, 2026, the City issued Request for Proposals (RFP) No. 26-036 for the sale and development of 20 individual parcels grouped into nine (9) property offerings, each identified by a distinct Parcel ID (Exhibit 2). The individual parcels were grouped into nine property offerings based on their location and configuration to facilitate their sale and potential development. To provide an opportunity for all interested parties to submit proposals, the RFP was solicited electronically on the City’s online bid management and publication system, PlanetBids. A summary of vendor participation and results is as follows:
955 Vendors notified
13 Santa Ana vendors notified
65 Vendors downloaded the bid packet
3 Responsive bids received
1 Responsive bid received from Santa Ana vendor
Proposals were opened on April 20, 2026, and evaluated. Three responsive proposals were submitted by the RFP deadline and determined to meet the specifications the City’s requirements. Three responsive proposals were evaluated by a selection committee comprised of personnel from Public Works, Finance, Community Development Agency, and Planning and Building Agency. Based on criteria outlined in the RFP, the following summarizes the top responsive proposal:

Parcel ID
APN
Entity Proposed
Development
Purchase Price

APN 008-225-23
APN 008-225-24
APN 008-231-25
Dustin Van Do Single Family
Residence $312,750
Staff recommends awarding a purchase and sale agreement to the highest-ranked proposer for the Parcel ID R1: Dustin Van Do (Exhibit 3). Dustin Van Do submitted the highest purchase price for Parcel R1 and has proposed a lot merger to develop a single-family residence designed to complement the surrounding neighborhood.

Approval of the recommended actions will authorize the sale and transfer of Parcel R1 to the respective buyer for timely development in accordance to the terms of the PSA.

The agreement establishes development milestones and includes liquidated damages and other provisions to discourage prolonged vacancy and ensure timely progress Appropriation Adjustment and Sale of Remnant Land at 217, 219, and 223 S. Bristol Street.

toward development. Activating citywide vacant lots supports general plan goals by fostering community development and increasing tax revenue, while reducing blight and ongoing maintenance costs and liability, in alignment with established municipal codes governing surplus property disposition.

In accordance with the terms of the grant agreement with OCTA, 100% of proceeds from the sale of remnant land may be used to fund Bristol Street Improvements. If not used for Bristol Street Improvements, a significant portion would need to be returned to OCTA. Staff recommends an amendment to the Fiscal Year 2026-27 Capital Improvement Program to add the entire sale proceeds of $312,750 to the Bristol Street Phase 3A Project (No. 13-6792) (Exhibit 4).

ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act (CEQA) and the CEQA Guidelines, that the declaration, sale, and conveyance of the subject surplus real property is exempt from CEQA pursuant to Section 15312 of the CEQA Guidelines because the property is surplus government land, is not located in an area of statewide, regional, or area-wide concern, and does not possess significant values for wildlife habitat or historical resources. (Title 14 California Code of Regulations (CCR) § 15312.) Additionally, the transaction is not subject to CEQA because the action consists solely of a transfer of title to vacant land without any concurrent entitlement, development approval, or authorization for physical construction or land disturbance and will not result in a direct or reasonably foreseeable indirect physical change in the environment. (14 CCR §§ 15060(c)(2), 15060(c)(3), and 15378(b)(5).) Furthermore, the transaction is exempt from CEQA because it can be seen with certainty that there is no possibility that the sale and conveyance of the surplus real property may have a significant effect on the environment. (14 CCR § 15061(b)(3).)

FISCAL IMPACT
Approval of the recommended Appropriation Adjustment will recognize receipt of $312,750 into the Select Street Construction, Sale of Land revenue account (No. 05917002-57071) and appropriate it to the City Street Projects, Improvements Other Than Buildings expenditure account (No. 05917666-66220), Project No. 13-6792.
