DISCUSSION:

Executive Summary
As a full-service City that provides a broad range of services to the local community and is also charged with maintaining infrastructure for public safety, recreation, and other critical functions, balancing the City’s annual operating and capital budget has become increasing challenging given the slow growth of tax revenues and substantial increases in staff, services, contracts, insurance, and many other expenses. Focusing on fiscal sustainability is a core complenent of Vision 2030 aimed at continuing to provide essential File Code No. 120.03

City services for the long-term. Along with implementing process improvements and reducing expenses wherever possible, additional, on-going revenue is required in order to balance the budget and meet the needs of the community going forward. A half-cent sales tax measure is being proposed for the upcoming November 2024 election that will fund local services for the Santa Barbara community.

Recent Impacts on Essential City Services
Prior to COVID and 2020, the City did not have to take substantial actions to balance its budget. During COVID, the rapid and substantial decline of the City’s sales tax and Transient Occupancy Tax (TOT) revenues resulted in a $30.0 Million reduction in revenue across all funds. Of this, the impact to the General Fund, which provides funding for essential City services like public safety, is estimated to be over $20.0 Million, or more than 10% of revenues.

The City was forced to take additional steps to control and reduce costs by nearly eliminating all hourly employees, delaying projects, and reducing services. Some examples of this have been reducing staff or not filling open positions in nearly all City departments – including Public Safety.

Vision 2030 and Fiscal Sustainability Initiatives
The City of Santa Barbara’s Vision 2030 boldly responds to current civic challenges through a commitment to staff and community for smart, collaborative, and resilient government. It is a framing of an initiative to preserve the best of what makes Santa Barbara unique, and direct us to where we are headed over the next 50 years. It positions the City as a leader in smarter, proactive government, ensuring the City is sustainable, fiscally responsible, and the community is thriving.

As part of Vision 2030, staff initiated a Fiscal Sustainability Initiative to develop recommendations and solutions to ensure the City continues to meet the needs of the Santa Barbara community now and for many years to come. The objectives of this initiative are to identify and assess options that will increase revenues, create efficiencies, eliminate redundancies, and make continual process improvements to reduce costs.

On June 14, 2022, the Finance Committee received a presentation from staff regarding the Fiscal Sustainability Initiative. Staff presented an overview of a number of budgetary and financial challenges that the City has faced in recent years including challenges that were addressed with budget balancing strategies and challenges that are anticipated to continue into future fiscal years.

Within Vision 2030, the Revenue Working Group was established to develop and evaluate potential revenue-generating options and policies for the Council’s consideration.

Revenue-generating options include those that may require voter approval, and fee and Finance Committee Agenda Report

Page 3 ends

other revenue changes that require Council approval. The working group evaluated 70 individual revenue generating options by considering legal requirements, types of funding, longevity of revenue, revenue volatility, approval process, technological requirements, and staff and other resources in order to implement and administer.

The Revenue Working Group identified a need for clear cost recovery guidelines to be implemented across the City. On June 13, 2023, the Council adopted a resolution implementing a Cost Recovery and Revenue Policy which serves as a guideline for staff and the Council in establishing the appropriate level of cost recovery and subsidy that may be required for various fees for government services. This policy has been implemented and, over time, additional revenues are projected to be recovered for direct services the public may receive from the City.

Fiscal Year (FY) 2025 General Fund Budget Overview
Like many California cities, the increasing cost of maintaining services continues to exceed projected revenues, and despite aggressive efforts to balance the budget, the City is projected to face a structural deficit anticipated to grow to 5-7% of the General Fund within the next three years.

The recommended General Fund budget in FY2025 has a structural budget deficit requiring the use of $7.1 Millon of reserves to balance the budget. Due to the anticipated, inadequate growth of many General Fund revenues to pay for known increases to expenditures, particularly pension costs, the FY2025 forecast shows a continued need to rely on reserves and implement on-going budget balancing strategies to balance the budget, with very little capacity to replenish General Fund reserves and implement any new programs or initiatives.

On October 10, 2023, the Council took decisive action to address the budget impacts related to pension costs by approving of a revision to the reserve policy which allocates any actual revenues that exceed expenditures to address pension-related expenses and future liabilities instead of being allocated to capital. General Fund reserves stayed relatively flat FY2023 and are projected to decline in FY2024 and FY2025, with the use of reserves as one of many tools being used to balance the budget. It continues to be the City’s priority that recovery efforts include a plan to replenish reserves to achieve the policy target as the economy recovers and the City’s budget stabilizes.

