CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: October 18, 2022
TO: Mayor and Councilmembers
FROM: Engineering Division, Public Works Department
SUBJECT: Authorize Execution of a Quitclaim Deed on Property Known as 219 East Haley Street [Resolution]
RECOMMENDATION:
That Council adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Authorizing the Public Works Director to Execute a Quitclaim Deed Conveying a Vacant Remnant Parcel Adjacent to Assessor Parcel Number 031-202-014.
DISCUSSION:
The City of Santa Barbara (City) Public Works Engineering Division has received an application from the private property owner of 219 East Haley Street to quitclaim a vacant sliver of land existing between the apparent property boundaries of two private parcels.
There is an existing Record of Survey from 1989 by the adjacent property owner to the north of the subject parcel showing a lot line adjustment appearing to correct a survey error dating back to the original land grant from 1852.
A chain of title search, land survey, and legal opinion of the attorney submitting the application appears to confirm the survey error going back to the 1852 original land grant from the City to the private party Ruiz creating the remnant City-owned parcel (see Attachment 1).
City Real Property staff has determined that there has been no past claim on this land or public use historically by the City, and that there is no anticipated future public use of, or any access to, said sliver of land by the City or the public.
A Resolution by the City authorizing the execution of a Quitclaim Deed will extinguish any real property ownership rights by the City that may exist for the sliver parcel and clear any cloud of title that may exist (see Attachment 2).
BUDGET/FINANCIAL INFORMATION:
Fees have been paid for staff cost recovery of the proposed real property action, and the proposed action has no other financial impact on the City.

A RESOLUTION OF THE COUNCIL OF THE CITY OF
SANTA BARBARA AUTHORIZING THE PUBLIC WORKS
DIRECTOR TO EXECUTE A QUITCLAIM DEED
CONVEYING A VACANT REMNANT PARCEL ADJACENT
TO ASSESSOR PARCEL NUMBER 031-202-014
WHEREAS, the City of Santa Barbara Public Works Engineering Division has received an application from the owner of the property located at 219 East Haley Street, Santa Barbara, CA (Assessor Parcel Number 031-202-014) for the City to convey a vacant, landlocked sliver of land that may be City-owned adjacent to the owner’s property; and WHEREAS, the apparent City-owned land is shown on the diagram attached as Exhibit A to this resolution;
WHEREAS, the owner has provided sufficient information demonstrating that the apparent City-owned land was the result of a survey error dating back to 1852; WHEREAS, there is no record of a historic claim to, or use of, the apparent City-owned land, and the land has no current use or value to the City; and WHEREAS, the City desires to correct the historic error by relinquishing any right, title, or interest the City may have in the apparent City-owned land by conveying it to the owner.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SANTA BARBARA THAT The Public Works Director is authorized to execute and cause the recordation of a Quitclaim Deed in a form approved by the City Attorney conveying the apparent City-owned land to the owner of the property located at 219 East Haley Street, Santa Barbara, CA.
CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: October 18, 2022
TO: Mayor and Councilmembers
FROM: Engineering Division, Public Works Department
SUBJECT: Authorize Execution of Underground Utility Easement to Southern California Edison on City Park Property Adjacent to 900 Calle de Los Amigos [Resolution]
RECOMMENDATION
That Council adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Authorizing the Public Works Director to Execute an Underground Utility Easement to Southern California Edison on City Park Property Adjacent to 900 Calle de Los Amigos.
DISCUSSION:
Southern California Edison (SCE) has an existing transformer and electrical service facility on the City of Santa Barbara’s (City) Hidden Valley Park property adjacent to the street address of 900 Calle de Los Amigos. SCE has requested an additional Underground Utility Easement (Easement) within the already encumbered area to serve a small cell wireless communications facility with an antenna attachment to an existing City streetlight (see Attachment 1).
The permit application for the small cell facility is currently submitted, pending final approval by Public Works. The small cell facility, which is located on the street adjacent to Hidden Valley Park, needs an electrical service meter and connection to power the equipment (see Attachment 2). The small cell facility services the Hidden Valley neighborhood, which is known to have gaps in wireless communications service. The subject Easement is necessary for an underground connection from the existing SCE facility. The Parks and Recreation Director has determined that the Easement will not interfere with their operations and the Easement includes appropriate relocation and termination language should that be necessary.
Staff recommends approval of the Resolution to grant the Easement to SCE due to the necessity for electrical service at the new small cell facility.
BUDGET/FINANCIAL INFORMATION:
The proposed action has no financial impact on the City.

In most cases, encumbrance balances exist at year-end. These encumbrance balances are obligations of each fund and must be reported at the beginning of each fiscal year. In addition, a corresponding appropriations entry must be made in order to accommodate the 'carried-over' encumbrance amount. Most differences between budgeted annual revenues and expenses are due to these encumbrance carryovers.

