CITY OF SANTABARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: August 22, 2023
TO: Mayor and Councilmembers
FROM: Housing and Human Services Division, Community Development Department
SUBJECT: Approval to Subordinate the City’s Affordability Covenant on Sanctuary Center’s Public Benefit Project Located at 115 West Anapamu Street [Ordinance Introduction]
RECOMMENDATION: That Council:
A. Approve a request from Sanctuary Center of Santa Barbara, Inc., to subordinate the City’s affordability covenant on their new public benefit development project located at 115 West Anapamu Street; and
B. Introduce and subsequently adopt, by reading of title only, an Ordinance of the Council of the City of Santa Barbara Approving a 55-Year Affordability Control Covenant Imposed on Real Property Located at 115 West Anapamu Street and Authorizing the Community Development Director to Execute Such Agreement, Subject to Approval as to Form by the City Attorney, as Necessary.
DISCUSSION:
Background
Sanctuary Center of Santa Barbara, Inc., (Sanctuary Center) is a local nonprofit that provides services and housing to mentally ill and unhoused individuals living in the Santa Barbara community. In 1995, Sanctuary Center acquired the two-story, eight-unit residential building known as Hollister House Apartments located on the property at 115 West Anapamu Street. Hollister House Apartments serves as an independent living facility for mentally disabled clients and as a residence for low-income tenants.
Project
Sanctuary Center has applied to build a Supportive Housing project with a total of 34 lowincome affordable housing units on a 15,013-square-foot site. An existing eight-unit affordable apartment building will remain, and a five-story, 30,948-square-foot, mixed-use Agenda Item No. 2
File Code No. 660.04
Council Agenda Report
Approval to Subordinate the City’s Affordability Covenant on Sanctuary Center’s Public Benefit Project Located at 115 West Anapamu Street
August 22, 2023
building with full basement will be constructed. The new building will provide an additional 34 studio units averaging 450 square feet, along with an approximately 3,575-square-foot Co-Occurring Disorders Center and an approximately 4,290-square-foot Integrated Care Clinic focused on serving people with mental illness (Project).
Because it meets all requirements as a Supportive Housing Project, the Project is allowed by right and is subject to the regulatory requirements under State Density Bonus Law (Government Code § 65915), Housing Accountability Act (Government Code § 65589.5), and Supportive Housing Act (Government Code § 65650 et seq.).
Affordability Covenant Requirement
In accordance with the Project requirements, the City will record a new affordability covenant for the State Density Bonus and Supportive Housing allowances to restrict the affordability of the property and to ensure the provision of supportive services for 55 years, per State regulations. No City funding is involved in the project, so the City will defer to State requirements for the term of the covenant.
Proposal
The Project has garnered support from many agencies across the State and County that recognize the great need for the project and the potential public benefit. With the cost of construction at an estimated $30 million, several funding sources are required.
Congressman Salud Carbajal has lobbied and gained financial support for the Project from the State of California. As a result, and since the City is not contributing any financial assistance to the Project, the City is being asked to subordinate its affordability covenant to all of the bank, state, and county agencies involved that will be recording documents on the property’s title.
The City is being asked to subordinate to the following senior liens:
Agency Agreement Type
First Republic Bank Deed of Trust and Related Documents California Department of Housing NPLH Competitive Deed of Trust and Regulatory Agreement

Approval to Subordinate the City’s Affordability Covenant on Sanctuary Center’s Public Benefit Project Located at 115 West Anapamu Street
August 22, 2023
City Policy
According to the City’s Affordable Housing Policy and Procedures, “requests to subordinate the City’s affordability covenant will not be approved, unless reviewed and approved by the City Council.” As a request to subordinate the City’s affordability covenant, this request requires City Council approval.