Public Opinion Polling
To help the Council consider whether to place a transaction and use tax measure on the ballot, a poll was conducted in April 2023, and a tracking poll was conducted in April 2024, to gather community input on specific funding options for continuing to provide essential City services to the Santa Barbara community. Fairbanks, Maslin, Maulin, Metz & Associates (FM3) conducted community surveys online and by telephone with registered Finance Committee Agenda Report

voters, including bilingual surveys. The poll gauged interest in a general purpose transaction and use tax increase that would require voter approval (greater than 50%).

An overview of the poll will be presented to the Finance Committee.

Recent Public Outreach
Staff embarked on an extensive public outreach campaign to inform and educate the community about the services the City provides and discuss budget challenges that the City faces. This included key business groups as well as over a dozen community meetings with civic clubs, homeowners associations, non-profit organizations, and other key community groups. The City also held a series of Townhall meetings in each Councilmember district in late April and early May to have a discussion with the community about these topics, answer questions, and gather survey responses to further inform staff’s and the City Council’s process when considering a possible transaction and use tax increase.

Meetings held to-date include the following:

1.Downtown Santa Barbara (BID) - 10/10/23

feedback regarding the importance of various City services. Five informational videos featuring departments that provide essential services to the community can be found on the site, including Police, Fire, Parks and Recreation, Library, and Community Development. Bilingual communications regarding this site were completed through social media channels, E-Newsletters, website news, and utility billing inserts.

For the Community Town Hall meetings that occurred in late April and early May, bilingual outreach to the community included press releases, webpage and City News updates, event listings on the City’s webside calendar and other community calendars, social media posts across X, Facebook, Instagram, Nextdoor, and YouTube, City E-Newsletters, event email to all City subscribers, City staff and Mayor and Council, a citywide mailer to all addresses within City zip codes, an event flyer that was distributed to local townhall venues and communications staff, and Spanish Radio public service announcements.

Proposed Ballot Measure, Resolution and Ordinance
At this time, direction is needed from the Council to officially place a half-cent transaction and use tax increase on the November 2024 ballot. The proposed tax would be a general tax requiring a simple majority approval of voters.

If Council approves of placing a measure on the ballot, the proposed language is as follows:

CITY OF SANTA BARBARA ESSENTIAL LOCAL SERVICES

MEASURE
YES
Shall the measure maintaining 9-1-1
emergency/fire/paramedic/police response, keeping
neighborhood fire stations open; improving housing
affordability; addressing homelessness; keeping public
areas/parks safe, clean; maintaining library services;
stormwater protection; improving natural disaster
preparedness; retaining local businesses/jobs, and for
general government use; by establishing a ½¢ sales tax
providing approximately $15,600,000 annually until
ended by voters; requiring audits, public spending
disclosure, all funds used locally, be adopted?
NO
To officially place this measure on the ballot, Council would introduce and subsequently adopt the proposed ordinance authorizing the Essential Local Services Tax subject to voter approval of a measure authorizing levy of a half-cent cent transaction and use (sales) tax and adopt the accompanying resolution that:

Finance Committee Agenda Report
Proposed Ballot Measure on Transaction and Use Tax Increase to Maintain Essential Local Services for the November 5, 2024 General Election May 14, 2024

Page 6 ends

1. Approves and places the Santa Barbara Essential Local Services Measure on the November 5, 2024 ballot.

2. Directs the City Attorney to prepare an impartial analysis.

The proposed ordinance would require an annual audit of taxes collected to be performed by an independent accounting firm. The audit results may be combined with the audit of other City funds, as long as proceeds are reported separately. The Council shall discuss the results of such audit at a meeting of the Council that is open to the public and the audit shall be posted on the City’s website. The ordinance must be introduced and adopted by the affirmative vote of five member of the Council (two-thirds vote).

