CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 23, 2024
TO: Mayor and Councilmembers
FROM: Airport Patrol, Airport Department
SUBJECT: Introduction of an Ordinance Authorizing Airport Patrol to Join Peace Officer Standards and Training [Ordinance Introduction] RECOMMENDATION:
That Council introduce and subsequently adopt, by reading of title only, an Ordinance of the Council of the City of Santa Barbara Amending the Municipal Code by Adding Section
2.12.035 Regarding Airport Patrol Peace Officer Standards and Training Participation, and Accepting the Requirements of California Penal Code Sections 13510, 13512, and 13522, Relating to the Recruitment and Training of Peace Officers for the Airport Patrol.
DISCUSSION:
Background
The Santa Barbara Airport Patrol serves as the Law Enforcement Division of the Airport Department for the City of Santa Barbara. Airport Patrol Officers are sworn Peace Officers under California Penal Code § 830.33(d) and are required under Federal law to have the power to arrest and provide armed law enforcement services at the Santa Barbara Municipal Airport. The Airport Patrol originally began as a security unit and has evolved into a specialized law enforcement organization in response to emerging threats to civil aviation.
The Commission on Peace Officer Standards and Training (POST) is the State regulatory body that sets the minimum standards for selection and training of peace officers in California. The mission of POST is to continually enhance the professionalism of California law enforcement in serving its communities. POST participating agencies agree to comply with and continue to adhere to minimum selection and training standards and all Commission Regulations. Currently, more than 600 agencies in the State of California participate in the POST Program and subsequently have access to POST’s vast services.
POST requires that the City adopt an Ordinance as part of its admission process.
Agenda Item No. 2
File Code No. 560.01
Council Agenda Report
Introduction of an Ordinance Authorizing Airport Patrol to Join Peace Officer Standards and Training [Ordinance Introduction]
April 23, 2024
Federal Requirements for Airport Law Enforcement:
Pursuant to Title 49 CFR 1542.215, the Santa Barbara Airport is required to provide uniformed law enforcement personnel in the number and manner necessary to support its Airport Security Program and Federal Transportation Security screening operations.
Those Law Enforcement Officers must be available and committed to respond to any incident in support of a civil aviation security program or commercial air carrier program.
Airport Law Enforcement Officers employed by the Santa Barbara Airport must be armed, have the authority to arrest with or without a warrant, be identifiable by appropriate indicia of authority and meet the training standard for law enforcement officers prescribed by either the State or local jurisdiction in which the airport is located for law enforcement officers performing comparable functions.
POST Membership Process:
POST Commission Regulations and California law establish the procedures necessary for the Airport Patrol to become a participating member of the POST Program. Under POST Commission Regulation 1010, prospective agencies must comply with the following procedures:
Adopt an Ordinance wherein the City and its law enforcement agency agree to abide by the training and recruitment standards for peace officers as enumerated in Section 13510 of the California Penal Code (PC). The Ordinance must also authorize the Commission to make inquiries as deemed necessary to ascertain that the City’s peace officer personnel adhere to the aforementioned standards pursuant to 13512 PC. Finally, the Ordinance must also include a request from the City to receive aid from the State of California as codified in 13522 PC. Submit to the Commission a letter of intent to participate in the POST program.
The letter shall be accompanied by a copy of the signed Ordinance mentioned above.
Following the submission of the letter of intent and signed Ordinance, POST staff will work with the prospective agency to ensure each incumbent officer is compliant with POST minimum training standards that were applicable at the time of each officer's appointment.
POST participating agencies shall require every peace officer, appointed on or after the agency's entry into the POST Program, to attend a full POST Basic Academy and earn a POST Basic Certificate as specified in Commission Regulation 1202(a)(5).
Council Agenda Report
Introduction of an Ordinance Authorizing Airport Patrol to Join Peace Officer Standards and Training [Ordinance Introduction]
April 23, 2024
When the agency is found to be in full compliance, participation will be confirmed by the Executive Director of POST and an effective date of entry established.