Risks
There is a degree of risk in being junior in position on title to the other parties: if a default occurs, resulting in a foreclosure on any of the senior liens, the City’s affordability covenant might be dismissed in the overall cure. However, since the City does not have funding in the Project, there is no inherent financial risk to the City. The only potential loss is affordable units under the City’s covenant. Overall affordability may remain restricted through senior lienholders that will also be recording affordability covenants totaling 55 years.
Conclusion
Staff recommends that Council approve subordination of the City’s affordability covenant in this case due to the profound need for affordable housing and services for the City’s unhoused and mentally ill residents. Since it will not have any financial participation in this project, the City’s risk is greatly decreased. Affordability restrictions will also be placed on the title as conditions to some of the senior liens’ funding contributions, helping to ensure the units will remain affordable should there be a default.
BUDGET/FINANCIAL INFORMATION:
There are no City funds involved in this project and no budget/financial implications for consideration.

2 1. The foregoing recitals are true and correct and are incorporated into these findings.
2. All written, graphic, and oral materials and information submitted to the Single Family Design Board and the City Council by City staff, the public, and the parties are hereby accepted as part of the record of proceedings.
3. The City Council has carefully reviewed the evidence it obtained during the public hearing as described above and from the record of proceedings, and based upon that evidence, denies the appeal to reverse the decision of the Single Family Design Board, making the findings and determinations set forth below:
I. CEQA Environmental Review Findings
The project qualifies for exemptions from further environmental review pursuant to California Environmental Quality Act (CEQA) Guidelines, Article 19, Section 15301 (Existing Facilities), which allows for additions to existing structures. No significant project-specific or cumulative environmental impacts are expected as a result of the project. The project does not have the potential to damage scenic highways or historic resources, and the project site is not identified as a hazardous waste site; therefore, none of the exceptions apply (per Guidelines Section 15300.2).
II. City Council Findings
City Council denies the appeal to reverse the decision of the Single Family Design Board’s decision granting Project Design Approval based on the following findings resulting in a project that is consistent with the Neighborhood Preservation findings as set forth in Santa Barbara Municipal Code Section 22.69.050.A.:
Neighborhood Preservation Findings:
1. Consistency and Appearance. Is the project’s design consistent with the scenic character of the City and will it enhance the appearance of the neighborhood.
The proposed development is consistent with the scenic character of the City and will enhance the appearance of the neighborhood. The applicant has provided multiple studies and images of the floor-to-lot area ratio (FAR), materials, and heights of the neighborhood. The proposed size and FAR are supportable based upon the Board’s review of neighborhood FAR’s and the fact that approximately 200 square feet of the FAR square footage is a product of an unenclosed carport.
2. Compatibility. Is the proposed development compatible with the neighborhood, and are its size, bulk, and scale appropriate to the site and neighborhood.
The City Council found that the proposed development is compatible with the neighborhood, and its size, bulk, and scale is appropriate to the site and neighborhood. 3 3. Quality Architecture and Materials. Is the proposed development designed with quality architectural details, and do the proposed materials and colors maintain the natural appearance of the ridgeline or hillside.
The proposed buildings and structures are designed with quality architectural materials and details. The proposed materials and colors maintain the natural appearance of the ridgeline or hillside.
4. Trees. Does the proposed project include removal of or significantly impact any designated specimen tree, historic tree, or Landmark tree? To the maximum extent feasible, does the proposed development preserve and protect healthy, non-invasive trees with a trunk diameter of four inches or more? If the project includes the removal of any healthy, non-invasive tree with a diameter of four inches or more, does the project include a plan to mitigate the impact of such removal by planting replacement trees in accordance with applicable tree replacement ratios.
Removal of healthy, non-invasive trees is not proposed for this project and additional trees of a significant size are being added for privacy. Following the Single Family Design Board’s direction, the mature olive trees proposed shall be a minimum of 20 feet in height from top of canopy to finish grade.
5. Health, Safety, and Welfare. Are public health, safety, and welfare appropriately protected and preserved.
The public health, safety, and welfare are appropriately protected and preserved.