BUDGET/FINANCIAL INFORMATION:

A half-cent transaction and use tax is projected to generate approximately $15.6 Million annually. If the voters approve of the tax measure on the November 2024 election, the new sales tax rate of 9.25% would take effect on April 1, 2025. Approximately 25.0% of the $15.6 Million annual projected revenue amount, or $3.9 Million, is anticipated to be collected in FY2025, with the first full year of annual revenue projected in FY2026.

The General Fund has a projected deficit in FY2025 of $7.1 Million, with deficit projections growing in future fiscal years. Implementing additional revenue generating options, along with continuing to implement operational efficiency and expenditure reduction strategies are required in order to balance the City’s General Fund budget going forward.

If this transaction and use tax measure is not approved, staff will continue to work with the Council to evaluate and consider alternative revenue measures. General Fund reserves will continue to deplete if additional revenue sources are not identified to continue to fund essential City services which may require further reductions to City services.

§ 4.15.030 Purposes.

This chapter is adopted to achieve the following, among other purposes, and directs that the provisions hereof be interpreted in order to accomplish those purposes:

1. To impose a retail transaction and use tax in accordance with the provisions of Part 1.6 (commencing with Section 7251) of Division 2 of the Revenue and Taxation Code and Section 7285.9 of Part 1.7 of Division 2.

2. To adopt a retail transaction and use tax ordinance that incorporates provisions identical to those of the Sales and Use Tax Law of the State of California insofar as those provisions are not inconsistent with the requirements and limitations contained in Part 1.6 of Division 2 of the Revenue and Taxation Code.

3. To adopt a retail transaction and use tax ordinance that imposes a tax and provides a measure therefore that can be administered and collected by the California Department of Tax and Fee Administration in a manner that adapts itself as fully as practicable to, and requires the least possible deviation from, the existing statutory and Finance Committee Review Draft
administrative procedures followed by the Department in administering and collecting the California State Sales and Use Taxes.

4. To adopt a retail transaction and use tax ordinance that can be administered in a manner that will be, to the greatest degree possible, consistent with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, minimize the cost of collecting the transactions and use taxes, and at the same time, minimize the burden of recordkeeping upon persons subject to taxation under the provisions of this chapter. § 4.15.040 Contract with State.

Before the operative date of this chapter, the City will contract with the Board to perform all functions incident to the administration and operation of this chapter; provided, that if the City shall not have contracted with the Board before the operative date, it shall nevertheless so contract and in such a case the operative date shall be the first day of the first calendar quarter following the execution of such a contract. The City Finance Director is authorized to execute contracts under this section. § 4.15.050 Transactions Tax Rate.

For the privilege of selling tangible personal property at retail, a tax is hereby imposed upon all retailers in the incorporated territory of the City at the rate of one-half percent of the gross receipts of any retailer from the sale of all tangible personal property sold at retail in said territory on and after the operative date of this chapter. The tax imposed by this section is additional to the tax imposed under Chapter 4.14 of this Code. § 4.15.060 Place of Sale.

For the purposes of this chapter, all retail sales are consummated at the place of business of the retailer unless the tangible personal property sold is delivered by the retailer or his/her agent to an out-of-state destination or to a common carrier for delivery to an outof-state destination. The gross receipts from such sales shall include delivery charges, when such charges are subject to the state sales and use tax, regardless of the place to which delivery is made. In the event a retailer has no permanent place of business in the State or has more than one place of business, the place or places at which the retail sales are consummated shall be determined under rules and regulations to be prescribed and adopted by the State Board of Equalization.
§ 4.15.070 Use Tax Rate.

An excise tax is hereby imposed on the storage, use or other consumption in the City of tangible personal property purchased from any retailer on and after the operative date of this chapter for storage, use or other consumption in said territory at the rate of one-half percent of the sales price of the property. The sales price shall include delivery charges when such charges are subject to state sales or use tax regardless of the place to which delivery is made.
§ 4.15.080 Adoption of Provisions of State Law.

A. Except as otherwise provided in this chapter and except insofar as they are inconsistent with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, all the provisions of Part 1 (commencing with Section 6001) of Division 2 of the Revenue and Taxation Code are hereby adopted and made a part of this chapter as though fully set forth herein, except as otherwise provided in subsection B.

B. Wherever the State of California is named or referred to as the taxing agency, the name of this City shall be substituted, therefore. However, the substitution shall not be made when:

Finance Committee Review Draft

1. The word "State" is used as a part of the title of the State Controller, State Treasurer, State Board of Control, State Board of Equalization, State Treasury, or the Constitution of the State of California.