Approval of an agency’s participation in the POST Reimbursable Program will also be confirmed.
BUDGET / FINANCIAL INFORMATION:
While there is no direct cost to join the POST program, there may be indirect training costs incurred if officers need to attend additional classes to meet POST minimum standards. Specifically, if POST staff determine an incumbent Airport Patrol Officer does not meet the minimum POST training standards to remain in that role, then that officer must be sent to additional training to correct the deficiency. Based upon our collective research, the possibility exists that some Airport Patrol Officers may lack current proof of law enforcement certification. If so, POST could require those officers to attend a 4-week Requalification Course. The current estimate for tuition, travel, lodging and per diem for the 4-week Requalification Course is about $9,000 per officer.
Unfortunately, POST staff will not disclose in advance any officer-specific information related to training or potential deficiencies, so the number of Airport Patrol Officers who may need to attend a Requalification Course cannot be accurately predicted.

COUNCIL AGENDA REPORT
AGENDA DATE: April 23, 2024
TO: Mayor and Councilmembers
FROM: Creeks Division, Sustainability & Resilience Department SUBJECT: Authorize a Fund Transfer for Creek Property Restoration at the De La Vina Bridge Replacement Project [Resolution]
RECOMMENDATION:
That Council adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Amending Resolution No. 23-076, Adopting the Budget for Fiscal Year 2024, to Transfer Funds from the Creeks Fund to the Public Works Department for a Land Transfer from the Public Works Department to the Sustainability and Resilience Department for the Mission Creek at De La Vina Street Creek Restoration Project.
DISCUSSION:
Background
On March 11, 2016, the City’s Public Works Department received authorization through Caltrans from the Federal Highway Administration (FHWA) to initiate the engineering design phase for the De La Vina Bridge Replacement Project (Bridge Project). The De La Vina Street Bridge (Bridge) is currently designated as “structurally deficient,” which indicates that a structure inadequacy exists and that elements of the structure are in poor condition. A structural evaluation indicated the structure is not suitable for rehabilitation and requires replacement. The Bridge Project has been designed to meet current seismic, safety, and design standards and will include realigning roadway approaches, removing building structures, abating hazardous building materials, relocating utilities including domestic water and sanitary sewer facilities, constructing channel walls, planting landscape materials, restoring creek and native riparian habitat, and adding storm water treatment facilities. Construction of the Bridge Project required acquisition of multiple real property interests, including three temporary construction easements, two minor partial acquisitions, one permanent access easement, and two full property acquisitions.
Current Status
The Bridge Project is at 95 percent design and is in the process of finalizing right-of-way acquisitions and environmental permitting. The phased construction project is anticipated to start in spring 2025.

Council Agenda Report
Authorize a Fund Transfer for Creek Property Restoration at the De La Vina Bridge Replacement Project [Resolution]
April 23, 2024
As part of the Bridge Project, the property located at 2726 De La Vina (051-220-015) was acquired on August 1, 2023, in accordance with applicable federal and state laws. The property will be used for construction staging and access but is in excess of the area required to be restored as compensatory mitigation for the Bridge Project. Typically, surplus property would go to auction, but because of the location and nature of the property it provides an opportunity for additional creek restoration. This fund transfer of $1,086,647 from the Creek Fund to the Public Works Department, is for the creek side parcel (051-220-015), as shown in the attached Location Exhibit. This additional creek side habitat will be restored with native riparian plant species by the Creeks Division following the Bridge Project construction. The transfer will enable the Creeks Division to provide watershed protection and restoration along Mission Creek, in support of the Creeks Division mission to restore natural creek systems. The Creeks Division will be responsible for the long-term maintenance and monitoring of this site.
The Creeks Division has been working with the Engineering Division of the Public Works Department to design the Creek Restoration Project for this property in conjunction with the Bridge Project designs.