6. Good Neighbor Guidelines. Does the project generally comply with the Good Neighbor Guidelines regarding privacy, landscaping, noise, and lighting.
The project generally complies with the Good Neighbor Guidelines regarding privacy, landscaping, noise, and lighting. The applicant has made changes to the windows, relocated rooms, and added trees of a significant size for privacy. The westerly deck is supportable due to its diminutive size.
7. Public Views. Does the development, including proposed structures and grading, preserve significant public scenic views of and from the hillside.
No public views are impacted by the project.

FROM: Administration Division, Airport Department
SUBJECT: Airport Department Draft Response to City of Goleta Noise Action Plan Letter Request Dated January 17, 2023
RECOMMENDATION:
That Council consider Airport Department’s draft response to City of Goleta’s Noise Action Plan Letter dated January 17, 2023 for further revision and/or transmittal to the City of Goleta.
EXECUTIVE SUMMARY:
The Santa Barbara Airport (SBA) has prepared a draft response to the City of Goleta Noise Action Plan request letter to City Council Dated January 17, 2023. Airport staff worked with City Council, the Airport Commission, and consultants to prepare the attached draft letter response for Council’s review and consideration. Staff seeks input and direction on the attached draft letter. If approved, staff will transmit a response to the City of Goleta on behalf of City Council. Any projects that result from the response to the City of Goleta letter will be funded by a combination of Airport operating funds and federal funds from the Federal Aviation Administration (FAA).
DISCUSSION:
Background
In response to an increase in noise complaints from the public, the City of Goleta hosted a public workshop on December 7, 2022 to review Airport development projects and to provide information regarding aircraft noise. Santa Barbara Airport staff provided a presentation and responded to comments and questions from the Goleta City Council and the public at the workshop. Airport staff, City of Goleta Council, and the public explored several possible strategies to address noise concerns.
On January 17, 2023, the City of Goleta Council authorized Mayor Perotte to sign and transmit a letter to the Santa Barbara City Council regarding a request for a Santa Barbara Municipal Airport Aircraft Noise Action Plan (Action Plan). Prior to this, City of Goleta and Agenda Item No. 8

Airport Department Draft Response to City of Goleta Noise Action Plan Letter Request Dated January 17, 2023
August 22, 2023
Airport staff were meeting over the preceding months to identify specific steps that can be taken to address noise impacts.
On March 14, 2023, Santa Barbara City Council authorized Airport staff to collaboratively work with the Santa Barbara Airport Commission to consider the Noise Action Plan Request Letter and prepare a response.
On April 15, 2023 the Airport Commission reviewed and considered a response prepared by Airport staff. Airport staff discussed the technical aviation subject matter of the thirteen separate requests in the January 17, 2023 letter, and received unanimous direction from the Airport Commission to proceed with the proposed response discussed at the meeting.
The details of the proposed response are described below and attached in the response letter prepared by staff.
Draft Responses to Noise Items:
SBA staff and Airport Commission have determined that several of the proposed strategies by the City of Goleta Council align with the information and potential areas for improvement presented by SBA staff at the December 2022 public workshop. Staff recommends that an Airport Noise Working Group be formed to proactively address several of those items and others that may develop through that process. Bringing together key stakeholders including airlines, corporate aircraft operators, flight training institutions, air traffic control representatives, neighborhood advocates, City of Goleta, County of Santa Barbara, and SBA would create a collaborative platform that will allow for the development of practical and effective noise mitigation strategies. The specific items taken directly from the City of Goleta letter that the working group could address, and provide recommendations and guidance to airport staff are:
2) Prepare charted visual approach procedures to align aircraft on flight paths that mitigate noise exposure over residential communities. These procedures can also improve communications between pilots and the Federal Aviation Administration (FAA) Air Traffic Control Tower (ATCT) to further encourage flight path compliance.