2. The result of that substitution would require action to be taken by or against this City or any agency, officer, or employee thereof rather than by or against the Board, or other agency or department of the State, in performing the functions incident to the administration or operation of this chapter.

3. In those sections including but not necessarily limited to sections referring to the exterior boundaries of the State of California, where the result of the substitution would be to:
a. Provide an exemption from this tax with respect to certain sales, storage, use or other consumption of tangible personal property which would not otherwise be exempt from this tax while such sales, storage, use or other consumption remain subject to tax by the State under the provisions of Part 1 of Division 2 of the Revenue and Taxation Code, or;
b. Impose this tax with respect to certain sales, storage, use or other consumption of tangible personal property which would not be subject to tax by the state under the said provision of that code.

4. In Sections 6701, 6702 (except in the last sentence thereof), 6711, 6715, 6737, 6797, or 6828 of the Revenue and Taxation Code.

C. The word "City" shall be substituted for the word "State" in the phrase "retailer engaged in business in this State" in Section 6203 of the Revenue and Taxation Code and in the definition of that phrase in Section 6203.
§ 4.15.090 Permit Not Required.

If a seller's permit has been issued to a retailer under Section 6067 of the Revenue and Taxation Code, an additional transactor's permit shall not be required by this chapter. § 4.15.100 Exemptions and Exclusions.

A. There shall be excluded from the measure of the transaction tax and the use tax the amount of any sales tax or use tax imposed by the State of California or by any city, city and county, or county pursuant to the Bradley-Burns Uniform Local Sales and Use Tax Law or the amount of any state-administered transaction or use tax.

B. There are exempted from the computation of the amount of transaction tax the gross receipts from:

1. Sales of tangible personal property, other than fuel or petroleum products, to operators of aircraft to be used or consumed principally outside the county in which the sale is made and directly and exclusively in the use of such aircraft as common carriers of persons or property under the authority of the laws of this State, the United States, or any foreign government.

2. Sales of property to be used outside the City which is shipped to a point outside the City, pursuant to the contract of sale, by delivery to such point by the retailer or his or her agent, or by delivery by the retailer to a carrier for shipment to a consignee at such point. For the purposes of this paragraph, delivery to a point outside the City shall be satisfied:
a. With respect to vehicles (other than commercial vehicles) subject to registration pursuant to Chapter 1 (commencing with Section 4000) of Division 3 of the Vehicle Code, aircraft licensed in compliance with Section 21411 of the Public Utilities Finance Committee Review Draft
Code, and undocumented vessels registered under Division 3.5 (commencing with Section 9840) of the Vehicle Code by registration to an out-of-City address and by a declaration under penalty of perjury, signed by the buyer, stating that such address is, in fact, his or her principal place of residence; and
b. With respect to commercial vehicles, by registration to a place of business out-of-City and declaration under penalty of perjury, signed by the buyer, that the vehicle will be operated from that address.

3. The sale of tangible personal property if the seller is obligated to furnish the property for a fixed price pursuant to a contract entered into prior to the operative date of this chapter.

4. A lease of tangible personal property which is a continuing sale of such property, for any period of time for which the lessor is obligated to lease the property for an amount fixed by the lease prior to the operative date of this chapter.

5. For the purposes of paragraphs 3 and 4 of this subsection, the sale or lease of tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract or lease has the unconditional right to terminate the contract or lease upon notice, whether or not such right is exercised.

C. There are exempted from the use tax imposed by this chapter, the storage, use or other consumption in this City of tangible personal property:

1. The gross receipts from the sale of which have been subject to a transactions tax under any state-administered transactions and use tax ordinance.

2. Other than fuel or petroleum products purchased by operators of aircraft and used or consumed by such operators directly and exclusively in the use of such aircraft as common carriers of persons or property for hire or compensation under a certificate of public convenience and necessity issued pursuant to the laws of this State, the United States, or any foreign government. This exemption is in addition to the exemptions provided in Sections 6366 and 6366.1 of the Revenue and Taxation Code of the State of California.

3. If the purchaser is obligated to purchase the property for a fixed price pursuant to a contract entered into prior to the operative date of this chapter.