BUDGET/FINANCIAL INFORMATION:
The interdepartmental fund transfer from Sustainability and Resilience Department to the Public Works Department is funded by the Creeks Restoration and Water Quality Improvement (Measure B) Capital Fund. The transfer will go to the Mission Creek at De La Vina Bridge Project in the Streets Grants Capital Fund and be used as matching funds to construct the Bridge Project. The transfer amount was determined as a percentage of the acreage from the acquisition costs paid by the City. The 0.19 acres of the creek side habitat to be restored by the Creeks Division is 51% of the total parcel size of 0.37 acres, and the transfer amount equals the same percentage of the purchased parcel value.
There are sufficient available reserves in the Creeks Restoration and Water Quality Improvement Capital Fund in Fiscal Year 2024 to fund the transfer.
SUSTAINABILITY IMPACT:
The land transfer to the Creeks Division will provide long-term watershed protection and restoration along Mission Creek. It will preserve this creek side property from future development while also providing an opportunity to restore native riparian habitat by planting native trees and understory species.
ENVIRONMENTAL REVIEW:
Under California Environmental Quality Act (CEQA) Section 15032, the City’s Community Development Department issued a Notice of Exemption for filing with the County of Santa Barbara on May 21, 2021. The Council approved the exemption in connection with the Council Agenda Report

The Recreation Division of the Parks and Recreation Department (Department) offers various classes, clinics, camps, leagues, and tournaments for youth and adults that are organized and delivered by a third-party contractor. Parents and participants continue to overwhelmingly support the programs provided by these two contractors. 805 Beach Inc. will provide thirteen (13) one-week youth beach volleyball camps in winter, spring, and summer, four (4) two-week after school youth clinics, and four (4) four-week adult evening classes serving approximately 1,200 youth and 150 adults. Lobster Jo’s Camps will provide twenty-seven (27) one-week beach, art and, skate camps serving approximately 1,200 youth.

COUNCIL AGENDA REPORT
AGENDA DATE: April 23, 2024
TO: Mayor and Councilmembers
FROM: Planning Division, Community Development Department SUBJECT: Authorization to Execute a Contract with BAE Urban Economics for Inclusionary Housing, Density Bonus, and Hotel Linkage Fee Analysis [Agreement]
RECOMMENDATION:
That Council authorize the Community Development Director to execute a contract for consulting services with BAE Urban Economics in the amount of $194,815 to evaluate potential updates to the City’s Inclusionary Housing Program (including in-lieu fees) and the City’s Density Bonus Program, and to conduct an analysis of potential hotel linkage fees to implement multiple Housing Element policies and programs.
DISCUSSION:
The City’s 2023–2031 Housing Element, which was adopted in December 2023, includes a series of programs aimed at prioritizing and funding deed-restricted affordable housing.
Housing Element Policy HE-13 explicitly calls for an assessment of the current Inclusionary Housing requirements and in-lieu fee amounts to ensure alignment with the City’s goal of providing affordable housing with new housing development. The policy also allows for potential revisions to local ordinances to enhance their effectiveness and increase responsiveness to local housing needs.
Housing Element Policy HE-12 calls for the City to study and implement strategies to encourage and incentivize development of deed-restricted affordable housing for very low- to upper-middle-income households and special needs households, including employer-sponsored housing. These strategies include amending the City’s Density Bonus Program to encourage affordable housing production for lower-income households on smaller lots.
In alignment with Policy HE-13, BAE Urban Economics (BAE) will evaluate the City of Santa Barbara’s Inclusionary Housing Programs (rental and ownership) and the associated in-lieu fee payment options. In support of Policy HE-12, BAE’s analysis will Agenda Item No. 6

include an evaluation of the City’s Density Bonus Program and recommendations. BAE’s proposal also includes an analysis of hotel linkage fees in Santa Barbara consistent with Policy HE-31, which seeks additional permanent funding mechanisms for affordable housing. Hotel linkage fees would require certain hotel-related development to contribute to an affordable housing fund to offset the additional housing needs generated by the development.
