Edison’s Charge Ready Transport (SCE-CRT) program, which will fund much of the electrical infrastructure needed for the larger project.
The City has been awarded $116,000 through the SBAPCD 2024 Carl Moyer Clean Air Grants Infrastructure Program and $146,330 from the US Department of Energy’s Energy Efficiency Conservation Block Grant Program for the purchase of a mobile EV fast charger.
A mobile EV fast charger can be deployed throughout the City and during emergency events. Staff are in the process of determining the exact model of mobile charger to be procured.
Lastly, in coordination with various governments and organizations in the tri-county area, and with UCSB as the prime grant recipient, the City has been awarded $1,117,468 as a subrecipient of the California Energy Commission’s Reliable, Equitable, and Accessible Charging for Multi-family Housing 2.0 (REACH 2.0) grant. This grant will pay up to 100% of eligible costs to install 130 EV chargers across nine Santa Barbara City Housing Authority properties and five Santa Barbara Unified School District parking lots. The school district chargers will be utilized by district staff during the day and available for multi-family residents from nearby designated low-income census tracts to use during evenings and weekends.
The table below provides a summary of the proposed EV projects:
BUDGET/FINANCIAL INFORMATION:
Staff’s recommended action to accept these grants and increase related appropriations will provide $2,185,798 towards the cost of various EV Charger installations across the City. There is no requirement to provide matching funds as a condition of accepting these grants.
SUSTAINABILITY IMPACT:
The transportation sector accounts for the majority of City greenhouse gas emissions and thus is a major focus of the City Council approved 2024 Climate Action Plan. The EV chargers will help the City move towards its carbon neutrality goal by 2035 by facilitating EV adoption. These grants directly achieve the following measures from the City’s 2024 Adopted Climate Action Plan:

T-6.3: Add new publicly accessible EV charging stations through the City and Cityowned facilities T-2.2: Install additional zero emission vehicle chargers in municipal parking lots for fleet and employee use.
ENVIRONMENTAL REVIEW:
These projects are considered maintenance and minor alterations of existing facilities, which are categorically exempt from the California Environmental Quality Act under Guideline 15301 (Existing Facilities). City staff have determined that the projects are exempt from Coastal Development Permits.

In most cases, encumbrance balances exist at year-end. These encumbrance balances are obligations of each fund and must be reported at the beginning of each fiscal year. In addition, a corresponding appropriations entry must be made in order to accommodate the 'carried-over' encumbrance amount. Most differences between budgeted annual revenues and expenses are due to these encumbrance carryovers.

COUNCIL AGENDA REPORT
AGENDA DATE: April 15, 2025
TO: Mayor and Councilmembers
FROM: Human Resources Department
SUBJECT: Amendment of City Attorney Employment Agreement [Agreement] RECOMMENDATION:
That Council approve and authorize the Mayor to execute a second amended employment agreement between the City of Santa Barbara and City Attorney Sarah J. Knecht.
DISCUSSION:
The City Council negotiation team of the Mayor and Mayor Pro Tempore has come to a recommended agreement for an amendment to the employment contract with the City Attorney, Sarah Knecht. This Amendment establishes a 401(a) Defined Contribution Plan (or other agreed deferred compensation plan) and City contribution in the amount of $2,000, monthly, retroactive to January 1, 2025. The contributions are made on a pre-tax basis, and the contributions are not reportable to CalPERS. This is an important consideration as compensation increases through deferred compensation versus salary (which is reportable under CalPERS) and the contribution to a deferred compensation plan balances the need to recruit and retain employees while also allowing public agencies to manage a pension plan's Unfunded Accrued Liability by not increasing future required contributions, therefore, reducing long-term debt. All other terms of the original Employment Agreement (No. 28,232) and the First Amended Employment Agreement (No. 28,453) shall remain unchanged.
BUDGET/FINANCIAL INFORMATION:
A $2,000 monthly contribution into a 401(a) Defined Contribution Plan or its equivalent, totaling $24,000 annually.