4. If the possession of, or the exercise of any right or power over, the tangible personal property arises under a lease which is a continuing purchase of such property for any period of time for which the lessee is obligated to lease the property for an amount fixed by a lease prior to the operative date of this chapter.

5. For the purposes of paragraphs 3 and 4 of this subsection, storage, use, or other consumption, or possession of, or exercise of any right or power over, tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract or lease has the unconditional right to terminate the contract or lease upon notice, whether or not such right is exercised.

6. Except as provided in paragraph 7 of this subsection, a retailer engaged in business in the City shall not be required to collect use tax from the purchaser of tangible personal property, unless the retailer ships or delivers the property into the City or participates within the City in making the sale of the property, including, but not limited to, soliciting or receiving the order, either directly or indirectly, at a place of business of the Finance Committee Review Draft
retailer in the City or through any representative, agent, canvasser, solicitor, subsidiary, or person in the City under the authority of the retailer.

7. "A retailer engaged in business in the City" shall also include any retailer of any of the following: vehicles subject to registration pursuant to Chapter 1 (commencing with Section 4000) of Division 3 of the Vehicle Code, aircraft licensed in compliance with Section 21411 of the Public Utilities Code, or undocumented vessels registered under Division 3.5 (commencing with Section 9840) of the Vehicle Code. That retailer shall be required to collect use tax from any purchaser who registers or licenses the vehicle, vessel, or aircraft at an address in the City.

D. Any person subject to use tax under this chapter may credit against that tax any transaction tax or reimbursement for transaction tax paid to a district imposing, or retailer liable for a transaction tax pursuant to Part 1.6 of Division 2 of the Revenue and Taxation Code with respect to the sale to the person of the property the storage, use or other consumption of which is subject to the use tax.
§ 4.15.110 Amendments to State Law.

All amendments subsequent to the effective date of the ordinance codified in this chapter to Part 1 of Division 2 of the Revenue and Taxation Code relating to sales and use taxes and which are not inconsistent with Part 1.6 and Part 1.7 of Division 2 of the Revenue and Taxation Code, and all amendments to Part 1.6 and Part 1.7 of Division 2 of the Revenue and Taxation Code, shall automatically become a part of this chapter; provided, however, that no such amendment shall operate so as to affect the rate of tax imposed by this chapter.
§ 4.15.120 Enjoining Collection Forbidden.

No injunction or writ of mandate or other legal or equitable process shall issue in any suit, action or proceeding in any court against the State or the City, or against any officer of the State or the City, to prevent or enjoin the collection under this chapter, or Part 1.6 of Division 2 of the Revenue and Taxation Code, of any tax or any amount of tax required to be collected.
§4.15.130 Audit.

The proceeds of the tax imposed pursuant to this chapter, as well as the expenditure thereof, shall be audited annually by an independent accounting firm. The audit results may be combined with the audit of other City funds, so long as the proceeds are reported separately. The City Council shall discuss the results of such audit at a meeting of the City Council that is open to the public. The report of such audit shall be posted on the City's website.
§ 4.15.140 Severability.

If any provision of this chapter or the application thereof to any person or circumstance is held invalid, the remainder of the chapter and the application of such provision to other persons or circumstances shall not be affected thereby. § 4.15.150 Effective and Operative Dates.

This chapter relates to the levying and collecting of City transaction and use taxes and shall take effect immediately upon adoption by the City Council. However, no tax imposed by this chapter shall be effective unless that tax has been approved by majority vote of the City electorate at an election as required by article XIIIC, section 2(b) of the California Constitution and applicable law. Notwithstanding the effective date, this chapter and the Finance Committee Review Draft
tax imposed by it will be operative on the first day of the first quarter commencing 110 days after the date of the election at which the tax is approved (the “operative date”). § 4.15.160 Definitions
As used in this chapter, the term “City” means the City of Santa Barbara and the term “Board” means the California Department of Tax and Fee Administration. § 4.15.170 Termination and Repeal.

The authority to levy the taxes imposed by this chapter shall be in effect until and unless this chapter is repealed.