BAE has extensive expertise in inclusionary housing financial analysis, with experience conducting nexus analyses of commercial linkage fees and affordable housing fees, which assess the increased demand for affordable housing generated from commercial development and market rate housing. Their approach includes technical analysis and financial feasibility testing to ensure the viability of new development while addressing the need for affordable housing funds.
BAE’s familiarity with Santa Barbara’s real estate development environment and housing policy context, stemming from their recent work on the City’s Housing Element Update and a financial feasibility study, makes them well suited to conduct this analysis.
BUDGET/FINANCIAL INFORMATION:
There are sufficient expenditure appropriations in the Fiscal Year 2024 Community Development General Fund budget to support the recommended contract of $194,815 with BAE.
SUSTAINABILITY IMPACT:
The evaluation of the City’s Inclusionary Housing Program and the Density Bonus Program and the analysis of hotel linkage fees are expected to support the City’s environmental sustainability goals by promoting affordable housing and ensuring that new developments contribute to the availability of such housing.

Council Agenda Report
Sustainability and Resilience Equity Programs, and Acceptance of Funding [Resolution] April 23, 2024
EXECUTIVE SUMMARY:
The Sustainability and Resilience Department has recently been awarded approximately $1.7 million in funding for several new and expanded equity actions and programs: lowincome access to the City’s Bicycle Share Program, food recovery and aid efforts, and community access to swim lessons. These programs build upon other equity initiatives of the Department, including rebates and incentives for low-income utility customers, community clean ups, youth education events, improvements to creeks, active and alternative transportation, and renewable energy sources in under resourced areas of the City.
DISCUSSION:
The Sustainability and Resilience Department has been making focused efforts to ensure the department’s programs enhance equity, support under-resourced populations, and provide bilingual support for our community. While notable, the efforts listed here are just a start — the Department recognizes and is committed to continually enhancing equity and improving access in all of our work and our programs. This report includes information about several funding awards that the Department has recently received which will expand equity programming.
Energy and Climate Division
The Energy and Climate Division is committed to reducing greenhouse gas emissions across the city and protecting all of our community members from the impacts of climate change. As the City moves towards carbon neutrality, the Division is especially committed to assisting vulnerable and under-resourced populations in gaining the health and air quality benefits related to transitioning to electrical appliances and clean transportation options. Every measure of the pending update to the City’s Climate Action Plan was evaluated for equity considerations to ensure that the plan does not create disproportionate burden on low-income communities and includes program design to support low-income and under-resourced communities.
Currently, the Division offers the following programs to support equity: (1) discounted BCycle Bike Share memberships; (2) twice the rebate value for income qualified customers through Santa Barbara Clean Energy’s (SBCE) electric vehicle incentive; and (3) a low-income electrification program including assistance, incentives, and rate design (in development). The Division also recently completed a bi-lingual outreach, planning, and programming effort for the development of Resilience Hubs to be potentially hosted at the Franklin Center and Eastside Library.
Ensuring equitable access to safe and sustainable transportation options is a priority for the Energy and Climate Division. As such, the Division is partnering with the City of Santa Barbara Housing Authority and the Santa Barbara Unified School District to create an innovative network of public electric vehicle (EV) chargers designed to serve low-income and under-resourced neighborhoods and areas with high concentrations of rental units Council Agenda Report

and multi-family housing. The Division is also working on expanding the BCycle Bike Share program in similar areas through the Clean Mobility Options Voucher Pilot Program.
In May 2023, Santa Barbara City Council approved a three-year extension of the Bicycle Share Pilot Program and received an update on performance to date. At that time, feedback from City Council, the Sustainability Council Committee, and the Transportation and Circulation Committee indicated the desire to further bolster the low-income component of the program and to enhance equitable access to this sustainable transportation mode in Santa Barbara.