3) Incentivize airline compliance with noise abatement flight paths. 4) Encourage all four airlines serving the Airport to use a “proprietary” instrument approach procedure currently used by three of the four airlines. 5) Address noise issues and noise abatement compliance at the time SBA negotiates with new airlines and new routes by existing airlines. 6) Address business jet operations and chartered aircraft separately from commercial airlines through outreach to Fixed Base Operators (FBO) supporting these owners and operators. Create noise mitigation procedures specifically for charter aircraft and business and private jets by aligning with National Business Council Agenda Report
Airport Department Draft Response to City of Goleta Noise Action Plan Letter Request Dated January 17, 2023
August 22, 2023
Aircraft Association (NBAA) Noise Abatement Program. Apply these procedures to east and west noise abatement corridors used for airline and general aviation operations.
8) Explore new outreach efforts to pilots to get them information on preferred approach and departure procedures and noise-mitigating measures.
SBA staff and Airport Commission have determined that many of the remaining proposed strategies by the City of Goleta Council could have a significant impact on other neighboring communities, local businesses, and the general traveling public. These items should be a considered carefully, thoroughly evaluating each of them and allowing for adequate public comment and transparency. SBA staff and Airport Commission recommend that these items be addressed through an official Airport Noise Compatibility Planning Study to update the previous 2004 study that no longer reflects the current operations and aircraft fleet mix at the Santa Barbara Airport. The specific items taken directly from the City of Goleta letter to be evaluated through an FAA approved planning study are:
1) Reinstate the Runways 7 and 25 voluntary flight procedure for visual and instrument flights over the Ellwood-Devereux Open Space and More Mesa area.
The community desire is to include all operations within these corridors to the maximum extent possible.
7) Analyze and report on departure procedure use, which departure and arrival procedures are “quietest”, and whether those are being used most often (if not, why). Explore solutions for reducing noise impacts especially during early morning and late evening hours.
9) Explore the potential benefits and costs of a voluntary aircraft noise curfew, understanding the trade-off that airlines and passengers would likely lose some flight connections.
10) Analyze and report on the fleet mix at the Airport, the number of older, louder aircraft still landing and departing, and hours of operation. Develop strategies to discourage older, louder aircraft use, especially during early morning and late evening hours.
13) Develop “fly quiet” flight procedures for takeoff and arrival for all operations to mitigate noise impacts to residential areas around the Airport.
SBA staff and Airport Commission have determined that two remaining items from the City of Goleta letter do not fall directly under the scope of the updated noise study or the Noise Working Group. These items address aircraft emissions and the governance of the Airport, specifically the makeup of the Airport Commission. Aircraft emission are beyond the purview of our City Council's powers and responsibilities, Staff recommends continued research and implementation of environmentally friendly practices as Council Agenda Report

appropriate for the specific operation of the Santa Barbara Airport as they relate to aircraft emissions, fuels, and other technological advances. Staff also recommends notifying the City of Goleta and the County of Santa Barbara when positions on the Airport Commission become vacant, and encourage Goleta and unincorporated county residents to submit applications to serve on the Santa Barbara Airport Commission with an understanding that geographical diversity will be considered as a factor while making appointments to the Airport Commission. The specific items taken directly from the City of Goleta letter stated above are:
11) Gather and report data on aircraft particulate emissions. 12) Advise on an amendment to the Santa Barbara Airport Commission Charter to give the City of Goleta a permanent seat and voice in Airport decisions directly impacting the City. Include informal consideration of City of Goleta nominations for Commission representatives from the City of Goleta or County of Santa Barbara.
SBA Staff is committed to building trust and transparency in the operation of the Santa Barbara Airport with the understanding that the airport serves the entire region, and the impacts from these operations have an affect the surrounding communities of Santa Barbara, Goleta, and Santa Barbara County residents.
BUDGET/FINANCIAL INFORMATION:
Staff considered each item in the letter after direction from Airport Commission on April 26, 2023. While staff can address some issues in the letter, a separate Part 150 Noise Study will cost approximately $1,200,000 and could be partially funded by the FAA if programmed in the Airport Capital Improvement Program for Federal Fiscal Year 2024.