SECTION 3. However, no tax imposed under the chapter adopted by this ordinance will be effective unless that tax has been approved by majority vote of the City electorate at an election as required by article XIIIC, section 2(b) of the California Constitution and applicable law. CITY OF SANTA BARBARA

COUNCIL AGENDA REPORT
AGENDA DATE: May 14, 2024
TO: Mayor and Councilmembers
FROM: City Attorney’s Office
SUBJECT: Correction of Inadvertent Codification Errors Regarding Just Cause Tenant Protection, and Street Improvement and Permitting Requirements [Ordinance Introduction]
RECOMMENDATION:

That Council introduce and subsequently adopt, by reading of title only, an Ordinance of the Council of the City of Santa Barbara Correcting Inadvertent Codification Errors Relating to Ordinance No. 6139 Regarding Just Cause Tenant Protection, and Ordinance No. 6143 Regarding Street Improvement and Permitting Requirements.

DISCUSSION:

The proposed ordinance corrects two inadvertent errors that occurred in the processing of Ordinance Nos. 6139 and 6143. As to Ordinance No. 6139, the ordinance presented to and adopted by Council at its meeting of January 23, 2024, contained a subsection

26.40.070 B.2.d.iii that read: “Filed with the Community Development Director a copy of the written opinion signed under penalty of perjury from the construction expert and the documents served on the tenant under subsection 2.d.iii.” Because of amendments that were made during the introduction of the ordinance at the Council meeting of January 9, 2024, the section should have read, “Filed with the Community Development Director a copy the documents served on the tenant under subsection 2.d.ii.” Thus, preserving the filing requirement under the existing code. The proposed ordinance will correct the Municipal Code to preserve the pre-existing filing requirement consistent with the Council’s actions on January 9 and January 23, 2024. As to Ordinance No. 6143, the word “owner” was inadvertently removed from the definition section 22.44.005. The proposed ordinance will correct that omission.

COUNCIL AGENDA REPORT
AGENDA DATE: May 14, 2024
TO: Mayor and Councilmembers
FROM: Administration Division, Parks and Recreation Department SUBJECT: Records Destruction for Parks and Recreation Department [Resolution]
RECOMMENDATION:

That Council adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Relating to the Destruction of Records Held by the Parks and Recreation Department in the Administration, Golf, Parks, and Recreation Divisions.

DISCUSSION:

The Council adopted Resolution No. 16-005 on February 9, 2016, approving the City of Santa Barbara Records Management Policies and Procedures Manual. The Manual contains the records retention and disposition schedules for all City departments. The schedules are a comprehensive listing of records created or maintained by the City, the length of time each record should be retained, and the legal retention authority. If no legal retention authority is cited, the retention period is based on standard records management practice.

Pursuant to the Manual, the Parks and Recreation Director submitted a request for records destruction to the City Clerk Services Manager to obtain written consent from the City Attorney. The City Clerk Services Manager agreed that the list of records proposed for destruction conformed to the retention and disposition schedules. The City Attorney has consented in writing to the destruction of the proposed records.

The Parks and Recreation Director requests the Council to approve the destruction of the Parks and Recreation Department records in the Administration, Golf, Parks, and Recreation Divisions listed on Exhibit A of the proposed Resolution, without retaining a copy. Gaps in dates reflect older files not previously destroyed.

COUNCIL AGENDA REPORT
AGENDA DATE: May 14, 2024
TO: Mayor and Councilmembers
FROM: Engineering Division, Public Works Department
SUBJECT: Design and Environmental Services for the Vic Trace Reservoir Replacement Project [Resolution; Agreement]
RECOMMENDATION: That Council:

A. Authorize the Public Works Director to execute a City Professional Services contract with Kennedy Jenks Consultants Inc., in the amount of $1,025,545 for initial design services for the Vic Trace Reservoir Replacement Project and authorize $102,555 for potential extra services, for a total expenditure authority of $1,128,100;
B. Authorize the Public Works Director to execute a City Professional Services contract with Rincon Consultants Inc., in the amount of $320,510 for environmental and permitting support services for the Vic Trace Reservoir Replacement Project and authorize $64,102 for potential extra services, for a total expenditure authority of $384,612; and
C. Adopt, by reading of title only, a Resolution of the Council of the City of Santa Barbara Amending Resolution No. 23-076, Adopting the Budget for Fiscal Year 2024, to Appropriate Funds for Design and Environmental Services for the Vic Trace Reservoir Replacement Project.