The City actively monitors the budget status of each department and takes measures to address potential over budget situations before they occur.
For Enterprise and Internal Service Funds, the level of budgetary control is at the fund level. The City also monitors and addresses these fund types for potential over budget situations.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: October 18, 2022
TO: Mayor and Councilmembers
FROM: Engineering Division, Public Works Department
SUBJECT: Access Advisory Committee – Annual Report
RECOMMENDATION:
That Council receive an update on the recent activities and achievements of the Access Advisory Committee.
DISCUSSION:
In 1988, the City of Santa Barbara (City) recognized the importance of accessibility in design and construction and started an ad hoc advisory committee to assist the Architectural Board of Review and the Historic Landmarks Commission with accessibilityrelated items. In 2001, this ad hoc committee became a standing committee known as the Staff Advisory Access Committee under Council Resolution 01-034. In 2008, under Resolution 08-095, it was officially renamed the Access Advisory Committee (AAC).
Per the AAC’s governing Resolution 08-095, and the updated Resolution 21-061, the City’s Americans with Disabilities Act (ADA) Coordinator will report annually to Council regarding the activities and achievements of the AAC. This update provides a brief history of the AAC, outlines the AAC’s role, discusses future goals and objectives, and highlights recent achievements.
AAC Purpose
In 2021, Resolution 21-061 revised the scope of the Committee’s purpose, function, membership requirements, term length, meeting frequency, and procedures. The revised resolution defines the purpose and function of the AAC as assisting and advising staff on public disability issues by:
a. Actively promoting the total integration and participation of persons with disabilities in all areas of economic, political, and community life. b. Serving as a coordinating body for the purpose of receiving input from citizens on the needs and concerns of the disabled community, formulating and recommending solutions based on these identified needs and concerns, and conveying such recommendations to the appropriate City departments.

f. Providing advice regarding the setting of priorities for projects to remove barriers and improve access within the City’s public rights-of-way. g. Identifying opportunities to educate the public about disability and disabilityaccess issues within the community.
Recent Achievements
Over the past year, the AAC has actively engaged in a variety of areas related to accessibility. The majority of AAC members have a physical disability and personally navigate accessibility challenges throughout the City on a daily basis. One key area of ongoing interest and concern is the ADA compliance of temporary outdoor business facilities operating within the City’s right of way, as authorized under the City Council’s Economic Recovery Extension and Transition Ordinance through December 31, 2023.
In the past year, AAC has achieved the following related to accessibility:
Provided guidance and feedback to City staff on accessibility for the City’s Outdoor Dining Program;
Performed a walk-through of the State Street Promenade with City staff to assess ADA compliance of temporary outdoor business facilities; o City staff, with support from a Certified Access Specialist consultant, performed ADA compliance inspections of temporary outdoor business facilities within the State Street Promenade.
First round of inspections found that 12 of 44 outdoor business facilities were ADA compliant.
Performed multiple outreach and education sessions, in group settings and one-on-one meetings, with business owners and operators regarding ADA compliance standards and
requirements.
Through outreach, education, and enforcement efforts, 33 of 44 were in compliance as of August 24, 2022. (Note: The majority of the remaining 11 non-compliant facilities have accessible dining areas, but don’t meet the letter of the ADA requirements.) Advocated for the addition of six additional Accessible Parking Zones in the Downtown Plaza area, which were installed by City staff; Notified City staff of a non-compliant parklet on private property infringing on required disabled parking spaces, which have now been restored for use; Prioritized sidewalk barrier removals, such as missing access ramps, sidewalk Council Agenda Report

Reviewed and provided feedback on the City’s draft Housing Element update; Initiated monthly meetings with the AAC Chair, Vice Chair, and ADA Coordinator to discuss and plan meeting agendas;
Passed a Resolution at the June 2022 AAC meeting requesting that Council allocate sufficient funding, resources, and direction to resolve the lack of accessibility of temporary outdoor business areas operating in the City’s right of way;

o 89 new and retrofitted access ramps
o 140,000 square feet of new sidewalk

Started the construction phase of the Central Library Plaza Renovation and the ADA Elevator Project;
City Hall Restroom Remodel is in final design; and the ADA Elevator Project is in design.
Future Goals, Objectives, Priorities, and Challenges
The future goals, objectives, priorities, and recognized challenges for the City and the AAC include:
Goals:
Improve accessibility throughout the City;
Raise awareness of ADA deficiencies on private property that is open to the public; Encourage community collaboration;

Objectives:
Explore the City’s capacity and resources to establish a full-time ADA Enforcement Officer;
Form an Ad Hoc Committee to review and develop a scope of work to update the ADA Transition Plan by June 2023;
Budget for Preparation of a Draft ADA Transition Plan for the Public Right of Way; and
Draft a new AAC Member Orientation Manual by June 2023.
Priorities:
ADA Transition Plan Update;
Accessibility of outdoor dining facilities (parklets); Blue Curb Parking Initiative;
ADA parking enforcement;
In-service training for City ADA Liaison staff and AAC members; Develop outreach and education tools for local businesses and the public; and Sidewalk barrier removal.
Challenges:
Competing for limited staff resources amongst other City high-priority commitments and requirements; and
Identifying funding sources for activities, programs, and services.
Since the inception of the ADA in 1990, the City has worked to ensure equal opportunities for those with disabilities. The AAC is a valuable community stakeholder that assists City staff with identifying needs and suggesting solutions to improve access to programs, services, and facilities within the City.
BUDGET/FINANCIAL INFORMATION:
Several of the goals and objectives identified above have future unbudgeted costs associated with them. For example, potential future unfunded costs include the addition of a full-time ADA Enforcement Officer, professional in-service training for ADA Liaison staff and AAC members, ADA Transition Plan updates, and increased ADA inspection and enforcement (potentially via a consultant).