The portion of the proposed Part 150 Noise Study not funded by the FAA would be funded by the Airport operating budget. Additional items would be supported by currently unprogrammed staff time.
SUSTAINABILITY IMPACT:
The Santa Barbara General Plan focuses on a stated mission statement of “Living Within Our Resources” and stresses sustainability for development (City of Santa Barbara 2011).
Also, a guiding principle of the 2017 Airport Master Plan (AMP) and the MPU is to support sustainable design of airport facilities and the wise use of resources. The response to the Noise Action letter from the City of Goleta would be consistent with both the General Plan and the AMP.
ENVIRONMENTAL REVIEW:
Any projects that result from the response to the Noise Action Plan request will be subject to the California Environmental Quality Act. If federally funded, any projects that result from the response will be subject to the National Environmental Protection Act.

RE: Santa Barbara Airport – Aircraft Noise Action Plan
Dear Mayor Rowse and Councilmembers:
The Goleta City Council wishes to express appreciation for your willingness to work proactively and cooperatively with us to address noise concerns resulting from Santa Barbara Airport (Airport) operations. We also commend Airport staff for their collaborative approach under Airport Director Chris Hastert’s leadership in working with Goleta staff and residents on these issues. In this regard, we would also like to request certain follow-up actions to the recent City of Goleta Council public workshop at which Airport staff presented information and responded to questions.
As you know, the Airport, which serves as an important commercial air travel hub for the region, is located within the City of Santa Barbara’s jurisdiction adjacent to the City of Goleta. Airport operations, existing and planned, are of great interest and concern to the City of Goleta and its residents. The effects of flight noise, traffic, and other Airport-related impacts are felt broadly in the City of Goleta, as the City is almost entirely located within the Airport Influence Area. In particular, aircraft noise continues to be a concern for Goleta residents.
On December 7, 2022, the City of Goleta hosted a public workshop regarding Airport projects and aircraft noise. The presentation and response to Goleta City Council and public comment was led by City of Santa Barbara Airport Director Chris Hastert and his staff. During the workshop, detailed and extensive comments were expressed by the Council and public regarding aircraft noise concerns. Airport staff, January 17, 2023
together with the Goleta City Council and public, explored a number of possible strategies to address noise concerns. Some of the strategies included:
1) Reinstate the Runways 7 and 25 voluntary flight procedure for visual and instrument flights over the Ellwood-Devereux Open Space and More Mesa area.
The community desire is to include all operations within these corridors to the maximum extent possible.
5) Address noise issues and noise abatement compliance at the time the Airport negotiates with new airlines and new routes by existing airlines. 6) Address business jet operations and chartered aircraft separately from commercial airlines through outreach to Fixed Base Operators (FBO) supporting these owners and operators. Create noise mitigation procedures specifically for charter aircraft and business and private jets by aligning with National Business Aircraft Association (NBAA) Noise Abatement Program. Apply these procedures to east and west noise abatement corridors used for airline and general aviation operations.
7) Analyze and report on departure procedure use, which departure and arrival procedures are “quietest” and whether those are being used most often (if not, why). Explore solutions for reducing noise impacts especially during early morning and late evening hours.
8) Explore new outreach efforts to pilots to get them information on preferred approach and departure procedures and noise-mitigating measures.
11) Gather and report data on aircraft particulate emissions. 12) Advise on an amendment to Santa Barbara Airport Commission Charter to give the City of Goleta a permanent seat and voice in Airport decisions directly impacting the City. Include informal consideration of City of Goleta nominations for Commission representatives from the City of Goleta or County of Santa Barbara.
January 17, 2023
13) Develop “fly quiet” flight procedures for takeoff and arrival for all operations to mitigate noise impacts to residential areas around the Airport.