DISCUSSION:

Background
The Vic Trace Reservoir (Vic Trace) is located at 740 Dolores Drive in the City of Santa Barbara’s (City) Mesa neighborhood (see Attachment). The existing facility was constructed in 1956 as a partially buried, 10-million-gallon concrete reservoir used for treated drinking water storage. The City identified the Vic Trace Reservoir Replacement Project (Project) as critical in its Water Distribution Infrastructure Plan (WDIP). The WDIP, finalized in February 2021, provides strategic guidance and practical recommendations to address the City’s water distribution and water supply needs through the Planning Year 2050. Vic Trace, the City’s largest reservoir, was recommended for replacement due to its age, increasing repair needs, and importance to the City’s overall water storage portfolio.

Agenda Item No. 6
File Code No. 540.09
Council Agenda Report
Design and Environmental Services for the Vic Trace Reservoir Replacement Project [Resolution; Agreement]
May 14, 2024

Page 2 ends

Project Description
The Project will design and construct one or more new buried reservoirs at the same total storage capacity and evaluate repair needs at nearby hydraulically connected pipelines, valves, and pump stations. The first phase of design includes a site layout alternatives analysis to identify possible locations for the replacement tanks, pipelines, and other beneficial facilities. The initial phase will identify site constraints, site access, and construction-phase truck hauling routes to inform public outreach and environmental documentation. Additionally, a funding feasibility analysis will be conducted to inform the Project’s competitiveness towards future funding opportunities. The final reservoir replacement design will enhance site resilience, improve operational flexibility, and ensure the long-term viability of a critical water storage facility.

The initial design will work in parallel and coordinate with ongoing environmental documentation and public outreach planning efforts. A preliminary (Phase 1) environmental assessment that analyzed the Project’s biological, archeological, cultural, and environmental impacts was completed in the fall of 2023. The final phase of environmental analysis and permitting will fulfill the Project’s environmental documentation and permitting needs, including California Environmental Quality Act (CEQA) compliance, design constraints, and ongoing Project environmental monitoring and mitigation requirements.

Current Status
The Project is beginning the preliminary design phase. Council awarded a contract for initial environmental services to Rincon Consultants Inc., (Rincon) on June 13, 2023.

Council also awarded a contract for initial public outreach planning services on October 17, 2023, to Katz & Associates Inc., (K&A). K&A is researching and finalizing a Project Strategic Communications Plan over the next nine months.

Upcoming Project milestones include selecting and awarding additional contracts for:
 Project public outreach implementation (expected fall of 2024);  Final Design (expected spring of 2025); and
 Construction Management and Constructability Review (expected spring of 2026).

Planning and design phase work is expected to take up to three years, followed by the award of a construction contract. Onsite demolition and construction of the new buried reservoir(s) would take place for a duration of approximately two years.

Design Services
Staff recommends that Council authorize the Public Works Director to execute a contract with Kennedy Jenks Consultants Inc., (Kennedy Jenks) in the amount of $1,025,545 for initial design services for the Project, and authorize $102,555 for potential extra services, for a total expenditure authority of $1,128,100. Kennedy Jenks is experienced in this type Council Agenda Report

of work and was selected as part of a competitive Request for Proposals process, from a total of eight firms submitted proposals. They were determined to be the most qualified following the proposal review and interviews.

The selection was made based on Kennedy Jenks’ qualifications to perform the full scope of design services to successfully deliver the Project. The contract recommended is for initial design services and the development of a design alternative analysis and preliminary design report only. Upon Kennedy Jenks’ successful delivery of this contract, staff will return to Council for approval of a separate contract to provide full design services for the Project and design support during the Project’s bidding and construction phases.

Environmental Services
Staff recommends that Council authorize the Public Works Director to execute a contract with Rincon in the amount of $320,510 for environmental documentation and permitting support services and authorize $64,102 for potential extra services, for a total expenditure authority of $384,612. Rincon completed the Phase 1 project environmental services, is experienced in this type of work, and was selected as part of a competitive Request for Proposals process in the spring of 2023. They were selected as the most qualified from a total of three firms that submitted proposals. A 20% contingency authority is proposed due to the level of uncertainty and additional unplanned work necessary to complete the project’s anticipated Environmental Impact Report.