Knecht, an individual, hereinafter referred to as “Employee” enter into this Second Amended Employment Agreement (Agreement”) on this 15th Day of April, 2025, for Employee’s services as City Attorney for the City of Santa Barbara.
WHEREAS, the City Council of the City of Santa Barbara, hereinafter “City Council”, determined that Employee has the necessary qualifications and experience for the office of City Attorney as required by the City Charter; and WHEREAS, on December 13, 2022, City and Employee entered into Employment Agreement No. 28,232 (“Original Agreement”) and on December 5, 2023, City and Employee entered into Amended Employment Agreement No. 28,454 (“Amended Agreement”) which together provide the terms and conditions of employment; and WHEREAS, Section 7 of Agreement No. 28,232 requires any modification to be done only upon written consent of the City Council; and WHEREAS, neither the Original Agreement nor the Amended Agreement provide any deferred compensation benefits.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 15, 2025
TO: Mayor and Councilmembers
FROM: City Attorney’s Office
SUBJECT: Proposed First Amendment to Lease Agreement No. 28,577 with Santa Barbara International Film Festival Inc., for the Property Located at 916 State Street [Agreement]
RECOMMENDATION:
That Council approve the First Amendment to Lease Agreement No. 28,577 with the Santa Barbara International Film Festival, Inc. (“SBIFF”), for the City owned property located at 916 State Street to correct a clerical error that resulted in statutory language being left out of the Lease Agreement.
BACKGROUND:
On October 8, 2024, Council approved the Lease Agreement with SBIFF for the 916 State Street Film Center. The Lease Agreement contained an omission concerning the statutory requirement on Certified Access Specialist (“CASp”) inspections. This CASp statutory language notifies a lessee of the requirement for a landlord to permit a Certified Access Specialist to inspect the premises to ensure ADA compliance. The City Attorney’s Office has informed SBIFF of the omission and SBIFF has agreed to execute the First Amendment to include the CASp provision pending Council approval. No other changes are made to the Lease Agreement.
BUDGET/FINANCIAL INFORMATION:
This action does not have a budget/financial impact on the City.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 15, 2025
TO: Mayor and Councilmembers
FROM: Community Development Department
SUBJECT: Amendment to Confluence Land Use LLC Professional Services Agreement for Land Use Consulting Services [Agreement]
RECOMMENDATION:
That Council authorize the Community Development Director to execute the second amendment to increase the amount of Santa Barbara City Agreement No. 22400110 with Confluence Land Use LLC by $95,000, for a total contract amount of $190,000, to provide land use consulting services.
DISCUSSION:
The Community Development Department’s Planning Division is responsible for developing public policies that reflect the community’s vision; managing land use entitlement processes; and ensuring that development aligns with zoning, environmental regulations, and broader policy goals. To support these efforts, the City contracts with independent firms that provide specialized land use consultation and project management services. These contracted services supplement the work of City staff and are essential to processing planning applications and managing large development proposals efficiently.
The recommended amendment enables the City to continue leveraging contract services that facilitate timely and thorough application reviews, ensure consistency with zoning and environmental regulations, and enhance public engagement in the planning process.
Contract services also help manage complex, high-priority projects and accommodate fluctuations in application volumes, particularly in areas experiencing significant development activity.
The Planning Division has an established working relationship with Confluence Land Use LLC, a consulting firm with demonstrated expertise in managing complex land use projects, coordinating stakeholder involvement, and ensuring compliance with local and state regulations. CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 15, 2025
TO: Mayor and Councilmembers
FROM: Public Works Department
SUBJECT: Milpas Street Crosswalk Safety and Sidewalk Widening Project - Environmental Determination for Notice of Exemption
RECOMMENDATION:
That Council determines the Milpas Street Crosswalk Safety and Sidewalk Widening Project is exempt under California Environmental Quality Act Guidelines (15301 (c) Existing Facilities) and approve and direct the filing of a Notice of Exemption in compliance with California Environmental Quality Act Guidelines Section 15062.
DISCUSSION:
Project Description
The Milpas Street Crosswalk Safety and Sidewalk Improvements Project (Project) site is along Milpas Street between Quinientos Street (south) and Canon Perdido Street (north).
This location is a designated Vision Zero Priority Corridor. The Project includes the following enhancements to address the collision patterns (Attachment 1):
New curb extensions at eight intersections;
High visibility crosswalks;
Additional street lighting;
Accessibility improvements between intersections;
Widened sidewalks at street corners and transit stops; Installation of leading pedestrian intervals at signalized intersections; New traffic signal at the intersection of Milpas and Yanonali Streets; An additional median refuge island and rectangular rapid flashing beacons (RRFBs) at the intersection of Milpas and Ortega Streets; Three-foot-wide buffers added to the existing bike lanes between Cota and Canon Perdido Streets; and
Additional bicycle parking.
Community engagement along Milpas Street is documented in the 2006 Pedestrian Master Plan, the 2016 Bicycle Master Plan, and several project-specific engagements from 2019 to the present. Most recently, staff went to the Street Tree Advisory Committee Agenda Item No. 20