As a follow-up to the workshop, we are seeking your support and direction to Airport staff to develop an Airport Aircraft Noise Action Plan (Action Plan) as soon as possible. The Action Plan would build upon the strategies discussed during the workshop and include an implementation schedule. The Action Plan and implementation schedule would help address many noise complaints.
Thank you again for this opportunity to collaboratively address important Airport aircraft noise impacts that directly affect the Goleta community. We are open to ways that our elected officials and staff might further assist you and your staff in this regard. Together, we will find the necessary solutions that will support Airport operations while protecting the Goleta community from excessive and disruptive noise.
We appreciate the City Council’s consideration of this request. Please feel free to contact me at [email protected] or Peter Imhof, Goleta Planning and Environmental Review Director, at [email protected] or 805-961-7541, if you would like to discuss our request in more detail.
Sincerely,

RE: Santa Barbara Airport – Aircraft Noise Action Plan
Dear Mayor Perotte,
Thank you for your letter expressing the City of Goleta's commitment to finding ways to lessen the impact of noise resulting from Santa Barbara Airport (SBA) operations. On behalf of the City of Santa Barbara City Council, we appreciate your collaboration and commend your efforts to work cooperatively on addressing noise concerns and building trust with surrounding communities.
We appreciate the acknowledgment of SBA Director Chris Hastert and the positive approach he has taken as a Goleta resident himself to engage with the Goleta City Council and residents. His leadership and the support of the professional airport staff has been instrumental in fostering a productive dialogue between our jurisdictions.
Regarding the City of Goleta Council public workshop held on December 7, 2022, we recognize the thoughtful and detailed comments that were shared by the Goleta City Council and the public on aircraft noise concerns. We value the strategies proposed during the workshop to address these concerns and believe that they form a solid foundation for further action which will be referred to as the Aircraft Noise Action Plan as referenced in your letter dated January 17, 2023 (attached).
We are pleased to inform you that the SBA staff and Airport Commission have carefully reviewed the proposed strategies within your letter. After thorough consideration, the City of Santa Barbara City Council fully supports the implementation of an Aircraft Noise Action Plan, and recommends categorization of the proposed strategies into three distinct areas:
1. Strategies Addressed Through an Airport Noise Compatibility Planning Study (14 CFR Part 150): (Strategies 1, 7, 9, 10, 13)
Several of the recommendations reference specific flight paths and affected communities. Due to changes in the current aircraft fleet mix utilizing the airport and development of additional housing near the University of California Santa Barbara (UCSB) campus and other areas, we recognize the need to update recommended procedures in and around SBA through an update to the previous 2004 FAA Part 150 noise study. The process of updating the noise study demonstrates a commitment to understanding and mitigating the concerns of ATTACHMENT 2
affected communities. This effort will foster better communication and engagement between SBA, residents, and stakeholders, lending the Airport to make well informed decisions factoring in public comment and concerns through a comprehensive process encouraging input from all stakeholders.
The Santa Barbara City Council wholeheartedly supports this effort and directs staff to begin coordination with the Federal Aviation Administration (FAA) to secure funding and plan for a comprehensive update of the Part 150 noise study.
We believe that this updated study will provide valuable insights into the current noise landscape and help SBA formulate more effective strategies within the proposed Aircraft Noise Action Plan.
2. Strategies Addressed Through an Airport Noise Working Group: (Strategies 2, 3, 4, 5, 6, 8,)
The Part 150 Noise Study Process is not likely to start for at least 2 years due to the planning, funding, and coordination. Once started the process itself is also very time-consuming requiring time needed to gather data, conduct public outreach, and allow for FAA review.
While SBA awaits the completion of the updated FAA Part 150 noise study, Council recognizes that there is still important work that can be done to address the issue of aircraft noise in the interim. To assist staff in overseeing this effort, we endorse the establishment of a Noise Working Group. Bringing together key stakeholders including: airlines, corporate aircraft operators, flight training institutions, air traffic control representatives, neighborhood advocates, City of Goleta, County, and SBA, this collaborative platform will allow us to develop practical and effective noise mitigation strategies.