Community Outreach
With assistance from K&A, staff is developing a Project outreach communication plan.

The plan will identify stakeholders and strategies for engagement and input, including direct outreach to the community that will be affected by anticipated construction activity.

Community outreach planning started in the fall of 2023 and will continue throughout the Project’s environmental, design, and construction process.

BUDGET/FINANCIAL INFORMATION:

The City is currently evaluating different funding options, including the Drinking Water State Revolving Fund loan from the State of California Water Resources Control Board or the Building Resilient Infrastructure and Communities Grant from the Federal Emergency Management Agency to fund the total Project cost.

With the recommended appropriation of reserve funds from the Water Operating Fund to the Water Capital Fund in Fiscal Year 2024, there will be sufficient expenditure appropriations to cover the cost, including potential extra services, of the contracts recommended in this report and future design, environmental, and pre-construction outreach services. The Water Operating Fund continues to meet reserve policy targets in Fiscal Year 2024. The City's current and proposed water rates anticipated these expenses and the expectation that the City will be able to secure a low interest state loan.

ENVIRONMENTAL REVIEW:

Phase 1 environmental documentation was completed in October 2023. Phase 2 environmental analysis and documentation will be conducted under Rincon’s Phase 2 contract. The Project’s required environmental documentation and permits will be secured prior to the commencement of construction.

RESOLUTION NO.

A RESOLUTION OF THE COUNCIL OF THE CITY OF
SANTA BARBARA AMENDING RESOLUTION NO. 23-076,
ADOPTING THE BUDGET FOR FISCAL YEAR 2024, TO

APPROPRIATE FUNDS FOR DESIGN AND

ENVIRONMENTAL SERVICES FOR THE VIC TRACE

RESERVOIR REPLACEMENT PROJECT
WHEREAS, in accordance with the City Charter, the City Administrator filed with the Council a proposed budget for fiscal year beginning July 1, 2023; WHEREAS, the City Council is required to adopt a budget before the beginning of the fiscal year on July 1, 2023;
WHEREAS, the City Charter provides that at any public meeting after the adoption of the budget, the City Council may amend or supplement the budget by motion adopted by the affirmative votes of at least a majority of the total members of the City Council; and WHEREAS, as authorized by Resolution No. 23-076, this Resolution approves the amendment to the budget as provided herein.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SANTA BARBARA THAT in accordance with the provisions of Section 1205 of the City Charter, the budget for the Fiscal Year 2024, as adopted by Resolution No. 23-076, is hereby amended as follows:

COUNCIL AGENDA REPORT
AGENDA DATE: May 14, 2024
TO: Mayor and Councilmembers
FROM: Finance Department
SUBJECT: First Amendment to Workplace Investigation Services Agreement [Agreement]
RECOMMENDATION:

That Council authorize the City Administrator to execute an amendment to Agreement No. 22400130 for special investigation services with Meyers Nave to increase the notto-exceed amount from $75,000 to $300,000. The Meyers Nave law firm provides investigative services related to a personnel matter.

DISCUSSION:

There is a need to contract with an outside investigator on personnel matters. The dominant purpose of the workplace investigation is for the investigator to gather facts and issue a report to the assigned attorney from the City Attorney’s Office. The staff attorney will rely upon the facts and report to provide legal advice to the City. Therefore, this investigation and accompanying work product falls under the attorney-client privilege that belongs to the City.

The staff from the City Attorney’s Office and the Human Resources Department selected the firm Meyers Nave to address the current needs. Staff selected the firm based on its unique skills and expertise to address the assigned personnel matters.

Risk Management provides funding and financial oversight for contracts related to claims and litigation. The tasks assigned to the investigator exceed the established financial threshold on the agreement. Increasing the value of the agreement allows the firm to complete the investigation and submit its findings to the City Attorney’s Office.

BUDGETARY IMPACTS:

The Self-Insurance Fund (SIF) uses the existing appropriations established in the adopted budget to pay for legal support and related investigation costs for these types of Agenda Item No. 7

cases. Risk Management continues to monitor expenditure appropriations and actual expenses related to all the open cases. The additional costs associated with this investigation combined with expenses on other open cases may lead Risk Management to propose additional expenditure appropriation using SIF available reserves as part of the quarterly budget review process as necessary.