and Parks and Recreation Commission (PRC) for approval to remove 13 street trees (to provide required ADA clearance for path of travel and sightline issues affecting traffic) and plant 37 new street trees as part of the Project. The PRC approved the request and recommended four new canopy species to plant that include the Water Gum, Sydney Red Gum, New Zealand Christmas, and African Fern Pine trees. The Project went before City Council on March 11, 2025, for an appeal of the PRC’s approval by a resident. City Council denied the resident’s appeal.
Environmental Review
California Environmental Quality Act (CEQA) Guidelines Section 15301 (also known as the “Class 1 Exemption”) covers the operation, repair, maintenance, or minor alteration of existing facilities involving no or negligible expansion of existing or former use. This Project falls under subdivisions (c) of Section 15301 as the access ramps, high visibility crosswalks, pedestrian refuge island, traffic signal, rapid flashing beacons, lighting, and street tree removal and plantings for the purposes of public safety will not result in an increase in use or capacity. The phasing of tree removals and new tree plantings will benefit the replacement of tree canopy. New trees will be planted as soon as feasible to provide optimum growth opportunity and to add to the tree canopy aesthetics of Milpas Street. Considering the minimal number of trees proposed for removal along and the net increase of total trees with the potential new tree planting opportunities, the impacts to trees are considered less than significant.
For these reasons, the Public Works Director, exercising authority under Santa Barbara Municipal Code Section 22.100.080, has determined that the Project is exempt under CEQA. The City Council has final authority to approve the Project. Therefore, the City Council must confirm the exemption before Project approval and authorize the filing of a Notice of Exemption (NOE) for the Project.
Next Steps
The Project is ready to move into final design and requires the filing of the NOE. The Project is expected to go before the Transportation and Circulation Committee later this year for another Project update and the Architectural Board of Review for a courtesy review on pavement materials.
Construction is anticipated to begin in 2027 in coordination with a separate City maintenance project, which includes pavement grind and overlay, and significant sidewalk and accessibility repairs due to tree uplifts along Milpas Street from Hutash to Anapamu Streets. All sidewalk maintenance work is focused on the intersection enhancements of this Project. The City will continue to evaluate advancing the construction schedule on this safety project.
Community outreach will be ongoing with the next community meetings focused on the construction phase.
Council Agenda Report
Milpas Street Crosswalk Safety and Sidewalk Widening Project - Environmental Determination for Notice of Exemption
April 15, 2025
BUDGET/FINANCIAL INFORMATION:
This Project is funded primarily by a $7.9 million State Active Transportation Program Grant, which covers 80 percent of the Project costs. The 20 percent City share is funded by the Measure C Capital Fund. City match monies were allocated on November 3, 2023, in the amount of $500,000 for the design phase. Future appropriations for the remaining $1.5 million will be recommended by staff as part of the City’s capital program budget.
SUSTAINABILITY IMPACT:
The Project will improve safety and accessibility for pedestrians and cyclists and will contribute to the City’s sustainability goals by encouraging more people to walk and bike, reducing energy consumption and air pollution. The Project is also consistent with the City’s Vision Zero Strategy and the City’s Climate Action Plan.