The City applied for and was granted a $1,500,000 Clean Mobility Options (CMO) Voucher Pilot Program award, which is a statewide initiative funded by the California Climate Investments and administered by the California Air Resources Board. The voucher will fund physical bike share infrastructure in AB 1550 designated low-income areas and provide targeted community outreach to expand the impact of the low-income program. The City will work with our partners to develop, implement, and market a robust and streamlined low-income membership process, as well as continue to develop and promote safer bicycling infrastructure and equitable access to active transportation options throughout our City.
City staff recommend extending the Bicycle Share Pilot Program for approximately two additional years to comply with the CMO voucher requirement of four full years of mobility service operation. Following City Council’s extension of the Program, City staff will need to extend the Coastal Development Permit and BCycle’s Operator’s Permit.
Clean Community Division
The Clean Community Division was recently awarded $229,264 through the California Department of Resources Recycling and Recovery’s (CalRecycle) SB 1383 Local Assistance Grant Program. The primary focus of the grant will be to increase regional food recovery efforts and aid food recovery organizations. Food recovery means collecting edible food that would otherwise go to waste and redistributing it to feed people in need.
The Clean Community Division is partnering with the Parks and Recreation Department to use grant funds to increase the number of food pantries as part of their Food Distribution Program. These programs help address local food insecurity through fresh produce and essential foods for lower income and minority populations. The grant will also fund outreach and education, which are essential to the implementation of organic waste reduction programs. The success of these programs contributes to the reduction of organic waste-related methane emissions from our community. These efforts form a part of the statewide effort to mitigate climate change impacts.
In addition to this expanded initiative, the Clean Community Division maintains several ongoing programs that assist underserved populations. The Division holds monthly clean- Council Agenda Report

up events that provide the opportunity to engage the community while cleaning parts of the city that traditionally see more litter and blight. The Division also offers up to $500 to any affiliated youth group who cleans for three hours in their community. The City provides cleanup supplies and picks up and disposes of bags through this program. Lastly, the Clean Community Division also provides bilingual outreach (both in person and in writing), training, service level adjustments, material ban assistance, and code enforcement to provide support to a wider demographic of our community.
Creeks Restoration and Water Quality Improvement Division Equity initiatives of the Creeks Division relate to the mission of improving water quality and restoring urban creeks systems. Foundational to the mission is safe access to our beaches and creeks for all residents and visitors in Santa Barbara. Initiatives to improve equity include identifying beach water quality as an environmental justice issue, increasing beach access by supporting swimming skills, developing urban creek trails, providing community creek stewardship opportunities, funding youth education, and creating bilingual media and outreach materials.
After spending time cleaning East Beach with Community Engagement staff, West Coast Financial recently made a generous donation of $6,500 to the Creeks Division. The contribution will be directed to the PARC foundation to fund scholarships for swimming lessons, with the intention of providing safer access for all to enjoy Santa Barbara’s coastal assets.
BUDGET/FINANCIAL INFORMATION:
The Clean Mobility Options voucher award totals $1,500,000 and will reimburse costs for the City and implementation partners like BCycle to install and operate up to 150 bike share docks and up to 75 pedal assist e-bikes in designated AB 1550 low-income communities in the City of Santa Barbara over the next five years. In addition to helping build and enhance the physical bike share network in AB 1550 communities, CMO voucher monies will fund development of a more robust and streamlined low-income membership program with targeted outreach to lower-income demographics. As approved partners can invoice directly to the CMO, the maximum City out-of-pocket reimbursable expense is anticipated to be $236,500. Staff recommends that Council accept the voucher funds and increase revenue appropriations and expenditure appropriations by $236,500 in the Fiscal Year 2024 Sustainability and Resilience Miscellaneous Grants Fund budget.
CalRecycle awarded the City a total of $229,264 through the SB 1383 Local Assistance Grant. Funds will be used to purchase equipment for food recovery organizations, fund hourly outreach personnel, and develop educational mailers and materials. Staff requests that Council accept the grant award and increase revenue appropriations and expenditure appropriations by $229,264 in the Fiscal Year 2024 Solid Waste Fund budget.