The Airport Noise Working Group could proactively address several of the recommendations that would not require as much public input, such as:
encouraging all airlines serving our market to develop or use existing “proprietary” instrument approaches; addressing noise issues with new airlines or new routes with incumbent carriers; coordinating with the FAA to develop charted visual approaches; conducting outreach efforts; researching existing local conditions and other industry efforts that could be adopted locally; and evaluating other options to incentivize compliance with recommended noise abatement procedures.
3. Other: (Strategies 11, 12)
As staff continues to explore and refine a Noise Action Plan, additional strategies may emerge that do not fall directly under the purview of the Part 150 noise study ATTACHMENT 2
or the Noise Working Group. We will remain flexible and open to considering other innovative solutions that align with our shared goals of minimizing noise impacts and fostering a harmonious environment for our communities. Other concerns including aircraft emissions may be beyond the purview of our City Council's powers and responsibilities, however we encourage staff to research and implement appropriate environmentally friendly practices within the aviation industry, which aligns perfectly with our shared goals of reducing the overall environmental impact of the Airport.
We recognize that our decisions can have far-reaching consequences, and we are committed to finding a balance that considers the negative impacts of airport operations with the benefits and economic impact to our local businesses, tourism markets, and general traveling public. As these decisions are being made, we seek information and recommendations from staff, and the Airport Commission as they remain focused exclusively on the operation of the Airport and industry updates, as well as input from the public and other interested parties.
When selecting Airport Commission members, the Council weighs several factors to ensure their success including demeanor, knowledge, experience, community interest, and diversity within those areas. As part of our commitment to transparency and inclusivity, we encourage Goleta and unincorporated county residents to submit applications to serve on the Santa Barbara Airport Commission. We understand the importance of geographical diversity in these appointments, and we will certainly consider this factor while making our Commission member appointments.
It is essential to acknowledge that there are certain limitations to the power of our City Council when it comes to making changes regarding noise or timing of aircraft flights.
Many of these decisions fall under the jurisdiction of federal regulations and the FAA.
Despite these limitations, we will continue to work diligently to find practical and effective solutions that alleviate noise concerns.
We look forward to initiating the Noise Action Plan and working together on addressing noise concerns though the strategies discussed above. We value the partnership between our cities and remain optimistic about the positive impact we can achieve through collaborative efforts.
Sincerely,
Randy Rowse
Mayor

FROM: City Attorney’s Office
Community Vitality Initiatives Division, Community Development Department
SUBJECT: Establishment of the State Street Promenade Pilot Program Committee [Resolution]
RECOMMENDATION: That Council:
A. Adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Establishing the State Street Promenade Pilot Program Committee as a Standing Committee of the City Council; and
B. Appoint three City Council members to the State Street Promenade Pilot Program Committee.
DISCUSSION:
During the June 27, 2023, City Council consideration of the agenda item regarding Continued Closure of State Street Promenade to Motor Vehicles and Direction Regarding Future of Temporary Outdoor Dining Operations Upon Expiration of the Economic Recovery Extension and Transition Ordinance, Council provided staff with direction to establish a standing committee, subject to the Brown Act, with jurisdiction over implementation of the ongoing State Street Promenade Pilot Program. The standing committee would replace the temporary (ad hoc) State Street Interim Operations Ad Hoc Committee (Oscar Gutierrez, Mike Jordan, Kristen Sneddon).
The proposed resolution establishes a new State Street Promenade Pilot Program Committee as a standing committee composed of three City Councilmembers. The resolution established the committee’s subject matter jurisdiction and duration. Because it is subject to the Brown Act, the committee will have regularly scheduled meetings, open to the public. The purpose of the State Street Promenade Pilot Program Committee is to provide the City Administrator with clear direction for the types of pilot programs to be implemented on the State Street Promenade until a State Street Master Plan is adopted Agenda Item No. 9
File Code No. 610.01
Council Agenda Report