COUNCIL AGENDA REPORT
AGENDA DATE: April 15, 2025
TO: Mayor and Councilmembers
FROM: Community Development Department
SUBJECT: Designation of Proposed Development at 419 W. Pueblo Street (Cottage Hospital Child Care Center) as a Community Benefit Project RECOMMENDATION:
That Council designate the proposed project at 419 W. Pueblo Street as a Community Benefit Project pursuant to Santa Barbara Municipal Code Chapter 30.170 and allocate a total of 7,600 square feet (net) of nonresidential floor area to the project from the Nonresidential Growth Management Program’s Community Benefit Category.
DISCUSSION:
Proposed Project
The project site is a 2.4-acre lot located at the corner of West Pueblo and Castillo Streets and is developed with the Cottage Hospital Pueblo Parking Structure, an existing 8,202- square-foot child care center, a storage structure, and a surface parking lot. The proposed project involves construction of a two-story 7,600-square-foot addition to the existing child care center. The project site is zoned SP8-H (Hospital Specific Plan) and has a General Plan designation of Institutional. The application currently under review requires a Conditional Use Permit and a Development Plan to be approved by Planning Commission. The purpose of the project is to increase the child care program from 80 to 160 students in order to serve Cottage Health staff.
Nonresidential Growth Management Ordinance
Adopted in 2013, the City’s Nonresidential Growth Management Program limits specific new nonresidential growth to 1.35 million net new square feet until December 31, 2033.
This floor area limitation is divided among three development categories: Community Benefit Projects, Small Additions, and Vacant Property. The initial allocations by City Council were: 600,000 square feet for Community Benefit Projects, 400,000 square feet for Small Additions, and 350,000 square feet for Vacant Property.
New nonresidential projects must be floor area allocated from one or more of the three categories and must also be consistent with the City’s Traffic Management Strategy as Agenda Item No. 21
File Code No. 700.09

implemented by Santa Barbara Municipal Code (SBMC) Section 30.170.030. The project site is in the Downtown Development Area.
Community Benefit Projects include three subcategories: Community Priority Projects; Economic Development Projects; and New Vehicle Sales Projects. The applicant requests the designation of the proposed project under the Community Priority Project subcategory.
A Community Priority Project is defined as one that has a broad public benefit, is not principally operated for private profit, and is necessary to meet a present or projected need directly related to public health, safety, or general welfare (e.g., museums, child care facilities, health clinics).
Community Benefit Project Designation
The 7,600 square feet of requested Community Benefit Project floor area for the childcare center at 419 W. Pueblo Street represents 1.3 percent of the original 600,000 square feet allocated to Community Benefit Projects in the Nonresidential Growth Management Program until 2033. To date, City Council has allocated a total of 368,475 square feet from the Community Benefit Category to 16 projects, as identified in the table below.
Additionally, 142,668 square feet of expired, small-addition floor area has been reallocated to the Community Benefit category by the Planning Commission since 2013, when the allocations were initially established. To date (slightly more than halfway through the 20-year allocation period), a total of 511,143 square feet, or 85 percent, of the floor area remains available for Community Benefit Projects through 2033.

Refer to the applicant letter (attached) for a description of the project and an explanation for why the applicant believes that the project qualifies as a Community Benefit Project.
Staff finds that the project qualifies as a Community Benefit Project because it meets the criteria for a Community Priority Project. The proposed childcare center meets the City’s zoning requirements and is not principally operated for private profit. The childcare center meets a present need related to public health by helping Cottage Hospital recruit and retain critical medical personnel who serve our community. Additionally, the center promotes general welfare by providing needed childcare facilities. Furthermore, the project is consistent with policies of the City’s General Plan related to Land Use and Economy and Fiscal Health.
GENERAL PLAN (2011)
LG7. Community Benefit Non-Residential Land Uses. Community Benefit Land Uses are determined and defined by City Council and shall include the following categories:
Possible Implementation Action to Be Considered
LG7.1 Findings. Develop project level findings of approval for the following Community Benefit Non-residential development uses:
a. Community Priority Development. This type of project addresses a present or projected need directly related to public health, safety or general welfare including but not limited to:
Parks and recreation facilities;
Community centers;
Educational institutions and uses including schools;
Public cultural or art facilities;
Youth development programs and child care facilities; and Community gardens and urban farming
EF4. Existing Businesses. Give priority to retaining existing enterprises as the best source of business expansion and local job growth, and encourage government, Council Agenda Report

businesses and residents to patronize local businesses and contractors, by working with local businesses to initiate a “Buy Local” program, with the City setting the example.
EF14. Local Needs. Encourage enterprises that serve the needs of existing local residents, workers, and businesses.
BUDGET/ FINANCIAL INFORMATION:
The requested designation would have no budgetary or financial impact.
ENVIRONMENTAL REVIEW:
The designation of a project as a Community Benefit Project and reservation of floor area enables the City to accept the development application for processing, but does not commit City Council or the Planning Commission to a definite course of action (CEQA Guidelines §15352(a) Approval); therefore, the Community Benefit designation and allocation of floor area are not subject to environmental review pursuant to the California Environmental Quality Act. If the requested Community Benefit floor area is allocated for the project, the application will continue through the City’s standard review process.
Environmental review would be completed as part of the development application review.
CONCLUSION:
The proposed addition to the Cottage Health Child Care Center conforms to the Community Priority findings and can be allocated 7,600 net square feet of new nonresidential floor area from the Community Benefit category of the City’s Nonresidential Growth Management Program.
In addition, the proposed project is consistent with the City’s Traffic Management Strategy as implemented by SBMC Section 30.170.030 because it is located in the Downtown Development Area, which allows Community Priority Projects.

Re: Growth Management Program Community Benefit Project Designation Request Cottage Hospital Child Care Center Addition
419 W. Pueblo St. APN: 025-171-050 (SP8-H)
Dear Mayor Rowse and Council Members,
On behalf of the property owners, the Santa Barbara Cottage Hospital, Inc., I am pleased to provide the following project description and applicant letter to request a Growth Management Program Community Benefit Project Designation for 7,600 sq. ft. to be utilized for the proposed Child Care Center addition located at 419 W. Pueblo St. within the SP8-H, Specific Plan Area 8, Hospital zone district.
The existing 2.4-acre (104,544 sq. ft.) parcel contains the Cottage Hospital Pueblo Parking Structure, an existing 8,202 sq. ft. child care center, storage structure and surface parking lot. The property is located in the Oak Park General Plan neighborhood, adjacent to Los Olivos, Castillo and Pueblo streets and surrounded by a mix of SP8-H, Office, Commercial and Residential uses to the north, south, east, and west. The property has an average slope of 4%.
Community Benefit Designation
The City’s Pre-Application Review Team (PRT) letter dated November 25, 2024, enclosed, states the proposed project appears to meet the definition of a Community Benefit Project under the Community Priority Project category per §30.170.020 as noted below:
§ 30.170.020 Definitions.
The following words and phrases shall have the meaning indicated, unless the context or usage clearly requires a different meaning:
Community Benefit Project.
A project which has been designated by the City Council as satisfying one or more of the following categories is a Community Benefit Project:
A Community Priority Project is a project that has a broad public benefit, is not principally operated for private profit, and is necessary to meet a present or projected need directly related to public health, safety or general welfare (e.g., museums, childcare facilities, health clinics).

Requested Square Footage Allocation
The proposed addition of the existing Child Care Center is considered a Community Priority Project as it provides a public benefit by increasing the child care program from 80 to 160 students. The existing and future child care center serves Cottage Health staff, which has a robust and increased demand for child care services. Presently there are over 100 healthcare workers that include nurses, clinical and support staff on the waiting list. This addition will assist in retaining and recruiting staff who serve our community.
The project itself will not negatively impact the health and welfare of the surrounding neighborhood community. It does not impact public or private viewsheds and the project is consistent with that of the neighborhood. Further, the proposal is consistent with applicable General Plan Policies and Municipal Code.
CUP, Development Plan Proposal
A Planning Application (PRT) was submitted to the City in July of 2024 for a Conditional Use Permit (CUP) for a proposed 7,600 sq. ft. addition to the existing 8,202 sq. ft. child care center.
The new structures comprise of a 5,331 sq. ft. ground floor child care center with a 448 sq. ft lobby, and 1,821 sq. ft of second floor office and administration uses. A covered walkway will be provided to connect the existing and proposed structures. The existing surface parking lot containing 19-space parking lot will be demolished. One (1) oak tree on site that will be protected in place to remain. Access will be taken from Castillo St.
Development History
The existing child care center was a part of the City Planning Commission approval of the Santa Barbara Cottage Hospital Development Plan and Specific Plan (SP8-H) in 2005, per PC Resolution No. 020-5, enclosed. Per Chapter 30.125.040, all new development in the SP8-H zone requires a Conditional Use Permit.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 15, 2025
TO: Mayor and Councilmembers
FROM: Human Resources Department
SUBJECT: Amend the CalPERS Contract for Local Safety Members to Include Airport Police Officers [Ordinance Introduction; Resolution] RECOMMENDATION: That Council:
A. Introduce and subsequently adopt, by reading of title only, an Ordinance of the Council of the City of Santa Barbara Authorizing an Amendment to the Contract between the City of Santa Barbara and the Board of Administration of the California Public Employees’ Retirement System; and
B. Adopt, by reading of title only, a Resolution from the California Public Employees’ Retirement System entitled Resolution of Intention to Approve an Amendment to Contract Between the Board of Administration California Public Employees’ Retirement System and the City Council of the City of Santa Barbara.
DISCUSSION:
On September 30, 2021, Governor Gavin Newsom signed Senate Bill 2 (SB 2) into law, aiming to increase accountability among peace officers. A key provision of SB 2 mandates that law enforcement agencies may only employ Peace Officers who hold a current and valid Basic Peace Officer Standards and Training (POST) Certificate.
Recognizing that Airport Police Officers are designated as peace officers under California Penal Code Section 830.33(d), the City acknowledges their critical role in ensuring airport security and compliance with both Federal and State regulations. Airport Police Officers perform a broad range of law enforcement and airfield operations duties, including:
1. Providing law enforcement services with arrest authority to comply with Transportation Security Administration (TSA) regulations and supporting the City’s Airport Security Program.
Agenda Item No. 22
File Code No. 410.01
Council Agenda Report
Amend the CalPERS Contract for Local Safety Members to Include Airport Police Officers [Ordinance Introduction; Resolution]
April 15, 2025
2. Conducting airfield operations, including the Daily Airfield Self-Inspection Program, to meet Federal Aviation Administration (FAA) regulations and maintain compliance with the Airport Certification Manual.
To align with statutory requirements and recognizing the unique law enforcement functions of Airport Police Officers, the Human Resources Department is requesting an amendment to the City’s contract with the Board of Administration of the California Public Employees’ Retirement System (CalPERS). This amendment would reclassify Airport Police Officers from “miscellaneous members” to “local safety members,” as authorized under Government Code Section 20423.3 and allow them to receive retirement benefits that accurately reflect their law enforcement duties at the Airport. The Airport Police Officer classifications will remain represented by the Treatment and Patrol Bargaining Unit.
Now classified as “local safety members,” Airport Police unit members will be classified as “new members” as it relates to their new retirement formula under the Public Employees’ Pension Reform Act (PEPRA). Their retirement benefits will be structured under the 2.7% @ 57 formula, as stipulated in Government Code Section 7522.25(d).
Their final compensation will be calculated based on a three-year average, per Government Code Section 7522.32(a), and employees will contribute one-half of the total normal cost, as determined annually by CalPERS’ valuation report. For Unit members classified as “classic members,” their prior years of service will remain under the 2.7% at 55 miscellaneous retirement formula. The City will provide One-Year Final Compensation for Classic Miscellaneous employees under PERS, pursuant to Government Code section 20042.
Pursuant to Government Code Section 20474, a secret ballot election is required for affected employees whenever an amendment to the employees' contribution rate is proposed, per Government Code Section 20469. In alignment with the 2023-2025 Memorandum of Understanding (MOU) between the City and the Treatment and Patrol (TAP) Bargaining Unit, the City has committed to completing the necessary administrative processes to facilitate this amendment.
As the first step in fulfilling this obligation, the attached Resolution of Intention must be approved by the City Council and submitted to CalPERS. This approval will formally initiate the amendment process, ensuring that Airport Police Officers receive retirement benefits that accurately reflect their law enforcement duties and responsibilities as defined and allowed by CalPERS.
BUDGET/FINANCIAL INFORMATION:
The costs for FY2025 of this change is estimated to be $10,496. The costs for FY2026 of this change is estimated to be $125,957. No additional funding is being requested at this time, but may be reviewed as part of the quarterly budget process.

FROM: Human Resources Department
SUBJECT: City Workforce Vacancies, Recruitment, and Retention Trends - Assembly Bill 2561
RECOMMENDATION:
That Human Resources provide a status update on vacancies, recruitment, and retention trends; and that the City Council receive a presentation from bargaining units that chose to make a presentation regarding vacancies within its unit; and hold a public hearing and take any public comment pertaining thereto.
DISCUSSION:
Governor Newsom's signing of Assembly Bill 2561 (AB 2561), which took effect January 1, 2025, requires public agencies, including the City of Santa Barbara, to hold at least one (1) public hearing per fiscal year to discuss vacancies and recruitment and retention efforts. This report discusses the City of Santa Barbara’s legal obligations under the new law.
AB 2561 was introduced as a measure to address the issue of job vacancies in local government, which can adversely affect the delivery of public services and employee workload. The bill mandates that public agencies present the status of vacancies and recruitment and retention efforts during a public hearing before the agency’s governing body at least once per fiscal year.
In compliance with the new legal obligations, the City of Santa Barbara is required to do the following:
1. Public Hearing: At least once each fiscal year, at a public hearing before the City Council, the City shall present information regarding the status of vacancies and recruitment and retention efforts (Gov. Code § 3502.3(a)(1)) and identify any necessary changes to policies, procedures, and recruitment activities that may lead to obstacles in the hiring process (Gov. Code § 3502.3(a)(3)). presentation must occur prior to the City Council’s adoption of the final budget. (Gov. Code § 3502.3(a)(2).)
2. Employee Organization Participation: Allow the recognized employee organization for each bargaining unit at the City of Santa Barbara to make presentations during the public hearing concerning vacancies and recruitment and retention efforts.
There is no required percentage threshold needed to allow a bargaining unit to make a presentation. There are eight (8) represented bargaining units in the City of Santa Barbara that represent full-time positions.
Bargaining Unit

SEIU General Unit
SEIU Treatment and Patrol (TAP)
Police Management Association (PMA)

Fire Association
3. Additional Reporting for High Vacancy Rates: If vacancies within a single bargaining unit meet or exceed 20% of authorized full-time positions in that bargaining unit, upon request of the recognized employee organization for that bargaining unit, the City of Santa Barbara must provide additional information during the public hearing, which includes the following: (1) the total number of vacancies; (2) the number of applicants; (3) the average time to fill positions; and (4) opportunities to improve compensation and working conditions for employees in the bargaining unit.
At the time of this report, no bargaining unit within the City meets or exceeds the 20% vacancy rate.
BUDGET/FINANCIAL INFORMATION:
There is no direct fiscal impact associated with conducting the public hearing required under Government Code Section 3502.3. However, addressing recruitment and retention issues may involve future budget and bargaining considerations, which will be presented to the City Council as necessary.
